Duke of Brunswick Wolfenbuttel, or of fuch other Perfon or Perfons as fhall by the faid Duke be duly authorized and appointed to receive fuch Annuity or any Part thereof, fhall be a good and fufficient Difcharge for the Payment thereof; and the faid Debentures to be made forth and paffed upon the faid Warrant shall be a fufficient Authority to the feveral and refpective Officers of the Receipt of the Exchequer now and for the time being, for the Payment of fuch Annuity to the faid Duke during the Continuance of the fame, without any further or other Warrant to be fued for, had or obtained in that Behalf; and that the faid Annuity fo to be given and granted fhall be free and clear from all Taxes, Rates and Affeffments, and all other Charges whatfoever.

An Act to extend the Provifions of an Act paffed in the Forty eighth Year of His prefent Majefty's Reign, intituled, An Act to permit certain Goods imported into Ireland to be warehoused or fecured without the Duties due on the Importation thereof being first paid, and to amend the fame. [2d June 1810.] WHEREAS it is expedient to amend certain Provifions con- 48 G. 3. c. 32.

tained in an Act made in the Forty eighth Year of His $7. prefent Majefty's Reign, intituled, An Ad to permit certain Goods • imported into Ireland, to be warehoufed or fecured without the Duties due on the Importation thereof being first paid: And whereas it is, among other Things, enacted by the said Act, that no Goods, Wares or Merchandize which shall have been lodged in any Warehouse or Warehouses, or otherwife fecured according to the • Directions of the faid A&t, fhall be delivered from or taken out of any fuch Warehoufe or Place except for Exportation, or to be ufed or confumed in Ireland: And whereas it may be expedient ' in certain Cases to permit Goods, Wares and Merchandize to be taken from the Port or Place where they were firft warehoused or fecured, for the Purpose of being transferred or conveyed to fome other Port or Place in Ireland, there to be warehoused or fecured under the Provifions of the faid recited A&t:' Be it therefore enacted by the King's Mott Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled and by the Authority of the fame, That from and after the paffing of this Act, it fhall and Removing may be lawful for any Perfon who fhall have imported any Goods, ways fecured in Wares or Merchandize into Ireland, and who fhall have lodged the Warehouse under fame in Warehouse, or otherwife fecured the fame, at any Port in recited Act. Ireland, under the Provifions of the faid recited Act, or of any A& for altering or amending the fame, to remove fuch Goods, Wares and Merchandize, or any Part thereof, out of fuch Warehouse or Place, for the Purpofe of fending and transferring the fame Coaftways, to be warehoufed or fecured without Payment of Duty in any other Port in Ireland, in which fuch Goods are allowed to be warehoufed or fecured by the Provifions of the faid recited Act, under the Regulations and Provifions hereinafter mentioned, directed and contained; any thing in the said recited A&t to the contrary notwithstanding.

II. Provided always, and be it enacted, That whenever any fuch Goods, Wares or Merchandize fhall be entered to be shipped at any Port in Ireland for the Purpofe of being fent and transferred as aforefaid to any other Port in Ireland, there to be warehoufed or fecured, the Master or other Person who fhall have the Charge of the Ship or Veffel on board which any fuch Goods, Wares or Merchandize fhall be laden in any Port of Ireland, to be landed and difcharged in fome other Port thereof, fhall, before the Ship or Veffel be permitted to depart from the Port or Place where he shall take in his Lading, take out a Coat Cocket, Certificate, Letpafs or Tranfire, as the cafe may require; and the firft Importer, Proprietor or Confignee of fuch Goods, Wares and Merchandize fhall enter into a Bond with Two fufficient Sureties to His Majefty, his Heirs and Succeffors, in a Sum equal to the Value of the actual Quantity of fuch Goods, Wares or Merchandize fo laden or taken on board fuch Ship or Veffel, conditioned for the Delivery or Difcharge thereof, in the Port or Place for which the fame fhall be entered as aforefaid, and alfo conditioned to return a Certificate within Two Calendar Months after the Date of fuch Cocket, Certificate, Letpafs or Tranfire, under the Hand and Seal of the proper Officer of the Port where fuch Goods, Wares or Merchandize fhall be landed and warehoused or fecured, to the Collector or other Chief Officer of the Port in which fuch Goods, Wares or Merchandize fhall have been put on board, that fuch Goods, Wares and Merchandize were landed and warehoused or fecured at the Port for which the fame fhall have been entered, and that Bond was duly given upon the warehousing of fuch Goods at fuch Port in manner hereinafter directed; and in cafe any fuch Malter or other Perfon fhall omit or neglect to take out fuch Cocket, Certificate, Letpafs or Tranfire, fuch Mafter or other Perfon fo neglecting or omitting fhall, for every fuch Offence, forfeit the Sum of One hundred Pounds.

