An Act for making perpetual certain of the Provifions of an Act of the Fifth Year of King George the First, for preventing the clandeftine running of uncuftomed Goods, and for preventing Frauds relating to the Customs.

HEREAS certain of the Provifions of the Act hercinafter mentioned have by Experience been found useful ' and beneficial, and it is expedient that the fame fhould be made petual;' Be it therefore enacted by the King's most Excellent Majesty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That the feveral Claufes in an Act made in the Fifth Year of the Reign of His Majefty King George the Firt, intituled, An A&t againft clandeftine running of uncuftomed Goods, and for the more effectual preventing of Frauds relating to the Cuftoms, relating to fuch Foreign Goods, Wares and Merchandize as fhall be taken in at Sea out of any Ship or Veffel, in order to be landed or put into any other Ship or Veffel or Boat; and also relating to Goods not reported and found after clearing Ships; and whereby further Remedies are provided againft relauding Goods prohibited to be worn in this Kingdom; and Foreign Goods fhipped out for Parts beyond the Seas; and relating to the opening or altering the Package of Goods on board of Ships outward bound; and alfo relating to hovering Ships or Veffels of the Burthen of Fifty Tons or under; and alfo concerning the Bales or Package in which Coffee fhall be. exported; and alfo relating to Rum imported in Cafks or Veffels Dot containing Twenty Gallons at the leaft; and also relating to

An Act to continue an Act, made in the Forty fourth Year
of His prefent Majefty, for permitting the Exportation of
Salt from the Port of Naffau in the Island of New Provi-
dence, the Port of Exuma and the Port of Crooked Island in
the Bahama Islands, in American Ships coming in Ballast; and
amend and continue an Act made in the Forty eighth Year
of His present Majefty, for permitting Sugar and Coffee to
be exported from His Majefty's Colonies or Plantations, to
any Port in Europe to the Southward of Cape Finisterre, and
Corn to be imported from fuch Port, and from the Coaft of
Africa, into the faid Colonies and Plantations, until the
Twenty fifth Day of March One thoufand eight hundred
and thirteen.

Cape Finifterre, and Corn to be imported from fuch Port, and from the Coaft of Africa, into the faid Colonies and Plantations, fhall be, and the fame is hereby continued until the Twenty fifth Day of March One thoufand eight hundred and thirteen.

Provided always, and be it enacted, That it fhall and may be lawful to export Cocoa, the Growth or Produce of any of His Majefty's Colonies or Plantations in America, from fuch Colonies or Plantations direct, to any Port in Europe to the Southward of Cape Finisterre, in the like Ships and Veffels, and under the fame Rules, Regulations, Conditions and Restrictions, Penalties and Forfeitures, as are prefcribed by the faid A&t of the Forty eighth Year of His prefent Majefty's Reign, with refpect to Sugar and Coffee.

An Act for the Regulation of His Majefty's Royal Marine
Forces while on Shore.
[24th March 1810.]

IV. AND be it further enacted, That it shall and may be lawful to and for the said Lord High Admiral, or Three or more of the Commiffioners for executing the Office of Lord High Admiral, at any Time during the Continuance of this Act, to make and establish Rules and Articles in Writing, under his or their refpective Hand or Hands, for the Punishment of Mutiny and Defertion, Immorality, Mifbehaviour and Neglect of Duty, in any of His Majefty's Royal Marine Forces while on Shore, in any Part of this Kingdom, or in any other of His Majefty's Dominions, and for bringing Offenders againit the fame to Juftice; and to erect and conftitute Courts Martial, with Power to try, hear and determine any Crimes or Offences specified in fuch Rules and Articles, and inflict Punishments, by Sentence or Judgment, for the fame according to the true Intent and Articles of War Meaning of this Act; and all fuch Articles of War shall from time to time, as foon after the fame fhall have been eftablished, as the fame can be done, be tranfmitted by the Secretary of the Admiralty for the time being to the Judges of His Majefty's Courts at Wejiminfer and Dublin, and into Scotland refpectively.

Provifo for Perfons haftily enMing.

