AN ACT to amend an act entitled "An act in relation to the appointment of two stenographers and an interpreter to the marine court of the city of New York," passed April twentyfifth, eighteen hundred and sixty-seven.

SECTION 1. AN ACT in relation to sewerage in the city of
Oswego.

The People of the State of New York, represented in
Senate and Assembly, do enact as follows:

SECTION 1. The common council of the city of Oswego are hereby authorized and empowered to cause and procure to be made, surveys, maps, plans and profiles, with a view to the making and establishing of a general and permanent system of sewerage for said city. And the said council may cause the expense of making such surveys, maps, plans and profiles to be assessed and levied upon the taxable property in said city at the same time with the general city tax, and in addition to any sum which said council are now authorized by law to raise. § 2. This act shall take effect immediately.

Chap. 676.

AN ACT to amend section six of chapter seventy of the laws of eighteen hundred and forty-five, as amended by section four, chapter two hundred and fifty-nine, of the laws of eighteen hundred and fifty-one, relating to Clinton prison.

Passed May 7, 1869; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section four of chapter two hundred and fifty-nine of the laws of eighteen hundred and fifty-one is hereby amended so as to read as follows:

§ 4. The sixth section of the act entitled "An act to amend an 'An act in relation to State prisons, passed May first, eighteen hundred and forty-four,' passed April sixteen, eighteen hundred and forty-five," is hereby amended so as to read as follows:

Chap. 677.

AN ACT in relation to the reconstruction of a dam on the Seneca river, at Baldwinsville, for canal purposes.

Passed May 7, 1869; three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The Canal Board are hereby authorized and directed, whenever, in their judgment, it shall become necessary to rebuild the dam at Baldwinsville, on the Seneca river, which is necessary to the navigation of the Baldwinsville canal, to rebuild such dam of stone and in such manner as shall, in the judgment of the Canal Board, render such structure permanent, and at all times reliable for the purposes of navigation on said canal; the expenses of such work to be paid out of any moneys appropriated, or to be appropriated, for ordinary or extraordinary repairs on the middle division of the canals of this State.

§ 2. This act shall take effect immediately.

AN ACT in relation to evidence in criminal prosecutions, and in all proceedings in the nature of criminal proceedings.

Passed May 7, 1869. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. In the trial of all indictments, complaints and other proceedings against persons charged with the commission of crimes or offenses, and in all proceedings in the nature of criminal proceedings in any and all courts, and before any and all officers and persons acting judicially, the person so charged shall, at his own request, but not otherwise, be deemed a competent witness; but the neglect or refusal of any such person to testify shall not create any presumption against him. § 2. This act shall take effect immediately.

AN ACT to authorize the draining of certain lands in the town of Murray, in the county of Orleans, caused to overflow by the Erie canal.

Passed May 7, 1869; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The Canal Commissioners are hereby authorized to construct and maintain, at the expense of the State, a ditch for the purpose of draining the waters from the lands of Thomas McGuire, in the town of Murray, in the county of Orleans, which are caused to Cost there be overflowed by the Erie canal, provided the same shall not exceed fifteen hundred dollars in cost of construction.

§ 2. The Treasurer shall pay, on the warrant of the Auditor, such sums as shall be necessary to defray the expenses of constructing and maintaining such ditch, out of any moneys appropriated, or to be appropriated, for the repairs of canals.

§ 3. This act shall take effect immediately.

Chap. 680.

AN ACT to amend the charter of the village of
Little Falls.

Passed May 7, 1869; three-fifths being present.
The People of the State of New York, represented in
Senate and Assembly, do enact as follows:

SECTION 1. The act incorporating the village of Little Falls, passed April sixteen, eighteen hundred and fifty, and the several acts amendatory thereof, are hereby amended as follows:

§ 2. Subdivision nine of section twelve of said act is amended so as to read as follows:

9. For maintaining and keeping in repair, in good order for use, an engine house for each fire engine and apparatus. its apparatus, and for a fire-hook and ladder company

§ 7. Section forty-eight of said act is hereby amer so as to read as follows:

§ 48. Upon the completion of the highway assessin the trustees shall cause a copy thereof, with their warran for the collection thereof in money, at the rate of ou dollar for each day's labor assessed, to be delivered to the collector of the village, who shall proceed to collect the same and to pay over the moneys collected to the treasurer of the village.

§ 8. This act shall take effect immediately.

Chap. 681.

AN ACT respecting the extension of the charters of certain insurance companies.

Passed May 7, 1869.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. The charters as amended of the Commercial Mutual Insurance Company, of the Atlantic Mutual Insurance Company, and of the New York Mutual Insurance Company (each of which companies was heretofore established in the city of New York), having been during the existence of such charters respectively extended, such extensions shall commence in each case at the expiration of the term of such existing charter, and shall continue for the period mentioned in the fifteenth section of the act entitled "An act to provide for the incorporation of insurance companies," passed April tenth, eighteen hundred and forty-nine, and no longer unless authorized by law or permitted by the Legislature of this State.

§ 2. This act shall take effect immediately.
