No reimburse ment of the capi. tal to be made in a lefs fum than ten per cent, When the Market defraying the expences incurred, and to be incurred, for completing the fame; and further to borrow on legal intereft, a fum of money not exceeding fifteen hundred Pounds, currency, to be applied to the payment of what is at prefent, and may hereafter become due, for the building and finifhing of the faid Market Houf. Provided always, that the whole coft of the building and completing the faid Market Houfe, fhall not exceed the fum of four thousand five hundred Pounds currency, including all the monies already expended, and the debts and monies now due and owing, for and in refpe&t of the faid Market House; and, for fecurity of the capital and intereft of the money which fhall be thus borrowed, it fhall and may be lawful for the faid Trustees, and they are hereby authorifed to enter into obligations, giving fpecial mortgage, in favor of the lenders of the faid monies on the rents, profits and revenues, which fhall arife from the faid Market Houfe, in the manner as is herein after provided; and all fuch obligations may be ceded and conveyed by the perfon or perfons, to whom they fhall have been granted to any other perfon or perfons, who fhall thereupon become the proprietor or proprietors thereof, and fhall be vefted with the fame rights, mortgages and privileges, which fhall have been granted to the original lenders, by virtue of fuch obligations. Provided always, that all and every affignee or affignees, fhall deliver to the Treasurer, a copy of the deed by which he or they fhall have become a proprietor or proprietors of fuch obligations, as above faid, within the ten days next after the paffing of fuch deed, and the faid Treasurer is hereby required, to enter a copy thereof, in a Register to be by him kept for that purpose, in order that the said Trustees may at all times. know to whom the fums of money so borrowed, are due. X. And be it further enacted by the authority aforefaid, that it fhall be the duty of the Treasurer, under the direction of the faid Trustees, to pay the intereft of the fums thus borrowed, when the fame fhail become due, and that fo foon as the faid Market Houle fhall be finished, and that fufficient funds fhall come into his hands, from the rents of the faid Market House, it fhall be the duty of the faid Trustees to pay and reimburse to the lenders or affignees of such lenders, the capital of the monies thus borrowed, Provided always, that no reimbursement fhall be made of the Capital of the faid fums, in a lefs proportion, than ten per cent, on the capital, and to each of the creditors of the faid fums, in equal proportions unless it be otherwise agreed upon between the said Trustees and the faid creditors; in which cafe, a minute thereof, fhall be made on the Register fo kept as aforefaid, by the Treasurer which fhall be figned by all the parties. X. Et qu'il foit de plus ftatué par la fufdite autorité, qu'il fera du devoir du Tré forier, fous la direction des dits Sindics, de payer l'intérêt des fommes ainfi emprun. tées, quand il fera dû, et que fitôt après la dite Halle achevée, et que des fonds fuffifants parviendront entre fes mains par les revenus de la dite Halle, il fera du devoir des dits Sindics de rendre et rembourfer aux prêteurs ou aux ceffionnaires de tels prê teurs, le capital des argents ainfi empruntés. XII. And be it further enacted by the authority aforefaid, that the faid Trustees fhall meet once in every year, between the first and the tenth day of April, for the purpose of fixing the rate of the rents at which the Stalls that now are or fhall be built in the faid Market Houfe fhall be put up to fale by Auction, or outcry, and, alfo, for fixing the day, hour and place, for fo proceeding to the fale and adjudication of the faid Stalls, (which day fhall be, between the twentieth of April and the fift of May of each year) and they fhall caufe notice thereof to be given, in the Quebec Gazette, once, and on the Market places of the Upper and Lower Towns of Quebec, by the Public Bellman, two fucceffive days, (that fhall immediately precede the day fo fixed for putting up and adjudging the faid Stalis,) between the hours of nine and eleven o'clock in the forenoon; and the faid Trustees fhall accordingly, proceed, on the faid day, hour and place, thus fixed and announced, to put up by auction or outcry, and adjudge to the highest bidder each of the faid Stalls fepa than what rately. Provided always, that no adjudication fhall be made at a lefs rent than fhall have been fixed by the faid Truftees as aforefaid. And Provided also, that if the whole or part of the faid Stalls are not then let, or if being let, fhould from any unforeseen circumftance remain without a tenant, then and in fuch cafe or cafes, the faid Trustees fhall and they are hereby authorised to meet again, for the purpose of not have been let putting up by Public Auction or outcry, and adjudging foch Stalls to the high ft bidder in the manner herein before mentioned, having previously caufed notice thereof to be given in the manner herein before directed; and the rent of the said