Public A&t. XII. And be it further enacted by the authority aforefaid, that this A&t, shall be deemed a Public Act, and fhall be Judicially taken notice of as fuch, by all Jud. ges, Juftices and other perfons whomfoever, without being specially pleaded. Preamble, Claufe in A& 9. recited. CA P. XXV. AN ACT more effectually to provide for the making, altering and repairing the Highways and Bridges, within the Inferior District of Gafpé, and to repeal fo much of an Act, paffed in the thirty-fixth year of His Majefty's Reign, intituled, "An Act for making, repairing and altering "the Highways and Bridges within this Province, and for other purpofes as regards the faid Inferior Diftrict. WH (14th April, 1808.) 'HEREAS that part of an Act, made and paffed in the Legiflature of this Province, in the thirty-fixth year of His prefent Majefty's Reign, intituled, 36 Geo.111. Cap. An A&t for making, repairing and altering the Highways and Bridges within this "Province, and for other purpofes," which provides for the Highways and Bridges in the Inferior District of Gafpé, has, from experience, been found insufficient ; in order therefore to facilitate the making, repairing and altering of the faid Highways and Bridges within the faid Inferior District: Be it enacted by the King's Moft Excellent Majefly, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of, and under the authority of an Act, paffed in the Parliament of Great Britain, intituled, " An Act to repeal certain parts of an Act, paffed in the four"teenth year of His Majesty's Reign, intituled, "An Act for making more effectual provifion for the Government of the Province of Quebec, in North America ;" and "to make further provifion for the Government, of the faid Province;" And it is hereby enacted by the laid authority, that fo much of the aforefaid Act, of the thirty-fixth of His prefent Majefty, as is contained in the thirty-fifth clause thereof, and which authorifes the Judge of the Provincial Court of Galpé, with three Justices of the Peace and the Grand Voyer for the faid Inferior Diftrict of Gaspé, to make and conclude, in their discretion, Bye Laws and Regulations for laying out, making and repairing Highways and Bridges within the fame, and which directs, that no perfon fhall be obliged to contribute more than twelve days labour, in any year, towards the making and repairing of Highways and Bridges, which fhall be neceffary to be made by joint labour; and every matter and thing in the faid Clause contained be and the fame are hereby epealed, and that, from and after the paffing of this Act, all and every the regula So much of the A& 36 Geo. 111. Cap. 9 which has seference to Gafpe, repealed and the other provi. fions of the Act extended to the Inferior Diftria of Gafpé. and provifions in and by the faid in part recited XII. TTENDU que cette partie d'un Acte fait et paffé dans la Légiflature de cette ATTENDU Province, dans la trente-fixième année du Règne de Sa préfente Majefté, intitulé, "Acte pour faire, réparer et changer les grands Chemins et Ponts dans cette "Province, et pour d'autres effets," qui pourvoit pour les grands Chemins et Ponts dans le Diftrict Inférieur de Gaspé, a été trouvé, par expérience, infuffifante; afin donc de faciliter les moyens de faire, réparér et changer les dits grands Chemins et Ponts, dans le dit District Inférieur: Qu'il foit ftatué par la très Excellente Majef té du Roi, par et de l'avis et confentement du Confeil Législatif et de l'Affemblée de la Province du Bas-Canada, conftitués et affemblés en vertu et fous l'autorité d'un Acte paffé dans le Parlement de la Grande Bretagne, intitulé, “ A&te qui rappelle "certaines parties d'un Acte paffé dans la quatorzième année du Règne de Sa Ma jefté, intitulé," Alte qui pourvoit plus efficacement pour le Gouvernement de la Pro"vince de Québec, dans l'Amérique Septentrionale," Et qui pourvoit plus amplement "pour le gouvernement de la dite Province;" Et il eft par le préfent ftatuée par la dite autorité, qu'autant du fufdit Acte de la trente-fixième de Sa préfente Majefté, qui eft contenu dans la trente-cinquième claufe d'icelui, et qui autorife le Juge de la Cour Provinciale de Gafpé, avec trois Juges de Paix et le Grand Voyer pour le dit Diftrict Inférieur. de Galpé, de faire et établir, à leur difcrétion, des règles et réglements pour tracer, faire et réparer les grands Chemins et Ponts dans le dit Diftrict, et qui enjoint qu'aucune perfonne ne fera obligée de donner plus de douze journées de travail dans chaque année, pour faire et réparer les grands Chemins et Ponts qui demanderont a être faits en