authority to lay and maintain in and through all such streets and alleys of the city of Milwaukee, such under ground conduits, with all the necessary manholes, poles and house-connections, and to do all things necessary to accomplish such purpose.

Section 2. The streets, alleys and squares referred to in section I (in addition to the streets, alleys and squares in which the said company has heretofore passed its under ground conduits in accordance with an ordinance passed March 25, 1889), are as follows:

Ist. From the central office, 424 Broadway, through the alley lying between Broadway and Milwaukee streets, north to Biddle street; on Biddle street east to Astor street; on Astor street, north to Knapp street; on Knapp street, east to Franklin street; on Franklin street, north to Farwell avenue; thence on Farwell avenue to Albion street.

2d. From Mason street, through the alley between. Broadway and East Water street, north to Biddle street; west on Biddle street to the alley between Market and East Water streets; north through said alley to Johnson street, and under the river to the center of Third and Prairie streets.

3d. From the river, opposite Mason street, to West Water street; thence northerly, via West Water and Third streets, to Walnut street.

4th. On Chestnut street, from Third street to a point about half way between Fifth and Sixth streets.

5th. From Second street, in the alley between Wells street and Grand avenue, west to Eighth street, north on Eighth to Wells street; thence west on Wells street to Thirty-fifth street.

6th. From the river, in the alley between Clybourn and Fowler streets, west to Fifth street, north on Fifth to Clybourn street, and west on Clybourn to Sixth street.

Section 3. The said Wisconsin Telephone Company, Wires to be reis successors and assigns, are hereby ordered and directed to remove its wires now running upon the streets and alleys hereinafter mentioned in this section, and substitute therefor aerial cables, and for such purpose are hereby authorized and directed to string such cables in said streets, upon its poles, as follows:

From Johnson street to Ogden avenue, via East Water and North Water streets.

On Sixth street, from Clybourn southerly, across the Menominee river, over such streets and ways as the chief engineer of the fire department may determine.

Section 4. On such other streets, alleys and public places not mentioned in the preceding sections, over which the lines of said company now run, or may hereafter be extended, the said Wisconsin Telephone Company, its successors and assigns, are hereby ordered, directed and authorized to replace its present telephone poles and wires by other and better construction and equipment, whenever the public interests shall require.

Section 5. In every under ground conduit hereby authorized to be constructed by said company, sufficient and necessary space shall be reserved free of cost, charge or expense, for the use thereof, to the city of Milwaukee, and for the use of the fire and police departments of said city, and for the telephone wires belonging to said city, and upon every pole heretofore or hereafter to be erected by said Wisconsin Telephone Company, there shall be a sufficient space reserved at the top of said poles for the wires and fixtures of the fire and police departments of said city, free of cost, charge or expense to said city of Milwaukee.

Section 6. All work performed under this ordinance in any of the public streets, alleys or public places of said city, shall be upon notice to the board of public works, and under its immediate supervision and control, and the said streets, alleys and public places shall be restored, as nearly as practicable, to the condition in which they were before said work was commenced, and to the satisfaction of the said board of public works. And whenever, in constructing or laying any conduits, electric conductors, or making excavations therefor, or in making any connection contemplated in this ordinance, or in making any repairs to said conduits, from time to time, it becomes Streets, etc., to be necessary to interfere with or disturb any street, alley, pavement, sidewalk or public place, the same shall be replaced and restored as hereinbefore provided, at the cost and expense of said company, its successors or assigns, under the supervision and direction of the board.

Section 7. The work necessary to carry out the provisions of this ordinance shall be commenced within sixty days after its passage and publication, and completed by the 31st day of December, 1893.

Section 8. All provisions of an ordinance passed March 25, 1889, entitled, "An ordinance to authorize the Wisconsin Telephone Company to lay and maintain under ground cables and wires, and for other purposes," so far as they conflict with the provisions of this ordinance, are hereby modified and repealed.

XXVII.-WESTERN UNION TELEGRAPH CO.

3-AN ORDINANCE

To authorize the Western Union Telegraph Company to maintain lines of aerial cables over, across and along certain alleys and streets in the city of Milwaukee.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. The Western Union Telegraph Company, its successors and assigns, is hereby authorized and empowered to erect and maintain all necessary telegraph poles, and to construct, maintain and use thereon lines of aerial cables over, across and along the following alleys and streets, to-wit:

In the alley between East Water and Broadway, from Michigan street south to Detroit street; thence on and along Detroit street westward to the river, over and across intersecting streets.

In the same alley from the south side of Michigan street northward to Martin street, thence westward to East Water street, over and across intersecting streets and alleys.

On Fowler street, from the river westward to West Water street, thence south to the Menominee river.

On South Water street, from the Chicago, Milwaukee & St. Paul right-of-way westward to Reed street, thence south on Reed street to Oregon street, thence east on Oregon street in Barclay street, over and across intersecting streets and alleys.

Section 2. The poles authorized to be erected by the first section of this ordinance shall be of the usual size of telegraph poles and shall be placed on the outer edge of the sidewalk and no two poles shall be erected within eighty (80) feet of each other, and shall not interfere with any lamp post or other posts now authorized to be maintained on or along the street or sidewalk.

Section 3. In consideration whereof, the Western Union Telegraph Company agrees to issue, so long as this ordinance remains in force, to such officers of the city of Milwaukee as may be designated by the mayor thereof, annual franks authorizing the free transmission over any of the lines of the telegraph company in the United States of messages relating strictly to the corporate business of the city of Milwaukee, to an amount not exceeding four hundred ($400) dollars per annum. The tolls on all such messages shall be calculated at the regular commercial day rates of the telegraph company between the points at which such messages originate and the points to which they may be destined, and the said city of Milwaukee agrees to pay to the telegraph one-half of the aforesaid tolls on all such messages in excess of four hundred ($400) dollars. Accounts shall be rendered and settlements made yearly.

Section 4. Within thirty days from the passage of this ordinance the said Western Union Telegraph Company shall commence the construction of the lines, poles and cables herein authorized by section 1 of this ordinance, and said work shall be completed within ninety days thereafter.

Section 5. Within thirty days from the completion of the work of construction of the lines, poles and cables hereby authorized, the said Western Union Telegraph Company shall remove from the streets and places hereinafter named all of its poles and wires now located

therein, that is to say, along East Water street from the river northward to Michigan street; on Broadway from the river northward to Mason street; on Jefferson street from the river northward to Michigan street; on Huron from Beach street to Broadway; on Michigan street from Broadway to East Water street; on Menominee street from Jackson street to Broadway; on Erie street from Broadway to East Water street; on South Water street from Florida street to Ferry street; on Oregon street from South Water street to Barclay street; on Mason street from Broadway to East Water street; on City Hall Square from Mason street to Oneida street; on Market street from Oneida to Biddle street; on Biddle street from Market street to East Water street; on East Water street from Biddle street to Martin street; on West Water street from Fowler street to State street; on Third street from State street to Poplar street.

Section 6. Nothing herein contained shall in any manner affect the right which the city may now have to compel said company, its successors or assigns, to remove entirely from the streets, alleys and public grounds of said city its wires, poles, cables or other appliances.

33-AN ORDINANCE

To amend an ordinance entitled "An ordinance to authorize the Western Union Telegraph Company to maintain lines of aerial cables over, across and along certain alleys and streets in the city of Milwaukee.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. Section 1 of the ordinance named in the title hereof is hereby amended by striking out the third paragraph of the same and by inserting in lieu thereof the following: "In the same alley from the south side of Michigan street northward to Martin street; thence westerly along Martin street to the alley running north and south between East Water street and Market street; thence northerly through the alleys running through
