AN ORDINANCE
To amend an ordinance granting certain rights to the

Milwaukee Light and Power Company, passed April
II, 1890.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. The ordinance named in the title hereof is hereby amended by adding after the paragraph entitled: "West Side," the following: Except on the following streets and alleys, viz.: From the power-house of said company across Commerce street and the right of way of the Chicago, Milwaukee & St. Paul Railway Company, to the alley running north and south in block 21; thence north along said alley in block 21 to Galena street, thence

west on Galena street to the intersection of the west line of Fourth street, upon which said streets said company may stretch its conductors on poles, said conductors to be properly insulated, and said poles to be of the first quality, not to be more than 150 feet apart.

217-AN ORDINANCE

To amend an ordinance granting certain rights to the

Milwaukee Light and Power Company, passed April II, 1890.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. The ordinance named in the title hereof is. amended by adding after the paragraph entitled “West Side,” the following: "Except in the alley running north and south from Reservoir avenue to State street between Third and Fourth streets and the alley between Chestnut and Prairie streets, running from Third street to Fourth street, and in the alley running from Walnut street to Reservoir avenue, between Second and Third streets; and also to cross all streets intersecting with said alleys; provided, the common council of the city of Milwaukee reserves the right to order said wires to be laid under ground at any time.

119-AN ORDINANCE

Granting certain rights to the Milwaukee Power and

Lighting Company, its successors and assigns.

Whereas, On April 11, 1890, the mayor and common council of the city of Milwaukee, duly passed, enacted, and approved a certain ordinance entitled:

“An ordinance granting certain rights to the Milwaukee Light and Power Company," whereby certain rights, particularly defined in said ordinance, were granted to the said Milwaukee Light and Power Company, its successors and assigns; and

Whereas, By certain other ordinances passed, adopted and approved by the mayor and common council of said. city since that time certain other rights have been likewise granted to said Milwaukee Light and Power Company, its successors and assigns, and

Whereas, The said Milwaukee Light and Power Company has sold, assigned, transferred and conveyed to the Milwaukee Power and Lighting Company all the rights granted to said Milwaukee Light and Power Company by said several ordinances; now, therefore,

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. The Milwaukee Power and Lighting Com- Right to construct pany, of Milwaukee, a corporation organized under and lines of wire, etc. by virtue of the laws of Wisconsin, its successors and assigns, is hereby authorized to maintain all lines of wires and other electric conductors for the transmission of electricity for the purpose of furnishing light, heat, power and signals heretofore constructed or maintained by the said Milwaukee Light and Power Company, or by the Milwaukee Power and Lighting Company, in the streets, alleys, tunnels and public grounds of said city, and also to construct and maintain in the streets, alleys, tunnels and public grounds of said city other and further lines of wires or other electric conductors to be used for the transmission of electricity for the same uses and purposes. Such electricity to be generated and supplied by the Western Electric Company system of arc lighting, or such other system as the common council may approve, for the purpose of furnishing light, heat, power and signals.

Section 2: The lines in the districts hereinafter named, Streets on which except loops to lamps wherever they pass in any part of wires shall be any street or alley, in the direction of such street or alley,

underground. shall be under ground.

When they cross any alley they shall be under ground unless permission be given by the board of public works to have them strung overhead. Wherever such lines are carried over private buildings of any sort, they shall be supported at least nine feet clear from the roofs of such buildings, and wherever carried over other private property, they shall be constructed in such manner as shall be satisfactory to the board of public works and chief of fire department.

They shall in all cases be properly insulated and loops to buildings shall be supplied with switches at least one

to every half block, arranged so that firemen can cut off the current in case of fire.

Whenever said company shall desire to extend its lines in any of said districts, over or along any street or alley of said city, it shall prepare a plan showing the mode of extension proposed, and submit the same to the chief of the fire department and board of public works, who shall, if they approve the same, endorse their approval thereon, and the same shall be filed with the city clerk.

If they do not approve such plan, they shall make such modifications thereof as they deem proper and approve the same as modified, and the same as modified shall be filed with the city clerk, and such extension shall be made agreeably to the plan so approved, and shall be constructed under the supervision of the board of public works, or such other officer or department of the city government as may hereafter be designated by ordinance or by law to perform the said duty, or the duties of said board of public works.

EAST SIDE.

East Water street, North Water street to Milwaukee street, Michigan street, Wisconsin street, Broadway, Erie street, Juneau avenue, all entire; Milwaukee street entire, and the district bounded east by Milwaukee street from river northwardly to river; then following river southwardly to place of beginning; all the streets and alleys in the Third ward.

WEST SIDE.

Grand avenue entire; State street from the river tu Twentieth street; Chestnut street from the river to Twentieth street; Winnebago street from Chestnut to Vliet; Vliet street from Winnebago to Twentieth; Galena street from Third to Twentieth; Walnut street from Thiri to Twentieth ; West Water street entire; Second street entire; Third street entire; Twelfth street entire, and the district bounded by Fourth street from Fowler street north to Reservoir avenue, thence east to the river, then following the river south to Fowler street, thence west to place of beginning; also the district bounded as follows: The Milwaukee river on the east, Twelfth street (inclusive) on the west, Fowler street on the south, and by Cedar street on the north, except in and over the following streets and alleys, to-wit: From the power-house over right of way of the Chicago, Milwaukee & St. Paul Railway Company, to alley, running north and south in block twenty-one (21), thence north in said alley to Galena street, thence west on Galena street to Fourth street).

And also, (excepting north and south alley between Third and Fourth streets from Reservoir avenue to State street; alley between Chestnut and Prairie streets from Third to Fourth streets, alley between Second and Third streets from Walnut to Reservoir avenue, and to cross all streets intersecting said alley).

SOUTH SIDE.

Clinton street to National avenue; Reed street entire; Grove street to Greenfield avenue; National avenue entire; Florida street entire; Lake street entire; and the district bounded by Hanover street from Menominee river to Florida street, thence east to Milwaukee river, thence following said river to the place of beginning.

The said company is hereby prohibited from placing poles in any block in any street of the south division for the sole purpose of illuminating a parallel street by looping from one street to the other, otherwise to have the privileges heretofore granted.

The city of Milwaukee shall at all times have the right and privilege to use the poles of said company for the purpose of stretching and maintaining thereon a line or lines of wire for the use of the fire department, the police department, or any other department of the city government without any compensation therefor.

Section 3. Whenever it may be found necessary in Pavements to be making any of the connections contemplated in this ordinance or in repairing the same to interfere or disturb any street, alley, pavement or sidewalk, the same shall be
