making fuch Claim, or in obtaining any fuch Abatement, or fhall
fraudulently or untruly declare the Amount or Value of fuch Loffes,
or the Amount or Value of any Abatement made or agreed to be
made in the Rent of the Lands in his or her Occupation, on account
of fach Loffes, with Intent fraudulently to obtain any fuch Abate-
ment, he, fhe or they fo offending fhall forfeit the Sum of Fifty Penalty.
Pounds, and Treble the Amount of Duty charged on fuch Perfon
or Perfons in refpect of the faid Lands; and if any Owner or
Owners of any fuch Lands whereon fuch Loffes have been fuftained,
or any other Perfon or Perfons whatever, fhall aid, abet or affift any
Perfon or Perfons charged to the said Duties, in making fuch falfe
or fraudulent Claim, or fhall fraudulently or untruly declare the Aiding.
Amount or Value of any Abatement made or agreed to be made in
the Rent of the faid Lands or Amount of fuch Loffes, with intent
fraudulently to obtain for himself, herself or themselves, or for his,
her or their Tenant or Tenants, or for the Owner or Owners, or
Tenant or Tenants of the faid Lands, any fuch Abatement as afore-
faid, every fuch Owner or Owners, or other Perfon or Perfons
aforefaid, thall forfeit the Sum of One hundred Pounds; which feveral Penalty.
Penalties fhall be recovered and applied as any Penalties may be re-
covered and applied by the faid A&.

VII. And be it further enacted, That the Profits arifing from Eaft India Dock the Docks called the East India Docks, fituate in the County of Company how Middlefex, fhall be affeffed by the Commiffioners acting for the City affelled. of London, under the faid Act for granting Duties arifing from the Profits of Property, Profeffions, Trades and Offices, fo long as the general Accounts of the faid Docks fhall be made up within the Taid City.

An A&t to regulate the Examination and Payment of Affign ments for Clothing of His Majefty's Forces.

WHEREAS an Act paffed in the Forty fifth Year of the 45 G. 3. c. 58. Reign of His prefent Majelty, intituled, An Act to repeal an A made in the Twenty third Year of His prefent Majefly, for the • better Regulation of the Office of Paymaster General of His Majefly's Forces, and the more regular Payment of the Army; and for the more effectually regulating the faid Office: And whereas it is expedient that the faid A&t fhould be amended as to examining and Payment of Affignments for the Clothing of His Majefty's Forces:' May it' therefore please Your Majefly that it may be enacted; and be it' enaced by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons," in this prefent Parliament affembled, and by the Authority of the fame, That from and after the Twenty fifth Day of December One Affignments from thoufand eight hundred and nine, all Affignments from Colonels or Colonels, &c. for other Officers commanding Regiments, Corps, Troops or Companies Clothing of Regiin His Majefty's Regular and Fencible Forces, for the Clothing of ments, &c. tranffuch Regiments, Corps, Troops and Companies for any Period com- mitted to Secremencing from the Twenty fifth Day of December One thoufand tary at War. eight hundred and nine, or commencing from any fubfequent Period, fhall be tranfmitted to and lodged with the Secretary at War, to be

examined and checked with the proper Establishments of the feveral Regiments, Corps, Troops and Companies, for which fuch Affiguments fhall have been given, and the Amounts of Money to be iffued for the Payment of fuch Affignments fhall be ascertained by the Officer of the Secretary at War, in fuch manner, and under fuch Regulations as fhall be from time to time made by the Secretary at War in that behalf; and all Monies to be iffued in respect of such Affignments fhall be included and specified in Warrants to be made out for that Purpofe; and all Payments to be made by the Paymaster General of His Majefty's Forces, in refpect of any fuch Affignments, fhall be made and iffued upon fuch Warrants only and not otherwife; and fuch Warrant fhall be a fufficient Discharge to the Paymafter General for fuch Iffue and Payment, any thing in the faid recited Act or any other A&t or Acts, or Law or Laws to the contrary notwithstanding.

