So, formerly, no person was capable of being Property elected a Member of the House of Commons, unless abolished. he was at the time of his election and return seized, possessed of, or entitled to a property qualification within the United Kingdom of a certain specified amount and description; but since the 28th June, 1858, all the statutes, requiring on the part of Members of the House of Commons elected for England and Ireland respectively certain qualifications in respect of property, have been repealed. 21 & 22 Vict. c. 26.

At common law, the office of a Sheriff was incom- Sheriffs. patible with his duties as Member for the County of which he was Returning Officer: see 4 Inst. 48; Litt. R. 326 and by an old statute or ordinance, made in the 46 Edward III., A.D. 1372, it was enacted that

The Union Disqualification.

no Sheriff, for the time that he is Sheriff, shall be returned or accepted Knight of the Shire.

For the purpose of carrying out the Legislative Union between Great Britain and Ireland, it was declared that from the 20th of June, 1801, all persons disabled from or incapable of being elected or sitting or voting in the House of Commons of any Parliament of Great Britain, are disabled from and are incapable of being elected or sitting or voting in the House of Commons of the United Kingdom, for any County, City, or Borough, in that part of the United Kingdom called Great Britain: 41 Geo. 3, c. 52, s. 1:

All persons disabled from or incapable of being elected or sitting or voting in the House of Commons of any Parliament of Ireland, are disabled and incapable of being elected or sitting and voting in the House of Commons of the United Kingdom for any County, City, or Borough, in that part of the United Kingdom called Ireland: Id. s. 2:

Any persons theretofore disabled by British Statutes from sitting and voting in the House of Commons of Great Britain are disabled from sitting or voting in the House of Commons of the United Kingdom for any County, City, or Borough, in Ireland and all persons theretofore disabled by Irish Statutes from sitting or voting in the House of Commons of Ireland, are disabled from sitting or voting in the House of Commons of the United Kingdom for any County, City, or Borough, in Great Britain: Id. s. 3:

And no person who shall by himself or his deputy, or any other in trust for him or for his benefit, take, hold, enjoy, or execute, any of the following offices, employments, or places of profit in or for that part of the United Kingdom called Ireland, shall be capable of being elected or chosen a member of or of sitting or voting as a member of the House of Commons of the United Kingdom; that is to say, any person who shall be a Commissioner of customs, excise, or stamps, or who shall be concerned, directly or indirectly, in the farming, collecting, or managing any of the sums of money, duties, or aids, granted to the Crown (except the Commissioners of the Treasury and their Secretary):

Any person who shall be a Commissioner for determining appeals concerning the said duties of the customs, excise, or stamps, or for controlling or auditing the account of said duties (except the Auditor-General of the Exchequer):

Any person who shall be a Commissioner of imprest duties:

Any agent of any regiment.-Id. s. 4.

Every person who shall have in his own name, or in the name or names of any person or persons in trust for him or for his benefit, any office or place of profit from or by the nomination or appointment, or by any appointment subject to the approbation of the Lord Lieutenant, or other Chief Governor or Governors of Ireland, created or erected after the passing of the Act of the 33 Geo. 3, c. 41 (Irish), A.D. 1793, shall be incapable of being elected,

unless the office be for life, or during good behaviour. Id. ss. 5, 8.

So, Commissioners for auditing the military accounts were incapable of being elected: 52 Geo. 3, c. 51; and also Commissioners for auditing the public accounts. 52 Geo. 3, c. 5.

So, aliens, though naturalized by Act of Parliament, are incapable of being members of either House of Parliament. 19 & 20 Geo. 3, c. 29, s. 2; 23 & 24 Geo. 3, c. 38, s. 2; 36 Geo. 3, c. 48, s. 3; 12 & 13 W. 3, c. 2, Eng. ; 7 & 8 Vict. c. 66, s. 5.

So, no Judge of the Court of Session or Justiciary, or Baron of the Court of Exchequer in Scotland, is capable of being elected a member of the House of Commons: 7 Geo. 2, c. 16; et vide 41 Geo. 3, c. 52, s. 1; and a Sheriff Depute or Steward Depute is equally disqualified. 21 Geo. 2, c. 19.

And any Governor or Deputy-Governor of any of the settlements, presidencies, territories, or plantations in India, is disqualified to be selected a member of the House of Commons while he continues to hold such office. 10 Geo. 4, c. 62.

So, by the 6th and 7th Wm. 4, c. 29, s. 19, no Justice of the Peace or Receiver appointed by virtue of that Act is, during the continuance of such appointment, capable of being elected.

And take notice, that all persons who are guilty of Bribery at the said election will, on conviction of such offence, be liable to the penalties mentioned. in'that behalf in "The Corrupt Practices' Prevention Acts." (a)

And take notice, that all persons who are guilty of Treating or Undue-influence at said election will, on conviction of such offence, be liable to the penalties mentioned in that behalf in "The Corrupt Practices' Prevention Acts."