Stalls, shall be paid into the hands of the faid Treasurer, every fix months, or otherwife, in fuch manner as the faid Trustees fhall deem moft expedient; and as to the other parts of the faid Market Houfe, the faid Trustees are hereby authorifed to let them to fuch perfons, and at fuch ates, and fubje&t to fuch claufes, and conditions, as they fhall deem moft advantageous either by private agreement or by public out. Provided always, that the leafe or leafes of fuch other part or parts of the faid Market Houfe fhall not in any cafe exceed the term of nine years. And Provided time. Pourvu toujours, qu'aucune adjudication ne pourra être faite moyennant une rente moindre que celle qui aura été fixée par les dits Sindics comme fufdit. Et pourvu auffi, que fi le tout ou par tie des dits étaux n'eft pas alors loué, ou qu'après avoir été loué, il y en ait quelqu'un qui, par quelque circonftance imprévue, refte fans locataire, alors et dans chacun des fufdits cas, les dits Sindics auront l'autorité, comme ils font par le préfent autorisés, de s'affembler de nouveau à l'effet de faire crier et adjuger au plus offrant et dernier enchériffeur, tels étaux de la maniere ci-devant mentionnée, en ayant préalablement fait donner avertiffement par un ban, ainsi qu'il eft ci-deffus dirigé. Et la rente des dits étaux fera payée entre les mains du dit Tréforier tous les fix mois ou autrement, tel que les dits Sindics le jugeront le plus convenable. Et quant aux autres parties de la dite Halle, les dits Sindics font par le préfent autorifes de les louer à telles perfonnes, et pour télsprix, charges, claufes, et conditions qu'ils,trouveront bon être, foit de gré-à gré ou à la crie. Pourvu toujours, que le bail ou les baux de telles autres parties de la dite Halle ne pourra ou ne pourront, en aucun cas, excéder le terme de neuf année. Et pourvu auffi, qu'il fera auffi réfervé de la dite Halle une place de dépot pour mettre les pompes à feu, feaux, et autres uftenciles en dépendans qui font ou feront à l'ufage public. XIII. Trustees empow ered to act as Juftices of the Peace, Truftees may fue Treasurer. alfo, pay any further fum of money, that two Juftices of the Peace in their weekly fittings, before whom the complaint is made, fhall deem a reasonable fatisfaction for the damage done by fuch offenders; and on failure of payment, within ten days after conviction of fuch perfons, the faid Juftices of the Peace are hereby authorised to commit each and every of them to the Houfe of Correction or Common Gaol of the District, for a time which fhall not exceed thirty days. XIV. And be it therefore enacted by the authority aforefaid, that it fhall be lawful for the faid Truflees, acting under the authority of this Act, to act, also, as Juftices of the Peace, for the purposes of carrying this Act into execution. XVI. And be it further enacted by the authority aforefaid, that all persons ofin the name of the fending againft this Act, may be sued by the Treaforer, and all fines and forfeitures recovered fhall be paid to His Majefty's Receiver General, for the use of His Majefty, and fhall be applied to the public ufes of this Province, and the fupport of the Civil Government thereof; and the Juftices of the Peace or any two of them, in their weekly fittings, are hereby authorifed and required to hear and determine on the oath of one or more credible Witnefs or Witneffes, other than the informer, all complaints for offences against this Act. Duty of the Clerk of the Market. XVI. And be it further enacted by the authority aforefaid, that it fhall be the fpecial duty of the Clerk of the Market, and he is hereby required to oversee the carrying into effect, all Rules and Regulations of, and refpecting the faid Market Penalty for ne- Houfe, and to profecute all offences against the fame; and the laid Clerk of the Market for every neglect of duty, fhall be fubject to, and incur a Penalty not exceeding Forty Shillings, anh not lefs than Twenty Shillings current money of this Province. glect. Rents &c. how recoverable. Limitation of action. XVII. And be it further anacted by the authority aforefaid, that the Rents, Fines and Forfeitures which by this A&t fhall become due, fhall be recoverable and levied by feizure and fale of the Goods and Chattels of the debtors or offenders, by Warrant, under the Hands and Seals of any two or more Jftices of the Peace for this Diftrict; and the perfon or perfons authorifed by fich Warrant, to feize fuch Goods and Chattels, is, and are hereby authorifed to feil the fame, returning the overplus money (if any there be,) to the owner of fuch Goods and Chattels, upon demand, after that fuch Rents, Fines and Forfeitures with reasonable colts of fuit, shali have been deducted and paid. XVIII. And be it further enacted by the authority aforefaid, that all offences against this Act, fhall be fued for within one month after the off nce committed, and not afterwards; and in all cafes, where any Action fhall be inftituted against any perion for any matter or thing done in purfuance of this Act, fuch Action fhall be commenced, within one Month next after it fhall be alledged, that the fact was committed |
