And be it further enacted by the authority aforefaid, that before the building in and estimate of the faid Court House and proper Offices fhail be commenced, the faid Commide, to be fald be miffioners or any two of them in the faid D'ftrict, fhal, and they are hereby directed and if approved of, to caufe a plan of the faid Couri-Houfe and proper Offices with an eftimate of the may contract for the expence of erecting the fame, to be made; which plan and eftimate fhall by the faid building ofthe Court Commiffioners or any two of them in the said District, be laid before and approved of by the Governor, Lieutenant-Governor or perfon adminiftering the Government of this Province for the time being; and after fuch approbation, it shall and may be lawful for the faid Commissioners or any two of them in the faid District, from time to time, to agree by contract or contracts in writing or otherwife in their difcretion, with any perfon or perfons as well for conducting and infpecting the works as for providing materials and hiring workmen and labourers, and for the building of the faid Court House and proper Offices in the faid Difrict, and for the building of fuch part or parts of fuch Court-House and proper Offices, as and for which the faid Commiffioners or any two of them in the said district, fhall think it expedient to contract or agree. Provided always, that previous to making any contract or contracts. in writing, fourteen days notice at leaft fhall be given in one or more of the public newspapers, printed within the cities of Quebec or Montreal,expreffiing the object and intention of fuch contracts and the time and place for receiving propofais for the fame. And be it further enacted by the authority aforefaid, that when and fo foon as the faid Court House fhail be erected, and fufficiently finished in the faid Town of Three-Rivers, the feveral Courts of King's Bench for the faid District of ThreeRivers, the feveral Provincial Courts for the faid Diftrict, the feveral Courts of General Quarter or Special Seffions of the Peace for the faid Diftrict, the Weekly Sittings of the Juftices of the Peace of and for the faid Diftrict, and all other meetings of the faid Juftices, and all fpecial Courts of Oyer and Terminer, and General Goal Delivery or other defcription, shall be holden and kept in the faid CourtHoufe in the said Town of Three-Rivers, any Law, cuftom or ufage to the contrary notwithstanding. Et qu'il foit deplus ftatué par l'autorité fufdite, qu'avant que la bâtiffe de la dite falle d'audience et offices convenables, foit commencée, les dits Commiffaires front faire un plan ou deux d'entr'eux dans le dit diftri& feront, et ils font par le préfent requis de faire des dépenses pour faire un plan de la dite falle d'audience et offices convenables avec une eftimation des tre soumise à f'apdépenfes pour l'ériger, lefquels plans et eftimations feront par les dits Commiffaires Verneur et après ou deux d'entr'eux du dit District, mis devant le Gouverneur, Lieutenant Gou- pourront contracter verneur, ou la Perfonne ayant l'Adminiftration du Gouvernement de cette Province pour le tems d'alors, pour être par lui approuvés et après telle approbation, il Tera et pourra être loifible aux dits Commiffaires ou à deux d'entr'eux dans le dit Diftrict, de convenir de tems à autre par contrat ou contrats, par écrit ou de la manière qu'ils aviseront avec quelque perfonne ou perfonnes, tant pour pourvoir de matériaux et engager des ouvriers et journaliers, que pour bâtir la dite falle d'audience avec des Offices convenables, dans le dit District, et pour bâtir telle ou telles parties de telle falle d'audience et offices convenables, tel et ainfi que les dits Commiffaires ou deux d'entr'eux dans le dit Diftri&t le trouveront expédient de contracter ou de convenir. Pourvû toujours, qu'avant de paffer aucun contract ou contrats par écrit, un avis de quatorze jours au moins fera donné dans un Papier Contr nouvel imprimé dans les Cités de Québec et de Montréal, exprimant l'objet et l'intention de tels contrats, et le tems et lieu pour en recevoir les propofitions. Avis de 14 jours sera donné, expri mant l'objet de tel VI. Et qu'il foit de plus ftatué par l'autorité fufdite, que lorfque et aufitôt que la dite falle d'audience fera érigée et fuffisamment achevée dans la dite Ville des Trois-Rivières, les différentes Cours du Banc du Roi pour le dit District des Trois Rivières, les