X. XI. And be it further enacted by the authority aforefaid, the faid Louis Michel Viger, to entitle himself to the benefits and advantages to him, by this Act granted, shall and he is hereby required, to erect and complete the faid Bridge, Toll-Houfes, Turnpikes and conveniencies within four years from the day of the paffing of this A&t, and if the same shall not be completed within the time laft mentioned, so as to afford a convenient and fafe paffage over the faid Bridge, he the faid Louis Michel Viger, his heirs, executors, curators and affigns, fhall cease to have any right, title or claim, of, in or to the Tolls hereby impoled, which fhall, from thence-forward belong to His Majefty; and the faid Louis Michel Viger fhall not by the faid Tolls, or in any other manner or way, be intitled to any reimbursement of the expence he may have incurred in and about the building of the faid Bridge; and in cafe the faid Bridge, after it fhall have been erected and completed, fhall at any time become impaffable or unfafe for travellers, cattle or carriages, he the faid Louis Michel Viger, his heirs, executors, curators or affigns, fhall and they are hereby required, within three years from the time at which the faid Bridge fhall by his Majesty's Court of General Quarter Seffions of the Peace, in and for the faid District of Montreal, be ascertained to be impaffable or unfafe, and notice thereof to him or them by the faid Court given, to caufe the fame to be rebuilt or repaired, and made Penalty if not com- fafe and commodious for the paffing of Travellers, Cattie and Carriages; and if within the time last mentioned, the faid Bridge be not fo repaired, or rebuilt, as the cafe may require, then the faid Bridge or fuch part or parts thereof, as fhall be remaining, fhall be and be taken, and confidered to be the property of his Majefty; and after fuch default to repair or rebuild the faid Bridge, the faid Louis Michel Viger, his heirs, executors, curators or affigns fhall ceafe to have any right, title or claim, of, in, to or out of the faid Bridge, or to the remaining parts thereof, and the Tol's hereby granted, and his and their rights in the premifes, fhall be wholly and for During the inter- ever determined. XII. And be it further enacted by the authority aforefaid, that the penalties hereby inflicted, fhall, upon proof of the offences refpectively before any one or more of the Juftices of the Peace for the District of Montreal, either by confeffion of the offender or by the oath of one or more credible witness or witneffes, (which oath fuch Juftice is hereby empowered and required to adminifter) be levied by diftrefs and fale of the goods and chattels of fuch offender, by warrant figned by fuch Jeftice or Juftices, and the overplus, after fuch penalties and the charges of fuch diftrefs and fale are deducted, fhall be returned upon demand to the owner of such goods and chattels, one half of which penalties, refpectively, when paid or levied, hall belong to His Majefty, and the other half to the perfon fuing for the fame.

XIII. And be it further enacted by the authority aforesaid, that this Act or any thing herein contained, shall not extend or be conftrued to extend, to lessen, take away or affect the rights or privileges of the King's Majefty, his heirs or fucceffors, or any perfon or perfons, bodies politic or corporate, in any of the things herein-before mentioned,except as to the powers and authority hereby given to the faid Louis Michel Viger, his heirs and affigns, and except to the rights which are hereby altered or extinguished, but that His Majefty the King, his heirs and fucceffors, and all and every person or perfons, bodies politic or corporate, their heirs and affigns, executors and adminiftrators fhall have and exercise the fame rights (with the exceptions aforefaid) as they and each of them had before the paffing of this Act, to every effe& and purpose whatsoever and in as full and ample a manner as if this A&t had never been paffed..

XIV. And be it further enacted by the authority aforefaid, that the money to be this Act, and not levied by virtue of this Act, and not herein-before granted to the faid Louis Michel chel Viger, and the Viger, his heirs and affigns, and the feveral fines and penalties hereby inflated, fhall nalties, granted to be, and the fame are hereby granted, and referved to His Majefty, his Heirs and Suc. counted for to his ceffors, for the public ufes of this Province, and the Government thereof, in manner herein before fet forth and contained: and the due application of fuch monies, fines and penalties fhall be accounted for to His Majefty, his Heirs and Succeffors, in fuch manner and form, as His Majefty, his Heirs and Socceffors fhall direct, through the Lords Commiffioners of His Majefty's Treafury, for the time being.

