soch on tier or owners, part owner or part owners, consignee or conGgnees or any other person or petsons, acting cn the behalf, with the knowledge or under the atithority of any such master or commander, or of such owne>- or owners, part owner or part owners, consignee or corsignees, shall engage or shall receive, harbour or conceal on board of any ship or vessel or elsewhere, any seaman, landsman or apprentice, seamen, landsmen or apprentices, or any other person so legally engaged as aforesafd, knowing him or them to be such, who shall h^ve deserted as herein before mentioned, or (hall, by hin-self, themselves or any servant or servants, agent or agents, by words or with money,or by promises of future reward or compensation, or by any other ways or means whatsoever, directly or indin ctly, entice, prevail upon, procure, persuade or encourage or endeavour or attempt to entice, prevail upon, procure, persuade or encourage, any such seaman or seamen, landsman or landsmen, apprentice or apprentices, or any other such person, so legally engaged as aforesaid, to desert from the ship or vessel to which he or they may respectively belong; every such master or commander, owner and owners, part owner and part owners, consignee and consignees, and all and every other perlon and persons acting on the behalf, with the knowledge or under the authority of any such master or commander, owner or owners, part owner or part owners, consignee or consignees, shall, (on conviction thereof,) for every such offence, fo feit and pay a sum net exceeding Fifty Pounds, nor less than Twenty Pounls current money of this Province, at the discretion of the Court or Magistrate, before which the said offence shall be prosecuted, for every seaman, landsman or apprentice or such other person so legally engaged as aforesaid, who shall be received, harboured, concealed, enticed, prevailed upon, procured, persuaded or encouraged, or attempted to be enticed prevailed upon, procured, persuaded or encouraged to delertas aforesaid. Provided always, that nothing in this Act contained, shall ex.end or be construed to extend ;so to affect His Majesty's service, by sia or land, as to subject any seaman or landsman or any other person or persons whomsoever, for or in respect of his or their entering into His Majesty's service, nor shall any Officer in his Majesty's tervice, or any other person or persons acting by or on behaif, or in the iervice of his Majesty, be lubject to any pains, penalty or punishment, wh ch he or they would not hare been subject to, before the passing of this present Statute.

sonne agissant en faveur de tel Propriétaire ou Propriétaires, co-propriétaire ou copropriétaires, Facteur ou Facteurs, ou aucune autre personne ou personnes agissant pour, avec la connoissance ou fous l'autorité d'aucun tel Maitre ou Commandant, ou de tel Propriétaire ou Propriétaires, co-Propriétaire ou co-Propriétaires, Facteur ou Facteurs, engage ou reçoit, loge ou cache à bord d'aucun navire ou vaisseau ou ailleurs, quelque matelot, novice ou apprentis, matelots, novices ou apprentifs, ou aucune autre personne ainsi légalement engagée comme susdit, les connoissant pour tels, qui auront déserté tel que ci dessus mentioné, ou qui par lui-même, euxmêmes ou aucun domestique ou domestiques, ou quelque Agent ou Agents, par paroles ou avec de l'argent, ou par promesses de récompense future, ou de compensation, ou par aucune autre voie ou moyens quelconques, directement ou indirect?ment, incitera, engagera, excitera, persuadera ou encouragera, ou s'efforcera ou essayera d'inciter, d'engager, d'exciter, de persuader ou d'encourager tels matelot ou matelots, novice ou novices, apprentis ou apprentifs, ou aucune telle autre personne ainsi légalement engagée comme susdit, à déserter du navire ou vaisseau auquel il appartiendra ou ils appartiendront respectivement, chaque tel Maitre ou Commandant, Propriétaire et Propriétaires, co Propriétaire et co-Propriétaires, Facteur et Facteurs, et toutes et chaque autre personne et personnes agissant-en faveur, avec la connoissance ou fous l'autorité d'aucun tel Maitre ou Commandant, Propriétaire ou Propriétaires co-Propriétaire ou co-Propriétaires, Facteur ou Facteurs, fur conviction