LX. Provided neverthelefs, and it is hereby declared, That from and after the Twenty fifth Day of March One thoufand eight hundred and ten, when and as often as any Perfon or Perfons fhall be enlifted as a Marine or Marines in His Majefty's Service, he and they fhall, within Four Days, but not fooner than Twenty four Hours, after fuch Enlifting refpectively, be carried or go with fome Officer, Non-commifioned Officer or Marine belonging to the Recruiting Party by which he shall be enlifted, or with the Perfon employed on the Recruiting Service with whom he shall have enlifted, before fome Juftice of the Peace of any County, Riding, City or Place, or Chief Magiftrate of any City or Town Corporate, reliding or being next to, or in the Vicinity of the Place where fuch Perfon or Perfons fhall have been enlifted, and not being an Officer of Royal Marines, and before fuch Juftice or Chief Magiftrate he or they fhall be at Liberty to declare his or their Diffent to fuch Eulifting; and upon fuch Declaration, and returning the enlifting Money, and alfo each Perfon fo diffenting paying the Sum of Twenty Shillings for the Charges expended or laid out upon him, fuch Perfon or Perfons fo enlifted shall be forthwith discharged and fet at Liberty, in the Pre

fence of fuch Juftice or Chief Magiftrate; but if fuch Perfon or
Perfons fhall refufe or neglect, within the Space of Twenty four
Hours, to return and pay fuch Money as aforefaid, he or they fhall
be deemed and taken to be enlifted, as if he or they had given his or
their Affent thereto before the said Juftice or Chief Magiftrate; and
if fuch Perfon or Perfons fhall declare his or their having voluntarily
enlifted himself or themfelves, then fuch Juftice or Chief Magiftrate
fhall, and he is hereby required forthwith to certify under his Hand,
that fuch Perfon or Perfons is or are duly enlifted; fetting forth the
Place of the Birth, Age and Calling of him or them refpectively,
(if known), and that the Second and Third Sections of the Articles
of War, for the better Government of His Majesty's Royal Marine
Forces while on Shore, were read to him or them, and that he or
they had taken the Oath of Fidelity mentioned in the Twelfth
Section of the faid Articles of War, and alfo the Oath mentioned
in the Schedule to this A&t annexed, marked (A.); and if any fuch
Perfon or Perfons, fo to be certified as duly enlifted, fhall refufe to
take the said Oath of Fidelity before the faid Juftice or Chief Ma-
giftrate, it shall and may be lawful for fuch Officer, from whom he
has received fuch Money as aforefaid, to detain or confine fuch
Perfon or Perfons until he or they fhall take the Oath before requi-
red; and every Officer of Royal Marines that fhall act contrary here-
to, or offend herein, upon Proof thereof, upon Oath made by Two
Witneffes, before a General Court Martial to be thereupon called,
fhall, for fuch Offence, be forthwith cafhiered and difplaced from
fach his Office, and fhall be thereby utterly disabled to have or hold
any Civil or Military Office or Employment within this Kingdom,
or in His Majefty's Service: Provided always, that every Non-com- Provifo.
miflioned Officer or Private Marine who fhall enlift any Recruit, fhall,
at the Time of fuch enlifting, inquire the Chriftian and Surname, and
Place of Abode of fuch Recruit, and either take the fame down in
Writing, or give the fame to the Non-commiffioned Officer command-
ing the Recruiting Party to be fo taken down: Provided also, that
it thall be lawful for any Juftice of the Peace to difcharge any Perfon
who fhall have haftily enlifted, and who fhall apply to him to declare
his Diffent within fuch Four Days as aforefaid, upon Payment of the
Sum of Money required to be paid by any Recruit declaring his Dif
fent under this A&t, notwithstanding no Officer, Non-commiffioned
Officer or Private Marine belonging to the Recruiting Party fhall be
with the Recruit, if it fhall appear to fuch Magiftrate, upon the Ex-
amination of fuch Recruit, or of any other Person, that the Re-
cruiting Party have left the Place where fuch Recruit was enlifted,
or that fuch Recruit could not procure any Non-commiffioned Officer
belonging to fuch Party to go with fuch Recruit before the Juffice
of the Peace; and the Sum paid by fuch Recruit upon his Discharge
fhall be kept by the Justice of the Peace, and paid, when demanded,
to any Perfon belonging to the Recruiting Party, entitled thereto,
demauding the fame.

LXI. And be it further enacted, That if any Perfon or Perfons Perfons receiving fhall receive the enlifting Money from any Officer (knowing it to be Enlitting Money. fuch), and fhall abfcond or refufe to go before fuch Juftice or Chief Magiftrate; or if any Perfon having received any fuch enlifting Money as aforefaid, fhall thereafter abfent himfelf from the Recruiting Party with which he enlifted, or Perfon with whom he enlifted, and fhall
