State street.

Expiration of privilege.

Section 1. There is hereby given and granted to the West Side Street Railway Company, its successors and assigns, the right, permission and authority to extend a double track on State street from the intersection of Twelfth street to the intersection of Twenty-seventh street, with all necessary and convenient turn-outs, side-tracks, connections, switches and turn-tables for and during a term commencing with the passage and publication of this ordinance, and ending on June 1, 1924.

Section 2. The West Side Street Railway Company, its successors and assigns, shall commence work as contemplated herein in good faith, within thirty days after the passage and publication of this ordinance, and shall complete the line herein provided for and operate cars regularly thereon to Twentieth street within four months thereafter, and the rest by July 1, 1889. A failure to so commence, complete and operate the said line within the prescribed time shall work a forfeiture of all rights herein granted.

Conditions.

Keeping street in repair.

Section 3. The West Side Street Railway Company, its successors and assigns, shall keep in good repair that part of the street lying between its two outside rails, and in making such repairs said company shall use the same material as may be used on adjoining parts of the same street at the time at which such repairs shall be made, or such other material as may be approved by the Board of Public Works, and the necessity of such repairs shall be determined by the Board of Public Works, and such repairs shall be made within twenty-four (24) hours after the notice to do such work has been given by the Board of Public Works. The said railroad company failing to do such work within the prescribed time of twenty-four (24) hours, then the said Board of Public Works is hereby authorized and directed to cause the repairs to be made at the expense of said railway company,

Right to use of roadbed may be granted to others.

Section 4. The city of Milwaukee reserves the right to grant to any other person or persons, corporation or corporations, the right to use said tracks and roadbed, provided, however, that no such right to use such tracks and roadbeds shall be granted upon the said street to any person or corporation for a greater distance than three consecutive blocks in length, provided that before using the same, or any portion thereof, or such portion of said track or roadbed upon or over which the city of Milwaukee shall have granted a franchise to any other person or corporation, such person or corporation shall pay or cause to be paid to said West Side Street Railway Company a just and adequate compensation for the use Compensation for of said tracks and roadbeds, to be agreed upon between use of track, how them; and in case of their failure to agree upon such

determined. compensation within sixty days after written application by such person or corporation to the West Side Street Railway Company for the privilege of running cars over the last named company's tracks, a copy of which application shall be filed with the city clerk of the city of Milwaukee at the time when made, then such compensation shall be determined by arbitration, and the city of Milwaukee, by its mayor, shall name and appoint one person, and the West Side Street Railway Company shall name and appoint another person, and the said person or corporation to which said franchise shall have been granted shall name and appoint a third person, and the three persons appointed shall fix and determine the compensation, either in gross or payable in installments, as may in their opinion be just and proper, for the use of said tracks and roadbeds, due reference being always in fixing the same to the amount and character of the use to be made thereof, and in case of the failure of either of said persons or corporations to appoint a suitable person within said time, the mayor of the city of Milwaukee shall appoint a suitable person to act for and on behalf of the person or corporation failing to so nominate and appoint an arbitrator, and the compensation as fixed and determined for the use of said tracks and roadbeds by such arbitrators, or a majority of them shall be final and conclusive. The award of the arbitrators shall describe the character and amount of the use to be made as well as the compensation therefor, and shall be filed with the city clerk and be preserved by him in his office. Such compensation shall be subject to revision from time to time on similar application made by either party, if the character or extent of such joint use of the roadbed becomes materially changed or affected, and in such case it may be revised either by agreement or arbitration, as hereinbefore provided. Provided, always, that the West Side Street Railway Company has a prior right on its tracks everywhere to use its system of power, and no joint use thereof shall ever be enforced with any other person

or corporation that shall force said company to change its power or system, or to make it impossible to use the same in a practicable manner.

Section 5. The city of Milwaukee reserves the right to regulate the speed at which cars shall be run and the time and frequency of running same on tracks hereby authorized to be laid, as public safety and convenience may require.

AN ORDINANCE

To amend an ordinance entitled "an ordinance to author

ize the construction and operation of a certain horse railway in the Tenth Ward of the city of Milwaukee,” passed March 17, 1884.

The

mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. That an ordinance entitled “An ordinance to authorize the construction and operation of a certain horse railway in the Tenth ward of the city of Milwaukee," passed March 17, 1884, is hereby amended by adding after the words West Side Street Railway Company "in the second line of section 1 of the said ordinance the following words, "and to its successors and assigns."

AN ORDINANCE

To repeal an ordinance passed Sept. 29, 1879, entitled

"An ordinance to authorize the construction and operation of a certain horse railway in the Second, Fourth and Ninth wards (now in the Sixteenth, Fifteenth and Ninth wards) of the city of Milwaukee.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. The ordinance mentioned in the title hereof, passed Sept. 29, 1879, is hereby repealed and all franchises and privileges granted thereunder are hereby annulled and revoked.

AN ORDINANCE

To authorize the West Side Railroad Company to extend

its tracks.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. There is hereby given and granted to the Washington aveWest Side Railroad Company, its successors and assigns, the right, permission and authority to lay a single or double track for an electric railway in and along the center of Washington avenue, and the same to keep, maintain and use and to operate railway cars and carriages thereon to be propelled by electric power until July 1, 1924, commencing at the intersection of Chestnut street with Washington avenue with the right to connect with its line of railway on Washington avenue, thence northerly on and along Washington avenue to North street.

Section 2. The construction of said tracks shall be commenced within thirty days after the passage and publication of this ordinance and shall be completed within ninety days thereafter. Upon the failure to complete and operate the same as above provided, then all rights hereby granted shall cease and determine.

Section 3. It shall be the duty of said company at all Repair of street. times to keep in good repair the roadway between the rails and for one foot on the outside of each rail as laid on the above described route, and to submit to such reasonable rules and regulations as the common council may from time to time prescribe.

AN ORDINANCE Granting to the West Side Railroad Company the right Twelfth street.

to extend its tracks to Twelfth street.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. There is hereby given and granted to the West Side Railroad Company, its successors and assigns, the right, permission and authority to extend its tracks on Twelfth street, commencing at the intersection of

Center street with Twelfth street, thence northerly on and along Twelfth street to Burleigh street, and to keep, operate and maintain said road subject to the conditions contained in the ordinance heretofore passed, under which the tracks on Twelfth street are now built and operated.

Section 2. Said tracks shall be built and put in operation on or before the first day of June, 1891.

Burleigh street

AN ORDINANCE
To authorize the West Side Railroad Company to extend

its tracks.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. There is hereby given and granted to the West Side Railroad Company, of the city of Milwaukee, its successors and assigns, the right, privilege and authority to extend its tracks, commencing at the intersection of Burleigh street with Twelfth street, thence westerly on Burleigh street to its intersection with Teutonia street, and to operate cars thereon, subject to the same conditions and provisions as are contained in the ordinance granting said company the right to operate its cars on Twelfth street.

Section 2. Said road shall be completed and put in operation on or before the first day of August, 1891.

To amend an ordinance entitled "An ordinance to author

ize the West Side Railroad Company to extend its tracks," passed June 30, 1890.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. Section 2 of said ordinance is hereby amended by striking out all the words and figures after the word "completed," where it occurs in said section, and inserting in lieu thereof the following words and figures,
