XVI. And whereas many perfons refident within the parifh of La Chine, are liable to certain annual labour and others within that on the faid road, parish and the parish of Montreal, are by Law, chargeable indefinitely with the repairs of certain parts thereof, and it is equitable and would be convenient, that all fuch perfons fhould be exonerated from fuch labour and fuch repairs, and their fervices be compounded for money. Be it therefore further enacted, that every perfon fo liable to any specific annual labour upon the faid Road, may, on or before the laft day of March, in each year, compound for the fame, by paying to the Treasurer, and Clerk of the Trustees, the fum of five fhillings for each days labour of a horfe, cart and driver, and one fhilling and eight-pence currency, for each days labour of a man, to which he or she is liable; and every per fon who is chargeable indefinitely, with repairs to any part of the faid Road, may at the like period, in each year, compound for the fame by fo paying for each Land or Farm of three acres in front, by him or her owned or poffeffed and liable thereto, the fum of fifteen fhillings currency, or compound by agreeing to furnish in lieu of fuch fum when required by the Trustees, or their overseer, three days labour of a horse, cart and driver, at the option of any fuch perfon, but fuch option to be declared on or before the period above faid, and fo in proportion, be the Land or Farm of greater or leffer front, or if a village, house and lot, five fhillings currency; and every perfon refident along the Cote Saint Paul, may compound as above faid, by paying five fhillings for each farm of three acres in front, by him, her or them poffeffed, and fo in proportion and fuch payments in money or fuch labour if furnished, fhall, refpectively, exempt the perfons making them for the year, in which the compofition shall be so made from all Tolls, and from the labour upon the faid Road, other than the faid compofition labour to which they would otherwise be liable, the labour, however, refpecting the Road during the feafon of winter conveyances, (to which any fuch perfons may be liable by Law excepted;) and every perfon who may not be chargeable by Law with repairs to the faid Road, but fhall be defirous of compounding for the use of the fame, in fo far as fhall refpect coaches, chariots, landaus, chaises, phactons, gigs, calaches, chairs, or other carriages of pleasure, and in respect to saddle

Et attendu que bien des perfonnes réfidentes dans la Paroiffe de la Chine font fujettes à un certain travail annuel fur le dit Chemin, et que d'autres dans cette Paroiffe et la Paroiffe de Montréal font par la Loi fujettes à être chargées indéfini ment des réparations de certaines parties d'icelui, et qu'il eft équitable, comme il feroit convenable que toutes telles perfonnes fuffent déchargées de tel travail et de telles réparations, et que leurs fervices fuffent compenfées en argent : Qu'il foit donc de plus ftatué par l'autorité fus-dite, que toute perfonne ainfi fujette à queltravail annuel spécifique fur le dit Chemin, pourra, avant le dernier jour de Mars dans chaque année, compofer pour le dit travail en payant au Tréforier et Greffier des Syndics la fomme de cinq chellins courant pour chaque jour de Travail d'un Cheval, Charrette et Charretier, et un Chellin et huit deniers courant pour chaque jour de travail d'un homme, auquel elle eft fujette; Et toute perfonne qui est fujette à être chargée indéfiniment des réparations de quelque partie du dit Chemin, pourra au même tems dans chaque année compofer pour icelles en payant ainsi par chaque Terre ou Ferme de trois Arpens de front tenue ou poffédée par elle, et y étant affujettie, la Somme de Quinze Chellins Courant, ou compofer en convenant de fournir au lieu de telle fomme, quand les Syndics le requerront ou leur Inspecteur ou Sous-voyer, trois jours de travail d'un Cheval, Charette et Conducteurs à l'option d'aucune telle perfonne, cette option néanmoins devant étre déclarée avant ou au tems fus-dit, et ainsi à proportion pour une terre ou ferme d'un front plus ou moins étendu, ou fi c'eft une Maison et Emplacement de Village, Cinq Chellins courant; Et toute perfonne demeurant le long de la Côte Saint Paul peut compofer, comme il eft ci-deffus dit, en payant cinq Chellins pour chaque terre de trois Arpens de front par elle ou lui poffédée, et ainsi à proportion, et tel payement ou tel Travail, s'il eft fourni, exempteront refpectivement les perfonnes qui les feront pour l'année dans laquelle la compofition fera ainfi faite, de tout péage et du Travail sur le dit Chemin, (le dit Travail de compofition excepté) auquel elles auroient été autrement fujettes, excepté néanmoins le travail qui concerne le Chemin durant la Saifon des voitures d'hiver auquel aucune telle perfonne fera fujette par la Loi, et toute perfonne qui par la Loi, n'eft pas fujette à être chargée des réparations du dit Chemin, mais qui défirera compofer pour en faire ufage quand aux Caroffes, Chars, Landaux, Chaifes, Phaetons, Cabriolets, Caleches ou autres voitures de plaifir, et auffi à l'égard des

