HEREAS An Act was paffed by the Legislature of this Province in the fortyfecond year of His Majefty's reign, intituled, " An Act to empower the Fulti"ces of the Peace to make, for a limited time, rules and regulations for the government of Apprentices and others' the which A&t will expire at the end of the prefent Seffion of the Provincial Parliament. And Whereas it is neceffary that the faid A& fhould be continued, Be it therefore enacted by the King's moft excellent Majefty by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower-Canada, conftituted and affembled by virtue of and under the authority of An Act paffed in the Parliament of Great Britain, intituled, "An A& “ to repeal certain parts of An Ad paffed in the fourteenth year of His Majety's reign, intituled, " An Act for making more effectual provision for the Government "of the Province of Quebec in North America," and to make further provifion for ❝te Government of the faid Province; and it is hereby enacted by the authority of the fame, that the faid Act, intituled, " An Act to empower the Justices of the Peace "to make, for a limited time, rules and regulations for the government of Apprentices " and others" and all matters and things therein contained, fhall continue and be inforce until the first day of January one thousand eight hundred and eleven, and from thence to the end of the then next Seffion of the Provincial Parliament and no the orders under longer. AN ACT to regulate the Provincial Poft Houfes, and to repeal certain WH 186 (16th April, 1807.) THEREAS the Ordinances and Statutes concerning Poft Houfes in this Province, are in many refpects infufficient to furnish carriages and well regulated Pofts for the convenience of Travellers, and it being neceffary to provide more effectually for the fame, and it being alfo expedient to reduce into one act of the Provincial Parliament, the Ordinances and Statutes relating thereto: Be it therefore enacted by the King's moft excellent Majefty by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower-Canada, conftituted and affembled by virtue of and under the authority of An Act paffed in the Parliament of Great Britain, intituled, "An Act to repeal certain parts of An Act pafled "in the fourteenth year of His Majefty's reign, intituled' An An for making more effectual provifion for the Government of the Province of Quebec in North America;" "and to make further provifion for the Government of the faid Province" and it is hereby enacted by the authority aforefaid, that an Ordinance paffed in the twentieth Ordinance 20Geo year of His Majefly's reign, intituled, " An Ordinance for regulating all fuch perfons as keep horfes and carriages to let and hire for the accommodation of Travellers, com"monly called and known by the name of Maitre de Pofte" and alfo another act paffed in the thirty-fifth year of His Majefty's reign, intituled " An Act to amend and make "perpetual, An Act pafled in the twentieth year of His Majefty's reign, intituled, A&t 35 Geo. III. An Ordinance for regulating all fuch perfons as keep horfes and carriages to let and hire for the accommodation of Travellers commonly called and known by the name of "Maitres de Pofte" be and are hereby repealed. III. cap. 4. re. pealed. cap. 7. repealed, Superintendant to have the direction II. And be it further enacted by the authority aforefaid, that the Superintendant of the Provincia! of Provincial Poft-Houfes fhall have the fuperintendance and direction of the PoftHouses to be established, in conformity to this act, and it fhall be his duty to fee the fame carried duly into effect. And be it further enacted by the authority aforefaid, that from and after the first day of June of the prefent year, the faid Superintendant of Provincial PostHoufes fhall eftablifh Poft Honfes, for the convenience of Travellers, between the Cities of Quebec and Montreal, on the North fide of the river Saint Lawrence, and After ift of June the faid Superintendant fhall alfo eftablifh Poft-Houfes in all Places where he fhall be ordered fo to do, by the Governor, Lieutenant Governor or perfon adminiftering the Government of this Province for the time being. ATTENDU que les Ordonnances et Statuts concernant les Maifons de Pofte en cette Province font à plufieurs égards infuffisans pour fournir des voitures et poftes reglées pour la commodité des Voyageurs, et qu'il eft néceffaire d'y pourvoir plus efficacement; et qu'il eft auffi expédient de réduire dans un feul Acte du Parlement Provincial les Ordonnances et Statuts qui y ont rapport: Qu'il foit donc ftatué par la très excellente Majefté du Roi, par et de l'avis et confentement du Confeil Législatif et de l'Affemblée de la Province du Bas-Canada, conftitués et affemblés en vertu et fous l'autorité d'un Acte du Parlement de la Grande Bretagne, intitulé, "Acte qui rappelle certaines parties d'un Acte paffé dans la quatorzième "année du règne de Sa Majefté, intitulé, "Acte qui pourvoit plus