to other tracks laid by said company; provided, however, that it shall be the duty of said company to keep the track within the rails, and for at least one foot along the outside thereof, at all times, in good order and repair.

Section 2. The said company shall commence the work of so extending its track within two months after the passage of this ordinance, and shall so far complete the same as to run cars regularly as far as Railroad street, within four months from the date of the passage of this ordinance, and so far complete it as to run cars regularly to Maple street on or before December 1st, A. D. 1875, and in case of failure so to begin, and so far to complete said extension within the time specified, the company shall forfeit any right and privilege given by this ordinance as to any portion of said line, not so far completed; provided, that if said company shall be delayed in the work by the order or injunction of any court, or by the tearing up of Reed street, along any part of said line, for the purpose of constructing sewers or laying water pipes, or any other purpose authorized by said city, the time of delay so caused shall not be reckoned as a part of the time to which said company is hereby limited.

AN ORDINANCE

To authorize the Milwaukee City Railway to extend its track, and for other purposes.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. The Milwaukee City Railway Company is hereby authorized to extend its railway by a single or double track, with all necessary switches and turn tables, in and along Maple street, from the corner of Reed street, in the Twelfth ward, to Kinnickinnic avenue, in said ward, and also in and along Fourth avenue, from the corner of Elizabeth street, in the Eighth ward, to Mitchell street, in the Eleventh ward. The said track or tracks hereby authorized, shall be constructed, kept and maintained, used and operated in the manner, and upon the terms and conditions which are now provided by the ordinances of the city in reference to other tracks laid by said company; prorided, however, that it shall be the duty of said company to

keep so much of any street as is used and occupied by them in operating any railway hereby authorized, in good repair and condition, so long as it shall be so used and occupied.

Section 2. Said company shall commence the work hereby authorized on Maple street, by the first day of June next, and shall complete the same so that cars shall run regularly thereon to Kinnickinnic avenue by the first day of December, 1875, and said company shall complete the work hereby authorized on Fourth avenue, so as to run cars regularly thereon to Mitchell street, within three years from the passage of this ordinance, and in case of failure so to begin, and so to complete the extension hereby authorized, within the limit of time for each, respectively, the company shall forfeit any right hereby given, as to any part of either line not begun or not completed as herein provided. Provided, however, that if the company shall be delayed in its work by the order or injunction of any court, or by the tearing up of either street or avenue along any part of said extension for the purpose of constructing sewers or laying water pipes, or for any other purpose authorized by said city, the time of the delay so caused shall not be reckoned as a part of the time to which said company is hereby limited.

Section 3. The right of the Milwaukee City Railway Company to operate the various lines of railway heretofore authorized by different ordinances of the city, is hereby extended as to the lines authorized by this ordinance and as to lines heretofore authorized to the full time of fifty years from July 1, 1874, being the same period which is fixed for the Cream City Railroad Company by the ordinance under which that company operates, being an ordinance to authorize the construction and operation of a certain horse railway in the city of Milwaukee, passed June 8, 1874.

Section 4. This ordinance shall take effect and be in force from and after its passage and publication. Passed December 28, 1874

AN ORDINANCE

To authorize the Milwaukee City Railway to change a portion of its track, in the Fifth ward.

The mayor and common council of the city of Milwaukee do ordain as follows:

Elizabeth street.

Section 1. The Milwaukee City Railway Company is hereby authorized to take up and remove its track where it now lies in Florida and Greenbush streets, in the Fifth ward, and to extend its railway by a single or double track along Elizabeth street, from the corner of Reed street to the corner of Greenbush street. The track and tracks hereby authorized shall be constructed, kept, maintained. used and operated in the manner, and upon the terms and conditions, and for the period, which are now provided by the ordinances of the city, in reference to other tracks laid by said company, provided that the track hereby authorized, shall be laid and ready for use by said company within eight months after the passage of the ordinance, and until the expiration of that time, nothing herein contained shall in any way interfere with the right of said company to occupy that part of Florida and Greenbush streets now in use by said company, under the authority of the city.

