CA P. XXXVI. AN ACT to authorife Louis Michel Viger, Efquire, to erect a Toll-Bridge over the River Des Prairies. (22 March, 1817.) Preamble. WH HEREAS the erection of a fafe and convenient Bridge over the River Des Prairies, which feparates the Ifland of Montreal from Ifle Jefus, in the County of Effingham, in the Parish of Saint Vincent de Paul, would be advantageous for the intercourfe of the inhabitants of the neighbouring Parishes and of the public in general and most advantageous to the commerce and to the fupply of the Town of Montreal; And whereas Louis Michel Viger, of the City of Montreal, Efquire, hath by his petition to that effect, prayed for leave to erect a Toll-Bridge, at his own expence, over the faid River Des Prairies, from the Ifland of Montreal, in the Parish of La Vifitation du Sault au Recolet to Ifle Jefus, in the Parish of Saint Vincent de Paul, the faid Bridge to be erected in the said Parish of Sault au Recolet, below the Church and near the Mills of the Seigneurs of Montreal Island, whereby there will be at all times a fafe and commodious intercourfe between the Ifland of Montreal and the Ifle Jefus; be it therefore enacted by the King's Moft Excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower-Canada, conftituted and affembled by virtue of, and under the authority of an A& paffed in the Parliament of Great-Britain, intituled, “An Act to repeal certain parts of an A& passed in the fourteenth year "of His Majefty's Reign, intituled, "An A&t for making more effectual provifion for the "Government of the Province of Quebec, in North-America ;" and to make further "provifion for the Government of the faid Province;" And it is hereby enacted by the authority of the fame,that it fhall and may be lawful for the faid Louis MichelViger, Esquire, authorised and he is hereby authorised to erect and build a good and fubftantial Bridge, at his own cofts and charges, over the faid River Des Prairies, from the Ifland of Montreal in the faid Parish of La Vifitation du Sault au Recolet to Ile Jefus, in the Parish of Saint Vincent de Paul, at fuch place or places as the faid Louis Michel Viger fhall find most fuitable and beft adapted to this object, near the Mills of the Seigneurs of Montreal Island, below the Church of the faid Parish of La Visitation du Saultau Recolet, and to erect and build one or feveral Toll- Houses, and one or several Turnpikes with other dependencies upon or near the faid Bridge, and allo, to do, per. form and execute all other matters and things requifite, neceffary, ufeful and convenient for erecting, building, maintaining and upholding the faid intended Bridge, Toll-Houfes, Turnpikes and dependencies, fo intended to be made agreeably to the tenor and meaning of this Act; and further, in order to enable the faid Louis Michel Viger to build, erect, fupport and maintain the faid Bridge; he the faid Louis M. ATTENDU que l'Edification d'un Pont fur et convenable fur la Rivière des Prairies, qui fépare l'Ifle de Montréal de l'ifle Jéfus dans le Comté d'Effingh-m Paroiffe de Saint Vincent de Paul, faciliteroit beaucoup la communication des Habitans des Paroiffes voisines et du Public en général, et feroit très avantageux au Commerce et à l'approvifionnement de la Ville de Montréal ; Et attendu que Louis Michel Viger, Ecuyer, de la Cité de Montréal, a par fa requête à cet effet demandé permiffion de conftruire à fes propres frais un Pont de Péage fur la dite Rivière des Prairies, de l'Ifle de Montréal dans la Paroiffe de la Vifitation du Sault au Récollet à l'Ifle Jéfus dans la Paroifle de Saint Vincent de Paul, le dit Pont à être érigé dans la dite Paroiffe du Sault au Récollet au dessous de l'Eglifeet près des Moulins des Seigneurs de l'Isle de Montréal, au moyen duquel il pourra y avoir en tout tems une communication fûre et commode depuis l'Isle de Montréal jufqu'à l'Ifle Jéfus; Qu'il foit donc ftatué par la Très Excellente Majefté da Roi,par et de l'avis et confentement du Confeil Législatif et de l'Affemblée de la Pro vince du Bas-Canada,conftitués et affemblés en vertu et fous l'autorité d'un Acte paffé dans le Parlement de la Grande Bretagne, intitulé, "Acte qui rappelle certaines par"ties d'un Acte pafé dans la quatorzième Année du Règne de Sa Majesté, intitulé, “Alle qui pourvoit plus efficacement pour le Gouvernement de la Province de Québec dans "PAmérique Septentrionale;" Et qui pourvoit plus amplement pour le Gouverne"ment de la dite Province;" Et il eft par le préfent ftatué par la dite autorité, qu'il fera et pourra être loifible au dit Louis Michel Viger, et il eft par le préfent autorisé à construire et bâtir, à fes propres frais et dépens, un Pont folide et fuffifant fur la dite Rivière des Prairies de l'Ifle de Montréal dans la dite Paroiffe de la Vifitation du Sault an Récollet, à l'Ifle Jétus dans la Paroiffe de Saint Vincent de Paul, et ce à telle place ou places que le dit Louis Michel Viger trouvera les plus convenables et les plus propices à cet objet, près des moulins des Seigneurs de l'Isle de Montréal, fitués au deffous de l'Eglife de la dite Paroiffe de la Vifitation du Sault au Récollet, et d'ériger et conftruire une ou plufieurs Mailons de péage, et une cu plufieurs Barrières