III. And be it further enacted, that the faid Trustees or Survivors of them or any three or more of them, at the first General meeting of the Trustees aforefaid, to be held at the City of Montreal, on the firft Monday in May, One Thousand eight Hundred and Five, or at any of their other meetings as herein after authorised, fhall and may erect or caufe to be erected, a Gate or Turnpike, on or across the faid Highway or Road, and may alfo erect or build, or leafe or otherwise agree for a Toll House, at fuch place as thall be fixed by the faid Trustees, or any three or more of them, at a general meeting, and may cause the faid Turnpike or the faid Toll House to be, from time to time, if need be, taken down, removed or altered as they or any three or more of them, at fuch meeting, fhall judge proper, and may demand, take and receive the Tolls and Rates following, before any faddle Horse, Mare or Gelding, or any Waggon, Wain Cart or other fuch Carriage or any Coach, Chariot, Landau, Chaife, Phaeton, Gig, Calafh, Chair or other fuch wheel Carriage be permitted, (as after mentioned) to pass through the faid Gate or Turnpike, that is to fay: For every Horfe, Mare or Gelding with a Rider, the fum of Four pence currency. For every Waggon, Wain Cart or other fuch wheel Carriage, (unless the fame be exempted in manner after mentioned) drawn by one or two Horfes, Oxen or other Beast of draught, if the fame be loaded in whole or in part, and ifthe wheels thereof fhall have fellies of the breadth of five inches English measure, (taken from the outside to the outfide, of the iron or irons furrounding or fhoeing the faid fellies, or if not fhoed, then to be measured across fuch part of the faid fellies as fhall be on a line or flat furface,) the fum of Eight Pence currency, or if the fellies fhall be of a leffer breadth, when fo measured, the fum of Twelve Pence currency: and further for any additional number of Horfes or Beasts of draught by which they are drawn, Four Pence currency, each For every Coach Chariot, Landau, Chaise, Phaeton, Gig, Calafh, Chair, or other fuch wheel Carriage drawn by two Horfes, Mares or Geldings, the fum of Twelve Pence currency, and further, for any additional number by which they are drawn, Four Pence currency, each. For every wheel Carriage of any fuch laft-mentioned defcription, drawn by one Horfe, Mare or Gelding, the fum of Eight Pence currency. And fuch Tolls and Rates, printed or written, fhall be pofted up at each Toll Gate, in fuch fituation and manner as to be diftinct and visible to perfons paffing the fame.

IV. Provided always, and it is further enacted, that no Cart or other wheel Carriage of any defcription, going to market on any Tuesday, Thursday or Friday, along any part of the faid Road, with the produce of the farm or ground of the perfon to whom fuch Cart or Carriage belongs, nor in returning from market on any

Et qu'il foit de plus ftatué par l'autorité fufdite, que les dits Syndics ou leurs Survivans, ou trois ou plus d'entr'eux, à la première affemblée générale des Syndics fufdits qui fera tenue dans la Cité de Montréal le premier Lundi de Mai, Mil huit cent cinq, ou à quelqu'autres de leurs affemblées, tel que ci-après autorifé, pourront ériger ou faire ériger une Barrière ou Tourniquet fur ou à travers le dit Chemin, et pourront auffi ériger et bâtir ou affermer, ou autrement entrer en marché pour une Maifon de Péage en tel lieu qui fera fixé par les dits Syndics, ou trois ou plus d'entr'eux, à une Affemblée générale, et pourront, de tems à autre, fi befoin eft, faire abattre, enlever ou changer la dite Barrière ou Tourniquet, ou la dite Maifon de Péage, ainfi qu'eux ou trois ou plus d'entr'eux le jugeront convenable dans telle Affemblée, et pourront demander et recevoir les Péages et Taux fuivans avant qu'aucun Cheval de Selle, Jument ou autre Cheval ou aucun Chariot, Charette ou autre semblable voiture, ou aucun Caroffe, Char, Landau, Chaife, Phaeton, Cabriolet, Calèche ou toute autre femblable voiture roulante, comme ci-après mentioné, ait permiffion de paffer par la dite Barrière ou Tourniquet, c'est-à-dire : Pour chaque Cheval ou Jument avec un Cavalier, la Somme de quatre deniers courant. Pour chaque Chariot, Charette ou autre femblable voiture roulante, à moins qu'elle n'en foit exempte en la manière ci-après mentionnée, tiré par un ou deux Chevaux, Boeufs ou autres Bêtes de Somme, fi elle eft chargée en tout ou partie, et fi les Roues ont les jantes de la largeur de cinq pouces mefure Angloife (à prendre de dehors en dehors du bandage en fer des dites jantes, ou fi elles ne font point férées, alors à mefurer à travers telle partie des dites jantes qui fera fur une ligne ou furface plate) la Somme de huit deniers courant, ou fi les jantes ont moins de largeur lorfqu'elles feront ainfi mesurées, la Somme de douze deniers courant, et de plus pour tout plus pour tout nombre additionel de Chevaux ou bêtes de fomme par lequels elles feront tirées, quatre deniers courant chaque. Pour chaque Caroffe, Char, Landau, Chaise, Phaëton, Cabriolet, Calèche ou autre voiture femblable roulante tiré par deux Chevaux, Juments ou autres Chevaux, la fomme de douze deniers courant, et de plus pour tout nombre additionel par lesquels ils feront tirés, quatre deniers courant chaque; Pour chaque voiture roulante d'une description femblable à la dernière mentionée, tirée par un Cheval ou Jument, la Somme de huit deniers courant; Et tels Péages et Taux imprimés ou écrits feront affichés à chaque Barrière de péage er tel endroit et de telle manière qu'ils puiffent être vus diftinctement des per fonnes qui y pafferont.

