II. And be it further enacted by the authority aforefaid, that all and every subvoluntarily enter- ject of his Majefty who, from and after the paffing of this Act, fhall voluntarily enter into France, or any part of the Dominions thereof, or into any country in alliance with France, or any part of the Dominions of fuch country, or into any fame regulations country in the occupancy or under the countroul of the arms of France or of her allies, fhall, upon his or her arrival in this Province, obey and perform all and every part of the Act hereby continued which refpects Aliens, and fhall be liable and fub. ject to all and every the pains and penalties thereby declared and enacted for dif obedience and neglect by any Alien therein defcribed, and the same powers and authority are hereby granted to all and every perfon for the execution of this A& refpe&ting his Majefty's fubjects abovefaid, and in every other refpe&, as were and are granted by the abovementioned A&t hereby continued for the execution of the fame respecting Aliens.

III. And be it further enacted by the authority aforefaid, that it fhall and may fuch frontier pofts be lawful to and for the Governor, Lieutenant Governor, or perfon adminiftering the Government of this Province, from time to time, by and with the advice and confent of His Majefty's Executive Council, by Order or Orders, Proclamation or Proclamations to be illued and published, to require Aliens of any defcription, and all or any other perfon or perfons which fhall in fuch Order or Orders, Proclamation or Proclamations be fpecified, coming into this Province by land or inland navigation, to enter the fame by fuch Frontier, Poft or Pofts, or Place or Places only as fhall therein be designated, and at fuch Frontier, Pofts or Places to make unto fuch perfon or perfons, and at fuch place, houfe or Office as fhall be appointed for that purpose by the Governor, Lieutenant Governor or perfon adminiftering the Government of this Province for the time being, a declaration of their names and profeffions, with fuch particulars refpecting their paft or late refidences and their objects for wishing to enter this Province, as well as fuch other particulars as fhall of them be required by inftructions under the fignature of the Governor, Lieutenant Governor or person administering the Government of this Province for the time being, to the perfon or perfons fo to be appointed to receive fuch declaration, and no Alien or other person of any fuch descriptions as fhall be contained in any fuch Order or Orders, if by fuch Proclamation or Proclamations, Order or Orders, by and with the advice and confent of the faid Executive Council, it fhall be fo di rected, fhall pafs inwards into this Province beyond fuch Frontier-Pofts or places fo defignated, without a passport from the perfon or perfons fo appointed, which pafsport may be given or fulpended till the pleasure of the Governor, Lieutenant Governor or person adminiftering the Government thereon shall be signified to the

II. Et qu'il foit de plus ftatué par l'autorité fufdite, que tout fujet de Sa Majesté qui, depuis et après la paffation de cet Acte, entrera volontairement en France ou dans quelque partie des Domaines d'icelle, ou dans quelque pays en alliance avec la France, ou dans quelque partie des Domaines de tel pays, ou dans quelque pays occupé ou fous le contrôle des armes de la France ou de fes alliés, obéira et fe conformera, à lon arrivée dans cette Province, à toute et chaque partie de l'Acte par le préfent continué, qui a rapport aux Etrangers, et fera affujetti à toutes et chaque que les étrangers, peines et pénalités déclarées et ftatuées par icelui, pour défobéiffance et négligence commise par tout Etranger de la defcription mentionnée au dit Acte, et les mêmes pouvoirs et autorité qui ont été et font accordés par l'Acte ci-deffus mentionné, et qui eft continué par le préfent Acte pour fon exécution, concernant les Etrangers, font par le préfent accordés à toute et chaque perfonne pour l'exécution du préfent Acte, concernant les dits fujets de Sa Majefté, et à tous autres égards.

III. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'il fera et pourra être loifible au Gouverneur, Lieutenant Gouverneur ou à la Perfonne ayant l'Administration du Gouvernement de cette Province, d'ordonner, de tems à autre, par et de l'avis et confentement du Confeil Exécutif de Sa Majefté, par ordre ou ordres, ou par une Proclamation ou des Proclamations qui feront émanées et publiées, que les Etrangers de toute defcription, et toute autre perfonne ou perfonnes quelcon. ques qui feront défignées dans tel ordre ou ordres, Proclamation ou Proclamations, venant dans cette Province par terre ou par la navigation intérieure, y entrent feulement par tel Pofte ou Poftes, Place ou Places fur les frontières qui y feront défignés, et à tels Poftes ou Places fur les frontières faffent à telle perfonne ou perfonnes, et à telle place, Maison ou Bureau qui fera fixé à cet effet par le Gouverneur, Lieutenant Gouverneur ou la Perfonne ayant l'Administration du Gouvernement de cette Province pour le tems d'alors, une déclaration de leurs noms et profeffions, avec telles particularités touchant leurs Domiciles paffés ou leurs derniers Domiciles, et leur objet en défirant d'entrer dans cette Province, ainfi que toutes autres particu larités qui feront exigées d'eux par des inftructions fous la fignature du Gouverneur, Lieutenant Gouverneur ou de la Perfonne ayant l'Administration du Gouvernement de cette Province pour le tems d'alors, à la perfonne ou aux perfonnes qui feront ainfi nommées pour recevoir telle déclaration; Et aucun Etranger, ni aucune autre perfonne de telle defcription qui fera contenue dans tel ordre ou ordres, par telle Proclamation ou Proclamations, Ordre ou Ordres, de l'avis et confentement du dit Confeil Exécutif, il eft ainfi ordonné, ne paffera en dedans de cette Province au delà de tels Poftes ou Places fur les frontières ainfi défignés, fans un paffeport de la perfonne ou des perfonnes ainfi prépolées, lequel paffeport pourra