avec d'autres dépendances fur ou près du dit Pont, et auffi de faire et exécuter toutes autres matières et chofes requifes et néceffaires, utiles et commodes pour ériger et conftruire, entretenir et foutenir le dit Pont projettés, Maisons de péage, Barrières et autres dépendances fuivant la teneur et le vrai fens de cet Acte,et de plus afin de parvenir à ériger, conftruire et entretenir ou foutenir le dit Pont, le dit Louis Michel Viger, fes Héritiers, Exécuteurs, Curateurs,. Louis Michel Viger, his heirs, executors, curators and affigns, fhall have full power and authority, from time to time, to take and use the land, on either fide of the faid river, and alfo the islands fituated near the faid Bridge, and there to work or cause the materials and other things neceffary for the erecting, building or repairing. the said Bridge, to be wrought: and in confequence the faid Louis Michel Viger, his heirs, executors, curators or affigns, or the perfons by him or them employed, hall caufe as little damage as poffible, and shall make a juft and reasonable compensation to the relpective proprietors or occupiers of all fuch lands, as may be charg ed, damaged or made ufe of, for the purpose of erecting the faid Bridge; and in cafe of difference or difpute about the amount of fuch compenfation, the fame shall be fixed by His Majefty's Court of King's Bench for the District of Montreal, after a previous furvey and eftimation of fuch places fhall have been made by Experts, to be named by the parties, refpe&ively, and in default of fuch nomination, by them or either of them, then by the faid Court in manner and form prefcribed by Law, for the nomination of Experts in Civil Causes, and the said Court is hereby authorised to hear, settle and finally determine the amount of such compensation, accordingly. II. And be it further enacted by the authority aforefaid, that while the faid Louis the erection of the Michel Viger,his heirs and affigns fhall be occupied ineftablishing or fixing the fcaffoldto as the ing neceflary for the erection of the faid Bridge or for the repairing thereof, no perfon or perfons fhall convey down or caufe to be conducted or conveyed down,any rafts or be given, of such cribs upon the faid River, at the place where the faid Bridge is to be built. Provided that the faid Louis Michel Viger, his heirs and affigns have given at least fix weeks previous notice in one of the Newspapers of the City of Montreal, at the time when they intend to establish or place the faid fcaffolding for the erection or repairing of be placed before the the faid Bridge. Provided alfo, that the faid fcaffolding fhall not be placed before 1st of August of the the first day of Auguft, in the year in which the faid Bridge fhall be erected or repaired. year in which Bridge is erected. An opening to be left between the Pil for floating down the Rafts. III. And be it further enacted by the authority aforefaid, that in erecting the faid lars of the Bridge, Bridge, there fhall be left an opening between the pillars thereof of at least eighty feet in width, at the deepest part of the River, and where the rafts are ordinarily floating down, fo that the faid rafts floating down the fame may meet with no obftruction, and it fhall be the duty of the proprietors or conductors of every fuch raft to give two hours previous notice to the Toll Gatherer or perfon having charge of the faid Bridge, of his or their intention to pafs through the fame with fuch raft.Provided always, that no more than two cribs fhall pafs at the fame time, and all damage caufed by any fuch raft as may come against the faid Bridge without fuch notice as aforefaid having been given, or containing more than two cribs, and further, the damages cauled to the faid Bridge, by the fault and negligence of the condu&tors of the faid rafts fhall be made good by the proprietor or conductors of such rafts to Proviso. the et ayant caufe auront plein pouvoir et autorité de prendre. de tems à autre, et de fe fervir du Terrein foit d'un côté ou de l'autre de la dite Rivière, et auffi des Ifles qui fe trouveront près du dit Pont, et là de travailler ou faire travailler les matériaux et autres chofes néceffaires à l'érection, conftruction ou réparation du dit Pont, pourquoi le dit Louis Michel Viger, fes Héritiers, Exécuteurs Curateurs ou Ayans caufe, ou les perfonnes par lui ou eux employées cauferont auffi peu de dommage que poffible, et accorderont une compenfation jufte et raisonnable aux Propriétaires et Occupants refpectifs de terres de tels Terreins qui feront chargés, endommagés et mis en ufage pour ériger le dit Pont, et en cas de différence d'opinion et de contefte fur le montant de telle compensation, il fera règlé par la Cour du Banc du Roi de Sa Majefté pour le District de Montréal, après que vifite, examen et eftimation des lieux auront été préalablement faits par des experts, qui feront nommés par les parties refpectivement, et à défaut de telle nomination par elles ou aucune d'elles, alors par la dite Cour, en telles manière et forme prefcrites par la Loi, pour la nomination des experts dans les caufes civiles, et la dite Cour eft par le préfent autorisée d'entendre, règler et finalement déterminer le