XVI. And be it further enacted by the authority aforefaid, that the Senior Captain of Militia, or in his abfence, the Senior Officer of Militia under him, of and in every Parish within this Province, on the firft Sunday of July in every year, at the Church door immediately after Divine fervice in the forenoon fhall read, or caufe to be read, the thirteenth, fourteenth and fifteenth claufes of the prefent A&t.

XVII. And whereas the lots of ground and beach, in front thereof, bordering on the river Saint Lawrence from the City of Quebec, to the farm of Sillery inclufive, are the places principally reforted to, by dealers in Lumber, who by laying their Rafts thereon, frequently without permiffion, take poffeffion of and occupy the said beach for a great length of time, to the great damage of the proprietors and tenants of fuch lots of ground and beach, for remedy whereof; Be it further enacted by the authority aforelaid, that from and after the paffing of this Act, if any Raft or Rafts, fhall be laid on the beach, in front of any lot of ground, bordering on the river Saint Lawrence between the City of Quebec, and the farm of Sillery inclufive, by any person or perfons without the permiffion of the proprietor or tenant of such lot, and beach, and fhall there remain for more than fix days, without being unloaded, the Owner or Owners of every fuch Raft or Rafts, or his her, or their agent or agents, who, after due notice given, shall refufe or neglect for the space of twenty four hours, to unload and haul up the Lumber of which fuch Raft is compofed, to fuch place above high water mark as the proprietor or tenant of fuch lot fhall point out, or after due notice fhall refufe or neglect, for the space of twenty four hours, to remove and depart with fuch Raft, fhall, for every fuch refusal or neglect, forfeit and pay to the nfe of the Proprietor, or Tenant of fuch lot of land and beach, Twenty Shillings, current money of this Province, Per Crib, day by day, for each and every day that fuch Raft or Rafts, or any part thereof, shall thereafter remain on fuch Beach, and in default of payment, it shall and may be lawful for the Proprietor, or Tenant of fuch Lot and Beach, to feize and detain fuch Raft or Rafis, or any part thereof, until full payment and fatisfaction is made, for the Penalty fo incurred, under and by virtue of this Act, and every part thereof. Provided always, that in every cafe, where notice as above faid, fhall be given, for the unloa ing and hauling up of Lumber contained in any fuch Raft, it fhall be optional to the Owner or Owners thereof, or his her or their Agent or Agents, fo to do, or to depart with the fame, within the time above limited.

XVIII. And be it further enacted by the authority aforefaid, that all the Penalties, Fines and forfeitures by this Act impofed, fhail be fued for, within fix months after the fact committed, and not afterwards, and fhall be recoverable with cofts in the fame manner as other debts of the fame value, are recoverable in this Province, by fuit, bill, plaint, or information; the one moiety of all which Penalties, fines and forfeitures, (except fuch as are herein before otherwife applied,) when re

Et qu'il foit de plus ftatué par l'autorité fufdite, que le plus ancien Capi taine de Milice, ou à fon défaut, le plus ancien officier de Milice après lui, dans chaque Paroiffe de cette Province, lira ou fera lire les treizième, quatorzième et quinzième Claufes du préfent Acte, à la porte de l'Eglife, à l'iffue de l'Office Divin du matin, le premier Dimanche de Juillet de chaque année.