perfon before whom the declaration above required fhall be made, and fuch passport, when given, fhall fpecify the place to which it is meant to extend, and allow a reasonable time for fuch Alien or other perfon as aforefaid to proceed thither, who, upon his arrival there or within three hours thereafter, fhall produce fuch pafsport to a Juftice of the Peace or to fuch other perfon as fhall be appointed for that purpose by the Governor, Lieutenant Governor or perfon adminiftering the Government of this Province for the time being, and every Alien or other person of any fuch defcription as abovefaid, who fhall wilfully neglect or refufe to make declaration of the aforefaid particulars, or either of them, or who fhall knowingly make any falfe declaration thereof, or shall otherwife act contrary to any of the requirements or obligations hereby imposed, shall, for every fuch offence, be apprehended by the warrant of any one of his Majefty's Juftices of the Peace of the District in which fuch Alien or other person as aforefaid shall be found, and committed to the Gaol of fuch Diftrict, and on conviction before any two or more of his Majefty's Juftices of the Peace for any Diftrict of this Province, fhall be imprisoned for any time not exceeding one month.

IV. And be it further enacted by the authority aforefaid, that it fhall and may be empowered to de lawful to and for the Governor, Lieutenant Governor or perfon adminiftering the Government of this Province for the time being, by warrant under his hand and feal iffued by and with the advice of his Majefty's Executive Council, to order any Alien to be detained in cuftody in this Province in fuch place and in fuch manner as the Governor, Lieutenant Governor or perfon adminiftering the Government of this Province for the time being, fhall fee fit during the continuance of this Act, or until fuch Governor, Lieutenant Governor or perfon adminiftering the Government of this Province for the time being, fhall give other order to the contrary. Provided always, that no Alien fhall be fo imprisoned, unless it fhall, by the advice of the said Executive Council, be declared in fuch warrant that it is dangerous to the fecurity of this Province to send and transport fuch Alien out of the limits thereof.

AN ACT for the better Regulation of the Fifheries in the inferior District of Gaspé, and to repeal an Act or Ordinance therein mentioned.

HEREAS the Fisheries have ever been found beneficial to the Trade of the mother country, as well as of great importance to her Colonies; and Whereas the Lawsnow in force to regulate the faid Fisheries within the inferior District of Gaspé

IV. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'il fera et pourra être loisible au Gouverneur, Lieutenant Gouverneur ou à la Perfonne ayant l'Admi- niftration du Gouvernement de cette Province pour le tems d'alors, par ordre sous fon seing et fceau émané par et de l'avis du Confeil Exécutif de Sa Majefté, de faire détenir fous garde tout Etranger en cette Province, en tel lieu et de telle maniere que le Gouverneur, Lieutenant Gouverneur ou la Perfonne ayant l'Adminiftration du Gouvernement de cette Province pour le tems d'alors, jugera à propos, n'excédant pas la durée de cet Acte, ou jufqu'à ce que tel Gouverneur, Lieutenant Gouverneur ou Perfonne ayant l'Adminiftration du Gouvernement de cette Province pour le tems d'alors, donne un autre ordre au contraire. Pourvu toujours, qu'aucun Etranger ne fera ainfi emprisonné, à moins qu'il ne foit déclaré dans tel ordre, de l'avis du dit Confeil Exécutif, qu'il eft dangéreux à la fûreté de cette Pro. vince d'envoyer et transporter tel Etranger hors des limites d'icelle,

have been found infufficient: in order to ameliorate and amend the fame, Be it therefore enacted by the King's moft Excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of and under the authority of an A& paffed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of an A& paffed in the fourteenth year of his Majefty's Reign, intituled, " An A&t for making more effectual provifion for the Government of the Province of Quebec in "North America," and to make further provifion for the Government of the faid "Province;" And it is hereby enacted by the faid authority, that all and every his Majefty's fubjects fhall peaceably have use and enjoy the freedom of taking bait and of fishing in any river, creek, harbour or road with liberty to go on fhore on any part within the inferior District of Gafpé, between Cap Cat on the South fide of the river Saint Lawrence and the firft Rapid of the River Riftigouche within the faid District, and on the Inland of Bonaventureoppofite to Percé, for the purpose of falting, curing and drying their fifh, to cut wood for making and repairing ftages, flakes, hurdles, cook-rooms and other purposes neceffary for preparing their fith for exportation, or that may be useful to their fishing trade, without hindrance, interruption, denial or molestation from any perfon or perfons whom foever. Provided fuch river, creek, harbour or road, or the land upon which fuch wood may be cut doth not lie within the bounds of any private property by grant from his Majefty or other title proceeding from fuch grant by his Majefty, or by grant made prior to the year one thousand seven hundred and fixty, or held under and by virtue of any location certificate or title derived from any fuch location certificate.

II. And be it further enacted by the authority aforefaid, that the mafter or com mander of every veffel fitted out from the United Kingdom of Great Britain and Ireland, or the Dominions thereunto belonging, may take poffeffion of fo much of the unoccupied beach within the aforefaid inferior District of Gafpé, as may be neceffary for curing his fifh and preparing it for exportation, and to retain and enjoy the fame fo long as he fhall not leave it unoccupied for the space of twelve Calendar months, in which case it shall be lawful for any other person or perfons to take poffeffion thereof in part or the whole, for the fame purposes and on the fame condition. Provided that fuch beach be not private property by grant from his Majefty, or other title proceeding therefrom, or by grant prior to the thousand feven hundred and fixty, or held under and by virtue of any location year one certificate or title derived therefrom. Provided also, that fuch new occupier fhall, when thereunto required by the preceding poffeffor or his lawful attorney, fuch de poffeffion of. mand being made within one year after poffeffion taken, pay him for such part Preceding pof. feffor not having the flakes and ftages, as fuch new occupier fhall have taken poffeffion of.