V. And be it further enacted, that in cafe, the Trustees or any three or more erect more than of them, at a general meeting, fhall, after twelve months experience, think it likely

to benefit the Tolls and Rates, (the charges of collection confidered,) that more than one Gate or Turnpike should be erected, then and in fuch cafe they are hereby authorised to erect the fame in the fituation or fituations that they fhall think moft fit. Provided always, that no perfon fhall thereby be fubjected to the payment of a greater Toll or Rate in the whole between Montreal and La Chine, if going through all the Gates in one day, than by this A&t is chargeable, if there fhall be but one Gate, and the Regulations in other refpects regarding one Gate as hereby established, fhall, in like manner, extend to the whole, but the whole Toll fhall be payable at the Gate firft paffed through, and no abatement or return of Tolls shall be made by reasons of not proceeding through more than one Gate.

VI. And be it further enacted, that the money fo to be raised and collected as &c. vefted in the aforefaid, together with the faid Gates or Turnpikes, and the Toll Houses, shall be and are hereby vefted in the faid Trustees, and the faid money, and every part thereof, fhall be paid and applied to and for the uses and purposes by this Act directed, and it shall and may be lawful to and for the faid Trustees, or fuch perfon or persons as they or any three or more of them, fhall, from time to time, nominate and appoint, to demand and take the Tolls and Rates hereby granted and made payable.

VII. And be it further enacted, that it shall and may be lawful to and for the faid Trustees, or any three or more of them, at a general meeting affembled, to choose and appoint a fit perfon or perfons to be, Collector or Collectors, and fome other fit perfon to be Treasurer and Clerk to the faid Trustees, for receiving the Tolls and Rates granted and made payable by this Act, and alfo, if need be, a fit perfon, to be Surveyor and Overseer of the faid Road, and from time, to time, to remove the perfons fo appointed, or any of them, and appoint new ones in cafe of death or luch removal: and all and every person or perfons, who is or are or 'fhall

V. Et qu'il foit de plus ftatué par l'autorité fufdite, que dans les cas où les Syn- ront ériger plus dics ou trois ou plus d'entr'eux, à une affemblée générale, croiront, après une expérience de douze mois, pouvoir tirer un plus grand avantage des Péages et Taux, eu égard aux frais de la collection, en érigeant plus d'une Barrière ou Tourniquet, alors et dans tel cas, ils font par le préfent autorifés de les ériger dans l'endroit ou les endroits qu'ils croiront les plus convenables. Pourvu toujours, qu'aucune perfonne ne fera par là affujettie à payer un plus fort Péage ou Taux pour tout le Chemin entre Montréal et La Chine en paffant par toutes les Barrières en un feul jour, que ce qui peut être exigé par le préfent Acte s'il n'y a qu'une feule Barrière, et les Règlemens qui, à d'autres égards, ont rapport à une feule Barrière telle. que par le préfent établie, s'étendront de la même manière fur le tout, mais tout le péage fera payable à la Barrière par où on paffera premièrement, fans qu'il foit fait de déduction ou remboursement de péage, par la raison qu'on aura paffé que par une Barrière.

