perfons, cattle, or carriages, across the faid River Chaudière, with n the faid limits aforefaid, fuch offender or offenders fhall, for each perfon, carriage or animal fo carried across, fo feit and pay a fum not exceeding forty things currency. Provided, that nothing in this A&t contained, fhall be conftrued to prevent the pub lic from paffing any of the fords in the faid river Chaudière, or in canoes, without gain or hire.

VII. And be it farther enacted by the authority aforefaid, that if any perfon fhall the bridge or tall malicior fly pull down, burn, or d ftroy the faid bridge, or any part then of, or the toll-house to be erected by virtue of this Act, every perfon fo offending, and being thereof legally convicted, fhall be deemed guilty of felony.

VIII. And be it further enacted by the authority aforesaid, that the faid François Verrault, to entitle himself to the benefits and advantages to him, by this Act granted shall and he is hereby required to erect and complete the faid bridge, toli-hofe, turn pike and dependencies within five years from the day of the paffi g of this A&t; and if the fame fhall not be compleated within the time last mentioned, so as to afford a convenient and safe paffage over the faid bridge, he the faid Françoi Verrault, his heirs, executors, cura ors and affigns, fhalt ceafe to have any right, title or claim of, in or to the toils hereby impo'ed, wh ch fhail, from thence forward belong to His Majefty; and the faid François Verrault, that not by the faid tells, or in any other manner or wy, be en'itied to any reimburl m.nt of the expences he may incurred in and about the building of the faid Bidge; ad in cafe the faid bridge after it fhill have been erected and complea ed, fhail at any time become impaffable or unsafe for travellers, Cattie o carriages, he the taid François Verrault, his heirs, executors, curators or aligns, fhl and they are h reby required, within two years Penalty if not for the time at which the tai bide thail, by His Majesty's Court of General Quarter Sffion of the Peace, in and for the faid D) ftrict of Quebec, be ascertainea to be impaffable or unfaf, and notice thereof to him or them by the faid Court given, o caute the fame to b rebuilt or repaired, and made fate and commodious for the paffage of travellers, cattle and carriages; end if within the time laft men. tioned, the laid bridge be not so repaired, or rebuilt, as the cale may require, then the faid bridge or fuch part or parts thereof, as shall be remaining, fhall be and be tak n, and be confidered to be the property of His Majefty; and after luch default to repair or rebuild the laid bridge, the faid François Verrault, his heirs, executors, curators or affigns fhail cease to have any right, title or claim, of, in, to or out of the faid bridge, or the emaining parts thereof, and the tolls hereby granted, and his and their rights in the premises, shall be wholly and forever determined.

IX. And be it further enacted by the authority aforefaid, that the prefent Act or any thing therein contained, fhall not extend or be conftrued to extend to weaken, diminish or extinguifh the rights and privileges of His Majefty the King, his heirs and fucceffors, nor of any perfon or perfons, body polic or corporate in any of the things therein-mentioned, (except as to the power and authority, hereby gi ven to the faid François Verrault, his heirs and affigns, and except as to the rights which are hereby exprefly altered or extinguifhed) but that his Majefty the King, his heirs and fucceffors, and all and every perfon or perfons, body polinc or corporate, their heirs and affigns, executors and adminiftrators, fhall have, and exer. cife the fame rights, as they and each of them had before the paffing of this Act, with the exceptions aforefaid, to every effect and purpose whatsoever, and in as ample manner, as if this Act had never been paffed.

X. And be it further enacted by the authority aforefaid, that in cafe the faid a draw bridge for river Chaudière fhould hereafter be navigated in part above and below the faid above and below bridge by veffels having mafts, the faid François Verrault, his heirs and affigns, the said Bridge. fhall caufe to be made a draw bridge, to admit of the paffing of fuch vessels navi gating in and upon the said river, without any toll, fee, or recompence.

XI. And be it further enacted by the authority aforefaid, that the penalties hereby inflicted, shall, upon proof of the offences refpectively before any one or more of the Juftices of the Peace for the District of Quebec, either by confeffion of the offender or by the oath of one or more credible witnefs or witneffes, (which oath fuch Juftice is hereby empowered and required to adminifter,) be levied by distress and fale of the goods and chattles of fuch offender, by warrant figned by fuch Juf tice or Juftices, and the overplus, after fuch penalties and the charges of fuch diftrefs and fale are deducted, fhall be returned upon demand to the owner of fuch goods and chattles, one half of fuch penalties, respectively, when paid and levied, Ihall belong to his Majesty, and the other half to the perfon fuing for the fame.

