V. And be it further enacted by the authority aforefaid, that if any perfon, fhall Dens forcibly passing forcibly país through the faid Turnpike, without paying the Toll or any part thereout paying Tells or of; or fhall interrupt or disturb the faid Jean Marie Langlois, otherwife called Jean the said Jean Marie Marie Germain, his heirs, executors, curators or affigns, or any person or perfons calied Jean Marie employed by him, or them, for the building or repairing the faid Bridge, or making or repairing the way over the fame, or any road or avenue leading thereto, every perfon fo offending, in each of the cases aforesaid, shall for every fuch offence, forfeit a fum not exceeding forty fhilling, currency.

As soon as the Bridge is completed, no other bridge to be erected within

the said Bridge, &c.

VI. And be it further enacted by the authority aforefaid, that as soon as the faid Bridge fhall be paffable and opened for the use of the public, no perfon or perfons half a league above shall erect or cause to be erected, any Bridge or Bridges, or works, or use any Ferry for the carriage of any perfons, cattle or carriages whatsoever, for hire, across the faid River Yamaska, within half a league above the faid Bridge, and below the said Bridge, as far as the line of the feigneury or parish of Saint Hyacinthe, on the North fide of the faid River; and if any perfon or perfons shall erect a Toll-Bridge or Toll-Bridges over the faid River Yamaska, in the faid limits, he or they fhall pay to the faid Jean Marie Langlois, otherwife called Jean Marie Germain, his heirs, executors, curators and affigns, treble the Tolls hereby impofed, for the perfons, cattle and carriages, which shall pass over fuch Bridge or Bridges, and if any person or perfons fhall, at any time, for hire or gain, pass or convey any person or perfons, cattle, or carriages, across the faid River, within the limits aforefaid, fuch offender or offenders, fhall for each carriage, perfon or animal fo car. ried across forfeit and pay a fum not exceeding forty fhillings currency. Provided that nothing in this A&t contained, fhall be conftrued to prevent the public from passing the faid River Yamaska, at any of the Fords or in canoes, within the limits aforefaid, without gain or hire.

VII. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'au ffitôt que le dit Pont fera paffable et ouvert pour l'ufage du public, dès lors aucune perfonne quelconque ne pourra ériger ou faire ériger aucun Pont ou Ponts, pratiquer ou faire pratiquer demi-lieue, aussitôt aucune voie de paffage pour le tranfport d'aucunes perfonnes, beftiaux ou voitures parachevé." quelconques pour gages, à travers la dite Rivière; Yamafka à une demie lieue audeffus du dit Pont, et au deffous du dit Pont, jufqu'à la ligne de la Seigneurie ou Paroifle Saint Hyacinthe au Nord de la dite Rivière; et fi quelque perfonne ou perfonnes conftruifent un Pont ou des Ponts de Péage fur la dite Rivière Yamaska, et dans les dites limites, elle payera ou elles payeront au dit Jean Marie Lauglois dit Germain, fes Héritiers, Exécuteurs, Curateurs et ayans caule, trois fois la valeur des Péages impofés par le préfent Acte pour les perfonnes, beftiaux et voitures qui palleront fur tel Pont ou Ponts, et fi quelque perfonne ou perfonnes paffent en aucun tems que ce foit, ou tranfportent pour gages ou gain aucune perfonne ou perfonnes, beftiaux, voiture ou voitures à travers la dite Rivière dans les limites fufdites, tel contrevenant ou contrevenans encourront et payeront pour chaque perfonne, voiture ou animal ainfi traverfé, une fomme n'excédant Pourvû pas Quarante chelins courant. rien contenu en cet A&te ne fera cenfé que s'étendre à priver le Public de paffer la dite Rivière Yamaska à gué, dans les limites fufdites, ou en Canot fans lucre ou gage..

VII. Et qu'il foit de plus ftatué par l'autorité fufdite, que fi quelque perfonne abat, arrache, brule ou détruit malicieusement le dit Pont ou quelque partie d'ice- ront les Pont ou Mai lui, ou la Mailon de Péage qui fera érigée en vertu de cet Acte, toute perfonne ainfi contrevenante, et en étant légalement convaincue, fera jugée coupable de Felonie.