différentes Cours Provinciales pour le dit District, les différentes Cours de Quartier de Seffion Générales ou fpéciales de la Paix pour le dit Diftrict, les Séances hebdomadaires des Juges de Paix pour le dit Diftrict, et toutes autres Affemblées des dits Juges de Paix et toutes Cours fpéciales d'Oyer et Terminer et de Délivrance Générale des Prifons ou autre Cour, fe tiendront et feront tenues dans ladite Salle d'Audience dans la dite Ville des Trois-Rivières, nonobftant toute Loi, coutume ou usage à ce contraires. And be it further enacted by the authority aforefaid, that it fhall and may be lawful for the Governor, Lieutenant-Governor, or person adminiftering the Go. vernment of this Province for the time being, to allow to the person to be appointed Treasurer and Clerk, as aforefaid, a fum not exceeding two hundred pounds, currency, to be paid from the fum herein appropriated for erecting the faid Court houfe, and proper offices, as a compenfation for his fervices during the conftruation of the faid Court-house, and proper offices in the faid diftrict of Three-Rivers. IX. And be it further enacted by the authority aforefaid, that the faid Commifmonies expended, fioners in the faid diftrict of Three-Rivers, from time to time, when thereunto required by the Go- quired, fhall account to the Governor, Lieutenant-Governor, or perfon adminiftering the government of this Province for the time being, for the application and expenditure of all and every the fum or iums of money to be advanced to them, and ditributed by them in the erection of the faid Court-houfe, and proper offices, in fuch manner and form as the Governor, Lieutenant-Governor, or perfon adminiftering the government of this Province for the time being, fhall appoint and direct. AN ACT to amend an Act paffed in the thirty-fourth year of His Majefty's Reign, intituled, "An Act for the Divifion of the Province of Lower "Canada, for amending the judicature thereof, and for repealing cer "tain Laws therein mentioned, fo far as refpects the Superior Terms of "the Court of King's Bench, for the District of Three-Rivers." MOST GRACIOUS SOVEREIGN, (22 March, 1817.) WHEREAS the increase of population and commerce in the District of ThreeRivers, and the fecurity and welfare of His Majefty's fubjects, refident therein, render it neceffary that there should be an additional Superior Term of the Court of King's Bench in the faid District; may it therefore please Your Majefty that it may be enacted and be it enacted by the King's Moft Excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower-Canada, conftituted and affembled by virtue of and under the authority of an A&t paffed in the Parliament of Great-Britain, intituled, "An A&t "to repeal certain parts of an A&t paffed in the fourteenth year of His Majefty's "Reign, intituled," An Act for making more effectual provifion for the Government "of the Province of Quebec in North-America ;" and to make further provision for "Government of the faid Province ;" and it is hereby enacted by the authority of the fame, that in addition to the two Superior Terms of the Court of King's Bench appointed to be held in the Town of Three Rivers for the District of Three-Rivers, under the faid A&t paffed in the thirty-fourth year of His Majefty's Reign, there fhall be holden in the faid Town of Three-Rivers for the laid Diftrict of ThreeRivers,by the Justices of the Court of King's Bench for the faid diftricts of Quebec and Montreal and the Provincial Judge of the laid Diftri&t of Three-Rivers or any two Court of K.'s Bench of them, a third Superior Term of the Court of King's Bench for the Diftri&t of Three Rivers; that is to fay, from the tenth day of January to the thirtieth day of the fame month, in each and every year respectively, both days inclufive; and the faid Court fhall be holden every day during the faid term, (Sundays and holidays excepted) and the first and every other juridical day in the faid term, fhall be a return day, for all writs and procefs iffuing from the faid Court; and the faid Court, in the term thereof fo to be holden, fhall have the fame original jurifdiction, to take cognizance of, hear, try, and determine, all civil fuits or actions, as in and by the faid above-mentioned Act of the Provincial Parliament, is vefted in the Court of King's Bench for the faid diftrict of Three-Rivers, in the two terms thereof thereby appointed to be holden.