XII. And be it further enacted by the authority aforefaid, that the monies to be levied by virtue of this Act, and not herein-before granted to the faid François Verrault, his heirs and affigns, and the feveral Fines and Penalties hereby inflicted hall be, and the fame are hereby granted, and referved to his majefty, his heirs and fucceffors, for the public ufes of this Province, and the fupport of the Govern ment thereof, in manner herein-before fet forth and contained; and the due ar pli. cation of fuch money, fines and penalties fhall be accounted for to His Majesty, h's heirs and fucceffors, through the Lords Commiffioners of His Majefty's Treatu ry for the time being in fuch manner and form as His Majesty, his heirs and fucceffors fhall direct. X. Et qu'il foit de plus ftatatué par l'autorité fufdite, que dans le cas où la dite Rivière Chaudière deviendroit ci-après naviguée en partie audeffus et aud: ffous du dit Pont pour des Batimens portant des mats, le dit François Verrault, fes héritiers et ayans cause feront faire un Pont Lévis pour le paffage de tels Batimens navi guant dans et fur la dite Rivière fans aucun péage, émolument ou récompense quelconque.

XI. Et qu'il foit de plus ftatué par l'autorité fufdite, que les pénalités infligées le préfent A&te, feront prélevées fur pieuve des offenses refpectivement devant un ou plufieurs Juges de Paix pour le Diftrict de Québec, foit par confeffion du contrevenant, ou fur le ferment d'un ou plufieurs Témoins dignes de foi, (lequel ferment tel Juge de Paix eft par le préfent autorifé et requis d'adminiftrer) par. faifie et vente des effets et biens mobiliers de tel contrevenant, fur un ordre figné de tel Juge de Paix, et le furplus, après déduction faite de telles pénalités et des frais de telles faisie et vente, sera rendu à la demande du Propriétaire de tels effets et biens mobiliers, moitié desquelles pénalités respectivement, lorfque payées ou prélevées, appartiendra à Sa Majefté, et l'autre moitié à la perfonne qui en fera la pourfuite.

XIII. XIV. Provided always, and be it further enacted by the authority aforelaid, ats of this Act, to that the faid François Verrault to entitle himfelf to the benefit of this A&t, shall, and he is hereby required within two months from and after the paffing of th ́s Act, to give public notice three weeks in the Quebec Gazette, and in writing, to be affixed at the church door of the Parish of Sainte Marie, Nouvelle Beauce, during the famo space of time and publicly read after divine fervice in the morning of each Sunday and Holiday intervening in the courfe of that time, that he is thereby authorized to build and conftruct a bridge and toll-house over the faid river Chaudière, at the place above-mentioned; and that the inhabitants of the faid Parifh are entitled to ap-ply to the Grand Voyer, or to his Deputy, within three months after fuch notifica tion, for the purpose of themselves building the faid bridge, which faid notice thail be before a Juftice of the Peace, certified upon the oaths of any two Officers of Militia, refiding in the County of Dorchefter, to have been duly made and given, which Certificate, upon oath with a copy of the aforefaid notice, fhall be depofited? with any Notary public, refiding in the County of Dorchester.

XV. Provided always and be it further enacted by the authority aforesaid, that if Voyer for Proces the inhabitants of the faid Parifh of Sainte Marie, de la Nouvelle Beauce, fhail with in three months after fuch notification as aforefaid, apply by Petition to the Grand Voyer of the District of Quebec, or to his Deputy, to obtain a Procès Verbal and fhall cause the fame to be ratified according to Law, before the twenty-first day of July, one thousand eight hundred and nineteen, for the purpose of caufing the faid bridge to be erected by the faid Parish of Sainte Marie de la Nouvelle Beauce, or by a part of the fame, according to the laws now in force, and shall the eafter in virtue of the faid Procès Verbal, erect the faid bridge within one year to be com puted from the date of the homologation of the faid Procès Verbal, then and in fuch cafe the faid François Verrault, thall not avail himself of this Act, for the pur pofe of erecting the faid bridge and levying the faid rates of toll, provided always that if fuch Petition as above mentioned, be not made and prefented to the Grand Voyer or to his Deputy as aforefaid, within three months, and a copy thereof ferved upon the said François Verrault, within three months after fuch noufication as aforefaid, it shall forthwith after the expiration of the faid three months, be lawful for the said François Verrault, to avail himself of this A&t; and to proceed immedi ately thereafter to the erection and conftruction of the faid bridge and toll-houfe.
