fuch owner or owners, part owner or part owners, confignee or confignees or any other person or perfons, acting on the behalf, with the knowledge or under the authority of any fuch mafter or commander, or of fuch owner or owners, part owner or part owners, confignee or confignees, fhall engage or shall receive, harbour or conceal on board of any fhip or veffel or elsewhere, any feaman, landsman or apprentice, feamen, landsmen or apprentices, or any other perfon fo legally engaged as aforefaid, knowing him or them to be fuch, who fhall have deferted as herein before mentioned, or shall, by himself, themselves or any fervant or fervants, agent or agents, by words or with money, or by promises of future reward or compenfation, or by any other ways or means whatfoever, directly or indirectly, entice, prevail upon, procure, perfuade or encourage or endeavour or attempt to entice, prevail upon, procure, perfuade or encourage, any fuch feaman or feamen, landfman or landsmen, apprentice or apprentices, or any other fuch perfon, fo legally engaged as aforefaid, to defert from the fhip or veffel to which he or they may refpectively belong; every fuch mafter or commander, owner and owners, part owner and part owners, confignee and confignees, and all and every other perlon and perfons acting on the behalf, with the knowledge or under the authority of any fuch mafter or commander, owner or owners, part owner or part owners, confignee or confignees, fhall, (on conviction thereof,) for every such offence, fo feit and pay a fum not exceeding Fifty Pounds, nor lefs than Twenty Pounds current money of this Province, at the difcretion of the Court or Magiftrate, before which the faid offence fhall be profecuted, for every feaman, landsman or apprentice or fuch other person fo legally engaged as aforefaid, who fhall be received, harboured, concealed, enticed, prevailed upon, procured, perfuaded or encouraged, or attempted to be enticed Not to affed His prevailed upon, procured, perfuaded or encouraged to defert as aforefaid. Provided Majefty's fervice always, that nothing in this Act contained, fhall extend or be construed to extend by fa or land. fo to affect His Majefty's fervice, by fea or land, as to fubject any feaman or landsman or any other perfon or persons whomsoever, for or in refpect of his or their enHis Majefty's fer. tering into His Majefty's fervice, nor fhall any Officer in his Majefty's lervice, or any other perfon or perfons acting by or on behaif, or in the service of his Majefty, be lubject to any pains, penalty or punishment, wh ch he or they would not have been fubject to, before the paffing of this prefent Statute. And be it further enacted by the authority aforefaid, that upon complaint made upon oath before any one of his Majefty's Juftices of the Peace, by the mafter ves from their du⚫ or commander of any ship or veff, in the merchant fervice, or in his absence, by the chief mate thereof, or by any other perfon having the care or charge of fuch fhip or veffel, that any feaman, landsman or apprentice, or any other perfon legally bound or engaged to ferve on board fuch fh por ve flel, hath delerted therefrom, or hath conveyed away by himte t, or by any other means whatfoever, from fuch fhip or veffel, his clothes or bedding, or thoie of any other feaman, landiınan or appren fonne agiffant en faveur de tel Propriétaire ou Propriétaires, co-propriétaire ou copropriétaires, Facteur ou Facteurs, ou aucune autre perfonne ou perfonnes agiffant pour, avec la connoiffance ou fous l'autorité d'aucun tel Maitre ou Commandant, ou de tel Propriétaire ou Propriétaires, co Propriétaire ou co-Propriétaires, Facteur ou Facteurs, engage ou reçoit, loge ou cache à bord d'aucun navire ou vaiffeau ou ailleurs, quelque matelot, novice ou apprentif, matelots, novices ou apprentifs, ou aucune autre perfonne ainfi légalement engagée comme fufdit, les connoiffant pour tels, qui auront déferté tel que ci deffus mentioné, ou qui par lui-même, euxmêmes ou aucun domeftique ou domeftiques, ou quelque Agent ou Agents, par paroles ou avec de l'argent, ou par promeffes de récompenfe future, ou de compenfa tion, ou par aucune autre voie ou moyens quelconques, directement ou indirectement, incitera, engagera, excitera, perfuadera ou encouragera, ou s'efforcera ou ellayera d'inciter, d'engager, d'exciter, de perfuader ou d'encourager tels matelot ou matelots, novice ou novices, apprentif on apprentifs, ou aucune telle autre perfonne ainfi légalement engagée comme fufdit, à déferter du navire ou vaiffeau auquel il appartiendra ou ils appartiendront