travail commun, et toute matière et chofe contenues dans la dite Claufe, feront et font, par le préfent Acte, abrogés; Et que, dépuis ét après la paffation de cet A&te, tous et chacun des règlements et provifions faits par Mm a l'A&e Préambulé. Duty of the Grand Voyer. recited A&t made for the making, repairing and altering the Highways and Bridges in the feveral Country Parishes, Seigniories and Townships within this Province, and the powers and duties thereby given and prescribed to and for the Grand Voyer, or his Deputy, and alfo, the nomination, powers and duties of Surveyors and Overfeers of Roads and Bridges, be, and the fame are hereby extended to the feveral Parishes, Seigniories and Townships within the faid Inferior Diftrict of Gafpé, in in as full and ample a manner, as if the faid inferior Diftrict had been therein fpecially named and expreffed, and under the fame pains, penalties and forfeitures imposed by the faid Act, to be fued for, recovered and applied, as by the said A& is directed, in fo far as the fame may not be herein after particularly expreffed and declared. II. And be it further enacted by the authority aforefaid, that the ratification of all Procès Verbaux to be hereafter drawn up and made by the Grand Voyer of the faid inferior District of Gafpé or his Deputy, fhall be profecuted by the faid Grand Voyer or his Deputy, before the Juftices in their General Seffions of the Peace held in and for the faid Inferior Diftrict of Gafpé, at the feveral places, and in the manner herein after mentioned; that is to fay; at Carleton, in the Bay of Chaleurs, where the Procès Verbal may concern any Highway or Bridge within that part of the faid Inferior District, to the Weftward of the great River Cafcapedia; at Bonaventure, in the Bay of Chaleurs; where the Procès Verbal may concern any Highway or Bridge within that part of the faid Inferior District, extending from the Eaft fide of the faid Great River Cascapedia, as far down in the faid Bay of Chaleurs as the Weft fide of Point Mackarel; and at Percé, where the fame may concern any Highway or Bridge within that part of the faid Inferior Diftrict, to the Eaftward and North. ward of Point Mackarel aforefaid; and on the Coaft of the River Saint Lawrence, as far as the faid inferior Diftrict extends; and all offences committed against the. aforefaid Act of the thirty-fixth of His prefent Majefty, within the said Inferior District, fhall be profecuted and fued for in the refpective limits aforefaid, in which the offender or offenders may refide, and not elsewhere, and the faid General Seffions of the peace, for the faid inferior Diftrict, fhall have the fame jurifdi&tion, powers and authority as in and by the faid Act are given and granted to the Courts of General Quarter Seffions of the Peace, in the other Districts of this Province, re Jative to the country parishes. III. And be it further enacted by the authority aforefaid, that the Grand Voyer or his Deputy for the faid inferior Diftrict of Gafpé, fhall make his annual circuit, through the highways within the fame, in the manner and for the purposes prescribed and declared by the faid Act of the thirty fixth of His prefent Majefty, to and for the Grand Voyers of the feveral Diftricts of this Province, the faid circuit to be made at the times and in the manner following; that is to say; between the twen tieth day of May and the twenty fifth day of July, he shall travel over and vifit the highways l'Acte en partie ci-dessus récité, pour faire, réparer et changer les grands Chemins et Ponts dans les différentes Paroiffes, Seigneuries et Townships des campagnes dans cette Province, et les pouvoirst devoirs donnés et prefcrits par iceux, au Grand Voyer ou à fon Député, et auffi la nomination, les pouvoirs et devoirs des Infpecteurs et Sous Voyers des Chemins et Ponts, feront et font, par le préfent, étendus. aux différentes Paroiffes, Seigneuries et Townships dans le dit District Inférieur de Gafpé, d'une manière auffi parfaite et auffi ample que fi le dit District Inférieur y eut été spécialement nommé et exprimé, et fous les mêmes peines, pénalités et confifcations impofées par le dit Acte, dont la pourfuite, le recouvrement et l'appliration fe feront en la manière ordonnée par le dit Acte, excepté en autant que le contraire n'est pas ci-après particulièrement exprimé et déclaré. Manière de pour. du logations des procês verbaux Grand Voyer de Gafpé, II. Et qu'il foit de plus ftatué par l'autorité fufdite, que l'homologation de tous Procès Verbaux qui feront ci-après dreffés et faits par le Grand Voyer du dit Dif- fuivre les