VIII. Et qu'il foit de plus atué par l'autorité fuldite, que le dit Jean Marie Langlois dit Germain, pour fe donner le droit aux profits et avantages à lui accordés par cet Acte, érigera et complètera, et il eft par le préfent requis d'ériger et comСса

complete the faid Toll-Houfe, Turnpike and dependencies within four years from the day of the paffing of this A&t, and if the fame fhall not be completed. within the time laft mentioned, so as to afford a convenient and fafe paffage over the faid Bridge, he the faid Jean Marie Langlois, otherwife called Jean Marie Germain, his heirs, executors, curators and affigns, fhall cease to have any right, title or claim, of, in or to the Tolls hereby impofed, which fhall, from thence-forward belong to His Majefty; and the faid Jean Marie Langlois, otherwife called Jean Marie Germain, fhall not by the faid Tolls, or in any other manner or way, be entitled to any reimbursement of the expences he may have incurred in and about the building of the faid Bridge; and in cafe the faid Bridge, after it fhall have been erected and completed, fhall at any time become impaffable or unfafe for travellers, cattle or carriages, he the faid Jean Marie Langlois, otherwife called Jean Marie Germain, his heirs, executors, curators or affigns, fhall and they are hereby required, within two years from the time at which the faid Bridge fhall, by His Majelly's Court of General Quarter Seffions of the Peace, in and for the faid District of Montreal, be ascertained to be impaffable or unfafe, and notice thereof to him or them by the faid Court given, to caufe the fame to be rebuilt or repaired, and made fafe and commoPenalty if not com- dious for the paffage of travellers, cattle and carriages; and if within the time laft mentioned, the faid Bridge be not fo repaired, or rebuilt, as the cafe may require, then the faid Bridge or fuch part or parts thereof, as shail fill exift, fhall be and be taken, and be confidered to be the property of His Majefty; and after fuch default to repair or rebuild the faid Bridge, the faid Jean Marie Langlois, otherwife called Jean Marie Germain, his heirs, executors, Carators or affigns fhall ceafe to have any right, title or claim, of, in, to or out of the faid Bridge, the remaining parts thereof, and the Tolls hereby granted, and his and their rights in the premises, fhall be wholly and for ever determined. Provided always that to fecure to the public. a free paffage during the faid four years the faid Jean Marie Langlois, otherwise cal led Jean Marie Germain, fhall during the next Summer, erect a temporary Bridge on props (chevalets,) which Bridge on props (chevalets,) the faid Jean Marie Langlois, otherwife called Jean Marie Germain, fhall caufe to be approved by two Juftices. of the Peace before demanding the herein-before mentioned Rates of Toll upon the fame, and he shall every year keep up the faid temporary Bridge in a good state of fafety and paffable from the time of the breaking up of ice until the faid River Yamajka fhall be paffable upon the ice in Autumn, at the foot of the cascade, and during the time that the faid Bridge on props (chevalets) cannot be placed anew in the Spring, the faid Jean Marie Langlois, otherwife called Jean Marie Germain, hall have and keep Canoes for the paffage of the public at and for the fame Rates as aforefaid,

IX. And be it further enacted by the authority aforefaid, that the prefent Act or any of the difpofitions therein contained, fhall not extend or be conftrued to extend to weaken,diminish or extinguish the rights and privileges of His Majesty, his heirs and fucceffors, nor of any person or perfons, body politic or corporate in any of the things therein-mentioned, (except as to the powers and authority, hereby given to the

