moted by the erection of a Bridge from Repentigny, in the County of Leinster, to the Ifland, called Bourdon, to communicate with two other Bridges to be rebuilt from the faid Ifland to Lachenaye, and to the Ifland of Montreal, by the authority of an A&t of the Provincial Parliament, made and passed in the forty fifth year of His Majefty's reign, intituled, An Act to authorife Thomas Porteous, Efquire, to build a Bridge over a branch of the River Outaouais, otherwife, des Prairies from Lacheσε naye, to the Ifland, called Bourdon; and another Bridge from that Iland to the Is land of Montreal; to establish the rates of Toll, payable thereon, and for regulating "the faid Bridges." May it therefore please Your Majefty that it may be enacted and be it enacted by the King's Moft Excellent Majesty, by and with the advice and con. fent of the Legiflative Council and affembly of the Province of Lower Canada, conftituted and affembled by virtue of and under the authority of an Act paffed in the Parliament of Great Britain, intituled, An Act to repeal certain parts of an "Act paffed in the fourteenth year of His Majefty's reign," intituled, “ An A for making more effectual provifion for the Government of the Province of Quebec, in "North America," " and to make further provifion for the Government of the "faid Province," and it is hereby enacted by the authority of the fame, that it shall be lawful for the faid Thomas Porteous, and he is hereby authorifed and empowered, at his own costs and charges, to erect and build a good and fubftantial Bridge over the faid River Outaouais, otherwife des Prairies, from the bank or fhore, at Repentigny aforesaid, to the faid Ifland, Bourdon, at fuch conve nient place as the faid Thomas Porteous may find beft adapted to the purpose, and to erect and build one or more Toll Houfe or Toll Houfes and Turnpike or Turnpikes, with other conveniencies, on or near the faid Bridge; and alfo, to do, per form and execute all other matters and things requifite and necflary, ufelul or convenient, for erecting and building, maintaining and fupporting the said intended Bridge, Toll Houfes, Turnpikes and conveniencies, according to the true meaning and tenor of this Act: and further, that for the purpose of erecting building, maintaining or fupporting the laid Bridge, the faid Thomas Porteous, his heirs, executors, curators and affigns, fhall, from time to time, have full power and authority to take and use the land, on either fide of the faid river, and there to work up or caule to be worked up the materials and other things neceffary for erecting, conft.ucting or repairing the laid Bridge accordingly: he the faid Thomas Porteous, his heirs, execu tors, curators or affigns, and the perfons by him or them employed, doing as little damage as may be, and making realonable and juit fatisfaction to the respective owners and occupiers of all fuch ands and grounds as fhail be altered, damaged or made ufe of, by means of and for the purpose of erecting the laid Bridge; and in cafe of difference and diipute about the quantum of fuch fatisfaction, the fame fhall be fettled by His Majefty's Court of King's Bench, of and for th: District of Montreal, after a previous vifitation, examination and eftimation of the premites, fhall have been made by Experts, to be named by the Parties relpectively and in default of fuch nomination by them, or either of them, then by the faid Court, in manner and form prefcribed by law, for the nomination and appointment of Experts in Civil Suits at Law; and the faid Court is hereby authoriied and empowered to hear,