XVII. Et attendu que les lots de terre avec les grêves fur la devanture d'iceux, qui bordent le fleuve Saint Laurent depuis la Cité de Québec jufqu'à la ferme de Sillery inclufivement, font les places principalement recherchées par les marchands de bois (ou lumber) qui, en y mettant leurs cages, fréquemment fans permillion, prennent poffeffion des dites grêves et les occupent durant un tems confidérable, au grand préjudice des propriétaires et occupants de tels terreins et grêves; afin donc d'y remédier: Qu'il foit de plus ftatué par l'autorité fufdite, que, depuis et après la paffation de cet Acte, fi quelque cage ou cages font mifes fur la grêve de quelque terrein bordant le fleuve Saint Laurent, entre la Cité de Québec et la ferme de SilJery, inclufivement, par quelque perfonne ou perfonnes, fans la permiffion du Propriétaire ou Occupant de tel terrein et grêve, et y reftent plus de fix jours, fans être déchargées, le Propriétaire ou les Propriétaires de chaque telle cage ou cages, ou fes ou leur Agent ou leurs Agents, qui, après notice duement donnée, refuferont ou négligeront, durant un espace de vingt quatre heures, de décharger et tirer le bois (ou lumber) dont telle cage fera compofée, à telle place audeffus de la haute mer que le Propriétaire ou Occupant de tel terrein défignera, ou après due notice refuseront ou négligéront, durant l'efpace de vingt quatre heures, de s'ôter et partir avec telle cage, encourront et payeront pour chaque tel refus ou négligence, à l'ufage du Propriétaire ou Occupant de tel terrein et grêve, vingt chellins, argent courant de cette Province, de jour en jour, par train ou crib, pour tout et chaque jour que telle cage ou cages, ou quelque partie d'icelles refteront enfuite fur telle grêve; et à défaut de payement, il fera et pourra être loisible au Propriétaire ou Occupant de tel terrein et grêve de faifir et detenir telle cage ou cages, ou quelque partie d'icelles, jufqu'à ce que l'amende encourrue fous et en vertu de cet A&e, et chaque partie d'icelle, ait été entiérement payée et fatisfaite. Pourvu toujours, que dans chaque cas où notice fera donnée comme fufdit, pour décharger et haler le bois (ou lumber). contenu dans toute telle cage, il fera à l'option du Propriétaire ou des Propriétaires d'icelle, ou de les ou leur agent ou agents de le faire, ou de partir avec telle cage dans le tems ci deffus limité.

covered shall be paid into the hands of the Receiver General, for the use of His Majefty, towards the fapport of the Government of this Province, and shall be accounted for to His Majefty, through the Commiffioners of His Majefty's Treasury for the time being, in fuch manner and form, as His Majefty fhall direct and the other moiety, to any perfon who fhall fue for the fame.

XIX. And be it further enacted by the authority aforefaid, that if any action or fuit, fhall be commenced against any perfon or perfons, for any thing done in pirfuance of this Act, fuch fuit or fuits, fhall be commenced within the space of fix months next after the offence fhall have been committed, and not afterwards; and the defendant or defendants in fuch action or fuit, may plead the general iffue, and give this A&t and the special matter in evidence at any trial to be had thereupon, and that the fame was done in pursuance and by the authority of this Act, and if it fhall appear fo to have been done, then the Court fhall find for the defendant or defendants, and if the plaintiff fhall be non fuited, or dilcontinue his Action, after the defendant or defendants fhall have appeared, or if Judgement fhall be given, against the plaintiff, the defendant or defendants, fhall and may recover treble cofts, and have the like remedy for the fame, as defendants have in other cafes by law.

XX. And be it further enacted by the authority aforefaid, that this A&t shall continue and be in force, until the first day of January, which will be in the year of our Lord, one thousand eight hundred and eleven, and from thence, to the end of the then next Seffion of the Provincial Parliament, and no longer.

Pierre, in Saint Paul's Bay, and the Parishes of Saint Ferréol and Saint

MOST GRACIOUS SOVEREIGN.

HEREAS a road of communication between the Parish of Saint Pierre, in Saint Paul's Bay, and the Parishes of Saint Ferréol and Saint Joachim, would be of great benefit to agriculture and commerce in general; and that the fame has been fixed and regulated by the Procès Verbal of the Deputy Grand Voyer of the District of

Quebec,

après le fait commis, et non après, et feront recouvrables, avec les frais, de la même manière que d'autres dettes de la même valeur font recouvrabies dans cette Province, par poursuite, bill, plainte ou information; moitié de toutes lefquelles pénalités, amendes et confifcations (excepté celles qui font autrement appliquées par cet Acte) après avoir été recouvrées, fera payée entre les mains du Receveur Général, pour l'ufage de Sa Majefté, pour le foutien du Gouvernement de cette Province, et il en fera tenu compte à Sa Majefté par la voie des Commiffaires du Tréfor de Sa Majefté, pour le tems d'alors, en telles manière et forme que Sa Majesté ordonnera, et l'autre moitié à toute perfonne qui en fera la poursuite.