horses may compound for the fame, by paying as abovefaid, fuch fum or fums as the faid Trustees, or any three or more of them at a general meeting, fhall establish as the rule or ftandard for compofition, in fuch cafes: and which fum or fums fo paid, fhall exempt the perfons paying from every Toll and Duty during the like period, which fuch carriages of pleasure, or such faddle horses, would otherwife be liable to. But in neither of the cafes abovefaid, nor in any cafe whatever, fhall any waggon, cart or other carriage, when employed in transporting any merchandife, or other effects for hire, be compounded for, or be capable of compofition.

XVII. And whereas the road fund of the City of Montreal, is chargeable with the repairs of a the repairs of that part of the faid Road to La Chine, which is fituated between the bridge over the River Prudhomme and the bounds of the faid City, and the general Road Act, having provided for affiftance from that fund, towards the roads upon hills within the parish, affiftance therefrom was in confequence given towards the expence incurred upon the hills near the Tannery and at Urtubife's. Be it therefore further enacted, that from and after the paffing of this Act, the road fund of the faid City fhall be exonerated from the repairs of the faid part of the La Chine road, between the faid bridge and the City bounds: and alfo, from the repairs to the faid hills, to all which the faid Trustees fhall become liable, and in confideration thereof, there fhall annually be paid during the continuance of this Act, (the first payment whereof to be made out of the faid road fund, for the year one thoufand eight hundred and five,) by the road Treasurer, of the faid City to the Treasurer and Clerk of the faid Trustees, the fum of twenty-five pounds currency.

XVIII. And be it further enacted, that it fhall and may be lawful for the take and carry a faid Trustees, or any Perfon or Perfons whom any two of the Trustees fpecially fuperintending the repairs of the road fhall appoint, to fearch for, dig, gather, take, and from time, to time convey away Gravel, Stones, Sand, or other materials for roads, from any grounds within the parishes, through which the said road pasfes, or within a neighbouring parish, (not being the ground whereon any house stands or whereby, the foundation thereof can be injured, nor a garden, orchard, nurfery of trees, yard or avenue to any house,) where fuch materials have been in use, to be taken, or are, or may be found, and fo much thereof to carry away as fhall be necessary for improving and repairing the aforefaid road, paying only for the damage done to the furface of the faid grounds, (and for the expences of fencing in the part of the fame, where the furface is broken, and fhall require it) refpectively, where and from whence the fame fhall be dug, gathered or taken away, or over which the fame fhall be carried, the amount of which damage, fhall in the event of disagreement about the same be afcertained by an equal number of Arbitrators to be chofen by the faid fuperintending Trustees, or any two of them, and by the owner or cccupier of fuch grounds; and which Arbitrators fhall, if neceffary, appoint an Umpire, and the decifion of the majority of fuch Arbitrators,

XVII. Et attendu que les fonds établis pour les Chemins de la Cité de Montréal, font chargés des réparations de cette partie du dit Chemin de La Chine qui eft fitué entre le Pont fur la Rivière Prudhomme et les limites de la dite Cité, et l'Acte général des Chemins ayant pourvu à une affiftance de ces Fonds pour les Chemins fur les Côtes dans la Paroiffe, et cette affiftance ayant été en conféquence donnée pour défrayer les dépenfes encourrues fur les Côtes, près de la Tannerie et chez Urtubife; Qu'il foit donc de plus ftatué par l'autorité fufdite, que depuis et après la paffation de cet Acte, les Fonds des Chemins de la dite Cité feront déchargés des réparations de la dite partie du Chemin de La Chine entre le dit Pont et les limites de la Cité, et auffi des réparations des dites Côtes, à toutes lefquelles les dits Syndics deviendront fujets, et en cette confidération, il fera payé annuellement, durant la continuation de cet Acte, dont le premier payement fe fera fur les dits Fonds des Chemins pour l'Année Mil huit cent cinq, par le Tréforier des Chemins de la dite Cité au Tréforier et Greffier des dits Syndics, la Somme de vingt cinq Livres courant.

