the County Superintendent is authorized to draw his warrant upon the School Treasurer, for any sum equal to the amount contributed by private subscription of individuals in any school district; but in no case shall said sum exceed more than fifty cents to each person between the ages of four and twenty-one years in said district.

SEC. 13. The present Superintendent of Public Instruction in Storey county shall be charged with the duty of issuing his annual warrant, for an election of the members of the Board of Education, in some newspaper in the county, to be holden on the first Monday in January, eighteen hundred and sixty-three; he shall designate the Judges and Inspectors, places of holding said election in Virginia, Gold Hill, and Flowery District; the returns shall be made to him the day following, and he shall notify members elect of their election, administer to them the oath of office, and immediately after the organization of the Board, he shall transfer to said Board all books, maps, charts, and property of every description, belonging to the school districts of said county.

SEC. 14. This Act shall take effect from and after its passage.

CHAP. CVIII.—An Act to issue Bonds and Coupons.
[Approved December 20, 1862.]

Be it enacted, by the Governor and Legislative Assembly of the Terri-
tory of Nevada, as follows:

SECTION 1. That the Territorial Auditor be and is hereby authorized, at any time before the first day of February next, to borrow, on the credit of this Territory, a sum not exceeding twenty thousand dollars, or so much thereof as, in his opinion, the exigencies of the public service may require, to be used in the payment of the current demands upon the Treasury of the Territory, and for the redemption of Territorial Warrants, now, or which may be at the time of such loan being made, outstanding.

SEC. 2. Bonds shall be issued for the amount so borrowed, demption bearing interest not exceeding ten per cent per annum, and said bonds to be paid and redeemed as follows: The sum of five thousand dollars, within one year from the date thereof; the sum of five thousand dollars, within two years from the date thereof; and ten thousand dollars, within three years from the date thereof. And the Territorial Auditor be and is hereby authorized to cause such bonds to be prepared, which shall be signed by the said Territorial Auditor, and sealed with the seal of his department, and countersigned by the Territorial Treasurer, for the amount so borrowed, drawn in favor of the parties lending the same, or their assigns; provided, that no bonds shall be issued for a less sum than one hundred dollars.

SEC. 3. And be it further enacted, That John H. Kinkead be and is hereby appointed Commissioner to negotiate the sale of

such bonds; provided, that no sale shall be made at less than ninety cents on the par value of said bonds; and the said Commissioner shall report monthly to the Territorial Auditor the amount, number, and date of such bonds so disposed of by them [him.]

SEC. 4. And be it further enacted, That the Territorial Auditor Coupons. may cause coupons of semi-annual interest payable thereon to be attached to bonds, issued under and by virtue of this Act, and any bonds with such coupons of interest attached may be assigned and transferred by the delivery of the same.

SEC. 5. And be it further enacted, That the Territorial Treas- Payment urer be and is hereby authorized and directed to pay or cause to be paid the interest on said bonds issued under this Act at the time and times when, according to its provisions, the same should be paid. SEC. 6. SEC. 8. The Commissioner herein appointed shall be allowed two hundred and fifty dollars for his services as such Commissioner, and the remainder of the appropriation shall be devoted to the purposes specified in this section.

CHAP. CIX.-An Act entitled an Act for the Relief of Frank Moyer.

Be it enacted, by the Governor and the Legislative Assembly of the
Territory of Nevada, as follows:

SECTION 1. That the sum of two hundred and fifty dollars Claim is hereby audited and allowed as indebtedness against the Terri- allowed. tory of Nevada, to Frank Moyer, of the County of Humboldt, in said Territory, for services done and performed by said Moyer in and about the arrest and detention of one Allen Milstead, who murdered Timothy Varny, in Churchill County, Nevada Territory, November eighteenth, A. SEC. 2. It shall be the duty of the Territorial Auditor to issue to the said Frank Moyer, a bond of the sum of two hundred and fifty dollars; the said bond shall draw interest from the time of its issuance until the payment of the same at the rate of ten per cent per annum.

SEC. 3. It shall be the duty of the Territorial Treasurer to pay said bond out of any moneys in the Territorial Treasury not otherwise appropriated by law, and in its regular order, alike with other bonds issued by the Territorial Auditor of said Territory.

SEC. 4. This Act shall take effect from and after its passage.

CHAP. CX.-An Act supplementary and amendatory of an Act entitled an Act in relation to Common Jails, and the Prisoners thereof.

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1.