montant de telle compenfation en conféquence. Pendant le tems qu'on placera l'échation du pont, aucua faudage pour l'éreccageux ou Cribs u'y passera. donné de l'intention II. Et qu'il fait de plus ftatué par l'autorité fufdite, que pendant le tems que le dit Louis Michel Viger, fes Hoirs ou ayans caufe, établiront où placeront l'Echaffaudage néceffaire pour l'édification du dit Pont ou pour fon rétabliffement, perfonne ne pourra faire defcendre ou conduire aucun Cageux, Cages ou Cribs dans la dite Rivière, à l'endroit où le dit Pont doit être édifié. Pourvû que le dit Louis Michel Viger, fes hoirs et ayans caufe, aient donné notification ou avertiffement au moins de Six Semaines d'avance dans un des Papiers nouvelles de la Ville de Montréal, du tems où ils auront deffein d'établir ou placer le dit Echaffaudage pour la conftruction ou le rétabliffement du dit Pont. Pourvû auffi, que le dit Echafaudage ne pourra être placé avant le premier d'Août dans l'année où le dit Pont fera contrait ou rétabli. Avis préalable sera le plager. Il n'en sera placé ancun avant le 12 d'aout de l'année ou le Pont sera båti on réparé, Il sera laissé une Piliers du Pont pour sent passer. III. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'en érigeant le dit Pont, il fera laiffé une ouverture d'au moins quatre vingts Pieds entre les Piliers à l'endroit ouverture entre les le plus profond de la Rivière et où paffent ordinairement les Cages, afin que les que les ages puisdites Cages puiffent paffer fans interruption, et il fera du devoir des Propriétaires ou Conducteurs de toutes telles Cages, de donner notice au moins deux heures d'avance au receveur à la Barrière ou au Gardien du dit Pont, de fa ou de leur intention de paffer avec telles Cages. Pourvû toujours, qu'il ne paffera pas plus de deux trains ou Cribs à la fois, et tous les dommages que pourront caufer les Cages qui viendront contre le dit Pont, faute d'avoir préalablement donné telle notice, ou parcequ'elles feront compofées de plus de deux trains on Cribs, de plus les dommages caulés au dit Pont, par la négligence et faute des Conducteurs des dites Cages, feront remboursés au dit Louis Michel Viger, les hoirs, Exécuteurs, Carateurs A a Proviso. the faid Louis Michel Viger, his heirs, executors, curators or affigns, and shall be recoverable by fuit at Law in any Court of Record, taking cognizance of caules to the like amount. Grand-Voyer or his Deputy of the Dis thorised to change King's highway. IV. And whereas it may be neceffary for the purpose of effecting a communicatrict of Montreal au- tion with the faid Bridge, to change the direction of the King's highway in the vicinity the direction of the thereof, or to open a new highway or highways, be it further enacted by the authority aforefaid, that it fhall be lawful for the Grand-Voyer of the District of Montreal, or his Deputy, to fend an order to the Surveyor of highways, in every Parish, through which the faid King's highway or highways may pafs, to be by him read and pub. lished in the usual manner at the Church door of every such Parish; in which order, the faid Grand-Voyer or his Deputy fhall require all perfons interested in the faid King's highway or highways, to meet on the day and at the hour and place which he hall fix, to give fuch information as they may judge neceffary or proper, and after fuch meeting, the faid Grand Voyer or his Deputy, fhall go upon the spot to change the direction of fuch part or parts of the faid King's highway or highways, bye road or bye roads, and to open fuch other highways or bye roads, as may be neceffary for communicating with the faid Bridge; and the faid Grand-Voyer or his Deputy fhall fix and allot the work to be performed, and by whom it fhall be performed, upon fuch parts of the King's highway or bye roads, to be fo as aforefaid changed, and upon fuch highway or highways, bye road or bye roads, to be opened as aforefaid, of all which he fhall make his procès verbal, to be heard, examined and determined upon, in due course of Law. And be it further enacted by the authority aforefaid, that the faid Bridge, and the faid Toll- Houses, Turnpikes and conveniencies to be erected thereon, or near thereto, and alfo the afcents or approaches to the faid Bridge, and all mate rials which fhall be, from time to time, gotten and provided, for erecting, building, making, maintaining and repairing the fame, fhall be vefted in the faid Louis Michel Viger, his heirs and affigns for ever: Provided, that after the expiration of fifty Majesty may assume years, to be accounted from the paffing of this Act, it shall and may be lawful for the possession of the His Majefty, his Heirs and Succeffors, to affume the poffeffion and property of to Louis Michel Vi the faid Bridge, Toll-Honfes, Turnpikes and conveniencies, and the afcents and the lue thereof. approaches thereto, upon paying to the faid Louis Michel Viger, his heirs, executors, curators or affigns, the full and entire value which the fame may, at the time of When the Bridge fuch affumption, bear and be worth: And when and fo foon as the faid Bridge fhall is built and fit for the be erected and built, and made fit and proper for the paffage of Travellers, Cattle &c.