de l'offense, encourra et payera, pour chaque telle offense, une somme n'excédant point cinquante livres, ou n'étant pas moins de vingt livres argent courant de cette Province, à la discrétion de la cour ou du Magistrat devant laquelle la dite offense aura été poursuivie, pour chaque matelot, novice ou apprentis ou telle autre personne ainsi légalement engagée comme (usdit, qui fera reçu, logé, caché, ou qui aura été débauché, engagé, incité, persuadé ou encouragé, ou que l'on aura essayé d'exciter, d'engager, d'inciter, de persuader ou d'encourager à déserter comme susdit; Pourvu toujours, que rien dans cet Acte contenu ne s'étendra, ou ne fera entendu s'étendre à affecter le service de Sa Majesté sur terre ou sur mer, de manière à assujettir aucun matelot ou novice, ou aucune autre perlonne ou personnes quelconques à ou eu égard à son ou à leur entrée au service de Sa Majesté, et aucun officier au service de Sa Majesté, ou aucune autre personne ou personnes agissant par ou en faveur, ou au service de Sa Majesté ne feront lujets à aucunes peines, pénalités ou punitions auxquelles ils n'auroient pas été sujets avant la passation du présent statut.

IV. Et qu'il soit de plus statué par l'autorité susdite, que sur- plainte faite sur ferment devant un des Juges de Paix de Sa Majesté, parle Maitre ou Commandant de tout navire ou vaisseau dans le service marchand, ou en (on absence, par le second d icelui, ou par aucune autre personne ayant le soin ou la charge de tel navire ou vaisseau, qu'un matelot, novice ou apprentis ou aucune auire personne légalement engagée pour servir à bord de tel navire ou vaisseau, en est déserté, ou aura emporté par lui-même, ou par quelqu'autre moyen quelconque, de tel navire ou vaisseau, se» hardes ou lit, ou celles de quelqu'autie matelot, novice ou appren

de tout navire > vaisseau.

Cet Acte n'aflec. tera co aucune manière le servi» ce de Sa Majesté sur terre ou sur mer, n'empêchera point les matelot! d'entrer au servi, ce de Sa Majesté-, et n'assujettira point aucun offi* cier à de» pénalité».

tice, or any other person so legally engaged as aforesaid, or belonging to the said master or commander, mate or mates, or to the owner or owners of such ship or vessel, (such seaman, landsman or apprentice, or any such other person as last aforesaid) doing so, with the view, design or intention of deserting or of aiding, assisting, promoting or facilitating the desertion of any other person or persons lawfully engaged to serve on board any such ship or vessel or that such seaman, lands, man or apprentice, or other such person or persons, so legally engaged, hath absented himself, from such ship or vessel without leave first obtained fiom the said master or commander for the space of three hours, after the rising of the sun, and before the setting thereof, or for the space of six hours after the setting of the sun, or for fix hours succeeding each other, although such last mentioned hours shall commence before the setting of the sun, (unless the person or persons so absent, ing him or themselves, shall by the terms of his or their engagements have coo. tracted for an absence of longer duration than herein before mentioned,) or hath and still doth refuse to do and perform h s duty on board of such ship or vessel or elsewhere, agreable to his articles of agreement or indenture, as the case may be, such Justice before whom such complaint as aforesaid, for such offences or either of them, shall so as afor said be made, shall, if thcreun.o required, immediately grant and i.Tue a Warrant, addressed to and authorising and commanding any Constable or Constables of the D strict, for which such Justice shall act, to apprehend every s.,ch seaman, landsman or apprentice or other person so legally engaged, and who shall be so complained of, as aforesaid, and to .bring such seaman, landsman, or apprentice or other such person who had been so legally en. gaged before such Justice, to answer unto such complaint, and to be further deal? with according to law; and if any such seaman, landlmwn or apprentice, pr other such last mentioned person, shall, by such Justice be legally convicted os having deserted from such ship or vessel, or ot having absented himseif from