CA P. LXXI.

An A&t for appropriating Part of the Surplus of the Stamp Duties granted in the Forty eighth Year of His present Majefty, for defraying the Charges of the Loan made and Stock created in the prefent Seffion of Parliament.

[9th June 1810.] HEREAS by an Act of Parliament paffed in the Forty

• An Ad for repealing the Stamp Duties on Deeds, Law Proceedings,
• and other written or printed Inftruments, and the Duties on Legacies
and Succeffions to Perfonal Eftates upon Intefacies now payable in
Great Britain; and for granting new Duties in lieu thereof; it was
• enacted that all the Monies to arife from the Duties granted by the
faid Act, together with the Monies to arife from the Duties granted
by an Act of the Forty fourth Year of His Majefty's Reign, therein
recited and remaining unrepealed; and from the Duties on Li-
cences to deal in Thread Lace, granted by an Act of the Forty.
fixth Year of His Majefty's Reign, and then under the Manage-
ment of the Commiffioners of Stamps, should be paid into the Hands
of the Receiver General of the Duties on Stamped Vellum, Parch-
ment and Paper, who fhould from time to time pay the fame into
the Bank of England for fafe Cuftody, pursuant to the Act in that
cafe made and provided, and fhould thereafter pay the fame (after
deducting the Charges of raifing, collecting and accounting for the
fame, and all other Charges first payable thereout) into the Receipt
of His Majesty's Exchequer at Weminfler, in one Sum, at fuch
times and in fuch manner as the prefent Stamp Duties were by the
Laws in force directed to be paid, and that the Money fo paid
into the faid Receipt fhould be carried to and made Part of the
Confolidated Fund of Great Britain: And it was further enacted,
that from and after the Tenth Day of October One thoufand eight
• hundred and eight, out of the Monies fo to be paid into the Receipt
of the Exchequer as aforefaid, there fhould be fet apart the yearly
Sum of Three millions nine hundred fifty fix thousand seven hundred
ninety Pounds and Ten pence, being the aggregate Amount of the
net yearly Produce of the Duties granted by the faid Act of the
Forty fourth Year, and by another A&t of the Forty fifth Year
of His Majesty's Reign, therein mentioned (except the Duties on
Lottery Licences and Shares of Tickets fince repealed, and except
the Duties on Ale Licences and Game Certificates, which were
intended to be removed from the Management of the Commiffioners
⚫ of Stamps, by certain Acts of the fame Seffion), upon an Average
of Two Years ending the Fifth Day of January One thoufand eight
hundred and eight, and of the net Produce of the Duties on Ap
praisements and Licences to Appraisers, granted by an Act of the
Forty fixth Year of His Majefty's Reign, therein recited, for One
Year ending the fame Fifth Day of January; and that there should
alfo be fet apart at the Exchequer, Quarterly, fuch further Sum as
fhould be equal to the net Produce of the Duties on Licences to

⚫ deal in Thread Lace, of which a separate Account should be kept at the Stamp Office, and be tranfmitted to the Exchequer; and that after fetting apart the faid feveral Sums, the Remainder of the Monies fo to be paid into the Exchequer as aforefaid fhould be deemed an Addition made to the Publick Revenue of Great. Britain, for the Purpose of defraying the increased Annual Charge occafioned by any Loan made or Stock created by virtue of any Act or Acts paffed or to be paffed in the fame Seffion of Parliament: And whereas the net Produce of the Duties paid into the Exchequer pursuant to the Direction of the faid Act of the Forty eighth 48 G. 3. c. 14801 Year of His Majefty's Reign, in the Year ending on the Fifth Day of April One thousand eight hundred and ten, amounted to the Sum of Five millions one hundred eighty eight thousand four hundred twenty fix Pounds Seventeen Shillings and One Penny; and after ⚫ referving and setting apart thereout pursuant to the Directions of the fame Act, the faid Sum of Three Millions nine hundred fifty fix thousand seven hundred ninety Pounds and Ten pence, and the further Sum of One thousand feven hundred twenty nine Pounds Four Shillings and Nine pence, being the net Produce of the Du⚫ties on Licences to deal in Thread Lace; and alfo after referving and fetting apart the Sum of Thirty two thousand Pounds, Part of the yearly Sum of Forty two thoufand Pounds payable by the Governor and Company of the Bank of England as a Compenfation for the Exemption of their Promiffory. Notes and Bills from Stamp Duty, pursuant to an Act of the prefent Seffion of Parliameut, the 48 G. 3. c. 1.19. Remainder or Surplus of the faid Duties amounts to the Sum of § 15. One million one hundred ninety feven thoufand nine hundred and feven Pounds Eleven Shillings and Six pence: And whereas the total yearly Charge on account of Stock created by the Acts of the Forty eighth Year of the Reign of His prefent Majelty was Seven hundred and twenty nine thousand four hundred and forty one Pounds Nineteen Shillings and One Farthing, for which, befides the aforefaid Surplus of the Stamp Duties, Provifion was made by the Appropriation of certain expired Annuities; and by a Saving in the Charge paid for the Management of the Publick Debt, and by an Increase of the Affeffed Taxes, amounting together, accord ing to their actual Produce in the Year ending the Fifth Day of • January One thousand eight hundred and nine, to Six hundred and twenty two thousand fix hundred and fixty three Pounds Ten Shil lings and Seven pence Halfpenny, leaving only the Sum of Que • hundred and fix thousand feven hundred and feventy eight Pounds Eight Shillings and Four pence Three Farthings, to be defrayed by the aforefaid Surplus of the Stamp Duties: And whereas it is expedient that the Excefs of the faid Surplus of the Stamp Duties, • after referving annually One hundred and fifty thousand Pounds, which appears to be an ample Provision in addition to the other Duties appropriated to that Purpose for defraying the yearly Charge on account of the Stock created in the Year One thousand eight hundred and eight, fhould be appropriated to the Purpose of ⚫ defraying the increased annual Charge occafioned by any Loan made or Stock created in the prefent Seffion of Parliament;' Be it therefore enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Au