Section three of the Act of which this [is] amendatory, is hereby amended so as to read as follows:

Section 3. The Sheriff shall have the custody of the Jail in his county, and of the prisoners therein, and shall keep the same personally, or by his Deputy, for whose acts he shall be responsible, and shall furnish all necessary sustenance, bedding, clothing, fuel, and medical attendance, for the prisoners committed to his custody; and the Board of County Commissioners shall allow him, out of the County Treasury, one dollar and fifty cents per day compensation for the support of each prisoner confined on criminal or civil process.

SEC. 2. This Act shall take effect from and after its passage.

CHAP. CXI.-An Act relating to the manner of commencing Civil
Actions.

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. In all actions hereafter brought on contract, the defendants may be sued by the name or style under which the contract was made, and upon its being shown on the trial who are the persons of whom the name or style are descriptive, judgment may be rendered against them as now provided by law.

SEC. 2. In all suits against any company organized for mincompanies. ing purposes, or against any company transacting business or

keeping an office within this Territory, service may be made by reading and delivering a copy of the summons to the President, Secretary, Cashier, or Managing Agent thereof, and in case such service cannot be had, then by publication, as now provided by

law.

SEC. 3. This Act shall take effect from and after its passage.

CHAP. CXII.—An Act for the Relief of D. J. Gasharie, Sheriff of
Carson County.

Be it enacted, by the Governor and Legislative Assembly of Nevada
Territory, as follows:

SECTION 1. Seven hundred and fifty-three dollars and fifty Approcents is hereby appropriated, out of any funds in the Treasury of Nevada Territory not otherwise appropriated, to D. J. Gasharie, for services as Sheriff of Carson County, rendered in actions wherein the people were plaintiffs, and William Mayfield and Charles J. Shultz were defendants.

SEC. 2. The Territorial Auditor is hereby instructed to issue Payment of. his warrant upon the Territorial Treasury, payable out of any moneys in the General Fund not otherwise appropriated, in favor of D. J. Gasharie, for the sum of seven hundred and fifty-three dollars and fifty cents ($753 50).

SEC. 3. This Act to take effect from its passage.

CHAP. CXIII.—An Act to repeal an Act entitled an Act to provide Compensation for the Supreme Judges of the Territory, for the Transaction of Territorial Business, approved November twenty-ninth, eighteen hundred and sixty-one.

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. An Act entitled an Act to provide compensation Act repealed for the Supreme Judges of the Territory, for the transaction of

Legislative business, approved November, A. D. eighteen hundred and sixty-one, is hereby repealed.

CHAP. CXIV.—An Act for the Relief of Kinkead, Harrington & Co.

[Approved December 20, 1862.]

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. That the sum of four hundred and fifty-one dollars be and the same is hereby appropriated, to be paid out of any money in the Territorial Treasury not otherwise appropriated, to pay the account of said Kinkead, Harrington & Co., for rent of Court Room of the District Court at Carson City, from the fifteenth day of November, A. D. one thousand eight hundred and sixty-one, to February fifteenth, one thousand eight hundred and sixty-two, and for merchandize furnished said Court, and that the Auditor draw his warrant on the Treasurer for that amount.

CHAP. CXV.-An Act authorizing O. M. Evans, James Harold, and Jacob K. Gries, to establish and maintain a Toll Road in Washoe and Churchill Counties.

[Approved December 20, 1862.]

Be it enacted, by the Governor and Legislative Assembly of the Territory of Nevada, as follows:

SECTION 1. O. M. Evans, James Harold, and Jacob K. Gries, their associates and assigns, are hereby granted the right and privilege of maintaining a toll road from or near the north side of the Truckee River, at a point where the Truckee River enters the cañon at the foot or east side of Truckee Meadows, about one mile below the east line of the ranch owned by Gates & Stone, on the north side of Truckee River, on the Henness Pass Road, at or near Stout's Bridge; thence down said river to the lower crossing, on or near the old Emigrant Road; from thence, on the nearest and most practicable route, to the Sink of the Humboldt, a distance of seventy (70) miles.

SEC. 2. The said O. M. Evans, James Harold, and Jacob K. Gries, their associates and assigns, shall commence work upon said road by the first day of July, A. D. eighteen hundred and sixty-three, and complete the same with [within] three years from the passage of this Act.

SEC. 3. The said O. M. Evans, James Harold, and Jacob K. Gries, their associates and assigns, shall have the right and privilege to charge and collect tolls on said road not exceeding the following rates, viz:

Two horses and wagon, loaded, one dollar and fifty cents.
Each additional animal, twenty-five cents.

Empty teams, half price.

One horse and buggy, one dollar.

Two horses and buggy, one dollar and fifty cents.