JI. And be it further enacted, That it fhall be lawful for the Commiffioners of His Majefty's Treafury, and they are hereby authorized or empowered by any Warrant or Order under the Hands of any Three or more of them, to permit and allow any Military Clothing, Accoutrements or Appointments for His Majefty's Forces to be exported and fent to any of His Majefty's Forces ferving Abroad, whether in His Majetty's Dominions or otherwife, free of any Duty of Customs or Excife, or other Duty whatsoever, under fuch Reftrictions and Regulations as fhall be specified in any fuch Warrant or Order, or in any general Warrant or Order, made in that behalf, and tranfmitted to the Commiffioners of His Majefty's Customs for the Regulation of the Export of any fuch Clothing, Accoutrements or Appointments, any Act or Acts of Parliament or Law or Laws to the contrary notwithstanding.

An Act to amend and enlarge the Powers of an Act, paffed in the Second Year of His prefent Majefty, for the Encouragement of the Fisheries of this Kingdom, and the Protection of the Perfons employed therein.

[20th June 1810.]

WHEREAS by an A&t made in the Second Year of the

Reign of His prefent Majefty, intituled, An Ad for the better fupplying the Cities of London and Westminster with Fife, and to reduce the prefent exorbitant Price thereof, and to protect and encourage Fishermen, certain Perfons therein defcribed, being the Mafters of Fishing Ships, Smacks, Veffels or Boats employed in the Fishery on any of the Sea Coasts of Great Britain, or in any of the navigable Rivers within Great Britain, and Apprentices, • Mariners and Landmen employed in fuch Veffels, to a limited Number, according to the Tonnage of fuch Veffels, were protected from being impreffed into the Naval Service of His Majesty, his Heirs and Succeffors; and the Lord High Admiral of Great Britain, or the Commiffioners for executing the Office of Lord High Admiral of Great Britain for the time being, or any Three or more of them, were thereby empowered to grant fuch Protections: And whereas it hath been found fince the paffing of the said Act that ⚫ various Sorts of Fish retire in the Winter Seafon into deeper Water, ⚫ and

⚫ and it has therefore become neceffary, for the Supply of the Me-
tropolis and other Parts of the Kingdom with fuch Fish at all
Seasons of the Year, to build and use much larger Claffes of Fishing
Veffels, which cannot with Safety or Profit be navigated without
a greater Number of Men and Boys than are allowed to be exempt
• from being impreffed under the faid Act: And whereas the en-
couraging the taking of Apprentices on fuch Voyages is highly
⚫ beneficial, in establishing a Nursery for Seamen for His Majefty's
Navy; and it is therefore expedient that the Provifions of the faid
Aft, as to exempting Perfons employed in the Veffels therein de-
feribed, fhould be amended, and fhould, as to all Fishing Veffels,
⚫ be extended to Fishing in the deep Seas beyond the Coafts, and to
a greater Number of Apprentices:' May it therefore please Your
Majefty that it may be enacted; and be it enacted by the King's
Moft Excellent Majefty, by and with the Advice and Confent of the
Lords Spiritual and Temporal, and Commons, in this prefent Par-
liament affembled, and by the Authority of the fame, That from repealed.
and after the paffing of this Act, fo much of the faid recited Act as
relates to the exempting the Perfons employed in Veflels in the
Fisheries from being impreffed fhall be and the fame is hereby repealed;
fave and except as to any Protections from being impreffed to which
any Perfon may be entitled under the faid Act, which fhall remain
in full force for their full Period as if the faid A&t had remained in
full force.