thority of the fame, That from and after the Fifth Day of July One thousand eight hundred and ten, after fetting apart out of the Monies directed to be paid into the Exchequer, and made Part of the Confoli dated Fund by the faid first recited Act of the Forty eighth Year of the Reign of His prefent Majefty, the faid yearly Sum of Three millions nine hundred and fifty fix thousand seven hundred and ninety Pounds and Ten pence, and fuch further Sum as fhall be equal to the net Produce of the Duties on Licences to deal in Thread Lace according to the Provifions of that Aft, and alfo the yearly Sum of Thirty two thoufand Pounds, Part of the aforefaid yearly Sum of Forty two thousand Pounds payable by the Governor and Company of the Bank of England, pursuant to an Act of the prefent Seffion of Parliament, there hall in the next Place be referved and fet apart out of the faid Monies the yearly Sum of One hundred and fifty thousand Pounds, by Four equal Portions on the Fifth Day of January, the Fifth Day of April, the Fifth Day of July and the Tenth Ďay of Odober in every Year, towards defraying the increased annual Charge occafioned by the Stock created by the Acts paffed in the Forty eighth Year of His Majefty's Reign, and that the Remainder or Surplus of the faid Monies fhall be deemed an Addition made to the Publick Revenue of Great Britain, for the Purpose of defraying the increased annual Charge occafioned by any Loan made or Stock created by virtue of any Act or Acts paffed or to be paffed in the prefent Seffion of Parliament.

CA P. LXXII.

An Act for improving and completing the Harbour on the North Side of the Hill of Howth near Dublin, and rendering it a fit Situation for His Majefty's Packets. [9th June 1810.]

W

HEREAS the rendering the Harbour on the North Side of the Hill of Howth near Dublin, a fit Situation for His Majefty's Packets, is defirable for the regular and more fpeedy Con< veyance of the Mails between Dublin and Holyhead, and facilitating the Intercourse of Paffengers between Great Britain and Ireland: And whereas by virtue of an A&t made in the Forty fifth Year of His prefent Majefty's Reign, for granting a certain Sum of Money towards improving the faid Harbour, certain Perlons were appointed and authorized by the Lord Lieutenant of Ireland for the time being to apply the Sum granted towards improving the faid Harbour, and rendering it a fit Situation for His Majefty's Packets; and it was by the faid recited A&t further enacted, that fuch Perfons fo appointed should have all fuch Powers and Authorities as ⚫ are by Law given to or vested in the Corporation for preferving and improving the Port of Dublin, and which fhould be requifite and neceflary for the carrying of the faid recited Act into Execution; • and that all Piers, Wharfs, Quays, and other Erections and Buildings which might be made under the Directions of the said Persons, and all Ground applied to fuch Purposes by them, fhould be vested in the faid Corporation for preferving and repairing the Port of Dublin: And whereas it is expedient to provide for the due Ap⚫plication of whatever Sums may be granted or appropriated by Par•liament for the Improvement or towards the completing of the faid

Harbour; and further, to provide for the making and executing the Roads, Quays and Works neceffary for the Completion and Improvement of the faid Harbour:' May it therefore please your Majelty that it may be enacted; and be it enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That the feveral Per. Commiffioners foas heretofore appointed by the Lord Lieutenant of Ireland for for executing the time being for the Purpofe of carrying into Execution the hereinbefore recited Act of the Forty fifth Year of His prefent Majefty's Reign, and fuch other Perfon or Perfons as fhall or may from time to time be appointed or authorized by the Lord Lieutenant or other Chief Governor or Governors of Ireland for the time being, fhall be and they are hereby appointed Commiffioners for the Purposes of this A&: Provided always, that it fhall be lawful for the Lord Lieute nant or other Chief Governor or Governors of Ireland for the time being to revoke the Appointment of any fuch Perfon or Perfons to be fuch Commiffioner or Commiffioners, and from time to time to nomi. nate and appoint fuch other Perfon or Perfons to be a Commiffioner or Commiffioners as fuch Lord Lieutenant or other Chief Governor or Governors for the time being fhall think fit.

