XXVIII. And be it further enacted, that all the Tolls and Rates, Penalties and current money of Forfeitures, by this Act impofed, fhall be paid and taken in the current money this Province, to of this Province, and the fame, (when not other wife herein before directed,) fhall be levied by Seizure and Sale of the Offender's Goods and Chattels, by Warrant, under the Hands and Seals of any two or more Juftices of the Peace, for the Dif trict of Montreal, upon proof, before them made, of the default by the Oath of one or more credible Witness or Witneffes, other than the Profecutor; and the perfon or perfons authorifed, by fuch Warrant, to feize fuch Goods and Chattels, is and are hereby authorised to fell the fame, returning the overplus money, (if any there be,) upon demand, to the owner of fuch Goods and Chattels, after fuch Tolls, Rates, Penalties and Forfeitures, with the reasonable charges of profecution, and of feizure and fale, fhall be deducted and paid..

XXIX. And be it further enacted, that if any person or persons shall think him. felf, herself or themselves aggrieved by any order or other proceeding of the faid Juftices, it fhall and may be lawful, for him, her or them to appeal to the Juftices at their General or Quarter Seffions of the Peace for the District, first paying or giving fecurity for the amount of the Order or Judgment complained of, if of a pecuniary nature, who are hereby authorised to hear and finally determine the matter in difpute.

XXX. And be it futher enacted, that all perfons offending against this Act, may be fued by the Truftees, in the name of their Treasurer and Clerk or of their Collector or Collectors, or of their Surveyor or Overseer, and all monies recovered from perfons fo offending, fhall be paid to the faid Treasurer, and fhall compose part of the Funds applicable to the purposes of this A&t.

XXXI. And be it further enacted that in all cafes where actions shall be brought against any person for any thing done in purfuance of this Act, and that the perfon bringing any fuch action, fhall be non-fuited, or fhall withdraw the fame, every fuch person fhall pay triple cofts, and all informations, fuits or actions for any thing done in pursuance of this Act, or for any Toll, Rate, Fine, Penalty or Forfeiture thereby impofed, fhall be commenced within three Calendar Months after the fact done or committed, and not afterwards.

XXXII. And be it further enacted, that the due application of the monies levied money to be ac- under this Act, according to the purposes thereof, fhall, if required, be accounted Majefty. for, to his Majefty, his Heirs and Succeffors, through the Lords Coinmiffioners of his Majefty's Treasury, for the time being, in fuch manner and form, as his Majefty, his Heirs and Succeffors fhall direct.

Et qu'il foit de plus ftatué par l'autorité fufdite, que fi quelque perfonne ou perfonnes fe croyent lélées par quelqu'ordre ou autre procédé des dits Juges de Paix, il leur fera loifible d'en appeller aux Juges de Paix dans leurs Seffions Générales ou de Quartier de la Paix, pour le District, payant préalablement ou donnant fûreté pour le montant de l'ordre ou jugement contre lequel il y aura plainte, fi c'eft de nature pécuniaire, lefquels font par le préfent autorifés d'entendre et déterminer finalement la matière en litige.

XXX. Et qu'il foit de plus fiatué par l'autorité fufdite, que toutes perfonnes contrevenantes à cet Acte, pourront être pourfuivies par les Syndics au nom de leur Tréforier et Greffier, de leur Collecteur ou leurs Collecteurs ou de leur Inspecteur; Et tous les Argents recouvrés des perfonnes ainfi contrevenantes feront payés au dit Tréforier, et composeront partie du Fonds applicable aux fins de cet Acte.

XXXI. Et qu'il foit de plus ftatué par l'autorité fufdite, que dans tous les cas où des Actions feront intentées contre une perfonne pour quelque chofe faite en conformité de cet Acte, et que la perfonne qui intentera telle Action fera déboutée ou la retirera, toute telle perfonne payera triple dépens, et toutes informations, poursuites ou actions pour quelque chofe faite en conformité de cet Acte, ou pour quelque péage, taux, amende, pénalité ou confifcation impolée par icelui, feront commencés fous trois mois de Calendrier après le fait commis, et non après.

XXXII. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'il fera tenu compte à Sa Majefté, fes Héritiers et Succeffeurs, fi la chofe eft requife, de la due application des Argents prélevés en vertu de cet Acte, fuivant les fins d'icelui, par la voie des Lords Commiffaires du Tréfor de Sa Majefté pour le tems d'alors, en telles manière et forme que Sa Majefté, fes Héritiers et Succeffeurs l'ordonneront,

Preamble.

XXXIII. And be it further enacted, that this A&t fhall be taken and allowed in all Courts, as a Public Act, and all Judges and Juftices are hereby required to take notice thereof, as fuch, without the fame being fpecially pleaded.

XXXIV. And be it further enacted, that the powers hereby granted, fhall take place, from and after this A&t fhall receive the Royal Affent, and fhall continue for and during the term of Twenty One Years, and from thence to the end of the then next Seffion of the Provincial Parliament, and no longer. Provided always, that the Tolls and Rates hereby granted, fhall not be levied until, after a Gate or Turnpike be erected, and notice thereof given, at the Doors of the Parish Churches of Montreal and of La Chine, after Divine Service, on a Sunday.

CAP. XII.

AN ACT for the better Regulation of Pilots and Shipping in the Port of Quebec, and in the Harbours of Quebec and Montreal, and for improving the Navigation of the River Saint Lawrence, and for establishing a Fund for decayed Pilots, their Widows and Children.

HEREAS the Regulation of Pilots and Shipping in the Port of Quebec and the Harbours of Quebec and Montreal and the improvement of the Navigation of the Rivert Saint Lawrence, are objects of great importance to the commerce of this Province; Be it therefore enacted by the King's moft Excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lowwer Canada, conftituted and affembled by virtue of and under the authority of an &A paffed in the Parliament of Great Britain, intituled, " An Act to repeal certain parts of an A&t paffed in the fourteenth year of his Majefty's Reign, intituled, " An A&t for making more effectual Provifion for the Government of the Province of Quebec, in North America," And to make further provifion for the Government of the "faid Province," And it is hereby enacted by the authority of the fame, that it fhall and may be lawful to and for the Governor, Lieutenant Governor or perfon adminiftering the Government of this Province for the time being, by an Inftrument under the Great Seal of this Province, to conftitute and appoint two fit and proper perfons to be Mafter and Deputy Mafter, to refide in the city of Quebec, and not exceeding feven other perfons, (of whom the present Captain of the Port of Quebec or Harbour Mafter of Quebec, as herein after mentioned, and the Superintendant of Pilots, and fuch perfons as may hereafter be appointed to execute the duties of their offices refpectively, fhall be two,) to be Wardens of the Trinity House of Quebec, whereof four shall refide in the City of Quebec, and three
