meeting on the 1. enfuing the paffing of this A&t, then to enter upon the discharge of their duty: and it fhall and may be lawful for the faid Trustees, to caufe to be prepared and laid before them, a plan of a new Market-houfe with Stalls, to be erected within the faid City of Montreal, upon the new fquare or space ceded as above faid to the Magiftrates of the faid City, and the fame being approved of by the said Trustees, they are hereby authorised to treat and contract for the building of the faid Market-House and Stalls, with fuch perfon or perfons as may be willing to undertake for the fame. Provided always, that no contract fhall be entered into by the faid Truftees, until they fhall, by advertisement, for three weeks in the Quebec Gazette, and fuch other News paper as they shall judge expedient, have given notice, that they are ready to receive proposals in writing for the work to be performed.

III. And be it further enacted by the authority aforefaid, that for defraying the expences of erecting a new Market-Houfe with Stalls as aforefaid, it fhall and may be lawful for the faid Trustees to borrow on legal intereft, a fum of money, not house in the City exceeding two thousand five hundred Pounds currency, to be laid out in part or in whole, in the erecting a fuitable and convenient Market-House with Stalls in the City of Montreal, on the new fquare aforefaid, as to them may appear neceffary. Provided always, that it fhall be lawful for the faid Truftees to lay out fo much of the faid new Market-Houfe, as to them fhall appear neceffary, for the receiving and fafe keeping of one of the Fire Engines belonging to the City of Montreal, with buckets and other implements thereunto appertaining.

IV. And be it further enacted by the authority aforefaid, that for furety of principal and intereft of the money fo to be borrowed, it fhall and may be lawful for the faid Trustees, and they are hereby authorifed, to pass a deed of mortgage to the lenders of the money aforefaid, binding and hypothecating the rents or profits to be derived from the faid new Market-Houfe and Stalls, in manner as is herein after provided; but on no other funds rents or profits whatever fhall the lenders of the money, their Heirs, Executors, Curators or Affigns, have any lien or claim whatsoever, for or by reafon of the money they fhall have fo lent; and the bolders of fuch Mortgages refpectively, may transfer the fame to fuch perfon or perfons as they may think proper, and the transferees fhall have the fame right to payment of intereft and capital, as if he or they had been the original lender or lenders of the money for which the mortgage or mortgages were granted. Provided, that fuch transferees fhall caufe to be notified to the Treasurer of the Trustees by leaving a copy of fuch transfer, with him, that he or they have become proprietor or proprietors of such mortgage or mortgages, and the faid Treasurer fhall enregifter the fame in a book to be by him kept for the purpose.

V. And be it further enacted by the authority aforefaid, that it fhall be the duty

III. Et qu'il foit de plus ftatué par l'autorité fufdite, que pour fubvenir aux dépenses d'ériger une nouvelle Halle de Marché avec des étaux comme fufdit, il fera loifible aux dits Sindics d'emprunter à un intérêt légal, une fomme d'argent n'excédant pas deux mille cinq cents livres courant, pour être employée le tout ou en partie à ériger une Halle de Marché commode et convenable avec des étaux, dans la dite Ville de Montréal fur la nouvelle place fafdite, ainfi qu'il leur paroîtra néceffaire, Pourvu toujours, qu'il fera loifible aux dits Sindics d'approprier telle partie de la nouvelle Halle de Marché qu'il leur paroitra neceffaire, pour la réception et fauve garde d'une des poinpes à feu appartenantes à la Ville de Montréal, avec les fceaux et autres uftenfiles qui en dépendent.

IV. Et qu'il foit de plus ftatué par l'autorité fufdite, que pour la fûreté du capital et de l'intérêt de l'argent qui fera ainfi emprunté, il fera loifible aux dits Sindics, et ils font par le préfent autorifés de paffer contrat portant hypothêque aux prèteurs du fufdit argent, engageant et hypothêquant les rentes ou profits à être perçus de la dite nouvelle Halle de Marché et étaux, de la manière qu'il eft ci-après pourvu; mais fur aucuns autres fonds, rentes ou profits quelconques, ne pourront les prêteurs de l'argent, leurs Hoirs, Exécuteurs, Curateurs ou ayant caufe avoir aucune prétention ou droit quelconque, pour ou en confidération de l'argent qu'ils auront ainfi prêté, et les proprietaires refpectifs de telles hypothêques pourront les tranfporter å telle perfonne ou perfonnes qu'ils jugeront à propos, et les perfonnes en faveur desquelles tels tranfports feront faits, auront les mêmes droits de recevoir l'intérêt et le capital, de même que s'ils étoint les prêteurs origines d l'argent pour lequel telles hypothêques auront été données, pourvu que les perfonnes ainfi propriétaires en donnent notice au Tréforier des Sindics, en lui remettant une expédition du tranfport qui les conftitue propriétanes de telles hypothêques, et le dit Tréforier eft requis d'enregistrer le dit tranfport dans un livre par lui tenu à cet effet.