II. IA. B. do fwear, That I will, without Favour or Affection, Hatred or Malice, truly and impartially, according to the best of my Skill and Judgment, execute and perform all and every the Powers, Authorities and Duties of a Commiffioner, repofed in me ⚫ under and by virtue of an A& made in the Fiftieth Year of the Reign of His Majefty King George the Third, intituled, [here f * forth the Title of this A&.]'

Which Oath any One of the said Commiffioners, or any Perfon named in any Appointment of Commiffioners, is hereby authorized and required to adminifter at the First or any other Meeting to be held by virtue of this A&t.

III. And be it further enacted, That it fhall and may be lawful Commiffioners for the Commiffioners for the Purposes of this Act for the time being, may appoint or any Three of them, and they are hereby authorized and required Officers and from time to time to nominate and appoint by Writing under their make Contracts. Hands a Secretary, and One or more Clerk or Clerks, and alfo from time to time to employ fuch Engineers, Surveyors and other Officers, and fuch Labourers and Workmen as the faid Commiffioners fhall think proper and expedient for the better carrying into Execution the Purposes of this Act; and it shall and may be lawful for the faid Commiffioners, and they are hereby authorized and empowered to contract and agree with any fit and proper Perfon or Perfons, Artificers, Workmen and others, for the making, doing and preparing of all or any of the Roads and Works by this Act authorized or directed to be done and performed, or any Part thereof, or for fupplying any of the Materials for the fame, which Contract fhall be figned by the Contract by Perfon or Perfons contracting or agreeing to perform fuch Works whom figned.

in the Name of their Secretary.

A.D.1810. refpectively, and also by Three or more of the faid Commiffioners, or by the Secretary to the faid Commiffioners, authorized under the Hands of Three of the faid Commiffioners for that Purpofe; and all Contracts which shall have been made or entered into at any time before the paffing of this Act, by or on behalf or under the Authority of the Commiffioners nominated and appointed in purfuance of the faid recited Act of the Forty fifth Year, fhall be and the fame are hereby declared good, valid and effectual to all Intents and Purpofes, and shall be carried into effect in like manner as Contracts to be made under the Authority of this prefent Act.

IV. And be it further enacted, That the faid Commiffioners may fue and be fued in the Name of their Secretary for the time being, and that all Actions, Suits, Profecutions, Informations, Appeals and other Proceedings whatfoever that may be neceffary or expedient to be brought for the Recovery of any Penalty or Sum of Money due or payable by virtue of this Act, to be had, taken, profecuted or defended by or against the faid Commiffioners, fhall be had, taken, profecuted or defended in the Name of their Secretary, and that no Action, Suit, Profecution, Information, Appeal or other Proceeding to be had, taken, profecuted or defended by or against the faid Commiffioners in the Name of their Secretary, fhall abate or be difcontinued by the Death, Sufpenfion or Removal of fuch Secretary, or by any Act or Default of fuch Secretary done or fuffered, without the Confent or Direction of the faid Commiffioners, but that the Secretary to the faid Commiflioners for the time being shall be always demed the Plaintiff, Profecutor, Informant, Appellant, Defendant or Refpondent, in any fuch Action, Suit, Profecution, Information, Appeal or other Proceedings (as the Cafe may be), except in fuch Action or Actions, Suit or Suits, as fhall be profecuted between the faid Commiffioners and their Secretary for the time being, in which Action or Suit any One of the faid Commiffioners fhall or may be Plaintiff or Defendant (as the Cafe may be): Provided alRe-imbursement ways, that every fuch Secretary in whofe Name any fuch Action, of Secretary. Suit, Profecution, Information, Appeal or other Proceeding fhall be had, taken, profecuted or defended in purfuance of this or the faid recited Act, fhall be fully re-imburfed and paid out of the Mo. nies applicable to the Purposes of this Act, all fach Cofts, Charges, Damages and Expences as by the Events or in confequence of any Tuch Action, Suit, Profecution, Information, Appeal or other Proceedings, he or they fhall pay, bear, fuftain, expend or be put unto or become chargeable with or hable for, or be fairly entitled to by reafon of his or their being fo made Plaintiff or Plaintiffs, Defendant or Defendants, Informant or Informants, Appellant or Appellants, Refpondent or Refpondents as aforefaid, unlefs fuch Action or Suit fhall arife in confequence of his own wilful Neglect or Default, or have been brought or commenced, or be defended without thẹ Order or Direction of the faid Commiffioners.

V. And be it further enacted, That the faid Commiffioners fhall and they are hereby authorized and empowered to proceed in the improving and completing of the faid Harbour, and in the making and completing a Road and Quay along the Beach and Shore of the faid Harbour weftward of the Pier or Mole already in part erected, and to make fuch other Roads and Ways as they may think neceffary for the Conveyance of Materials to the faid Works, and to