doivent être rebâtis entre la dite Ifle et Lachenaie, et jufqu'à l'Ile de Montréal, fous l'autorité d'un Acte du Parlement Provincial fait et paflé dans la quarante-cinquième année du Règne de Sa Majefté, intitulé, "Acte qui autorife Thomas Porteous Ecuyer, ❝ à bâtir un Pont fur une branche de la rivière des Outaouais, autrement des Prairies, entre Lachenaie et l'Ifle nommée Bourdon, et un autre Pont entre cette Ifle et l'Ile de "Montréal, qui établit des Taux du péage payable fur iceux, et qui pourvoit à des règle"ments pour les dits Ponts," augmenteroit de beaucoup la commodité et la facilité de la communication entre les habitans des Paroiffes voisines et du public en géné. ral: Qu'il plaise donc à Votre Majefté qu'il puiffe être ftatué, et qu'il foit ftatué par la très Excellente Majefté du Roi, par et de l'avis et confentement du Confeil Légiflatif et de l'Affemblée de la Province du Bas-Canada, conftitués et affemblés en vertu et fous l'autorité d'un Acte paffé dans le Parlement de la Grande Bretagne, intitulé," A&te qui rappelle certaines parties d'un Acte paffé dans la quatorzième "Année du Règne de Sa Majefté, intitulé, " Acte qui pourvoit plus efficacement pour le Gouvernement de la Province de Québec, dans l'Amérique Septentrionale;" "Et qui pourvoit plus amplement pour le Gouvernement de la dite Province;" Et il eft par le préfent ftatué par l'autorité fufdite, qu'il fera loifible au dit Thomas Porteous, et il eft par le préfent autorifé et a pouvoir d'ériger et bâtir, à fes propres frais et dépen, un Pont folide et fuffifant fur la dite Rivière des Outaouais, autrement des Prairies, depuis la Rive ou le bord de la Rivière de Repentigny fufdite, jusqu'à la dite Ifle Bourdon, à telle place convenable que le dit Thomas Porteous trouvera la mieux adaptée à l'objet, et d'ériger et conftruire une ou plufieurs Maifons de péage, et une ou plufieurs Barrières avec d'autres dépendances fur ou près du dit Pont, et auffi de faire et exécuter toutes autres matières et chofes requifes et néces faires, utiles ou commodes pour ériger et conftruire, entretenir et foutenir le dit Pont projetté, Maifons de péage, Barrières et autres dépendances fuivant la teneur et le vrai fens de cet Acte, et deplus afin de parvenir à eriger, bâtir et entretenir ou foutenir le dit Pont, le dit Thomas Porteous, fes Héritiers, Exécuteurs, Curateurs et ayans caufe auront plein pouvoir et autorité de prendre, de tems à autre, et de fe fervir du Terrein foit d'un côté ou de l'autre de la dite Rivière, et là de travailler ou faire travailler les matériaux et autres chofes néceffaires à l'érection, conftruction ou réparation du dit Pont, en conféquence le dit Thomas Porteous, fes Heritiers, Exécuteurs, Curateurs ou Ayans cause, et les perfonnes par lui ou par eux employées caufant auf peu de dommage que poffible, et accordant une compenfa tion jufte et railonnable aux Propriétaires ou Occupants refpectifs de tous tels Terreins qui feront changés, endommagés ou mis en ufage pour ériger le dit Pont, et en cas de différence d'opinion et de conteftation fur le montant de telle compenfation, il fera règié par la Cour du Banc du Roi de Sa Majefté pour le Diftri&t de Montréal, après que vifite, examen et eftimation des lieux auront été préalablement faits par des experts, qui feront nommés par les parties relpectivement, et à défaut de telle nomination par elles ou aucune d'elles, alors par la dite Cour, en telles manière et forme prefcrites par la Loi, pour la nomination d'experts dans les caufes civiles et la dite Cour eft par le préfent autorifée et a pouvoir d'entendre, règler et finalement déterminer le montant de telle compenfation en conféquence. Provided always, that the faid Bridge, fhall not be erected until the Bridges, from Lachenaye, to the aforementi oned Illand, and thence to the Ifland of Montreal, which were heretofore erected by the authority of the A&t of the Provincial Parliament herein before recited, and which were fubfequently carried away by the ice, fhall have been rebuilt and open. ed for the passage of Travellers; and Provided alfo, that an open fpace, fhall be left between the Pillars of faid Bridge, of at least one hundred and fifty feet for the fafe and commodious paffage of Rafis.

II. And whereas it may be neceffary for the purpose of effecting a communication with the faid Bridge, to change the direction of the King's highway, in the vi cinity thereof, or to open a new highway or highways. Be it further enacted by the authority aforefaid, that it fhall be lawful for the Grand Voyer, or his deputy of the faid Diftrict of Montreal, to fend an order to the Surveyor of highways, in every Parish through which the faid King's highway or highways may pafs, to be by him read and published in the ufual manner, at the Church door of every fuch Parish ; in which order the faid Grand Voyer or his Deputy, fhall require the perfons interested in the King's highway or highways to meet, on the day and at the hour and place which he fhall fix, to give fuch information as they may judge neceffary or proper, and after fuch meeting, the faid Grand Voyer, or his Deputy, fhall go upon the fpot to change the direction of fuch part or parts of the faid King's highway or highways or bye loads, and open fuch other highways or highways, bye road or bye roads as may be neceffary for communicating with the faid Bridge; and the faid Grand Voyer, or his Deputy, fhall fix and allot the work to be performed, and by whom, upon fuch parts of the King's highway or highways to be so as aforefaid changed, and upon fuch highway or highways, bye road or bye roads, which fhall be opened as a forefaid, of all which he fhall make his Procès Verbal to be heard, examined and determined upon, in due courfe of law.