plêter le dit Pont, Maifon de péage, Barrière et autres dépendances, dans quatre années du jour de la paffation de cet Acte, et s'il n'eft point parachevé dans ce dernier tems mentionné, de manière à procurer un paffage fûr et commode fur le dit Pont, le dit Jean Marie Langlois dit Germain, fes Exécuteurs, Curateurs et Ayans caufe cefferont d'avoir aucun droit ou prétention fur les péages par le préfent impofés, lefquels dès lors appartiendront à Sa Majefté, et le dit Jean Marie Langlois dit Germain, n'aura point de droit par le moyen des dits péages, ou de quelqu'autre manière que ce foit, à aucun remboursement des frais qu'il pourra avoir encourrus en bâtiffant le dit Pont, et dans le cas que le dit Pont, après qu'il aura été érigé et parachevé, devienne en aucun tems impraticable ou dangereux pour les voyageurs, beftiaux ou voitures, le dit Jean Marie Langlois dit Germain, fes Héritiers, Exécuteurs, Curateurs ou Ayans caufe, ferort, comme ils font par le préfent requis de faire, fous deux ans du tems que le dit Pont fera constaté être impraticable ou dangereux, par la Cour de Seffion Générale de Quartier de la Paix de Sa Majefté, dans et pour le dit Diftrict de Montréal, et qu'avis en aura été donné à lui ou à eux par la dite Cour, réparer, conftruire et bâtir de nouveau le dit Pont, et le rendre fûr et commode pour le paffage des voyageurs, beftiaux et voitures, et fi, dans ce dernier tems, le dit Pont n'eft point réparé ou rebâti, ainfi point parachévé.. que le cas pourra être, alors le dit Pont ou telle partie ou parties d'icelui qui fubfifteront, deviendront et feront pris et confidérés comme étant la propriété de Sa Majefté, et après tel défaut de réparer et rebâtir le dit Pont, le dit Jean Marie Langlois dit Germain, fes Héritiers, Exécuteurs, Curateurs ou Ayans caufe cefferont d'avoir aucun droit, titre ou prétention fur le dit Pont ou les parties reftantes. d'icelui, et les péages par le préfent accordés, de même que fon ou leur droit dans les objets fufdits, feront entièrement et pour toujours terminés. Pourvû toujours, que le dit Jean Marie Langlois dit Germain, fera tenu d'ériger l'Eté prochain un Pont momentané fur des Chevalêts, pour affurer le paffage libre du Public pendant les dites quatre années, lequel Pont fur des Chevalêts, le dit Jean Marie Langlois dit Germain, fera tenu de faire approuver par deux Juges de Paix avant de demander les Taux ci-devant mentionnés pour le paffage furicelui, et il fera tenu de tenir le dit Pont momentané tous les ans en bon état de fûreté et paffable depuis le départ des glaces, jufqu'à ce que la dite Rivière Yamaska loit paffable l'automne fur la glace au pied de la Cafcade, et dans les intervalles où le dit Pont fur des Chevalêts ne pourra être replacé le Printemps, le dit Jean Marie Langlois dit Germain, fera tenu d'entretenir des Canots pour le paffage du Public, en prenant les mêmes Taux comme fufdit.

And be it further enacted by the authority aforefaid, that the penalties hereby inflicted, fhall, upon proof of the offences refpectively before any one or more of the Juftices of Peace for the District of Montreal, either by confeffion of the of fender, or by the Oath of one or more credible Witnefs, or Witneffes, (which Oath fuch Juftice is hereby empowered and required to administer,) be levied by diftrefs and fale of the goods and chattels of fuch offender, by warrant figned by such Juf tice or Justices of the Peace, and the overplus, after fuch penalties and the charges of such distress are deducted, fhall be returned upon demand to the owner of fuch goods and chattels, one half of fuch penalties, refpectively, when paid and levied, fhall belong to His Majefty, and the other half to the perfon fuing for the fame.

XI. And be it further enacted by the authority aforefaid, that the money to be levied by virtue of this Act, and not herein-before granted to the faid Jean Marie Langlois, otherwife called Jean Mare Germain, his heirs and affigns, and the feveral Fines and Penalties hereby inflicted, fhall be, and the fame are hereby granted, and referved to His Majefty, his heirs and fucceffars, for the public ufes of this Province, and the Government thereof, in manner herein-before fet forth and contained; and the due application of luch money, fines and penalties fhall be accounted for to His Majefty, his heirs and fucceffors, in fuch manner and form, as he or they shall direct, through the Lords Commiffioners of His Majefty's Treasury for the time being.

XII. And be it further enacted by the authority aforefaid, that this A&t shall be deemed a public Act, and fhall be judicially taken notice of as fuch, by all Judges, Juftices of the Peace, and all other persons whomsoever, without being specially pleaded.
