Preamble,

fuch accounts fhall not be fo made out, dated, certified, fworn to and depofited as abovelaid, the faid Corporation fhall forfeit and pay, the fum of fifty Pounds, for every month that the fame fhall be refused or neglected, after being thereunto requi red by any of His Majefty's Juftices of the Peace for the District abovefaid, to be recovered by action of debt, in any Court competent to decide thereon, and paid to the Perfon who fhall fue for the fame; and if any perfon fworn as abovefaid, who fhall wilfully, or corruptly fwear, falfely, every fuch perfon, being thereof duly convicted, fhall fuffer the punishment inflicted by law for Perjury.

XXVII. And be it further enacted by the authority aforefaid, that this A&t shall not have effect, nor fhall the faid Road and Bridges, or any part thereof be made, erected or built, until authority fhall be given, by the Governor, Lieutenant Governor or Perfon adminiftering the Government of this Province for the time being, by an inftrument in writing, under his hand and feal at arms, to the Corporation herein before conftituted, and fuch Corporation fhall be held and bound to make, erect and compleat the fane within five years, from the date of fuch authority, fo to be given in the manner herein before prefcribed, under the pains and penalties hereby impofed and laid.

XXVIII. And be it further enacted by the authority aforefaid, that no fuit or action shall be commenced or brought against any person offending against this A&t, unless the fame fhall be commenced or brought within three Calendar Months next after the offence committed, and not afterwards.

XXIX. And be it further enacted by the authority aforefaid, that this A&t shall be deemed a Public Act, and shall be judicially taken notice of as fuch by all Judges, Juftices and other persons whomsoever, without being specially pleaded.

AN ACT for repairing and ameliorating the ancient ¡Castle of Saint
Lewis.

(14th April, 1808.)

WHEREAS the ancient Caftle of Saint Lewis, in the City of Quebec, in this

Province, which hath at all times been the refidence of the Governors of this Province, is much decayed; May it therefore please Your Majefty that it may be enacted, and be it enacted by the King's Moft Excellent Majefty, by and with the ad

Et qu'il foit de plus ftatué par l'autorité fufdite, que cet A&te n'aura point effet, et le dit Chemin et les dits Ponts, ou aucune partie d'iceux, ne feront faits, érigés ou bâtis jusqu'à ce qu'il foit donné une autorité par le Gouverneur, Lieutenant Gouverneur, ou la perfonne ayant l'adminiftration du Gouvernement de cette Province pour le tems d'alors, par un inftrument ou écrit, fous fon Seing et le Sceau de les armes, à la Corporation ci-deffus conftituée, et telle Corporation fera tenue et obligée à ériger et complêter les dits Chemins et Ponts fous cinq années de la date de telle autorité qui fera ainfi donnée en la manière ci-deffus prefcrite, fous les peines et pénalités impofées par le présent Acte.

XXVIII. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'aucune poursuite ou action ne fera commencée ou intentée contre aucune perfonne contrevenant à cet Acte, à moins qu'elle ne foit commencée ou intentée dans trois mois de Calendrier après la contravention commife, et non après.

XXIX. Et qu'il foit de plus ftatué par l'autorité fufdite, que cet A&te fera jugé A&te public. être un Acte public, et que, comme tel, il en fera judiciairement pris connoiffance par tous Juge ou Juges de Paix et autres perfonnes quelconqnes, fans qu'il foit ipécialement plaidé.

TTENDU l'ancien Chateau Saint Louis, dans la Cité de Québec dans cette que Province, qui a été, de tout tems, la résidence des Gouverneurs de cette Province, eft dans un état très ruineux: Qu'il plaife donc à Votre Majesté qu'il puiffe être flatué, et Qu'il soit ftatué par la très Excellente Majefté du Roi, par et de l'a