III. Provided alfo, and be it further enacted, That every Importer, Proprietor or Confignee of any Goods Wares or Merchandize which may be carried or transferred from one Port in Ireland, and which Goods, or to pay may be landed under this Act at any other Port in Ireland, and Duty. warehoused or fecured there without Payment of Duty at the time of the Entry thereof at fuch Port to which the fame may have been transferred, fhall enter into Bond to His Majefty, his Heirs and Succeffors, in Double the Amount of the full Duties due and payable on the Importation of fuch Goods, Wares and Merchandize with Condition that fuch Goods, Wares and Merchandize shall be duly exported, or that the full Duties due and payable on fuch Goods, Wares and Merchandize, fhall be duly paid within the Space of Twelve Months from the Date of the First Entry of fuch Goods Wares or Merchandize, at the Port where such Goods, Wares or Merchandize were firft entered and warehoused or fecured, or within the time required by Law from the firft Entry as aforefaid, as to fuch Goods as may be warehoused in Ireland under any Act or A&ts other than the faid recited A&t of the Forty eighth Year aforefaid; and the faid Bond fhall be fo entered into within Forty eight Hours after the Port Surveyor and Landwaiter or other proper Officer fhall have ascertained the Quantity and Quality of the Goods, Wares and Merchandize fo to be bonded; and in cafe the Importer, Proprietor or Confignee of such Goods, Wares and Merchandize

to be computed from the Day of the first Entry thereof, at the Port

IV. And be it further enacted, That upon Production of a Certi- In what Cafe ficate under the Hand and Seal of the proper Officer of the Port to firft Bond vawhich any fuch Goods, Wares or Merchandize fhall have been trans- cated. ferred, and there landed and warehoused or fecured in manner directed by this Act, that fuch Goods, Wares and Merchandize, were duly landed and fecured there, and that Bond was entered into accordingly, purfuant to the Directions of this Act (which Certificate fuch Officer is hereby required and authorized to grant without Fee or Reward) it fhall be lawful for the proper Officer at the Port in which fuch Goods, Wares or Merchandize thall have been firft warehoused, to vacate the Bond given at fuch Port on the firft landing and warehoufing or fecuring of fuch Goods, Wares and Merchandize, by Indorsement thereon, fo far as relates to the actual Quantity of fuch Goods, Wares and Merchandize, which fhall have been carried and transferred from the said Port, and which by any fuch Certificate shall appear to have arrived at any fuch other Port in Ireland, and to have been there warehoused under the Directions and Provifions in this A&t contained.

V. And be it further enacted, That from and after the paffing of Unrefined Sugar this Act, it shall and may be lawful for any original Importer, Pro- of conquered or prietor or Confignee, of any White, or Clayed, or Brown, or Muf- ceded Place, Focovado Sugar, not refined, of the Growth or Produce of any reign or Bay Salt Country, Illand or Place conquered by or ceded to, or which shall hereafter be conquered by or ceded to His Majefty's Arms; or of any Foreign or Bay Salt, to warehouse and secure all fuch Sugar and Salt, under the Regulations and Provifions for warehousing contained in the said recited A&t of the Forty eighth Year, without the Duties due on the Importation of fuch Sugar and Salt being firft paid; and to export and deliver for Exportation fuch Sugar and Salt without Payment of Duty, according to the Provifions of the faid recited Act, any thing in any Act or Acts in force in Ireland to the contrary notwithtanding; and all fuch Sugar and fuch Salt fhall be deemed and taken to be warehoused under the Provifions of the faid Act, and to be entitled to all the Benefits of the faid Act, as fully to all Intents and Purposes as if fuch Sugar and fuch Salt had been fpecially named and included in Schedule (A) to the faid A&t annexed.

VI. by virtue of any Act or Acts in force in Ireland, and that all Salt on which fuch Drawback fhall be claimed fhall be exported fubject to the Regulations and Provifions contained in the faid recited Act of the Forty eighth Year aforefaid, or in any other A&t or Acts in force in Ireland, relating to the Exportation of Salt from Ireland.

VI. And be it further enacted, That this Act may be altered, amended or repealed, by any Act or Acts to be paffed in this Seffion of Parliament.

CA P. XXXIX.

