Juftices of Peace, granting an Extenfion of Furlough, to order

advance Pay to Soldiers.

Oath, or by the Knowledge of fuch Juftice of the Peace, it fhall appear or be found that fuch fufpected Perfon is a lifted Soldier, and ought to be with the Troop or Company to which he belongs, fuch Justice of the Peace fhall forthwith caufe him to be conveyed to the Gaol of the County or Place where he fhall be found, or the House of Correction, or other Public Prifon in fuch Town or Place where fuch Deferter fhall be apprehended; or to the Savoy, in cafe fuch Deferter fhall be apprehended within the City of London or Westminster, or Places adjacent; or to the Provost Marshal, in case fuch Deferter fhall be apprehended within the City or Liberties of Dublin, or Places adjacent; and tranfmit an Account thereof to the Secretary at War for the time being in London, or if the Deferter be apprehended in Ireland, to the Chief Secretary to the Chief Governor or Governors thereof, to the end that fuch Perfon may be removed by an Order from the Office of the faid Secretary at War, or Chief Governor or Governors, and proceeded against according to Law: And the Keeper of every Gaol, Houfe of Correction, or Prifon, in which fuch Deferter fhall at any time be confined, fhall receive fuch Subfiftence for the Maintenance of fuch Deferter during the time that he fhall continue in his Cuftody, as by His Majefty's Regulations is or fhall from time to time be directed in that Behalf, and the Keeper of every Gaol, Houfe of Correction, or other Public Prifon of the City, Town or Place at or in which the Party or Perfon conveying fuch Deferter fhall halt on the March, fhall, and he is hereby required to receive and confine every Deferter who fhall be delivered into his Charge and Cuftody by any Non-commiffioned Officer or Soldier who fhall be conveying fuch Deferter under any lawful Order, Warrant or Authority, while on the Road from the Place where he was apprehended, to the Place to which he is to be conveyed, without any other Warrant or Authority for fo doing than the Production of the Warrant of the Juftice of the Peace, on which fuch Deferter shall have been taken, or fome Order from the Office of the Secretary at War, or of the Chief Governor or Governors of Ireland, and fhall be entitled to One Shilling on account of the Imprisonment of the said Deferter; any Law, Ufage or Cuftom to the contrary notwithstanding.

XCVII. Provided always, and be it further enacted, That in all Cafes in which any Extenfion of Furlough fhall be granted as aforefaid, and upon the Requeft of any fuch Non-commiffioned Officer or Soldier to whom the fame fhall be granted, it fhall be lawful to the Juftice of the Peace granting the fame, to make an Order in Writing under his Hand upon the Churchwardens and Overseers of the Poor of the Parish, Township or Place wherein fuch Non-commiffioned Officer or Soldier fhall refide, requiring them to pay to fuch Non-commiffioned Officer or Soldier any Sum of Money directed in fuch Order, not exceeding what the Pay of fuch Non-commiffioned Officer or Soldier would amount to for the Period to which fuch Furlough shall be extended as aforefaid; and the fame fhall be paid accordingly, upon Production and Delivery to him of fuch Order, by any fuch Parish Re-imbursement. paid to fuch Parish Officer, to be applied to the Relief of the Poor, by fuch Collector of Excife or other Person out of any publick Monies in his Hands, and the fame fhall be allowed in his Accounts, and fuch Orders of Justices shall be taken as Cafh in the Payment of Duties of Excife received by him; and all Sums of Money fo advanced out of any Duties of Excife fhall be repaid to the Account of the faid ments to repay Duties by the Agents of the Regiments to which the Men to whom Money fo advanthe fame fhall have been paid fhall refpectively belong, to any Perfon or Perfons authorized by the Commiffioners of Excife in England and Scotland refpectively, or any Three or more of them refpectively, to draw for and receive the fame; Provided always, that if the Justice of Peace fhall not think fit to make fuch Order for paying any fuch Money as aforefaid, he fhall ftate his Reafons for fuch Refufal in Writing at the Back of the Furlough.

CXXX. And be it further enacted, by the Authority aforefaid, Continuance. That this A&t fhall be and continue in force, within Great Bri tain, from the Twenty fourth Day of March in the Year of our Lord One thousand eight hundred and ten, until the Twenty fifth Day of March in the Year of our Lord One thoufand eight hundred and eleven ; and fhall be and continue in force within Ireland, from the Thirty first Day of March in the Year of our Lord One thousand eight hundred and ten, until the First Day of April in the Year of our Lord One thousand eight hundred and eleven; and fhall be and con. tinue in force in Jerfey, Guernsey, Alderney, Sark and Man, and the lflands thereto belonging, as to fuch Parts thereof as relate to thofe Places refpectively, from the Thirtieth Day of April in the Year of our Lord One thoufand eight hundred and ten until the First Day of May in the Year of our Lord One thoufand eight hundred and eleven; and shall be and continue in force within the Garrison of Gibraltar and in His Majefty's other Dominions, or elsewhere, beyond the Seas, from the Twenty fourth Day of March in the Year of our Lord One thousand eight hundred and eleven until the Twenty fifth Day of March in the Year of our Lord One thoufand eight hundred and twelve.

