and vessels refusing imprisonment: and every master of such ship or vessel as aforesaid, who shall difoorder of such Pilots. bey the orders of fuch Pilot or Pilots in this refpect, fhall, for every fuch difobedience, forfeit and pay a penalty of fifty pounds, fterling money of Great Britain, and be imprisoned until the fame be paid.

V. And to prevent difficulties with the master or masters of arriving veffels, it is hereby further enacted by the authority aforefaid, that the mafter of the Port, or other perfon or perfons fo appointed under this Act, fhall fhow the fame, and allo the Act of the thirty-fifth of his prefent Majefty, chapter the fifth, commonly called the quarantine A&t, to the mafter or masters, commander or commanders, of fuch ar riving fhip or fhips as aforefaid.

VI. And be it further enacted by the authority aforelaid, that all and every penalty incurred under this Act, fhall and may be fued for or recovered in any of His Majefty's Courts of Record in this Province, by plaint or information, upon the oath of one or more credible witnels or witneffes, and the faid penalties fhall be paid to His Majesty, his heirs and fucceffors, for the public uses of this Province, and the fupport of the government thereof; and the due application of the fame, fhall be accounted for to His Majefty, his heirs and fucceffors, through the Lords Commiffioners of His Majesty's Treafury for the time being, in fuch manner and form, as His Majefty, his heirs and fucceffors fhall direct.

WH

HEREAS the overthrow of the Ufurper in France, and the restoration of the
House of Bourbon, has caufed many diicontented adventurers, and mif-

II. III. And be it further enacted by the authority aforefaid, that in all cafes concerning the execution of this act, when any queftion fhall arife, whether any perfon is or is not a native of France, or may or may not have refided in France,at any period since the first day of January, one thousand seven hundred and ninety-three, or may or may not have borne arms, or may or may not have held any office civil or military in the service of the power or powers, perfon or perfons governing France, and the Colonies, Territories or Dependencies thereof, at any time during the Revolution and Troubles therein, fince the fsaid first day of January, one thousand feven hundred and ninety three,or hath or hath not come into this Province during the contiuance of this Act, the onus probandi with respect to every fact which in any fuch question fhall exempt fuch perfo n or perfons refpectively from the operation of this Act, shall be, upon the perfon, touching whom such question shall arise.

IV. And be it further enacted by the authority aforefaid, that this A&t shall continue in force until the firft day of May, which will be in the year of our Lord, one thoufand eight hundred and eighteen, and no longer.

CA P. XXI.

AN ACT to appropriate a further Sum of Money towards the payment of of certain arrears due for the erection of a Common Gaol, in the District of Quebec,