VI. Et qu'il foit de plus flatué par l'autorité fufdite, que les dits Syndics feront, comme ils font par le préfent Acte, inveftis de l'Argent qui fera ainfi prélevé et recueilli comme fufdit, ainfi que des dites Barrières et Tourniquets, et des Maifons de Péage, et le dit Argent, et chaque partie d'icelui fera payé et employé aux ufages et fins dirigés par cet Acte, et il fera et pourra être loisible aux dits Syndics ou à telle perfonne ou perfonnes qu'eux ou trois ou plus d'entr'eux nommeront et appointeront, de tems en tems, de demander et prendre les Péages et Taux par le préfent accordés et rendus éxigibles.

VII. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'il fera et pourra être loifible aux dits Syndics ou à trois ou plus d'entr'eux en affemblée générale, de choifir et nommer une perfonne ou des perfonnes convenables pour être Collecteur ou Collecteurs, et quelqu'autre perfonne convenable pour être Tréforieret Greffier des dits Syndics, à l'effet de recevoir les Péages et Taux accordés et rendus éxigibles par cet A&te, et auffi, fi befoin eft, une perfonne convenable pour être Infpecteur et Surintendant du dit Chemin, et de deftituer, de tems à autre, les perfonnes ainfi nommées ou aucune d'elles, et d'en nommer d'autres dans le cas de mort ou de telle

fhall be liable by this Act to pay the faid Tolls or Rates, is and are hereby requi red to pay the fame unto the faid Collector or Collectors fo appointed: and the faid Collector or Collectors fhall, on the firft Tuesday of every month or at any other time to be appointed by the faid Trustees or any three or more of them, as aforefaid, give into their faid Treasurer and Clerk, all Monies or Notes or Tickets reprefenting Monies, which he or they fhall have received, and verify the fame upon oath if required (which oath and every other oath required by this Act, any Juftice of the Peace for the District of Montreal is hereby authorised to adminifter,) to be disbursed and laid out in improving and repairing the faid Road, and the faid Trustees or any three or more of them, as aforefaid, at a general meeting affembled, fhall and may, and they are hereby authorised and empowered out of the money arifing by the faid Tolls or Rates, to make fuch allowance unto their Treasurer and Clerk, Surveyor and Overfeer and Collector or Collectors, for and in confideration of their care and pains in the execution of their faid respective offices, as they fhall think juft and reasonable, but they fhall make no charge or allowance for their own trouble therein, and the faid Trustees or any three or more of them, may and they are hereby authorised if they fhall think fit, to take such fecurity from their Treasurer and Clerk, and from the Collector or Collectors, as they may deem expedient.

VIII. And be it further enacted, that all and every fum and fums of money to der of the Truf. be laid out and expended, under the authority of this A&t, fhall be paid upon the order of the Trustees or any three or more of them, at a general meeting affembled, or upon the order or approval of two or more of fuch Truftees, as may be appointed, (and which they are hereby authorifed, from time to time to appoint,) at fuch meeting, fpecially to fuperintend and direct the improvement and repairs gene rally agreed upon to be executed, and the faid Trustees fhall, by their Treasurer and Clerk, keep an exact account of the money received by virtue of this Act, and the application thereof, and all other their proceedings, and fhall cause the fame to be entered in a book or books, to be kept for that purpose, which book or books every person who has contributed or shall contribute, or who fhall lend any monies for the faid Road, fhall at all reasonable times be at liberty to infpect, without fee or reward, and the faid Treasurer and Clerk as often as he fhall be thereunto required by three or more Trustees, fhall make out and deliver to them at a general meeting, a true and particular account in writing under his hand, of all monies which he shall have received, paid and disbursed by virtue of this Act, and verify the fame upon oath, if required, in the manner herein before mentioned in refpect to the Collectors.

IX. And be it further enacted, that if any perfon or perfons fhall maliciously break down, pull up or otherwife deftroy or injure any Turnpike, Gate, Poft, Chain, Bar or other Works whatsoever, or any Toll Houfe erected, made or leafed for the use of the Turnpike, or abuse or maltreat any Collector or Toll Gatherer, or shall rescue any Person in cuftody for any fuch offence, every perfon fo offending in