efficacement pour "le Gouvernement de la Province de Québec dans l'Amérique Septentrionale" et qui "pourvoit plus amplement pour le Gouvernement de la dite Province;" Et il eft ftatué par la même autorité, qu'une Ordonnance paflée dans la vingtième année du règne de Sa Majefté, intitulée, "Ordonnance qui règle tous les particulièrs qui tien"dront des chevaux et voitures de louage pour la commodité des voyageurs,, vulgairement "appellés et connus fous le nom de Maitres de Pofle" et auffi un autre acte paffé dans la trente-cinquième année du règne de Sa Majefté, intitulé," Acte qui amende et "rend perpétuel un Acte ou Ordonnance paffé dans la vingtième année du règne de "Sa Majefté, intitulé," Ordonnance qui règle toutes telles perfonnes qui tiennent des "chevaux et voitures de louage pour la facilité des Voyageurs, communément appellées et connues fous le nom de Maitres de Pofte" font par le préfent révoqués. Le Surintendant II. Et qu'il foit de plus ftatué par l'autorité fufdite que le Surintendant des Maifons de Pofte Provinciales aura la Surintendance et direction des Maifons de Pofte aura la direction qui feront établies conformément à cet Acte, et il fera de fon devoir de voir que le dit Acte foit duement exécuté. III. Et qu'il foit de plus ftatué par l'autorité fufdite, que depuis et après le premier jour de Juin de la préfente année, le dit Surintendant des Maifons de Pofte Provinciales établira des Maifons de Pofte pour la commodité des Voyageurs, entre les Villes de Québec et Montréal, fur le côté du Nord du Fleuve St. Laurent, et que le dit Surintendant en établira auffi en tous endroits où il lui fera ordonné d'en établir par le Gouverneur, Lieutenant Gouverneur ou la Perfonne ayant l'Adminiftration du Gouvernement de cette Province pour le tems d'alors. des Maifons de Pofte Provincia. les. And be it further enacted by the authority aforefaid, that the faid Superindant of Provincial Poft-Houfes, fhall name and appoint perfons under the name of Maitres and Aides de Pofte, to keep the faid Poft-Houfes, for fuch space of time and in conformity to fuch ftipulations, as fhall be agreed upon between the faid Supe rintendant and the faid perfons, for the due execution of this A&t, and according to the true fenfe and meaning thereof, and for the greater advantage and convenience of Travellers, which time fhall not nevertheless exceed the duration of this A&. Provided always, that when the Poft fhall drive on one fide of any river only, nothing in this Act contained, fhall be confidered as compullory or obligatory on the faid Superintendant, to name or appoint any Aide de Pofte, there. V. And be it further enacted by the authority aforefaid, that every Maitre de tain number of Pofte, between the Cities of Quebec and Montreal, refpectively, fhall be provided fervants, hoi fes & with two able men Servants or Poftillions, and fhall have at leaft four good horfes neceffary harness. With four ftrong and convenient carioles and a like number of caleches, with iron criques or fprings and leather traces; alfo, four fetts of good and complete harness, with two fleighs, two carts and one faddle; and every Aide de Pofte fhall be provided with one able man fervant or poftillion, and at least two good horfes with two fets of good and complete harness, two carioles and two caleches one fleigh and one cart; and that every Maitre and Aide de Pofte in other parts of the Province, where Poft-Houses fhall be established, fhall be provided with, that is to say, each Maitre de Pofte at least one able man Servant or Poftillion, and two good horses, with an equal number of good and complete harness, carioles and caleches and one fleigh and cart, and one faddle: and each Aide de Pofte, with one able man Servant or Poftillion, and alfo, one good horfe, and at least one good and complete harnefs, and one cariole, one caleche, one fleigh, and one cart. VI. And be it further enacted by the authority aforefaid, that every Maitre and Aide de Pofte, fhall furnish immediately and without delay, upon being thereunto required by travellers, horfes with carriages or horfes with harness for the carriage or carriages of fuch travellers, or faddle horses; and fhall not retard travellers more than a quarter of an hour in the day time, and half an hour in the night time, and fhall convey the faid travellers with fpeed, at the rate of at least two leagues an hour, to the next Poft House, and shall be bound to put good and fufficient reins to each and every horfe, they fhall fo furnish and harness to fuch carriage or carriages. VII. And be it further enacted by the authority aforefaid, that every Maitre and Aide de Pofte may demand and receive from each traveller, for every league or in proportion for every part of a league, that he fhall convey fuch traveller the different prices and rates which follow, that is to fay, for the hire of a horse and caleche, or a horse and cariole or of a horfe, with the harness to put to the caleche or |