Et qu'il foit de plus ftatué par l'autorité fufdite, que le préfent Acte, ni tendra pas à affecter aucunes des difpofitions y contenues ne s'étendront, ni ne feront entendues s'étendre les droits du Roi. à affoiblir, diminuer ou éteindre les droits et privilèges de Sa Majefté le Roi, les Héritiers ou Succeffeurs, ou d'aucune perfonne ou perfonnes, corps politique ou incorporé en aucunes des chofes y mentionnées (excepté quant aux pouvoirs et au torité par le préfent donnés au dit Louis Michel Viger, Ecuyer, fes Hoirs et Ayans caufe, et excepté quant aux droits qui font par le préfent expreffément altérés ou éteints,) mais que Sa Majefté le Roi, Ses Héritiers et Succeffeurs et toutes et chaque perfonne ou perfonnes, corps politique ou incorporé, leurs Hoirs et Ayans caufe, Exécuteurs et administrateurs auront et exerceront les mêmes droits (fous les exceptions fufdites) qu'eux et chacun d'eux avoient avant la paflation de cet Acte à tous effets quelconques, et d'une manière auffi ample que fi le présent Acte n'avoit jamais été paffé.

XIV. Et qu'il foit de plus ftatué par l'autorité fufdite, que les argents qui feront prélevés en vertu de cet Acte, et qui ne font pas ci-devant accordés au dit Louis Michel Viger, les Hoirs et ayans caufe, et les différentes amendes et pénalités infligées par le préfent, feront, comme ils font par le préfent, accordées et réservées à Sa Majefté, fes Héritiers et Succeffeurs, pour les ufages publics de cette Province, et le Gouvernement d'icelle en la manière ci-devant exprimée et contenue et il fera tenu compte à Sa Majefté,les Héritiers et Succeffeurs de la due application de tels argents, amendes et pénalités, par la voie des Lords Commiffaires du Trésor de Sa Majefté pour le tems d'alors, en telles manières et forme que Sa Majefté, Ses Héritiers et Succeffeus l'ordonneront.

AN ACT to authorife Jean Marie Langlois, otherwife called Jean Marie Germain, to build a Bridge over the River Yamaska, at the foot of the cafcade, oppofite the village of Saint Hyacinthe, in the County of Richelieu, to fix the Rates of Toll for paffing thereon, and to provide regulations for the faid Bridge.

THEREAS Jean Marie Langlois, otherwife called Jean Marie Germain, has with confiderable expense purchased a certain lot of ground and a Bridge on props (chevalets) erected many years ago, over the River Yamafka at the foot of the cafcade of the faid River, oppofite to the village in the Parish of Saint Hyacinthe, in the County of Richelieu, and whereas the faid Jean Marie Langlois, otherwife called Jean Marie Germain, by his petition in that behalf has fet forth the nceffity, the benefit and the additional fecurity which the public would derive from the erection of a substantial and fufficient Toll Bridge at the place before mentioned, instead of the prefent infecure and incommodious Bridge on props (chevalets); be it therefore enacted by the King's Moft Excellent Majefty, by and with the advice and consent of the Legisla tive Council and Affembly of the Province of Lower-Canada, conftituted and affembled by virtue of, and under the authority of an A& paffed in the Parliament of Great-Britain, intituled, " An Act to repeal certain parts of an Act passed in the "fourteenth year of His Majesty's Reign, intituled, "An Act for making more effectual "provifion for the Government of the Province of Quebec, in North-America" and "to make further provifion for the Government of the faid Province;" And it is hereby enacted by the authority of the fame, that it fhall be lawful for the faid Jean Marie Langlois, otherwife called Jean Marie Germain, and he is hereby authorifed and empowered, at his own cofts and charges, to erectand build a permanent, fufficient and fubftantial Bridge, over the faid River Yamaska, at the foot of the cafcade of the faid River and oppofite to the village in the faid Parish of Saint Hyacinthe, and to erect and build one Toll- House and Turnpike with other dependencies,on or near the faid Bridge, and alfo to perform and execute all other matters and things requifite and neceffary, ufeful or convenient for erecting and building, maintaining and fupporting the faid intended Bridge, Toll-Houfe, and other dependencies, according the tenor and true meaning of this Act; and further, that for the purpose of erecting, building, maintaining or fupporting the faid Bridge, the faid Jean Marie Langlois, otherwife called Jean Marie Germain, his heirs, executors, curators and affigns, fhall, from time to time, have full power and authority to take and use the land, on either fide of the place called the cascade, and there to work up or canfe to be wrought up the materials and other things neceffary for erecting, conftruct