Mafters and Apprentices and

II. And be it alfo enacted, That from and after the paffing of this Act, every Perfon hereinafter specified who fhall be employed in the Mariners and Fisheries of thefe Kingdoms, fhall be freed and exempted from being Landmen, emimpreffed into the Service of His Majefty, his Heirs or Succeffors, ployed in Fifhing other than and except in the Cafes hereinafter excepted, that is to Veffels limited in fay, Firft, every Master who fhall have the Care or Conduct of any Number accordFishing Veffel or Boat which fhall be employed in the Fisheries of ing to Tonnage, this Kingdom, and who or fome Owner of which Fishing Veffel or protected from Boat fhall have or within Six Calendar Months before the applying being impreffed. for any Protection as hereinafter is allowed, fhall have had One or more Apprentice or Apprentices under the Age of Sixteen Years, each bound to him or to any fuch Owner as aforefaid, for a Term not less than Five Years, and which Apprentice or Apprentices in pursuance of fuch binding actually shall be or have been in the Service of fuch Mafter or Owner in the Business of a Fisherman: Secondly, every fuch Apprentice, not exceeding the Number of Eight Apprentices to every Mafter or Owner as aforefaid of any Fishing Veffel of the Burthen of Fifty Tons and upwards, and not exceeding Seven Apprentices to every Master or Owner as aforefaid of every Fishing Veffel of the Burthen of Thirty five Tons and upwards, and under Fifty Tons, and not exceeding Six Apprentices to every fuch Mafter or Owner as aforefaid of any Fishing Veffel of or above the Burthen of Thirty Tons and under Thirty five Tons, and not exceeding the Number of Four Apprentices to every such Mafter or Owner as aforefaid of any Fishing Veffel or Boat under the faid Burthen of Thirty Tons, during the time every fuch refpective Apprentice as aforefaid fhall continue as an Apprentice in the actual Service of fuch his Mafter only, or of his Reprefentatives or Affigns, in the Bufinefs of a Fisherman, and in no other Service, and until the refpective Age of Twenty Years of every fuch Apprentice who fhall fo long continue

in the Fishing Trade: Thirdly, One Mariner for every fuch Veffel or Boat of Ten Tons Burthen and upwards, befides the Mafter and his Apprentice or Apprentices as aforefaid, who fhall be employed to navigate or fifh in any Fishing Veffel or Boat of the Burthen of Ten Tous or upwards during the time fuch Mariner fhall continue and be fo actually and truly employed in the faid Fishing Service and, Fourthly, any Landmen above the Age of Eighteen Years and under Thirty Years, who fhall enter on board any fuch Fishing Veffel or Boat of the Burthen of Ten Tons or upwards, and be actually employed in navigating or fifhing therein, for and during the Space of Two Years, to be computed from the time of his firft going to Sea, employed as aforefaid in any fuch Fishing Veffel or Boat of the Burthen of Ten Tons or upwards as aforefaid, and to the End of any Fhing Voyage he may then be engaged in, and if he shall continue and be fo long really and truly employed in fuch Service.

III. And be it further enacted, That on an Affidavit fworn be fiore fome Juftice or Juftices of the Peace, that the Perfon or Perfons named and described in fuch Affidavit is or are within fome or one of the Descriptions hereinbefore specified, and inferting therein the Tonnagte of every fuch Fishing Veffel or Boat, and the Port or Place to which the belongs, and the Name and Defcription of everyfuch Mafter, and the Age of every fuch Apprentice, and the Term for which every fuch Apprentice fhall be bound and the Date of his Indenture, and the Name, Age and Defcription of every fuch Mariner and Landman refpectively, and the Time of every fuch Landman's first going to Sea, being offered to the Lord High Admiral of Great Britain, or to the Commiffioners for executing the Office of Lord High Admiral of Great Britain for the time being, or any Three or more of them, or left at the Office of Admiralty, the faid Lord High Admiral or Commiffioners of the Admiralty for the time being is and are hereby directed and required, with all convenient Speed after every such Affidavit fhall be tendered to him or them or left at the Admiralty Office (unless he or they fhall have reasonable Caufe to fufpect the Truth of any fuch Affidavit, and in every fuch Cafe he and they is and are hereby directed to caufe Enquiry to be made into the Truth of the Matters contained in every fuch Affidavit) from time to time to grant a feparate Protection to every fuch Perfon as aforesaid refpectively during the time he is allowed by this Act to be protected, and without any Fee or Reward to be paid or taken for the fame; and every Person who fhall be impreffed contrary to the Intent of this A& fhall, on producing the Protection which fhall have been granted to him in pursuance of this At, to the Commanding Officer who fhall have in his Custody or under his Care any fuch impreffed Perfon as aforefaid, be forthwith discharged and released by such Commanding Officer.