XVIII. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'il fera et pourra être loifible aux dits Syndics, ou à la perfonne ou aux perfonnes que deux des Syndics qui furveilleront fpécialement aux réparations du Chemin, nommeront, de chercher, faire creufer, amaffer, prendre et, de tems à autre, tranfporter des graviers, pierres, fables ou autres matériaux pour les Chemins, fur aucun terrein quelconque dans. les Paroiffes à travers lefquelles paffe le dit Chemin, ou dans une Paroiffe voifine, où de tels matériaux ont coutume d'être pris, ou qui peuvent s'y trouver, n'étant point un terrein fur lequel il y aura quelque maison érigée, ou qui pourroit porter préjudice aux fondations d'icelle, ni un Jardin, Verger, Pépinière, Cour ou. Avenue à quelque Maison, et d'en enlever autant qu'il fera néceffaire pour améliorer et réparer le fufdit Chemin, payant feulement les dommages faits à la furface des dits Terreins refpe&tivement, et les frais des Clôtures dans la partie d'iceux où la furface aura été brifée, et qu'il fera néceffaire de clore dans l'endroit où ils auront été creusés, amaffés et enlevés, ou fur les Terreins par où ils auront été tranfportés, le montant defquels dommages, dans le cas d'une différence d'opinion à ce regard, fera conftaté par un nombre égal d'arbitres, lefquels feront choifis par les dits Syndics furveillans ou deux d'entr'eux, et par le Propriétaire ou occupant de tels Terreins, et lefquels arbitres nommerout, s'il eft néceffaire, un fur-arbitre, et la décifion

or the decifion of fuch Umpire, (if the Arbitrators be equally divided in opinion,) shall be final, and the Treasurer and Clerk of the Trustees, fhall make payment accordingly, and if either the Trustees, or the owner or occupier of fuch grounds, fhall refuse or neglect to appoint Arbitrators, then the Juftices in their next General or Quarter Seffions of the Peace, or in a Special Seffion, which upon the application of either party may be fummoned for the purpofe, fhall hear and finally determine the amount of the damage, and payment therefor, fhall be made accordingly, but fuch difpute or difference fhall not in the mean time hinder the carrying off and using the faid materials, towards repairing the faid Road.

XIX. Provided nevertheless, and be it further enacted, that it shall not be lawful to dig, gather, take and carry away materials for the faid Road, without the conven of fuch inten. fent of the Proprietor or Occupier of the grounds from wheuce the fame are intended to be taken, until five days notice in writing fhall have been given to him or her or left with fame grown perfon, at his, or her refidence to appear, (at a time and place to be in fuch notice mentioned,) before two Juftices of the Peace acting for the District of Montreal, to fhew caufe, if any they have, why fuch materials should not be taken and carried away from fuch grounds, and the faid Juftices at the time and place appointed for fuch appearance, fhall, whether the Proprietor or Occupier do attend or not, upon a confideration of the circumftances, make fuch order therein, as they fhall fee proper and fit, either for authorifing or refufing fuch materials to be dug, gathered and carried away; and fuch order, fo made, shall be obeyed.

XX. And be it further enacted, that it fhall be lawful to cut and make fuch ches may be cut, drains and ditches, through the grounds lying contiguous to the faid Road, (not being within the reftrictions before mentioned,) as fhall be judged neceffary by the Trustees, or any three or more of them, for draining the faid Road; and if any part of the faid Road already formed, fhall be found to be too narrow, the fame may be widened: Provided, that no fence thereby removed unless by confent of the Proprietor or Occupier, and any part thereof not yet formed or fenced may be ftraightened and made of a breadth not exceeding forty English feet; and the neceffary bridges in the extent of the faid Road, may be made with ftone or timber, as fhall be judged moft adviseable, and ground neceffary for building Toll Houses thereon, (if the fame cannot be conveniently rented or leafed,) may be taken by the order of the Trustees, or any three or more of them, at a general meeting, upon paying fuch compenfation to the Proprietors or Occupiers whofe grounds fhall be fo damaged, by fuch drains or ditches or be fo taken for building fuch Toll Houses; and the amount of which compenfations, fhall be afcertained (if the fame be not agreed upon between the parties,) in the manner and form here. in before directed, in refpect to damage done to grounds by digging and carrying away gravel or other Road materials:
