III. And be it further enacted by the authority aforefaid, that every Alien who fhall arrive in any port or place of this Province, in any ship or veffel coming into declare in writ the gulph or river St. Lawrence, after the palling of this Act, fhall immediately afing to the Collector, &c. his name, ter fuch arrival, declare in writing to the Collector, Comptroller or other chief Officer &c. If a fervant of the Cuftoms, at or near fuch port or place, his or her name, rank, occupation or master and defcription, or if a domeftic fervant, then alfo the name, rank, occupation or defwhere he has refcription of his or her master or mistress; or fhall verbally make to fuch Officer as aforefaid, fuch declaration, to be by him reduced to writing; and fhall alfo in like manner declare the country, or countries, place or places, where he or the fhall have principally refided for fix calendar months, next immediately preceding fuch arrival.

IV. And be it further enacted by the authority aforcfaid, that every Alien who, after the fifteenth day of June, one thousand seven hundred and ninety-four, shall come into this Province by any inland communication or navigation, fhall immediately after fuch arrival, declare in writing to the nearest Juftice of the Peace, his or her name, rank, occupation, or defcription, or if a domeftic fervant, then alfo the name, rank, occupation or defcription of his or her mafter or miftrefs, or fhall verbally make to fuch Justice, fuch declaration to be by him reduced to writing; and fhall alfo in like manner declare the country or countries, place or places, where he or she fhall have principally refided for fix calendar months next immediately preceding fuch arrival.

V. And be it further enacted by the authority aforefaid, that all perfons, not being natural born subjects of his Majefty, nor Denizens, nor perfons naturalized by Act of Parliament, nor fubjects of his Majefly, having become fuch by the conqueft or ceffion of the province of Canada, who have arrived and come into this Province after the first day of May, one thousand feven hundred and ninety-two, and may refide within the fame, at the time of paffing this Act, fhall within thirty days therefrom, declare in writing, and the fame deliver, or caufe to be made and delivered to the Clerk of the Peace, at the town of Quebec or Montreal, or Three Rivers, or to the Clerk of the Peace of the diftrict of Gafpé, whichever may be nearest to the place of their actual refidence, his or her name, rank, occupation or description; or if a domestic servant, then alfo the name, rank, occupation or defcription of his or her mafter or mistress: and fhall alfo in like manner declare the country or countries, place or places, where he or the fhall have principally refided for fix months, next immediately preceding fuch arrival in this Province; and fhall alfo in like manner, declare the feveral places, and for what length of time in each they have refided in this Province, and the trade, bufincfs or occupation, if any, which he or the have followed during their refidence aforefaid.

VI. And be it further enacted by the authority aforefaid, that all and every Alien, zing or refufing to who by this Act is directed to make, or to caufe to be made, deliver, or caufe to derations, are, upon livered, any declaration in writing, or otherwise, who fhall neglect or refuse the same adjudged to de- to do and perform, or who fhall wilfully make or caufe to be made any falfe deciaout of the ration thereof, fhall, for every fuch offence, on conviction thereof, upon bill, plaint. or information to be exhibited in any of his Majefty's courts of King's Bench, or in any court of Oyer and Terminer and Gaol Delivery, or any General or Quarter Seffions of the Peace, be adjudged to depart out of this Province, within a time to be limited by the judgment of the court, before which fuch offender may be tried and duly convicted as aforefaid; and if he or the fhall be found therein, after fuch time in fuch judgment fo limited, without lawful caufe, he or fhe fhall, being duly convicted thereof before any of his Majefty's courts of King's Bench or any court of Oyer and Terminer and Gaol delivery, be tranfported for life..

III. Et qu'il foit de plus ftatué par la dite autorité, que chaque Etranger qui arrivera dans aucun port ou place de cette Province dans aucun navire ou vaiffeau venant dans le golfe du fleuve St. Laurent après la paffation de cet Acte, immédiatement après telle arrivée déclarera par écrit au Collecteur, Contrôleur ou autre Officier principal de douane à ou près de tel port ou place fes nom, rang, emploi ou defcription, ou s'il eft domeftique ou ferviteur, alors il déclarera auffi les noms, rang, emploi ou defcription de fon maître ou maitreffe; ou fera de vive voix telle déclaration à tel Officier comme ci-deffus, qui la rédigera par écrit ; et il déclarera auffi en la même maniére le ou les pays, place ou places où il aura principalement réfidé pendant l'efpace de fix mois de calendrier, précédant immédiatement telle arrivée.

IV. Et qu'il foit de plus ftatué par la fufdite autorité, que chaque Etranger qui après le quinziéme jour de Juin, mil fept cent quatre-vingt-quatorze, viendra dans cette Province par aucune communication ou navigation intérieure, déclarera immédiatement après telle arrivée, par écrit, au plus proche Juge de Paix, fon nom, rang, occupation ou fa defcription, ou s'il eft ferviteur domeftique, en ce cas auffi le nom, le rang, l'occupation ou la defcription de fon maître ou fa maitreffe, ou il fera verbalement au dit Juge telle déclaration qu'il mettra par écrit; et il déclarera auffi dans la même maniére le pays ou les pays, la place ou les places où il ou elle auraprincipalement réfidé pendant les fix mois de calendrier précédant immédiatement telle arrivée.

V. Et qu'il foit en outre flatué par la fufdite autorité, que toutes perfonnes qui ne font pas naturellement nées fujets de fa Majefté qui ne font pas Dénizens ou les perfonnes non naturainées par Acte du Parlement, ni sujets de fa Majeflé, ni devenues tels par la conquête ou ceffion de la province du Canada, qui font arrivées ou venues dans cette Province après le premier jour de Mai, mil fept cent quatre-vingt-douze, et peuvent résider en icelle lors de la pallation de cet Acte, déclareront dans trente jours d'icelle par écrit et délivreront leur déclaration ou la feront faire et délivrer au Greffier de la Paix dans la ville de Québec ou Montréal ou Trois Riviéres, ou au Greffier de Paix du district de Gafpé, laquelle peut être la plus près de la place de leur réfidence actuelle, leurs nom, rang, occupation ou defcription; ou s'il ou fi elle eft ferviteur ou fervante domeftique, en ce cas auffi le nom, le rang, l'occupation ou la defcription de fon maître ou de fa maitreffe, et déclareront auffi dans la même maniére le ou les pays, la cu les places où ils ou elles auront principalement réfidé pendant les fix mois précédant immédiatement telle arrivée dans cette Province, et déclareront auffi dans la mêine maniére les différentes places, et pour quel espace de tems en chaque lieu, ils ou elles auront réfidé dans cette Province, et le commerce, l'affaire ou l'occupation, s'ils ou fi elles en ont fuivi pendant leur réfidence fufdite.

VI. VIII. Provided always and be it further enacted, that nothing herein before contained fhall extend or be conftrued to extend to any mariner whom the mafter or commander of any ship or vessel, arriving in any port or place in this Province from fea, fhall certify to the Collector, Comptroller or other Chief Officer of his-Majefty's Customs of such port or place, in writing, fubfcribed by fuch mafter or commander, to be actually engaged and employed in the navigation of fuch fhip or veffel, during the time that fuch mariner fhall remain fo actually engaged and employed; and which certificate in writing, fo fubfcribed as aforefaid, every fuch mafter or commander as aforefaid is hereby required to give.

IX. And be it further enacted by the authority aforefaid, that all and every Collector, Comptroller, or other Chief Officer of his Majesty's Customs, and all and every Justice or Clerk of the Peace, who by this Act is required and may take and receive any declaration in this Act directed, fhall forthwith and without delay transmit the fame (keeping a copy thereof) to the Secretary of this Province in his office at the city of Quebec, to the intent that the fame may be immediately delivered to and for the confideration and order of the Governor, Lieutenant-Governor, or Perfon adPenalty for ae miniftering the Government of this Province, under and upon the penalty of five pounds for every neglect, to be recovered, paid, and applied as penalties impofed by the fecond fection of this A&.