refpectivement, chaque tel Maitre ou Commandant, Propriétaire et Propriétaires, co Propriétaire et co-Propriétaires, Facteur et Facteurs, et toutes et chaque autre perfonne et perfonnes agiffant en faveur, avec la connoiffance ou fous l'autorité d'aucun tel Maitre ou Commandant, Propriétaire ou Propriétaires co-Propriétaire ou co-Propriétaires, Facteur ou Facteurs, fur conviction de l'offense, encourra et payera, pour chaque telle offense, une somme n'excédant point cinquante livres, ou n'étant pas moins de vingt livres argent cou rant de cette Province, à la difcrétion de la cour ou du Magiftrat devant laquelle la dite offense aura été pourfuivie, pour chaque matelot, novice ou apprentif ou telle autre perfonne ainfi légalement engagée comme fufdit, qui fera reçu, logé, caché, ou qui aura été débauché, engagé, incité, perfuadé ou encouragé, ou que l'on aura effayé d'exciter, d'engager, d'inciter, de perfuader ou d'encourager à déferter comme fufdit; Pourvu toujours, que rien dans cet Acte contenu ne s'étendra, ou ne fera entendu s'étendre à affecter le fervice de Sa Majesté fur terre ou fur mer, de manière à affujettir aucun matelot ou novice, ou aucune autre perionne ou perfonnes quelconques à ou eu égard à son ou à leur entrée au fervice de Sa Majefté, et aucun officier au fervice de Sa Majefté, ou aucune autre perfonne ou perfonnes agiffant par ou en faveur, ou au fervice de Sa Majesté ne feront fujets à aucunes peines, pénalités ou punitions auxquelles ils n'auroient pas été fujets avant la paffation du préfent ftatut. de tout navire ou vaiffeau. Cet A&te n'affec. tera en aucune manière le fervi. ce de Sa Majesté fur terre ou fur mer, n'empèchera point les matelots d'entrer au fervi ce de Sa Majesté, et n'affujettira point aucun offis cier à des pénalités. Procédés contre les matelots &c. fentés de leur de. voir. IV. Et qu'il foit de plus ftatué par l'autorité fufdite, que fur plainte faite fur ferment devant un des Juges de Paix de Sa Majefté, par le Maitre ou Commandant de tout navire ou vaiffeau dans le fervice marchand, ou en fon abfence, par le qui fe feront ab fecond d'icelui, ou par aucune autre personne ayant le foin oa la charge de tel navire ou vaiffeau, qu'un matelot, novice ou apprentif ou aucune autre perfonne légalement engagée pour fervir à bord de tel navire ou vaiffeau, en eft déferté, ou aura emporté par lui-mème, ou par quelqu'autre moyen quelconque, de tel navire ou vaiffeau, fes hardes ou lit, ou celles de quelqu'autre matelot, novice ou appren tice, or any other perfon fo legally engaged as aforefaid, or belonging to the faid mafter or commander, mate or mates, or to the owner or owners of fuch fhip or veffel, (fuch feaman, landfman or apprentice, or any fuch other perfon as laft aforesaid) doing so, with the view, defign or intention of deferting or of aiding, affisting, promoting or facilitating the defertion of any other perfon or perfons lawfully en gaged to ferve on board any fuch fhip or veffel or that fuch feaman, landf man or apprentice, or other fuch perfon or perfons, fo legally engaged, hath abfented himself, from fuch fhip or veffel without leave firft obtained from the faid mafter or commander for the fpace of three hours, after the rifing of the fun, and before the fetting thereof, or for the space of fix hours after the fetting of the fun, or for fix hours fucceeding each other, although fuch laft mentioned hours fhall commence before the fetting of the fun, (unless the perfon or perfons fo abfent. ing him or themselves, fhall by the terms of his or their engagements have con. tracted for an abfence of longer duration than herein before mentioned,) or hath and ftill doth refufe to do and perform h's duty on board of fuch fhip or veffel or elfewhere, agreable to his articles of agreement or indenture, as the cafe may be, fuch Juftice before whom fuch complaint as aforefaid, for fuch offences or either of them, fhall fo as afor faid be made, fhall, if thereunto required, immediately grant and ifue a Warrant, addreffed to and authorising and commanding any Conftable or Conftables of the Dftrict, for which fuch Juftice fhall act, to apprehend every fach feaman, landfman or apprentice or other perfon fo legally engaged, and who fhall be fo complained of, as aforefaid, and to bring fuch feaman, landfman, or apprentice or other fuch perfon who had been fo legally en gaged before fuch Juftice, to anfwer unto fuch complaint, and to be further dealt with according to law; and if any fuch feaman, landman or apprentice, or other fuch laft mentioned perfon, fhall, by fuch Juftice be legaily