such ship or vessel, without'leave, as aforesaid, during such time as aforesaid, or of having refused to do and perform his duty on board of such fh p or vessel as aforesaid, and before such Just e.", shall rcsule io return onboard such ship or vessel, or to perform hi] duty as aforelaid, and Hull not assign a sufficient reason for such rtf isals, and each of them, to the satisfaction of such Justice, it shall and may be lawful to and for such Justice, to commit s ch seaman, landsman or apprentice or other such person so legally engage i as aforeLi J, so convicted, to the common Gaol or House of Collection of the District, in which such conviction shall be had, for any .time no( ejj ceeding twenty days, then to be ictumed and put on board the ship or vessel, in which sui h kaman, landsman or apprentice or other such person, so legally engaged as afoteSaid, (ha I be so as aforesaid bound and engaged to serve, .provided such fliip or vessel, shift, not then have taken her departure j and if spety seaman,' landsman or apprentice or other such person so leg illy engaged as aforelaid, shall, by such Justice, be comicted ot having*convtved away by bimlelf or by any oiher Queans whusoever from such ship or vessel, h'« cluihes* or beddings or thole of any other seaman, lanusman or apprentice,, or oiher such person, so,"legally engigscla^ ,a/ore'- •■ - i • i ... i . * .1- « I >. . j. .

îif, ou d'aucune autre personne ainsi légalement engigée comme susdit, ou appartenantes au dit Maitre ou Commandant, contre-maitre ou contre-maitres, ou au Propriétaire ou Propriétaires de tel navire ou vaisseau, (tel matelot, novice ou apprentis, ou aucune autre personne comme susdit, agissant ainsi dans la vue, le dessein ou l'intention de déserter, ou d'aider, assister, promouvoir ou faciliter la désertion d'aucune autre personne légalement engagée à servir à bord d'aucun tel , navire ou vaiffeau) ou que tel matelot, novice ou'apprentis, ou telle autre personne ainsi légalement engagée se sera absenté de tel navjre ou vaisseau, sans avoir piéalablement obtenu permission du dit Maitre ou Commandant, pour trois heures après le lever du soleil et avant le coucher d'icelui, ou pour un espace de six heures après le coucher du soleil, ou pour six heures de fuite, quand même les dites heures commenceroient avant le coucher du soleil, à moins que la perfonie Ou personnes qui s'absenteront ainsi n'ayent contracté, par les termes de leur engagement, po »r une plus longue durée que celle ci-devant mentionée, et qu'il aura refusé et refusera encore de faire et exécuter son devoir à bord de tel navire ou vaisseau, ou ailleurs, suivant ses articles de conventions ou brevet, ainsi que le cas pourra être, le die Juge de Paix devant lequel telle plainte arra été portée comme susdit, pour telles offenses ou une d'elles, accordera et émanera fans délai, s'il en est requis, un warrant ou ordre addreffé à un ou à des connétables du district pour lequel tel Juge de Paix agira, les autorisant et requérant d'arrêter tout tel matelot, novice ou apprentis, ou autre personne ainsi légalement engagée, et contre leq iel i! y aura plainte comme susdit, et d'amener tel matelot, novice ou apprentis, ou telle autre personne qui avoit été ainsi légalement engagée, devant tel Juge de Paix pour répondre à telle plainte,et être ensuite traité conformément à la loi, et si tel matelot, novice ou apprentis, ou telle autre personne sus-mentionée, est par tel Juge de Paix légalement convaincu d'avoir déserté de tel navire ou vaiffeau, ou de s'être absente fan» permission de tel navire ou vaiffeau comme susdit, durart tel tems comme susdit, ou d'avoir refusé de faire et exécuter son devoir à bord de tel navire ou vaisseau comme susdit, et qui refusera devant ni Juge de Paix de retcurnsr à bord ài tel navire ou vaisseau, ou d'exécuter son devoir comme susdit, et ne donnera point de raisons sussiïantes de tel refus et de ch. cun d'iceux, à la satisfaction de tel Jugede Paix, il fera et pourra être loisible à tel Juge de Paix d'envoyer tel matelot, novice ou apprentis, ou telle autre personne ainsi légalement engagée comme susdit, ainsi convaincu, à la prison commune, ou à la marlon de correction du district dans lequel telle conviction