An Act for repaying, in certain Cafes, the Duty paid on the
Export of Foreign Plain Linen.
[2d June 1810.]
HEREAS it is expedient that in certain Cafes the Duties
paid on Foreign Plain Linen by virtue of an Act paffed in
the prefent Seffion of Parliament, intituled, An Ad for granting a
Duty on Foreign Plain Linen taken out of Warehouse and exported
to Foreign Parts, fhould be repaid;' Be it therefore enacted by the
King's Moft Excellent Majefly, by and with the Advice and Confent
of the Lords Spiritual and Temporal, and Commous, in this present
Parliament affembled, and by the Authority of the fame, That in
all Cafes where any Duty has been or fhall be paid, or any Bond has
been or shall be entered into for Payment of any Duty impofed by
the faid Act, upon any Foreign Plain Linen that was fecured in
Warehouses, as therein defcribed, on or before the Eighteenth Day
of April One thousand eight hundred and ten, and which Linen has
been or fhall be delivered from any fuch Warehouse for the Purpose
of being exported to Foreign Parts, on or before the Fifteenth Day
of September One thousand eight hundred and ten, it fhall and may
be lawful for the Commiffioners of His Majefty's Customs in England
and Scotland refpectively, and they are hereby authorized and re-
quired, upon due Proof thereof, to caufe Repayment to be made
of fuch Duty so paid, and to caufe fuch Bonds fo entered into to
be cancelled; any thing in the said A&t to the contrary notwith-
ftanding.

An Act for discontinuing the Bounty on Exportation of Oil of Vitriol, and allowing a Drawback of a Proportion of the Duties paid on the Importation of Foreign Brimstone used in making Oil of Vitriol. [2d June 1810.] WHEREAS it is expedient that the Bounty now payable on the Exportation of Oil of Vitriol made in Great Britain 'fhould be discontinued, and that a Proportion of the Duties now payable and paid upon the Importation of Foreign Brimftone into Great Britain should be drawn back upon Brimftone used and confumed in making Oil of Vitriol, and repaid to the Manufacturers of fuch Oil made under certain Regulations and Reftrictions;' Be it therefore enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the 46 G. 3. c. 99. paffing of this Act, an Act paffed in the Forty fixth Year of the

Reign of His present Majefty, intituled, An Ad for allowing a repealed.
Bounty on the Exportation of Oil of Vitriol made in Great Britain,
fhall be repealed.

II. And be it further enacted, That from and after the paffing of this A&t, Nine Tenth Parts of the Duties of Cuftoms paid on the Importation into Great Britain, of Brimftone, fhall be allowed in refpect of fuch Brimftone ufed and confumed in making and preparing Oil of Vitriol, and the Amount of fuch Drawback fhall be paid and allowed to the Manufacturer of fuch Oil in Great Britain, under the following Regulations; (that is to fay, every Manufacturer of Oil of Vitriol intending to claim any fuch Drawback or Repayment under this Act fhall make an Entry of his Name and Place of Abode with the Collector of the Cultoms of the Port within or nearest to which his Work fhall be carried on,' and shall Once in every Month enter in a Book to be kept for that Purpose an Account of the whole Quantity of Foreign Brimftone ufed and confumed in his Manufactory within the preceding Month, and at the End of the Year to be computed from the Date of fuch Entry as aforefaid, shall deliver the faid Account to the Collector of the Cuftoms with whom he fhall have made fuch Entry as aforefaid.

III. And be it further enacted, That every fuch Manufacturer fhall make Oath to the Truth of the Account fo delivered to the Collector of the Customs under this A&t, in which Oath he shall depofe that full Nine Tenths of fuch Brimstone has been confumed in the manufacturing of Oil of Vitriol, and that the Refiduum does not contain a Quantity of Brimftone worth Extraction, and that such Quantity does not at the utmost exceed One Tenth of the whole Brimftone ufed in fuch Manufacture; and he fhall also specify in fuch Account the Name or Names of the Importer or Importers of fuch Brimstone, and the Times when the Duties due thereon were refpectively paid to His Majefty; and if upon a Certificate being produced from the proper Officers of the Cuftoms in Great Britain where fuch Brimstone was fo imported, it fhall appear that the full Duties were paid thereon, and if fufficient Proof be alfo made before the proper Officers of the Customs, that the Brimftone mentioned and referred to in fuch Certificate is the identical Brimftone fo ftated to have been used and confumed by the Manufacturer of fuch Oil of Vitriol, then, and in every fuch Cafe, a Debenture fhall be iffued for the Amount of the Drawback by this Act allowed upon fuch Brimftone; and the fame fhall be paid by the Collector of the Customs who fhall have received fuch Account as aforefaid, out of any Money remaining in his Hands on account of the Duties of Cuftoms.

IV. And be it further enacted, That if any Manufacturer of Oil Delivering falle of Vitriol fhall deliver any falfe Account of the Quantity of Foreign Brimftone ufed and confumed in making and preparing Oil of Vitriol with an Intent to defraud His Majefty, his Heirs or Succeffors, every fuch Manufacturer fhall, on being convicted of any fuch first Offence, forfeit the Sum of Two hundred Pounds, and for every Second or further Offence the Sum of Four hundred Pounds, to be fued for within Three Months after the Delivery of the Account, and recovered in any of the Courts of Record at Weftminfter, or in the Court of Exchequer at Edinburgh, and One Moiety of fuch Penalty fhall go and be applied to the Ufe of His Majesty, his Heirs and Succeffors, and the other Moiety to him or them who fhall fue or profecute for the fame.