IV. And be it further enacted, That if during the Continuance of any Protection which fhall be granted under this Act, any Perfon who fhall be thereby protected fhall be impreffed to ferve His Majefty, his Heirs or Succeffors (other than and except in the Cafe of an actual Inva fion of thefe Kingdoms, or imminent Danger thereof) and fignified by fome Order of His Majelty, or his Heirs, or of his or their Privy Council, to the Lord High Admiral, or to the Commiffioners for executing the Office of Lord High Admiral of Great Britain for tlae time being, and on producing the Protection which

fhall have been fo granted to him to the Commanding Officer of the Party or Gang who fhall imprefs any fuch Perfon protected as aforefaid, or if offering to produce the fame for the Infpection of fuch the Commanding Officer, any fuch Commanding Officer fhall refuse or neglect to see or examine fuch Protection, or fhall detain the fame Protection from the Party entitled thereto, and shall not forthwith difcharge the Party who fhall be fo impreffed; or if the Party fo im. preffed fhall be carried on board any Ship or Veffel of or in the Service of His Majefty, his Heirs or Succeffors, and the Captain or any Officer who fhall have the Command on board any fuch Ship or Veffel of or in the Service of His Majefty, his Heirs or Succefiers, fhall not on any fuch Protection granted as aforefaid being produced or tendered to him, or if fuch Protection fhall have been taken away from the Party to whom it was fo granted, at or after his having been fo impreffed, then if on an Affidavit being made before fome Juftice or Justices of the Peace that fuch Protection was fo granted and continues in Force and was taken away from the Party to whom the fame was fo granted, either at or after the time he was impreffed, and being tendered to the Captain or Officer who fhall have the Command on board any fuch Ship or Veffel as aforefaid, fuch Captain or Captain, &c. Officer having the Command as aforefaid fhall not forthwith discharge not discharging. the Party who fhall have been fo impressed and brought on shipboard as aforefaid, or if any Captain or Officer having Command as aforefaid, or any of the Crew or Company under him, fhall take away or detain any fuch Protection granted as aforefaid, then every Perfon who in any of the faid Cafes fhall fo offend, except in the Cafes hereinbefore excepted, fhall refpectively forfeit and pay to the Party impreffed, if not an Apprentice, and if an Apprentice, then to the refpective Mafter of every fuch Apprentice, the Sum of Twenty Pounds, to be recovered and levied in like manner as other Forfeitures incurred by this A&t are hereinafter directed to be recovered Penalty. and levied.

V. And be it further enacted, That in cafe any Seaman or Mari- Seamen refufing ner after he shall have entered into any Agreement or taken any Ear- to fulfil Agree neft for the Performance of any Fishing Voyage or for any ftipulated ment. time of any Fishing Seafon, fhall neglect or refufe to proceed on the intended Voyage or Voyages for which he fhall have engaged or taken Earneft, every fuch Seaman or Mariner fhall forfeit for every fuch Offence the Sum of Five Pounds, and it fhall and may be lawful, upon Penalty. Complaint made thereof to any of His Majefty's Juftices of the Peace within their refpective Jurifdictions by the Mafter or Owner or Owners, or any other Perfon having Charge or Command of the Veffel or Boat in which fuch Seaman or Mariner engaged to go, for fuch Juftice, and he is hereby required to iffue his Warrant to appre hend fuch Seaman or Mariner, and in cafe fuch Seaman or Mariner fhall not pay fuch Penalty, or give fufficient Reason for fuch Refufal to the Satisfaction of fuch Juftice, then to commit such Seaman or Mariner to the House of Correction, there to be kept to hard Labour for any time not exceeding Thirty Days, nor less than Fourteen Punishment. Days.

VI. And be it further enacted, That if any Mafter or Owner of Hiring or enany Ship, Veffel or Boat fhall hire, entice, harbour, entertain or em. ticing Appren ploy in any fuch Ship, Veffel or Boat, any Apprentice, Seaman or Landman, belonging to any Fishing Vellel or Boat, or who shall have