III. And be it further enacted by the authority aforefaid, that the faid Bridge and the faid Toll Houfes, Turnpikes and conveniencies to be erected thereon, or near thereto, and alfo the afcents and approaches to the faid Bridge, and all materials which fhall be from time to time gotten or provided, for erecting, building, making, maintaining and repairing the fame, fhall be vefted in the faid Thomas Porteous, his After the expi heirs and affigns for ever. II. Et attendu qu'il peut être néceffaire, à l'effet d'effectuer une communication avec le dit Pont, de changer la direction du chemin du Roi dans les environs d'icelui, ou d'ouvrir un ou plufieurs nouveaux chemins de Roi: Qu'il foit de plus ftatué par l'autorité fufdite, qu'il fera loifible au Grand Voyer ou à fon Député du dit ger la direction District de Montréal d'envoyer fon Ordre à l'Infpecteur des grands chemins de cha que Paroiffe, par où le dit ou les dits chemins de Roi pafferont, pour être par lui lu et publié en la manière ordinaire, à la porte de l'Eglife de toute telle Paroiffe, dans lequel ordre le dit Grand-Voyer ou fon Député, requerra les perfonnes intéreffées dans le chemin ou les chemins de Roi, de s'affembler à l'heure et au lieu qu'il fixera, afin de donner telle information qu'ils jugeront néceffaire et convenable, et après telle affemblée, le dit Grand-Voyer ou fon Député, fe tranfportera fur le lieu, pour changer la direction de telle partie ou parties des dits chemins de Roi ou Routes, et ouvrir tel autre chemin ou chemins, Route ou Routes qui feront néceffaires pour communiquer avec le dit Pont, et le dit Grand Voyer ou son Député fixera et répartira l'ouvrage à exécuter, et par qui il fera fait et exécuté fur telles parties du chemin ou des chemins de Roi ou Route qui devront être ainfi comme fufdit changés, et fur tel grand chemin ou chemins ou route qui feront ouverts comme fufdit, dont et du tout il dreffera fon Procès verbal pour être entendu et examiné, et être fur ce déterminé en conféquence fuivant le cours de la Loi.

Pourvu qu'après l'expiration de cinquante années, à compter depuis la paflation de cet Acte, il fera et pourra être loifible à Sa Majefté, fes Héritiers et Succeffeurs de reprendre la poffeffion et propriété du dit Pont, Maisons de péage, Barrières et autres dépendances ainfi que des abords et montées à icelui, en payant au dit Thomas Porteous, fes Héritiers, Exécuteurs, Cu- au rateurs ou Ayans caufe, l'entière et pleine valeur qu'il pourra avoir et valoir au tems de telle prife de poffeffion, et lors et auffi-tôt que le dit Pont fera érigé et confruit, et fait d'une manière propre et convenable pour le paffage des voyageurs, etconvenablepour beftiaux et voitures, ce qui fera certifié par deux ou plus des Juges de Paix, pour

authorifed to take of Montreal, after examination thereof, by three Experts, to be appointed and fworn by the faid Juftices, and to be advertised in the Quebec and Montreal Gazettes, it fhall be lawful for the faid Thomas Porteous, his heirs, executors, curators and affigns, from time to time and at all times, to aík, demand, receive, reco. ver and take to and for their own proper ufe and behoof, for Pontage, as or in the name of a Toll or Duty, before any paffage over the faid intended Bridge, fhall be permitted, at and after the fame rates as mentioned in the aforementioned A&t, of the forty fifth year of His prefent Majefty, chapter fourteenth, for paffing the fame, and one or other of the Bridges, therein mentioned, either to Lachenaye or to the Ifland of Montreal.

IV. Provided always and be it further enacted by the authority aforefaid, that no Perfon, Horfe or Carriage, employed in conveying a Mail or Letters, under the authority of His Majefty's Poft Office, nor the Horfes, Carriages, laden or not laden, and Drivers attending Officers and Soldiers of His Majefty's Forces, or of the Militia, nor the faid forces or Militia men, whilft upon their march or on duty, nor Carriages and Drivers attending on the Guard fent with Prisoners of any defcription, be chargeable with any Toll or rate whatsoever. Provided alfo, that it fhall and may be lawful for the faid Thomas Porteous, his heirs, executors, curators and affigns, to diminish the said tolls, or any of them, and afterwards, if he or they fhall fee fit, again to augment the fame, or any of them, fo as not to exceed, in any case, the rates herein before authorised to be taken. Provided alfo, that the faid Thomas Porteous, his heirs, executors, curators or affigns, fhall affix or caufe to be affixed, in fome confpicuous place, at or near each Toll gate, a Table of the rates, payable for paffing over the faid Bridge, and fo often as such rates may be diminished, or augmented, he or they fhall caufe fuch alteration to be affixed in manner aforefaid..

V. And be it further enacted by the authority aforefaid, that the faid Tolls fhall be, and the fame are hereby vefted in the faid Thomas Porteous, his heirs and affigns for ever. Provided, that if His Majefty fhall, in the manner herein before mentioned, after the expiration of fifty years, from the paffing of this Act, affume the poffel fion and property of the faid Bridge, Toll Houfes, Turnpikes and conveniencies, and the afcents and approaches thereto, then the faid Tolls fhall, from the time of fuch aflumption, appertain and belong to His Majefty, his Heirs and Succeffors, who fhall, from thence forward, be fubftituted in the place and ftead of the faid Thomas Porteous, his heirs and affigns, for all and every the purposes of this Act.

VI. And be it further enacted by the authority aforefaid, that if any perfon fhall forcibly pass through the faid Turapike or Turnpikes, without paying the Toll or any part thereof, or fhall interrupt or disturb the faid Thomas Porteous, his heirs, executors, curators or affigns, or any perfon or perfons employed by him or them, for building or repairing the faid Bridge, or for making or repairing the way over the