Section 2. The said railway company is hereby required and directed to repair the streets over which said railroad track shall be removed, as provided by this ordinance and leave them in good order and condition and to the satisfaction of and acceptance of the board of public works.

AN ORDINANCE

To authorize the Milwaukee City Railway Company to extend its track.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. The Milwaukee City Railway Company is hereby authorized to extend its railway, by a single or double track, with all necessary switches and turn-tables, in and along Third street, from the corner of Walnut street to the city limits. The track and tracks hereby authorized shall be constructed, kept and maintained, used and operated in the manner, and upon the terms and conditions which are now provided by the ordinances of the city in reference to other tracks laid by said company; provided, however, that it shall be the duty of said company to keep so much of any street as is used and occupied by

them in operating any railway hereby authorized, in good repair, so long as it shall be so used and occupied; and provided, further, that the cars shall run on the route herein specified until 11 o'clock in the evening of each day in the week.

Section 2. The company shall complete the work hereby authorized on Third street so as to run cars regularly thereon to North street by December first, A. D., 1876, and to the end of the route by July first, A. D., 1877; and in case of failure so to complete the extension hereby authorized within the limit of said time, the company shall forfeit any right hereby given as to any part of said line not completed as herein prescribed; provided, however, that if the company shall be delayed in its work by the order or injunction of any court, or by the tearing up of said streets along any part of said extension for the purpose of constructing sewers or laying water pipes, or for any other authorized by said city, the time of the delay caused shall not be reckoned as a part of the time to which said company is hereby limited.

AN ORDINANCE

To authorize the Milwaukee City Railway Company to extend its track.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. There is hereby given and granted to the Milwaukee City Railway Company, and to its successors and assigns, the right, permission, and authority to lay a double track for a railway with all necessary and convenient tracks for turnouts, side tracks and switches, in and along the following streets, viz: Commencing at the intersection of Railroad and Reed streets, with the right to connect with the railway already owned and operated by said company on Reed street, thence west on Railroad street to its intersection with Muskego avenue, thence southwesterly on said Muskego avenue to Forest Home cemetery. That portion of said road from the intersection of Railroad and Reed streets to the intersection of Railroad street and Fourth avenue, to be completed by September 1, 1878, and the remainder of said road from the

Muskego avenue.

Seventh, Germania,

Teutonia streets.

intersection of Railroad street and Fourth avenue to the terminus thereof at Forest Home cemetery, to be completed by September 1, 1880.

Section 2. It shall be the duty of said company, upon laying the track and tracks herein authorized, to immediately macadamize to the satisfaction of the board of public works, the roadway between the rails, and in case of a double track, also the roadway between the tracks, and to keep the same macadamized and in good order and repair at all times. In all other respects the track and tracks hereby authorized shall be constructed, kept, maintained, used and operated in the manner and upon the terms and conditions which are not provided by the ordinances of the city in reference to other tracks laid by said company, and all the provisions of the ordinances of the city in relation to the construction of the railway of said company, and the forfeiture of any right and privilege given thereby shall be applicable to the extension of said road herein authorized.

Section 3. This ordinance shall take effect and be in force from and after its passage and publication.

AN ORDINANCE

To authorize the Milwaukee City Railway Company to extend its track.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. The Milwaukee City Railway Company is Eighth, Center and hereby authorized to extend its track by a single or double track, with all necessary switches and turn-tables, from the intersection of Walnut and Seventh streets, north on Seventh street to its intersection with Germania street, thence northwesterly on Germania street to the intersection with Eighth street, thence north on Eighth street to its intersection with Center street, thence north on Center street to its intersection with Teutonia street, thence north on Teutonia street to the city limits.

Section 2. The Milwaukee City Railway Company is also hereby authorized to extend its track, as above, from the present terminus of said track on Walnut street, west on Walnut street to its intersection with Twentieth street.
