intersection of Twelfth and Sherman streets, in the Tenth ward of the city of Milwaukee, thence easterly along said Sherman street to the east side of Ninth street, with the right to connet with its line of railway, and also to lay and construct all necessary switches, turn-outs and turntables, and the common council to make such reasonable directions from time to time as to the manner of running the cars.

Section 2. It is expressly provided that the said company shall keep the street between the tracks and for a distance of one foot outside of each rail in good condition so that there may be no obstruction to the travel to other vehicles on said street.

Section 3. This ordinance shall take effect and be in force from and after its passage and publication. Passed March 17, 1884.

AN ORDINANCE

Granting certain rights to the West Side Street Railway
Company.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. There is hereby given and granted to the West Side Street Railway Company, its successors and assigns, the exclusive right, permission and authority to lay a single or double track street railway with the same shape and style of rail now used on the other lines of said company and with all necessary and convenient tracks for turn-outs, side-tracks, switches and turn-tables in and along the course of the street of the city of Milwaukee, hereinafter mentioned, and the same to keep, maintain, and use and to operate thereon street railway cars and carriages of the same general design and construction as those now used on the other lines of said company, to be drawn or propelled by animal power only for and during the full period of fifty years from the first day of July, 1874, commencing at the intersection of Grand avenue and Fifth street in the Fourth ward; thence northerly on and along the course of Fifth street to a point 200 feet north of the north line of Cedar street, in the Second ward; said

tracks to be laid as near the center of said street as practical.

Section 2. Said railway company shall at all times. keep in good repair the roadway between the rails of said track and all of the roadway lying between said double tracks and a space of one foot in width along the outside rails of said single or double tracks, and submit to such reasonable rules and regulations as to operating said road as the common council may, from time to time require, and to such other regulations as are prescribed in other ordinances passed heretofore, granting rights of way to said company. Said road shall be built and put in operation on or before the first day of May, 1885, otherwise all right hereby granted shall be forfeited.

Section 3. This ordinance shall take effect and be in force from and after its passage and publication. Passed January 19, 1885.

AN ORDINANCE

To authorize the West Side Street Railway Company to extend its track.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. There is hereby given and granted, subject to the limitation and conditions hereinafter contained, to the West Side Street Railway Company, of Milwaukee, its successors and assigns, the exclusive right, permission and authority to lay a single or double track for a street railway in and along Washington avenue, commencing at the intersection of Wells street with Washington avenue, thence northerly on Washington avenue to Chestnut street, and the same to keep, maintain and use for and during the same length of time and under and subject to the same conditions as are provided in other ordinances heretofore passed, granting rights of way to said company in the city of Milwaukee. All of the authority, rights and privileges granted to the said railway company, under this ordinance, shall cease and determine, on the first day of July, A. D. 1924, unless sooner determined according to law. This ordinance, and the rights, powers

and privileges granted to said railway company thereunder is granted by the city of Milwaukee and accepted by the said West Side Railway Company upon the express condition hereby reserved to said city, that it may subject only to the conditions hereinafter set forth, grant to the Milwaukee City Railway Company the right to operate during the continuance of the right and privileges granted under this ordinance in common with the said West Side Street Railway Company, railway cars and carriages upon so much of the track hereinbefore mentioned as shall be laid upon Washington avenue, between Chestnut street and Vliet street; subject to the conditions that before using said portion of said track, the said Milwaukee City Railway Company shall pay to the said West Side Street Railway Company, its successors or assigns, just and adequate compensation for the use of the same, as aforesaid, and which compensation shall be agreed upon between said companies. In case of their failure to agree thereon, the said companies shall each forthwith name and appoint a suitable person to act for them respectively, and the mayor of the city of Milwaukee shall then name and appoint a suitable person to act in the same matter on behalf of the city, and the compensation for the use of the said portion of said track as fixed and determined by the three persons so appointed, or a majority of them, shall be final and conclusive upon all of said parties.

Section 2. Said company shall complete and put in operation said railway on or before the commencement of the Wisconsin State Fair to be held in September, 1886.

Section 3. This ordinance shall take effect and be in force from and after its passage and publication. Passed August 2, 1886.

To authorize the West Side Street Railway Company to extend its track.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. There is hereby given and granted to the West Side Street Railway Company, and its assigns, the exclusive right and privilege and authority to lay, con

struct, maintain and regularly operate cars thereon, a single or double street railway track on the following named streets in the Fourth ward of the city of Milwaukee, according to the conditions and provisions contained in ordinances heretofore passed, granting the right to lay its tracks on Grand avenue and other streets in the city of Milwaukee, for and during the period of years, ending the first day of July, 1924, and no longer.

Section 2. Commencing at the intersection of Wells street and Washington avenue; thence southerly on and along Washington avenue to Clybourn street; thence westerly on Clybourn street to Western avenue. Also commencing at the intersection of Grand avenue and Eleventh street; thence southerly on Eleventh street to Clybourn street; thence westerly on Clybourn street to Twentieth street; thence westerly on Clybourn street to be produced to Washington avenue.

Section 3. Three-fourths of a mile of said track to be completed within sixty days after the passage and publication of this ordinance, and the balance within one year thereafter, except on that part of Clybourn street to be produced between Twentieth street and Washington avenue, which is to be completed within one year after the street is made and put in condition so as to make it practical to operate a street railway thereon.

Section 4. This ordinance and all the rights, privileges and authorities granted to said railway company thereunder, is granted by the city of Milwaukee and accepted by the said West Side Street Railway Company upon the express conditions hereby reserved to said city, that it may, subject only to the conditions hereafter set forth, grant to any person, persons or corporation the right to operate during the continuance of the rights and privileges granted under this ordinance in common with the said West Side street Railway Company, railway cars and carriages upon and over the track laid by virtue hereof on Washington avenue between Wells street and Clybourn, subject to the condition that before using said. portion of said track, such person, persons or corporations shall pay to the West Side Street Railway Company, its successors and assigns, just and adequate compensation for the use of the same as aforesaid, and which compensation shall be agreed upon between them; in case of their

failure to agree thereon, the West Side Street Railway Company and the person, persons and corporation making application for the franchise over said portion of said track and the mayor of the city of Milwaukee shall each name and appoint a suitable person to act for them respectively in said matter and the compensation for the use of said portion of said track as fixed and determined by the three persons so appointed, or a majority of them shall be final and conclusive upon all of said parties.

Section 4a. The tracks of said railway shall be of the gauge of not more or less than four feet eight and one-halt inches, and shall not be elevated above the surface of the street; shall be laid with modern improved rails, and shall be so laid that carriages and other vehicles can easily and freely cross said streets at any and all points, and in any and all directions, without obstruction, and shall be laid as near the center of said streets and as near together as practicable. The said grantees, their successors and assigns, shall keep all of any street in this ordinance named and used and occupied by them in operating said railway lying between two lines extended parallel with the outside rails of said tracks, and one foot therefrom toward the curb line, in good repair and condition, and of the same material of which said street is composed at the time when any such repairs shall become necessary and are made, during the term hereby granted, in accordance with whatever order or regulations may be passed or adopted in that behalf by the common council of said city or the board of public works thereof, and shall indemnify and save harmless the said city of Milwaukee from any and all loss or damage which it may incur or become liable to pay by reason of the malfeasance or nonfeasance of said grantees, their successors or assigns, in respect to the duties and conditions conferred by this ordinance.

Section 5. This ordinance shall take effect and be in force on and after its passage and pbulication.
