109—AN ORDINANCE To authorize the construction and operation of a street
railway in the city of Milwaukee.
The mayor and common council of the city of Milwaukee do ordain as follows:
Section 1. There is hereby given and granted to the General franchise Milwaukee & Waukesha Electric Railway Company, a granted corporation, created and existing under the laws of the state of Wisconsin, and to its successors and assigns, tho right, permission and authority to lay a double track for a street railway, with all necessary and convenient tracks, connections, switches, turn tables and appurtenances in and along the course of the streets and bridges in the city of Milwaukee hereinafter mentioned, and the same to use and occupy in a manner and upon the conditions hereinafter provided, including the rights subject to the provisions hereof, to at all times make all necessary excavations, ditches and trenches, and to make all necessary sewer connections, and the right, permission and authority hereby and herein granted shall expire, cease and determine on the first day of July, A. D. 1924.
Section 2. Commencing at the western limits of the Wells city of Milwaukee on Wells street, thence east on Wells West Water street street to West Water street, and the said Milwaukee & Waukesha Electric Railway Company, its successors and assigns, are hereby authorized to use the tracks of the Milwaukee Electric Railway & Light Company in the operation of its road on Wells street from West Water street to the westerly approach of Wells street bridge, and Wells street bridge. across said Wells street bridge to Oneida street, and on Oneida street,
East Water street. Oneida street to East Water street, upon paying or securing to be paid to the said Milwaukee Electric Railway & Light Company a just and adequate compensation for the use of said tracks and roadbed, to be agreed upon between Joint use of road. the said two companies; and in case of their failure to bed —compensa
tion-arbitration. agree upon the same within sixty days after written application by said Milwaukee & Waukesha Electric Railway Company for the privilege of running its cars over said piece of track--a copy of which application shall be filed with the city clerk at the time when made—then such compensation shall be determined by arbitration. The city of Milwaukee by its mayor shall appoint one person as arbitrator, and the said Milwaukee & Waukesha
Electric Railway Company another, and the Milwaukee Electric Railway & Light Company a third, and the three persons thus chosen shall fix and determine the compensation to be paid to said Milwaukee Electric Railway & Light Company, either in gross or in installments pursu
ant to the ordinance in that behalf provided. East

be permitted to lay any additional track or tracks, or construct any additional overhead electric trolley or feed wires on Wells street and State street, from the western city limits to Eleventh street, but shall use the rails and construction already existing, or which shall hereafter exist during the term of this grant on said streets; and unless legal and satisfactory arrangements shall be made with any person or corporation owning or having the right to operate any street railway on said Wells street and State street, within the limits hereinbefore set forth,