the faid Trustees fo foon as there fhall be funds in their hands for that purpose, and that the interest of the capital fhall have been paid, to pay off the principal, which, in virtue of and for the purpose of this Act, they fhall have borrowed, and the lenders of the money aforefaid, fhall be bound to receive back the fame in fuch payments and fums of money at a time, as the faid funds may be adequate to and the Truflees fee fit. Provided always, that not lefs of the capital than ten per cent fhall be paid off in one payment, and to all of the lenders, their heirs, executors, curators and affigns, in equal proportions, but it fhall not prevent the faid Trustees from paying a greater proportion to any one or more of the lenders, provided, three fourths in value of the other lenders, their heirs, executors, curators or affigns, fhall thereunto agree.

VI. And be it further enacted by the authority aforefaid, that in order to provide for the repayment of capital fo to be borrowed, and of intereft thereupon arifing, it fhall and may be lawful for the Trustees aforefaid, fo foon as the faid new Market-Houfe, with the Stalls or fuch part thereof as the Trustees fhall think fufficient for the purpose of felling butcher's meat, fhall be completed, to let out by the year or otherwife, the faid Stalls to fuch perfons as may be willing to hire the fame, at fuch rent, as by the Trustees and perfons hiring the fame fhall be agreed upon; or the fame may be let out by Public Auction, and the rent fo agreed upon, either by private bargain or public auction, shall be paid half yearly or otherwise as to the faid Trustees fhall feem expedient, into the hands of the Treasurer to be named and Treafurer to be appointed by the Trustees aforefaid, and they are hereby empowered to remove the faid Treasurer, and to appoint another, and from time to time, to make fuch appointment as thereafter may become neceffary by removal or by death of any Treafurer fo appointed.

VII. And whereas it may for fome time to come be unneceffary to fill up the whole of the faid new Market houfe with Stalls for the fale of butcher's meat, and part of the Stalls which are to be erected may at times remain unlet for that purpose. Be it therefore further enacted by the authority aforefaid, that the space unoccupied by Stalls, as alfo any Stalls unlet for the fale of butcher's meat, may, by the Trustees aforesaid, be let out to hire for the purpose of selling and exposing to fale Grain or any other Provifions, for such rent, as they may deem juft and reasonable, and can agree for; and in like manner, the faid Trustees may let to hire the space under cover along the fides of the faid new Market-house, for the fale of all forts of fruit and vegetables.

VIII. And be it further enacted by the authority aforefaid, that over and above the rent which any person or persons, hiring a Stall or Stalls or other places under cover, in either of the faid Market places, are bound to pay for the fame, it fhall

Et qu'il foit de plus ftatué par l'autorité fufdite, qu'afin de pourvoir au remboursement du capital qui fera ainfi emprunté et de l'intérêt qui en proviendra, il louer les étaux. fera et pourra être loisible aux Sindics fufdits, fitôt que la dite nouvelle Halle de Marché avec les étaux, ou telle partie d'iceux que les Sindics trouveront fuffifants pour y vendre des viandes de boucherie, feront achevés, de louer à l'année ou autrement les dits étaux à telles personnes qui pourront être disposées de les louer, à telle rente que les Sindics et les perfonnes les louant pourront convenir, ou ils pourront être loués par encan public,et la rente ainfi convenue foit de gré-à-gré ou par encan public fera payée tous les fix mois ou autrement, ainfi que les Sindics le jugeront expédient, entre les mains du Tréforier qui fera ci-après nommé et appointé par les Sindics fufdits, et ils font par le présent autorisés de deftituer le dit Tréforier et en nommer un autre à fa place, et de tems à autre de faire telle autre nomination qui pourra devenir néceffaire, foit par deftitution ou déces du Tréforier qui fera ainfi nommé.

