HEREAS His Grace the Governor in Chief hath, by His Meffage to both Houfes of the Provincial Parliament, been graciously pleafed to recommend . to their attention the general ftate of the Inferior District of Gafpé, with a view to secure the Inhabitants of the faid District in the poffeffion and enjoyment of their Lands, which in the most inftances have, from a wilderness, been cleared and improv. ed to an advanced ftate of Agriculture, and whereas it is expedient to fecure fuch perfons in the poffeffion and enjoyment of their Lands in the faid Inferior Diftria of Gafpé as have in good faith cleared and improved the fame. May it therefore please Your Majefty that it may be enacted, and be it enacted by he King's Most Excellent Majefty, by and with the advice and consent of the Legislative Council and Affembly of the Province of Lower-Canada, conftituted and affembled by virtue of and under the authority of an A&t paffed in the Parliament of Great Bri tain, intituled, " An Act to repeal certain parts of an A&t paffed in the fourteenth year of His Majefty's Reign, intituled, "An A&t for making more effectual provi "fion for the Government of the Province of Quebec in North America, and to make further provifion for the Government of the faid Province," And it is hereby enact ed by the authority of the fame, that it fhall and may be lawful to and for the Governor, Lieutenant Governor, or perfon adminiftering the Government of the Province for the time being, at any time during the space of three years from the paffing of this Act, to iffue fuch and fo many Commiffions under the Great Seal of this Province as he fhall think proper, to nominate three or more perfons to be Commiffioners, one of whom fhall be President of each of the faid Commiffions; which faid Commiffioners fhall have power and authority to hear and determine all ap. plications that fhall or may be made to them by perfons holding or claiming to hold Lands as aforefaid for Grants thereof under the Great Seal of this Province, in like manner as the fame might be heard and determined by His Majefty's Executive Council. And be it further enacted by the authority aforefaid, that it fhall and may be for the Comm lawful to and for the perfons fo holding or claiming to hold as aforefaid, to come produced before the faid Commiffioners, either in perfon or by their agents, and to produce ges and evidences to the faid Commiffioners the feveral Documents, Vouchers and other evidences on Commissioners which they leverally found their faid claims, and the faid Commiffioners or any two of them, one of whom fhall be the Prefident, fhall proceed to hear, decide and report the property they claim. to hear and decide on such claims. thereon CAP. Governor to notify and require that all persons present their claims to the thereon in manner herein after mentioned, and fh for that purpose have full power and authority to adminifter fuch oaths and alfo, by Warrant under their hands or the hand of one of them, to compel the attendance of all fuch persons and alfo the production of all fuch Books, papers and other evidences as they in their difcretion fhall think neceffary or proper, III. And be it further enacted by the authority aforefaid, that in hearing, and deciding all fuch claims, whether the fame be between fubject and subject, or between the fubject and the Crown, the faid Commiffioners fhall be guided by the real juftice and good confcience of the cafe, without regard to legal forms and folemnities, and shall direct themselves by the best evidence that they can procure or that is laid be fore them, whether the fame be fuch evidence as the Law would require in other cafes or not, and in cafe they or the major part of them shall be fatisfied that the person or perfons fo holding or claiming to hold the faid lands as aforefa d, 15, or are entitled in equity and good confcience to hold or have the faid Lands, they the faid Commiffioners, fhall'report the fame in the manner herein-after provided. IV. And be it further enacted by the authority aforesaid, that from and after the by Proclamation paffing of this Act, it fhall and may be lawful for the Governor, Lieutenant Governor or person adminiftering the Government of this Province, for the time being, to Commissioners. notify and require by Proclamation, all perfons holding or claiming to hold Lands in the faid Inferior District of Gaspé, to present their claims thereto before the Commiffioners who fhall have been fo as aforefaid appointed in virtue of this Act, within fifteen months next after the date of fach Proclamation, at fuch place or places as may be in the faid Proclamation Specified, to the end that fuch claims may be heard and determined; of which Proclamation a printed copy fhall immediately after the iffuing thereof, be tranfmitted to each and every Minifter, Miffionary or perfon exercising clerical functions, Juftice of the Peace, Militia and Peace Officer refiding within the faid Inf rior Diftrict of Gaspé, who are hereby required and enjoined to publish or cause the same to be published in the most public places nearest their refidences, respectively. And be it further enacted by the authority aforefaid, that when any claim or ed, Commission claims are fyled or lodged with the faid Commiffioners, they shall caufe Public notice to be given, by at least three Advertisements, during three months in the Quebec Gazette, that fuch claim or claims has or have been fyled, with a description of the land or lands claimed and the Township or place in which the fame are fituated, and requiring all and every person and perfons having any pretenfions to the lands fo advertized, to present their claims or pretenfions thereto in the course of two months thereafter, and that in default thereof, all claims and pretenfions to fuch land or lands will be barred and extinguished, except the claims and pretenfions then fyl ed |