XIX. Et qu'il foit de plus ftatué par l'autorité fufdite, que fi quelqu'action ou pourfuite eft commencée contre aucune perfonne ou perfonnes pour quelque chose faite en conformité de cet Acte, telle action ou pourfuite fera commencée dans l'efpace de fix Mois de Calendrier du tems que l'offenfe aura été commise, et non après, et le Defendeur ou les Défendeurs, dans telle Action ou Pourfuite, pourront plaider flue générale, et donner cet Acte et la matière fpéciale en évidence dans tout procès qui aura lieu à cet effet, et que la chofe a été faite en conformité et fous l'autorité de cet A&e; et fi elle paroit avoir été ainfi faite, alors la Cour décidera en faveur du Défendeur ou des Défendeurs; et fi le Demandeur eft debouté ou difcontinue fon action, après que le Défendeur ou les Défendeurs auront comparu, ou fi le jugement eft rendu contre le Demandeur, le Défendeur ou les Défendeurs recouvreront triples dépens, et auront le même recours pour iceux que les Defendeurs ont par la Loi dans d'autres cas.

XX. Et qu'il foit de plus ftatué par l'autorité fufdite, que cet A&te fera et continuera d'être en force jufqu'au premier jour de Janvier, qui fera dans l'an de Notre Seigneur mil huit cent onze, et de là jufqu'à la fin de la Seffion alors prochaine du Parlement Provincial, et pas plus longtems.

Quebec, dated the fifteenth, fixteenth, feventeenth, eighteenth and nineteenth of September, one thousand eight hundred and fix, duly homologated according to law. And whereas it is expedient and neceffary, that a fum fhould be granted to affift in opening the faid Road and in erecting the neceffary Bridges thereon. May it therefore please Your Majefty that it be enacted, and it is hereby enacted by the King's Moft Excellent Majefty, by and with the advice and confent of the Legiflative Council and Affembly of the Province of Lower Canada, constituted and affembled by virtue of, and under the authority of an Act of the Parliament of Great Britain, paffed in the thirty firft year of His Majefty's reign, intituled, "An A& to "repeal certain parts of an Act, paffed in the fourteenth year of His Majesty's "reign," intituled An Act for making more effectual provifion for the Government of the Province of Quebec, in North America," " and to make further provifion for the Government of the faid Province," and it is hereby enacted by the authority of the fame, that it fhall be lawful for the Governor, Lieutenant Governor, or the Perfon adininiftering the Government of this Province, for the time being, to caufe to be paid to the Grand Voyer of the District of Quebec, or to his Deputy, Out of any of the unappropriated monies which now are, or fhall at any time hereafter, be in the hands of the Receiver General of this Province, a fum of four hundred and fifty Pounds current money of this Province, to be by him employed and expended to affift in opening the above mentioned Road of Communication, between the Parish of Saint Pierre, in Saint Paul's Bay, and the Parishes of Saint Ferréol and Saint Joachim, and to affift in conftructing the neceffary Bridges, as fixed and regulated by the above mentioned Procès Verbal.

H. Provided always and be it further enacted by the authority aforefaid, that no part of the above mentioned fum, be employed upon any part of the faid road which is confidered as a front road (chemin de front) of any of the lands already conceded, nor on any Bridge of any fuch part of the faid Road, nor upon any part of the faid Road or Bridges, where the Procès Verbal above mentioned, obliges the Seignior or Seigniors of the lands where the said Road paffes, to open or caufe the fame to be opened according to law.

III. And be it further enacted by the authority aforefaid, that the faid Grand count to the Go- Voyer, or his Deputy, shall render an account from time to time, when thereunto required, to the Governor, Lieutenant Governor, or Perfon administering the Government of this Province for the time being, of the application of such monies, in fuch manner and form as the Governor, Lieutenant Governor or person adminiltering the Government of this Province, fhall direct and appoint.