VII. Et attendu que d'ici à quelque tems il pourroit n'être point néceffaire d'éri- Les Sindics pourger autant d'étaux pour la vente des viandes de Boucher, que pourroit en contenir taux pour d'aula dite nouvelle Halle, et que d'ailleurs partie des étaux qui feront érigés pourroit de tems à autre n'être pas louée pour cet objet: Qu'il foit donc de plus flatué par de boucherie. l'autorité fufdite, que l'espace de la nouvelle Halle où il ne fera point érigé d'étaux, et auffi les étaux qui ne feront pas occupés pour la vente des viandes de boucherie, pourront être loués, par les Sindics fufdits, à l'effet d'y vendre et expofer en vente des grains ou toute efpece de provifions quelconque, à telle rente qu'ils jugeront jufte et raifonable et qu'ils pourront en obtenir, et de la même manière les dits Sindics pourront louer l'efpace à couvert le long de la dite nouvelle Halle pour la vente des fruits et légumes.

VIII. Et qu'il foit de plus ftatué par l'autorité susdite, qu'en fus et outre la rente que toute perfonne ou perfonnes qui auront loué un étau ou des étaux ou places à couvert dans l'une ou l'autre des dites places de Marché, il fera loifible aux Juges

and may be lawful for the Juftices of the Peace in their Quarter Sellions, in the Terms of January, annually, to establish and allow to the Clerk or Clerks of the aforefaid Markets, fach fees as to them fhall appear to be reasonable; to be paid to the faid Clerk or Clerks of the Market by perfons occupying Stalls or other places under cover in the faid Market places. Provided that fuch Fees fhall be notified before letting faid Stalls or places, under cover, to the person or persons defirous of hiring the fame.

IX. And be it further enacted by the authority aforefaid, that the Treasurer fo to be appointed, fhall, before entering upon his office, give good and fufficient fecurity to the latisfaction of the Trustees, that he fhall faithfully account for all monies he may receive by virtue of this Act, and for the due execution of the trufts repofed in him, by virtue of the fame: and the faid Treafurer fhall be allowed for his trouble, in receiving and paying monies according to the purpofes of this A&, a fum not exceeding twelve pence in the pound on the monies fo paid; and it fhall be lawful for the faid Truftees to alter the allowances to be made to the Treasurer, by increasing or diminishing the fame as they fee fit and reasonable, fo as that the rate abovefaid, be not in any cafe exceeded.

X. And be it further enacted by the authority aforefaid, that from the time that forty Stalls at the leaft fhall be erected as aforefaid, it fhall not be lawful for any perfon or perfons whatfoever to fell or expofe to fale any butchers meat at any place or part, within the City of Montreal, or Suburbs thereof, other than at the faid Stalls, (excepting as herein after provided,) and if any person shall fell or expose to fale any batchers meat at any other part or place within the limits of the City of Montreal, (excepting as herein after provided,) such person fhall forfeit and pay for the first offence, the fum of Ten Shillings currency, and for the second and every fubfequent offence, the fum of Twenty Shillings, alfo, currency of the Province. Provided always, that nothing in this A&t contained fhall extend or be conftrued to extend, to prevent any butcher or other perton from felling any butchers meat in their own fhop or dwelling houfe. Provided alfo, that farmers and other. perfons, not being butchers, may fell and expofe to fale all kinds of butchers meat, grain, poultry, and other provifions in fleighs, carts or other carriages, to be arranged as the Juftices of the Peace fhall direct on the fquare of the old Market place, and on the ftreets bounding the new Market-houfe, on the North Eaft and South Weft fides thereof, in fuch manner, that the Street, called, Notre Dame, and alfo the Street, called, Saint Paul's, fhall, on market days, throughout the whole extent of the faid Streets be kept free and clear of all fuch carts, fleighs or other carriages: And Provided alfo, that for the convenience of the inhabitants of the Western part of the faid City, one range with double Stalls for the fale of butcher's meat shall be preferved upon the prefent Market Place or fquare, in the faid City, fo as that the fame be placed in fuch fituation under the direction of the Magiftrates