vice and confent of the Legiflative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of, and under the authority of an A& paffed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an A&t paffed in the fourteenth year of His Majefty's reign," intitaled, "An Act for making more effectual provifion for the Government of the Province of Quebec in North America; and to make further provifion for the Government £7000 granted of the faid Province; And it is hereby enacted by the authority of the same, that for repairing the out of all or any of the Revenues of this Province arifing or to arife, and which have Cafle of St, Lewis or fhall come to the hands of the Receiver General of this Province, there shall and may be ufed and applied to the reparation and amelioration of the ancient Caftle of Saint Lewis, in the City of Quebec, in this Province, any fum or sums of money, not exceeding in the whole, the fum of feven thousand pounds current money of this Province, which faid fum of seven thousand Pounds fhall be paid to fuch perfon or perfons, at fuch time and times, and in fuch proportions, respectively, as the Gouernor, Lieutenant Governor or perfon adminiftering the Government of this Province for the time being, by warrant or warrants under his hand, fhall direct, limit and appoint..

II. And whereas it is neceffary to establish a fund to provide the above mentio ned fum of leven thousand Pounds, current money of this Province, and to replace, from time to time, the fum and fums of money, fo to be expended; Be it therefore enacted by the authority aforefaid, that upon each Notarial Act of whatsoeyer def next, A&ts paffed cription, which, from and after the first day of June, in this year of our Lord Chrift, one thousand eight hundred and eight, fhall be executed or paffed, " avec minute or "en Brevet" before any Notary or Notaries by any perfon or perfons whosoever, there shall be paid into the hands of the Notary before whom fuch A&t shall be executed or paffed, before the execution or paffing of fuch A&t, the fum of one fhilling, current money of this Province.

III. And be it further enacted by the authority aforefaid, that in all cafes in which any Notarial A&t, fhall, after the faid first day of June, be executed, in the presence of one or more Notaries, the faid fum of one fhilling hereby imposed, shall be paid into the hands of the Notary, who shall keep and retain the minute of such A&t in his Etude, where fuch A&t fhall be executed or paffed, " avec minute;” and into the hands of the Notary who fhall prepare the Act for execution, where fuch a& fhall be executed or paffed" en brevei."

IV. And be it further enacted by the authority aforesaid, that, from and after the faid firft of June, any Act or writing whatsoever, bearing date after the faid firft day of June, and during the continuance of the Tax hereby impofed, which fhall be executed in this Province, and purport to be a Contract or Deed, whereby any real or immoveable property of any description whatsoever, or the ufufruct or enjoyment

vis et confentement du Confeil Législatif et de l'Affemblée de la Province du BasCanada, conftitués et affemblés en vertu et fous l'autorité d'un Acte paffé dans le Parlement de la Grande Bretagne, intitulé, "Ate qui rappelle certaines parties "d'un Acte paffé dans la quatorzième année du Regne de Sa Majefté, intitulé, "Acte qui pourvoit plus efficacement pour le Gouvernement de la Province de Québec, dans £7000 accordés "l'Amérique Septentrionale;" et qui pourvoit plus amplement pour le Gouverne- pour la réparation ment de la dite Province;" Et il eft par le préfent ftatué par l'autorité fufdite, que fur tous ou quelques uns des revenus de cette Province provenant ou qui proviendront, et qui font venus ou viendront entre les mains du Receveur Général de cette Province, il fera et pourra être avancé et employé à la réparation et améliora tion de l'ancien Chateau Saint Louis, dans la Cité de Québec dans cette Province, aucune fomme ou fommes d'argent quelconques n'excédant point en tout la fomme de fept Mille Livres, argent courant de cette Province, laquelle dite fomme de sept Mille Livres fera payée à telle perfonne ou perfonnes, à tels tems et en telles proportions refpectivement, que le Gouverneur, Lieutenant Gouverneur ou la perfonne ayant l'administration du Gouvernement de cette Province, pour le tems d'alors, par un Warrant ou des Warrants, ordonnera, limitera et fixera.