convicted of having deferted from fuch fhip or vellel, or of having abfented himself from fuch fhip or velfel, without leave, as aforefaid, during fuch time as aforefaid, or of having refufed to do and perform his duty on board of such ship or vellel as aforefaid, and before fuch Juftice, fhali refule to return on board fuch fhip or vellel, or to perform his duty as aforelaid, and fhall not affign a fufficient reafon for fuch refafals, and each of them, to the fatisfaction of fuch Juftice, it fhall and may be lawful to and for fuch Juftice, to commit fich feaman, landsman or apprentice or other such person to legally engaged as aforesaid, fo convicted, to the common Gaol or Houfe of Cor rection of the Diftrict, in which fuch conviction fhall be had, for any time not ex ceeding twenty days, then to be returned and put on board the fhip or vellel, in which fuch faman, landsman or apprentice or other fuch perfon, fo legally engaged as aforefaid, fhall be fo as aforefaid bound and engaged to ferve, provided fuch fhip or veifel, fhall not then have taken her departure; and if fuch feaman, landsman or apprentice or other fuch perfon fo legally engaged as aforelaid, fhall, by fach Juftice, be convicted of having conveyed away by himlelf or by any other means whatfoever from fuch fhip or velfel, his clothes or bedding, or thote of other feaman, lanufman or apprentice, or other fuch perfon. fo legally engaged as afore any tif, ou d'aucune autre perfonne ainfi légalement engagée comme fufdit, ou appartenantes au dit Maitre ou Commandant, contre-maitre ou contre-maitres, ou au Propriétaire ou Propriétaires de tel navire ou vaiffeau, (tel matelot, novice ou apprentif, ou aucune autre perfonne comme fufdit, agiffant ainfi dans la vue, le deffein ou l'intention de délerter, ou d'aider, affifter, promouvoir ou faciliter la défertion d'aucune autre perfonne légalement engagée à fervir à bord d'aucun tel navire ou vaiffeau) ou que tel matelot, novice ou 'apprentif, ou telle autre perfonne ainfi légalement engagée fe fera absenté de tel navire ou vaiffeau, fans avoir préalablement obtenu permiffion du dit Maitre ou Commandant, pour trois heures après le lever du foleil et avant le coucher d'icelui, ou pour un espace de fix heures après le coucher du foleil, ou pour fix heures de fuite, quand même les dites heures commenceroient avant le coucher du foleil, à moins que la perfone ou perfonnes qui s'abfenteront ainfi n'ayent contracté, par les termes de leur engagement, pour une plus longue durée que celle ci-devant mentionée, et qu'il aura refufé et refufera encore de faire et exécuter fon devoir à bord de tel navire ou vaiffeau, ou ailleurs, fuivant fes articles de conventions ou brevêt, ainfi que le cas pourra être, le dit Juge de Paix devant lequel telle plainte aura été portée comme fufdit, pour telles offenfes ou une d'elles, accordera et émanera fans délai, s'il en eft requis, un warrant ou ordre addreffé à un ou à des connétables du diftrict pour lequel tel Juge de Paix agira, les autorifant et requérant d'arrêter tout tel matelot, novice ou ap prentif, ou autre perfonne ainfi légalement engagée, et contre lequel il y aura plainte comme fufdit, et d'amener tel matelot, novice ou apprenuf, ou telle autre perfonne qui avoit été ainfi légalement engagée, devant tel Juge de Paix pour répondre à telle plainte, et être enfuite traité conformément à la loi, et fi tel matelot, novice ou apprentif, ou telle autre perfonne fuf-mentionée, eft par tel Juge de Paix légalement convaincu d'avoir déferté de tel navire ou vaiffeau, ou de s'êure abfente fans permiffion de tel navire ou vaiffeau comme fufdit, durant tel tems comme fufdit, ou d'avoir refufé de faire et exécuter fon devoir à bord de tel navire ou vaiffeau comme fufdit, et qui refufera devant tel Juge de Paix de retourner à bord de tel navire ou vaiffeau, ou d'exécuter fon devoir comme fufdit, et ne donnera point de raifons fuffisantes de tel refus et de chacun d'iceux, à la fatisfaction de tel Juge de Paix, il fera et pourra être loisible à tel Juge de Paix d'envoyer tel matelot, novice ou apprentif, ou telle autre perfonne ainfi également engagée comme fufdit, ainfi convaincu, à la prifon commune, ou à la naifon de correction du diftri&t dans lequel telle conviction aura cu lieu, pour un tems n excédant point vingt jours, et il fera alors renvoyé et mis à bord du navire ou vailleau dans lequel tel matelot, novice ou apprentif, ou telle autre perfonne ainfi légalement engagée comme fufdit, fera aiali comme fufdit engagé de fervir, pourvu que t 1 navire oa vaiffeau ne foit point alors parti;