CXXXI. Provided always, and be it enacted, That this Act, fo Act, in part, far as relates to the Allowances to be made for the quartering of Sol- may be altered diers and providing for their Horfes, or for the Provifion of Carriages, this Seffion. Horfes, Boats, Barges or other Veffels and Men, may be altered and varied by any A&t or Acts to be made in this Seffion of Parliament. Title of Viscount Wellington fhall defcend, in confideration
of his eminent Services.

THEREAS Your Majefty, by Your moft Gracious Meffage to Your moft faithful Commons, has been pleafed <to declare, That Your Majesty having taken into Your Royal Confideration the eminent Services rendered by Lieutenant General Arthur LordViscount Wellington, Knight of the most Honourable

Order of the Bath, in the brilliant and decifive Victory obtained by the Troops under his Command, against a fuperior French Force; at Talavera, on the Twenty eighth Day of July One thousand eight hundred and nine, Your Majefty was defirous to confer fome fignal Mark of Your Royal Favour upon Lieutenant General Lord Viscount Wellington, and the Two next fucceeding Heirs on whom the Titles of Vifcount Wellington of Talavera, and of Wellington in the County of Somerfet, and of Baron Douro of Wellesley in the faid County, fhall defcend, in order to enable them to fupport the Dignity of the Title conferred upon him, and for this Purpose to give and grant to him and to the Two next fucceeding Heirs Male, to whom the Titles of Viscount Wellington of Talavera and of Wellington in the County of Somerfet, and of Baron Douro of Wellesley in the faid County fhall defcend, for and during their Lives, a nett Annuity of Two thousand Pounds per Annum; but Your Majefty not having it in Your Power to grant an Annuity to that Amount, or to extend the Effect of the faid Grant beyond the Term of Your Majefty's own Life, recommended it to Your faithful Commons to confider of a proper Method of enabling Your Majefty to grant the fame, and of extending, fecuring and fettling, fuch Annuity to the faid Vifcount Wellington, and to the Two next • Perfons on whom the Title of Viscount Wellington of Talavera, and of Wellington in the County of Somerfet, and of Baron Douro of Wellesley in the faid County, fhall defcend, in fuch Manner as fhould be thought mofl cffectual for the Benefit of the said Vifcount Wellington and his Family:' We, Your Majesty's most dutiful and loyal Subjects, the Commons of Great Britain and Ireland in Parliament affembled, duly confidering Your Majefty's moft Gracious Intention, do most humbly befeech Your Majelty that it may be enacted; and be it enacted by the King's molt Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, That One Annuity, or Yearly Rent or Sum of Two thoufand Pounds of lawful Money of Great Britain, fhall be iffuing and payable out of and charged and chargeable upon, the Confolidated Fund of Great Britain, (after paying or referving fufficient to pay, all fuch Sum and Sums of Money as have been directed by any former Act or Acts of Parliament to be paid out of the fame, but with Preference to all other Payments which fhall or may hereafter be charged upon, or payable out of the faid Fund); and the fame fhall from time to time be paid quarterly, free and clear of all Taxes and Deductions whatsoever, in Manner and Form following; that is to fay, To the faid Vifcount Wellington, for and during the natural Life of the faid Viscount Wellington, and from and after his Deceafe, unto the Two next fucceeding Heirs Male of the Body of the faid Vifcount Wellington, on whora the Title, Honour and Dignity of Vifcount Wellington fhall defcend, for and Commencement. during their natural Lives; which faid Annuity, or Yearly Rent or Sum, fhall commence and take Effect from the Twenty eighth Day of July One thoufand eight hundred and nine; the First Payment to be computed from the faid Twenty eighth Day of July One thoufand eight hundred and nine, until the Fifth Day of January One thoufand eight hundred and ten, and from thenceforth fhall be paid and payable at the Four ufual Days of Payment in the Year, that is to

II. And it is hereby further enacted, That it fhall and may be Annuity to he lawful to and for the Commiffioners of His Majefty's Treafury now paid at the Exbeing, and the High Treafurer and Under Treafurer of the Ex- chequer, without chequer, and Commiffioners of the Treasury for the time being, and Fees. they are hereby authorized and required, by Warrant under their Hands, to direct the Auditor of the Receipt of the Exchequer, now and for the time being, to make forth and pafs Debentures, from time to time for paying the faid Annuity or yearly Rent or Sum of Two thousand Pounds, in manner as aforefaid, and as the fame fhall, from time to time, become due and payable, without any Fees or Charges to be demanded or taken for paying the fame, or any Part thereof; which faid Warrant, and the Debentures to be made forth, and paffed thereupon, fhall be a fufficient Authority to the feveral and refpective Officers of the Receipt of the Exchequer, now and for the time being, for the Payment of the faid Annuity, or yearly Rent or Sum, to the faid Viscount Wellington, and the Two next fucceeding Heirs Male of the Body of the faid Viscount Wellington, at the refpective quarterly Feaft Days in this Act before appointed for Payment thereof, without any further or other Warrant to be fued for, had or obtained, in that Behalf.