II. Et attendu qu'il eft néceffaire d'établir un fonds pour pourvoir à la fomme ci-deffus mentionnée de Sept Mille Livres, argent courant de cette Province, et remplacer, de tems à autre, la fomme et les fommes d'argent qui feront ainfi dépensées : Qu'il foit donc ftatué par l'autorité fufdite, que fur chaque Acte quelconque, de quelque defcription qu'il foit, qui, depuis et après le premier jour de Juin, dans l'année de Notre Seigneur mil huit cent huit, fera exécuté ou paffé avec minute ou en brevet, devant un ou plufieurs Notaires, par quelque perfonne ou perfonnes quelconques, il fera payé entre les mains du Notaire devant lequel tel Acte fera exécuté ou paffé, avant l'exécution ou paffation de tel A&te, la fomme d'un Chelin, argent courant de cette Province.

III. Et qu'il foit de plus ftatué par l'autorité fufdite, que dans tous les cas où quelque Acte fera, après le dit premier jour de Juin, exécuté en la préfence d'un Notaire ou plus, la dite fomme d'un Chelin par le préfent impofée, fera payée entre les mains du Notaire qui gardera et retiendra, dans fon étude, la minute de tel Acte, lorfque tel Acte fera exécuté ou paffé avec minute, et entre les mains du Notaire qui dreffera l'Acte pour l'exécuter, lorsque tel Acte fera exécuté ou paffé en

brevet.

IV. Et qu'il foit de plus ftatué par l'autorité susdite, que, depuis et après le dit premier jour de Juin, aucun A&te ou Ecrit quelconque portant date après le dit premier jour de Juin, et durant la continuation de la taxe impofée par le préfent Acte, qui fera exécuté dans cette Proyince, dont la teneur fera un Contrat ou Acte

joyment thereof, fhall, in any manner or way, be affected, (Bonds, Obligations, Recognizances and fecurities to His Majefty, Proceedings in His Majefty's Courts of Law of every defcription, Procès Verbals and other proceedings before any Grand Voyer or their Deputies or any Land Surveyor, and each and every of them always excepted,) or purport to be a Donation, Contract of Marriage, Ratification of any Notarial Act, Proteft, Inventaire de Communauté ou de Succeffion, Acte de Notoriété, Tanfport of Droits succeffifs, or of any fum of money due under or by virtue of any Notarial Act, Compromis, Tranfaction, Partage, Brevet d'Apprentisage, Ceffion de Biens, Don Mutuel, Marché pour Batiffe, Nantiffement or Procuration, and thall not be paffed and executed before any Notary or Notaries, and be an A&t authen. tique, fhall not be received or admitted to be evidence in any of His Majesty's Courts of Law of this Province, any law, ufage or custom to the contrary notwithflanding. Provided always, that nothing herein contained, fhall make valid or be conftrued to make valid any Acte or Altes which now by law ought to be paffed or executed before Notaries; and provided alfo, that nothing herein contained, fhall extend or be conflrued to extend to any Will or Teftament or to any Codicil which fhall be made or executed in any part of this Province, or to any Ale or other wri ting which fhall be made or executed in any of the Townships of this Province, or in any part of the Inferior District of Gafpé.

V. And be it further enacted by the authority aforefaid, that upon each Copy or peditions fubject Expedition of any Notarial Ate, now paffed or executed, or hereafter to be paffed or executed, which fhall be delivered after the faid first day of June, there fhall be paid into the hands of the Notary by whom fuch Copy or Expedition shall be cer tified or delivered, and before the delivery thereof, the sum of fix pence, current money of this Province.

VI. And be it further enacted by the authority aforefaid, that upon each copy or expedition of any Notarial Act or other writing depofited of Record in His Ma jefty's Courts of King's Bench, in this Province, or in either of them, or in the Archives of fuch Courts, or either of them, or in the Court Houfes of the Districts of Quebec, Montreal and Three Rivers or in either of them, which fhall be delivered after the firft day of June next, there fhall be paid into the hands of the Prothonotary, Keeper of the Archives, or other perfon by whom fuch copy or expedition fhall be cerufied or delivered, and before the delivery thereof, the fum of one fhilling, current money of this Province, Provided always, that nothing herein contained, fhall extend or be conftrued to extend, to any copy or expedition of any Judg ment which shall be delivered within one year, from the date of fuch Judgment.

VII. And be it further enacted by the authority aforefaid, that upon each Copy or Expedition of any Alte or other writing, depofited of Record in the office of the