aura eu Heu, pour un tems n excédant point vingt jours, et il fera alors renvoyé et mis à boid du navire ou vaisseau dans lequel tel matelot, novice ou apprentis, ou telle autre personne ainsi légalement engagée comme susdit, sera ainsi comme susdit engagé de lervir, pourvu que t l navire ou vaisseau rie soit point alors parti; Et fi tel matelot, novice ou apprentis, ou telle autre personne ainsi légalement engagée comme fuldir, est convaincu par ni Jugede Paix d'avoir enltvc par lui-même ou par quelqu'auire moyen quelconque, de tel navire ou vaisseau, ses hard' s ou fou ht, ou celles de queiqu'aotre matelot, novice ou apprentis, ou de quelqu'autie perlonne ainsi légalement engagée comme susdit, ou appaitenantes said, or belonging to the master or commander, mate or mates, or to the owner or owners of such ship or veflel, it shall and may be lawful to and for such Justice to commit such seaman, landsman or apprentice, or other luch person so legally en. gaged as aforesaid, so convicted to the common Gaol or House of Correction of the District in which such conviction shall be had, for any time not exceeding thirty days, then to be returned and put on board the ship or vessel in which such seaman, landsman or apprentice, or other such person so legally engaged as aforesaid, shall be so as aforesaid bound or engaged to serve, provided such ship or vessel shall not then have taken her departure; And if any such seaman, landsman or apprentice.or other such person so legally engaged as aforesaid, so as aforesaid convicted of any or either of the offences afo-esaid, shall thereafter be legally convicted by and before any Justice as aforesaid, of having deserted from such ship or veflel, or of having abiented himself from such ship or vessel without leave as aforesaid, during such time as aforesaid, or of having refused to do and perform his duty on board of luch ship or veflel as aforesaid, or of having conveyed away by himself; or by any other means whatsoever, from such ship or vessel, his clothes or bedding, or those of any other seaman, landsman or apprentice, or other such person so legally engaged as aforesaid, or belonging to the master or commander, mate.or mates, or to the owner or owners of such ship or vessel, it shall and may be lawful to and for such Justice to commit such seaman, landsman or apprentice, or other such person so legally engaged as aforesaid, so again convicted, to the common Gaol or House of Correction of the District in which such conviction, for such second offence, shall be had, there to remain for the space of forty days, or until the ship or vessel in which such seaman, landsman or apprentice, or other such person shall be so bound ot engaged to serve, shall sail and depart from such District. Provided always, that any such seaman, landsman or apprentice, or other such person so legally engaged as aforelaid, so convicted for such second offence, shall not, by virtue of this Act, be detained in such common Gaol or House of Correction upon such conviction for such second offence, for any time exceeding foity days ; And further that it shall and may be lawful to and for the master and commander of the ship or vessel in which any seaman, landsman or apprentice, or other such person so legally engaged as aforesaid, detained or imprisoned in any such common Gaol or House of Correction, under and by virtue of this Act, is bound or engaged to serve as aforesaid, to have and obtain at any time the discharge of any such seaman, landsman or apprentice, or other such person so legally engaged as aforesaid, so detained or imprisoned for such cause (and for no other) from such common Gaol or House of Correction, upon application for that purpose to the Justice by whom such seaman landsman or apprentice, or other such person so legally engaged as aforesaid, shall have been committed, and such Justice upon such application is hereby authorised and required to release and discharge such seaman, landsman or apprentice, oroiher such person so legally engaged as aforesaid, from such common Goal or House of Correction, by warrant of deliverance under his hand and seal addressed to the keeper of such common Gaol or House of Correction, as the cafe may require.
