IX. And be it further enacted by the authority aforefaid, that no dutiable goods to be removed or commodities, imported or brought into this Province in or upon any veffel, boat, raft sent of the Cus. or Carriage from any Port or place in the United-States of America, requiring to be weighed, guaged, taled or meted, in order to afcertain the duties thereupon, fhall be removed from any wharf or place upon which the fame may be landed, put or delivered, unless with the confent of fome of the Cuftom House officers of the Port or place at which the fame fhall have been landed, before the fame fhall have been weighed, guaged, taled or meted by or under the direction of the proper officer of the Cuftoms appointed for that purpose, which he is hereby required and directed to perform without delay; and if any fuch goods or commodities fhall be removed from fuch wharf or place before the fame fhall have been fo weighed, guaged, taled or meted, the fame shall be forfeited, and may be feized by any officer of the Customs.

XIII. And be it further enacted by the authority aforefaid, that it fhall be the secure any vessel, duty of all officers of His Majefty's Cuftoms whatsoever to feize and fecure any within their res- veffel, boat, raft, or carriage, goods or commodities, which fhall be liable to feizure in virtue of this Act, as well without as within their respective districts within this Province; and all goods or commodities which shall be feized by virtue of this A&t, fhall be depofited at the Custom-Houfe ftores, at or near the place where they fhall have been feized, until fuch proceedings fhall be had as by law are required, to ascertain whether the fame have been forfeited or not ; and all penalties and forfei tures created by this Act, fhall be recovered and declared in any of His Majefty's n of the seizure. Courts, having jurifdi&ion in fuch cafes in this Province, in the fame manner and form and upon the fame evidence and by the fame rules and regulations as any penalties or forfeitures incurred for any offences against the Laws relating to the Cuftoms and Trade of His Majefty's Colonies in America may now be recovered or declared forfeited in fuch Courts refpectively, and in all cafes of penalties or for feitures, incurred by virtue of this Act, after deducting the charges of prosecution from the grofs produce thereof, the remainder shall be paid and divided as follows, that is to say: one fourth to His Majefty, one fourth to the Governor of this Proyince, or person adminstering the Government thereof, one fourth to the feizing officer fuing for the fame, and one fourth to the Collector and Comptroller of the Cuftoms at the Cuftom-Houfe to which the feizing officer belongs, or to the Collector of the Cuftoms where there is no Comptroller.

XVI, And be it further enacted by the authority aforesaid, that all monies, fines appropriated by and forfeitures which thall be levied and which are not fpecially appropriated by and public uses of this in virtue of this Act, fhall be referved to His Majefty, His Heirs and Succeffors, for the public ufes of the Province, and the fupport of the Government thereof, and fhall be paid to, and remain in the hands of the Receiver-General of the Province, for the future difpofition of the Provincial Parliament, and fhall be accounted for to His Majefty, His Heirs and Succeffors through the Lords Commiffioners of His Majefty's Treafury, for the time being, in such manner and form as His Majelly, His Heirs and Succeffors fhall direct.
