Nineteenth street.

Completion of road.

Animal power to be used, street to be repaired.

AN ORDINANCE

To authorize the construction and operation of a certain horse railway in the Second, Fourth and Ninth wards of the city of Milwaukee.

The mayor and common council of the city of Milwau kee do ordain as follows:

Section 1. There is hereby given and granted to the West Side Railway Company the right, permission and authority to lay a single or double track for a horse railway in and along the center of Nineteenth street, in the Second, Fourth and Ninth wards of the city of Milwaukee, and the same to keep, maintain and use, and operate thereon railway cars and carriages for and during the full term of fifty years from the first day of July, A. D. 1879, and no longer, to-wit: Commencing at the intersection of Wells and Nineteenth streets, in the Fourth ward; thence running northerly along said Nineteenth street to the center of Clark street, in said Ninth ward of said city of Milwaukee, with the right to connect with its line of railway on Wells street, and also to lay and construct suitable turn-outs and turn-tables.

Section 2. The work on the line of street railway hereby authorized to be constructed and operated shall be commenced within thirty days from the passage and publication of this ordinance, and shall be completed and operated up to the center of Walnut street within six months of said date, and upon the failure to complete and operate the said railway as above provided, then all rights hereby granted and vested shall cease and determine; provided, however, that a failure to construct and operate any part of the railway mentioned in the preceding section, shall not work a forfeiture of the rights hereby granted so far as affects that part of the route actually completed, and also, provided, that if said completion and operation of said line of railway or any part thereof is delayed by any order or injunction of any court of record, then the time of such delay shall be excluded from the computation of time herein prescribed.

Section 3. The cars to be used upon said horse railway shall be operated with animal power only, and it shall be the duty of said company to keep the track within the rails and for at least one foot along the outside thereof at all

times in good repair, and to construct, maintain, keep, use and operate said line of street railway in the manner and upon conditions as provided by the general ordinances now in force or which may hereafter be enacted by the common council of the city of Milwaukee.

Section 4. This ordinance shall take effect and be in force from and after its passage and publication.

AN ORDINANCE

To amend an ordinance entitled “an ordinance to authorize the construction and operation of a certain horse railway in the Second, Fourth and Ninth wards of the city of Milwaukee," approved October 4, 1879.

Whereas, In the ordinance passed by the common council of the city of Milwaukee entitled "an ordinance to authorize the construction and operation of a certain horse railway in the Second, Fourth and Ninth wards of the city of Milwaukee," approved October 4, 1879, it is provided that the work on the line of street railway thereby authorized to be constructed and operated shall be commenced within thirty days from the passage and publication of said ordinance and shall be completed and operated up to the center of Walnut street within six months from said date, and

Whereas, It has become apparent that owing to the unexpected recent demands upon iron manufactories for railroad rails they are unable at this time to furnish them upon short notice, and also, to the proximity of the winter season the work on said line cannot be completed within the time fixed in said ordinance and that the commencement of such work without the possibility of completing the line at once would deprive the public of the full use of the street without yielding to them the benefit and accommodation of said street railway.

Therefore, The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. That section 2 of said ordinance is hereby Time extended. amended by striking out the words "thirty days" and

"six months" wherever they occur, and by substituting

and inserting in lieu thereof, the words "six months" for the words "thirty days," and the words "twelve months" for the words "six months."

Section 2. This ordinance shall take effect and be in force from and after its passage and publication.

Twelfth street.

AN ORDINANCE

To authorize the construction and operation of a horse railway on Twelfth street.

The mayor and common council of the ctiy of Milwaukee do ordain as follows:

Section 1. There is hereby given and granted to the West Side Street Railway Company, a corporation duly incorporated and organized under and by virtue of the laws of the state of Wisconsin, its successors and assigns, the exclusive right, permission and authority to lay a single or double track for a horse railway in and along the center of Twelfth street, and the same to keep, maintain and use and to operate thereon railway cars and carriages to be propelled by animal power, for and during the full term of fifty years from the first day of October, 1880. Commencing at the intersection of Beaubian street with Twelfth street, in the Tenth ward, with the right to connect with its line of railway on Twelfth street; thence northerly along the center of Twelfth street to its intersection with Center street.

Section 2. The tracks of said horse railway shall be of the gauge of not more or less than four feet eight and one-half inches, and shall not be elevated above the surface of the street; shall be laid with modern improved rails, and in such manner that carriages and other vehicles can easily and freely cross said street at any and all points and in any and all directions without obstructions, and shall be laid as near the center of said street as possible, and as near together as practicable.

Section 3. The construction of said railway shall be commenced and completed within two years from and after the passage and publication of this ordinance. Upon the failure to complete and operate the same as above pro

vided, then all rights hereby granted shall cease and determine; provided, however, that if the construction and completion of said railway, or any part thereof, is delayed by an order or injunction of any court, judge or court commissioner, then the time of such delay shall be excluded from the computation of the time herein prescribed.

Section 4. It shall be the duty of said railway company at all times to keep in good repair the roadway between the rails, and for one foot on the outside of each rail as laid on the above described route, and to submit to all such reasonable rules and regulations as the common council may from time to time prescribe, and the roadway between the rails and one foot outside shall be paved with wooden blocks or macadamized.

Section 5. This ordinance shall take effect and be in force from and after its passage and publication.

AN ORDINANCE

To amend an ordinance entitled "An ordinance to authorize the construction and operation of a horse railway on Twelfth street," passed November 22, 1880.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. That section three (3) of said ordinance be Time extended. amended by striking out the words, namely, "within two years," in the second line of said section, and substituting in place thereof the words, namely, "within four years.”

Section 2. That section three (3) of said ordinance be further amended by adding at the end of said section the following language, to-wit: Provided, also, that the failure to complete and operate the entire road hereby granted, within the time named, shall not work a forfeiture of the rights hereby granted, so far as affects that portion of the route actually completed and in operation.

Section 3. Before any cars shall be operated on said road, a license fee of ten dollars ($10.00) for each car shall be annually paid to said city of Milwaukee by the West Side Street Railway Company, its successors or assigns, in the manner provided in other ordinances granting rights of way to said company.

Section 4. This ordinance shall take effect and be in force from and after its passage and publication.

Grand avenue.

AN ORDINANCE

To amend an ordinance entitled "An ordinance to amend an ordinance entitled "An ordinance to authorize the construction and operation of a certain horse railway in the city of Milwaukee, passed June 29, 1874."

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. Section one of an ordinance entitled "An ordinance to amend an ordinance entitled 'an ordinance to authorize the construction and operation of a certain. horse railway in the city of Milwaukee, passed June 29, 1874,' is hereby amended by adding at the end of said. section: Except on Grand avenue, between Eighth and Eleventh streets, in the Fourth ward of the city of Milwaukee, where a single track shall be laid on each side of the public park, the center of which to be at least at a distance of five feet from the curb of said park.

Section 2. This ordinance shall take effect and be in force from and after tis passage and publication.

Sherman street.

AN ORDINANCE

To authorize the construction and operation of a certain horse railway in the Tenth ward of the city of Milwaukee.

The mayor and common council of the city of Milwaukee do ordain as follows:

Section 1. There is hereby given and granted to the West Side Street Railway Company, the right, permission and authority to lay a single or double track for a horse. railway in and along the center of Sherman street, in the Tenth ward of the city of Milwaukee, and the same to keep, maintain, use, and operate thereon railway cars and carriages for and during the full term of fifty years, from July 1, 1884, and no longer, to-wit: Commencing at the