homotrict Inférieur de Gafpé, ou fon Député, fera pourfuivie par le dit Grand Voyer ou fon Député, devant les Juges de Paix dans les Seffions Générales de la Paix tenues dans et pour le dit Diftrict Inférieur de Gaspé, aux différentes places et en la manière ci-après mentionnées, favoir: à Carleton, dans la Baie des Chaleurs, lorfque le Procès Verbal aura rapport à quelque Chemin ou Pont dans cette partie du dit District Inférieur, à l'Ouest de la Grande Rivière Cafcapédia; à Bonaventure, dans la Baie des Chaleurs, lorfque le Procès Verbal pourra concerner quelque Chemin ou Pont dans cette partie du dit District Inférieur qui s'étend depuis le côté de l'Ef de la dite Grande Rivière Calcapédia, en defcendant dans la dite Baie des Chaleurs, jufqu'au côté de l'Oueft de la Pointe au Maquereau; Et à Percé, lorsqu'il pourra concerner quelque Chemin ou Pont dans cette partie du dit District Inférieur, à l'Eft, et au Nord de la Pointe au Maquereau fufdite, et fur la côte du fleuve Saint Laurent, auffi loin que s'étend le dit Diftrict Inférieur; Et toutes les offenfes commifes contre Je fufdit Acte, de la trente-fixième de Sa préfente Majefté, dans le dit Diftri& Inférieur, feront pourfuivies dans les limites refpe&tives fufdites, dans lefquelles le: contrevenant ou les contrevenants pourront réfider, et non ailleurs; et les dites Seffions Générales de la Paix pour le District Inférieur, auront la même jurifdiction et les mêmes pouvoirs et autorité qui font donnés et accordés par le dit Acte, aux Cours de Seffions Générales de Quartier de la Paix, dans les autres Diftricts de cette Province, relativement aux Paroiffes de campagne. III. Et qu'il foit de plus ftatué par l'autorité fusdite, que le Grand Voyer ou fon Député pour le dit Diftrict Inférieur de Gafpé, fera fa tournée annuelle dans les Grands Chemins du dit District, en la manière et pour les objets prescrits et déclarés par le dit Acte de la trente-fixième de Sa préfente Majefté, pour les Grands Voyers des différents Diftricts de cette Province, laquelle dite Tournée fera faite aux tems et en la manière qui fuivent, c'eft-à-dire; entre le vingtième jour de Mai et le vingt-cinquième jour de Juillet, il paffera pour faire fa vifite par les chemins et Ponts Preamble. highways and bridges on the Weft fide of Point Mackarel, in the Bay of Chaleurs, from Port Daniel to Great Nouvelle, in the Township of Carleton; and between the tenth and thirty first days of Auguft, he fhall travel over and vifit the highways and bridges on the Eaft fide of Point Mackarel aforefaid, from Great Pabos, as fat as the Town of Percé, at the entry of the Bay of Gaspé. AN ACT to provide for the maintenance of good order on Sundays and (14th April, 1808.) WHEREAS it is neceffary to provide, in a special manner, for the mainte nance of good order within and without the Churches and Chapels and in the environs thereof in the refpective Parishes of this Province, on Sundays and Holidays. Be it therefore enacted by the Kings Moft Excellent Majefty, by and with the advice and consent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of and under the authority of an Act, passed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an Act paffed in the fourteenth year of His Majefty's Reign, "intituled, "An Act for making more effectual provifion for the Government of the "Province of Quebec in North America;" and to make further provifion for the "Government of the faid Province;" and it is hereby enacted by the faid authority, that from and after the paffing of this Act, it shall be the duty of the three feverat Duty of Church perfons who fhall laft have executed and difcharged the truft and Office of Church Warden, in each of the Parishes in this Province, to keep up and maintain good order in the Church or Chapel of each of the faid Parishes, refpectively, as well within and without the faid Churches or Chapels as in the environs thereof; and the faid three ancient Church Wardens, in the difcharge of the faid duty of Overseers, shall be replaced in the manner following; that is to fay; at the end of each year the eldeft in Office of the aforefaid three ancient Church Wardens, thall be discharged of fuch duty, and fhall be replaced, in that capacity of Overfeer, by the perfon who fhall then come out of the faid Office of Church Warden; and all and every fuch ancient Church Warden, Overfeer as aforefaid, who fhall refufe or neglect to do the duties, so impofed upon them in their capacity aforefaid, fhall incur and pay, for every negle & or refusal, a fum that fhall not be less than ten fhillings, nor exceed twenty fhillings.