X. And be it further enacted by the authority aforefaid, that when and so often as the Governor, Lieutenant-Governor, or Perfon adminiftering the Government of any Alien to de- this Province fhall, by his proclamation or his order made in the Executive Council of this Province, direct that any Alien, being or who may hereafter arrive within this Province during the continuance of this Act, fhall depart this Province within a time limited in fuch proclamation or orders refpectively; and any Alien who fhall knowingly neglect or refufe to pay due obedience to fuch proclamation or orders refpectively, or fhall be found in this Province contrary to fuch proclamation or orders, as the cafe may be, it fhall and may be lawful for any of his Majefty's Juftices of the Peace, by warrant under his hand and feal, to caufe every fuch Alien, fo neglecting or refufing as aforefaid, to be arrested and to be committed to any of his Majefty's gaols within this Province, and there to remain without bail or mainprize, until he or the fhall be delivered by due courfe of law and in cafes, where the Governor, Licutenant-Governor, or Perfon adminiftering the Government may apprehend that immediate obedience will not be paid to fuch proclamation or orders refpectively as aforefaid, it fhall and may be lawful, by warrant under his hand and feal, to give fuch 'Alien in charge to any Peace Officer, or to fuch other perfon or perfons, to whom he fhall think proper to direct fuch warrant, in order that fuch Alien may be conducted out of this Province, in fuch manner as may appear fuitable.

XI. Et qu'il foit de plus ftatué par la fufdite autorité, que chaque tel Etranger, défobéissant ainfi ou fciemment négligeant de rendre due obéiffance à telle proclamation ou tels ordres re'pectivement, ou étant trouvé dans cette Province contraire à telle proclamation ou tels ordres refpectivement, qui fera légalement convaincu de

XIII. And be it further enacted by the authority aforefaid, that it fhall and may be require of any lawful for any of his Majefty's Justices of the Peace, by notice in writing under their account of any A. hand refpectively, to be left at the houfe of any houfe-keeper, within the diftrict, iding in town, or place in and for which fuch Juftice fhall act, to require of fuch houfe-keep

er an account in writing within a time to be limited by fuch notice, to be fubfcribed with the name of fuch houfe-keeper (or otherwife authenticated) of the names, rank and occupation of all fuch Aliens as may be refident in his or her dwelling house, as far as the fame fhall have come to his or her knowledge, together with an account of the time, during which fuch Aliens refpectively fhall have been fo refident in his or her dwelling houfe, or if no fuch Alien fhall be refident therein, then in like manner he or fhe fhall certify the fame: and if any houfe-keeper fhall neglect or refufe to return fuch account or certificate as is hereby required, or fhall return a falfe account or certificate, every fuch houfe-keeper, being lawfully convicted thereof by his or her confeffion or on the oath of one or more credible witnefs or witneifes, before any two or more of his Majefty's Juflices of the Peace, fhall forfeit and pay the fum of ten pounds for every Alien, who fhall be proved to have been a lodger or inmate in fuch dwelling-houfe as aforefaid, either at the time when fuch notice, as aforefaid, was left at his or her dwelling houfe, or at the time of returning fuch account or certificate, and whom he or fhe fhall have wilfully neglected to return in fuch account; and in cafe there fhall be or have been no Alien in his or her dwelling houfe at fuch time refpe&tively, fhall forfeit and pay the fum of one pound, to be recovered in manner aforefaid; one moiety of fuch penalties refpectively to be to the informer or informers and the other moiety to the ufe of the poor of the parish or place in which fuch dwelling houfe fhall be fituate.