III. And it is hereby further enacted, That after figning of fuch Warrant, the fame fhall be good, valid and effectual in Law, according to the Purport and true Meaning thereof, and of this Act, and fhall not be determinable or revocable by or upon the Demife of His Majetty, (whom God long preferve!) or of any of His Heirs or Succeffors, or by or upon the Death or Removal of any of the faid Commiffioners of the Treafury, or the Lord High Treasurer, or by or upon the Determination of the Power, Office or Offices of them or any of them.

IV. And be it further enacted, That the Commiffioners of the Treafury to de Treafury now being, and the High Treasurer of the Treafury for neceffary Acts. the time being, Chancellor and Under Treafarer, Chamberlains and Barons of the Exchequer, and all other the Officers and Ministers of the Court of Exchequer, and of the Receipt thereof, now and for the time being, fhall, and they are hereby authorized and strictly enjoined and required to do, without Fee or Reward, all fuch Acts, Matters and Things, as are hereinbefore directed and required, or fhall be neceffary to be done and performed by them, or any or either of them, in order to render this A&t, and the feveral Payments hereby directed, effectual.

V. And be it enacted, That the Acquittance or Acquittances, The Receipt of Receipt or Receipts, of the faid Vilcount Wellington, and the Two Viscount Welnext fucceeding Heirs Male of the Body of the faid Vilcount Wellington, &c. a futficient Diflington, on whom the faid Title fhall defcend, fhall be a good and charge. fufficient Difeharge for the Payment of the faid Annuity or yearly Sum, without any further or other Warrant to be fued for or obtained

thereof, according to the true Intent and Meaning of this Act, or to do any At neceffary to enable the faid Vifcount, Wellington, and the Two next fucceeding Heirs Male of the Body of the faid Vifcount Wellington, on whom the faid Title, Honour and Dignity of Viscount Wellington fhall defcend, to receive the fame, then the faid Viscount Wellington, and the Two next fucceeding Heirs Male of the Body of the faid Viscount Wellington on whom the faid Title fhall defcend, may, from time to time, fue, profecute and implead fuch Officers, or any of them, their Heirs, Executors or Administrators, by Bill, Plaint or Action of Debt, and shall and may recover Judgment, and fue out Executions thereupon, againft fuch Officers refpectively, their Heirs, Executors or Adminiftrators for fo much of fuch Sum or Sums of Money then due and owing upon the faid Annuity, yearly Rent or Sum, or any Part thereof, as fhall have been in the Hands of the Officer or Officers of the Receipt of the Exchequer, at the time or times when Demands fhall have been legally made of the Payment of the faid Annuity, vearly Rent or Sum, or any Part thereof as aforefaid, or for the Refufal or Neglect to do any A&t neceffary to be done by fuch Officer or Officers refpectively.

VI. And be it further enacted, That the faid Annuity, yearly Rent or Sum of Two Thousand Pounds, fhall be, and the fame is by this A&t vefted in the faid Vifcount Wellington, and the Two next fucceeding Heirs Male of the Body of the laid Viscount Wellington, to whom the faid Title, Honour and Dignity of Viscount Wellington fhall defcend; and the fame, or any Part thereof, fhall not at any time or times hereafter be aliened, conveyed, difpofed, charged or incumbered, by the faid Viscount Wellington, or by either of the Two next fucceeding Heirs Male of the Body of the faid Viscount Wellington, on whom the faid Title fhall defcend, for any greater or larger Eftate, or Time, than during the natural Life of the Perfon fo aliening, conveying, difpofing, charging or encumbering the fame, fo as to prevent the fame from defcending to the next or fucceeding Heir Male of the Body of the faid Viscount Wellington, to whom the faid Title of Viscount Wellington fhall defcend, according to the Limitation aforefaid.

An Act to continue, until the Twenty fifth Day of March One thousand eight hundred and eleven, so much of an Act of the Forty seventh Year of His prefent Majefty, as allows a Bounty on British Plantation Raw Sugar exported.

[24th March 1810.] THEREAS an Act was paffed in the Forty feventh Year of His prefent Majefty's Reign, intituled, An Act to allow for Two Years, from and after the passing of this A&t, an additional Bounty on Double Refined Sugar, and to extend former Bounties on other Refined Sugar to fuch as fhall be pounded, crashed or broken; and to allow for One Year certain Bounties on British Plantation Raw Sugar exported; And whereas by another A&t paffed in the Forty eighth Year of His prefent Majefty's Reign, intituled, An A to amend and continue, until the Twenty fifth Day of March One thousand eight hundred and nine, so much of an A& of the Forty
