CHAP. 861.

AN ACT to regulate and increase the salaries of certain members of the Metropolitan Police Department.

PASSED April 30, 1866; three-fifths being present.

The People of the State of New York, represented in Senato and Assembly, do enact as follows:

§ 1. The sixty-third section of chapter four hundred and three of the Laws of eighteen hundred and sixty-four, is hereby amended so as to read as follows:

The salaries and compensation of the said commis- Salaries. sioners and other officers and employees of the board of metropolitan police shall from the first of May next be as follows: To the president of the board fifty-five hundred dollars per annum; to the treasurer fifty-five hundred dollars; to each of the other commissioners five thousand dollars; to the superintendent seventy-five hundred dollars; to the inspectors thirty-five hundred dollars each; the treasurer's book-keeper twenty-five hundred dollars; the president's secretary fifteen hundred dollars; chief clerk five thousand dollars; first deputy clerk twenty-five hundred dollars; clerk of superintendent fifteen hundred dollars; one clerk for each office inspector fifteen hundred dollars; the deputy clerks, each fifteen hundred dollars; the property clerk two thousand dollars; the stenographer sixteen hundred dollars; each police surgeon twentytwo hundred and fifty dollars; each captain of metropolitan police shall receive an annual salary of two thousand dollars, and each sergeant of metropolitan police shall receive an annual salary of sixteen hundred dollars. The salaries and pay aforesaid shall be paid monthly to each person entitled thereto, in modes to be prescribed by the rules and regulations, subject to such deductions each month from the salary or pay of members of the metropolitan police force, as the treasurer shall make (and which deductions he is hereby authorized to retain) to satisfy fines imposed on any member of the metropolitan police force, by way of discipline or punishment, as prescribed by the rules and regulations of the board. The salaries of the president, the treasurer and of each other commissioner, shall be paid quarterly by the comptroller of the state, out of the metropolitan police fund.

$ 2. Immediately after the passage of this act, the board of increase of metropolitan police shall make and cause to be certified and delivered to the board of supervisors of the county of New York, an estimate of the amount of money required to pay the increase of salaries and compensation provided for in and by this act, to the officers and members of the metropolitan police force, and which is chargeable to the county of New York; for the balance of the year, from and after the first day of May next, said board shall at the time make and cause to be certified and delivered to the board of supervisors of the county of Kings, a like estimate of the amount of money required to pay such increase of salaries and compensation, and which is chargeable to the city of Brooklyn for the same time.

$3. The board of supervisors of the county of New York shall cause the amount so estimated and certified to them, to be assessed, levied and collected upon and from the property of said county liable to taxation for* purposes, in addition to other sums which they are by law authorized or required to levy and collect, at the same time and in the same manner as other county taxes are levied and collected; and the said board of supervisors of the county of Kings, shall cause the amount of money so estimated and certified to them as chargeable to the city of Brooklyn, to be assessed, levied and collected upon and from the property of the said city of Brooklyn, liable to taxation for city purposes, in addition to other sum which they are by law required to assess, levy and collect, at the same time and in the same manner as other city taxes are levied and collected.

$4. The comptroller of the city and county of New York, is hereby authorized and required to borrow on the credit of the county of New York, the sum of money so as aforesaid estimated and certified as chargeable to the said county of New York, and issue and deliver as evidence of such loan or

debt, such bonds or certificates as he is by law authorized to issue for other city or county loans, in such denominations, payable at such times and drawing such rate of interest (not exceeding seven per cent per annum) as he shall approve; the money so borrowed shall be paid into the treasury of the state, as provided by section sixty-two of chapter four hun-' dred and three of the Laws of eighteen hundred and sixtyfour, to be expended by the treasurer of the metropolitan police, in pursuance of the provisions and purposes of this act. And the mayor and the comptrollor of the city of Brooklyn of mayor and comp are hereby authorized and required to borrow on the credit troller of of the city of Brooklyn, the sum of money so as aforesaid estimated and certified to the board of supervisors of the county of Kings, as chargeable to said city of Brooklyn and issue and deliver, as evidence of such loan or debt, such bonds or certificates as are authorized to be issued for other loans on the credit of said city of Brooklyn, in such denominations, payable at such times and drawing such rates of interest (not exceeding seven per cent per annum), as they shall approve. The moneys so borrowed shall be paid into the treasury of the state, as provided by the sixty-second section of chapter four hundred and three of the Laws of eighteen hundred and sixty-four, to be expended by the treasurer of the metropolitan police, from time to time, in pursuance of the provisions and purposes of this act.

S5. The moneys assessed, levied and collected by virtue of this act, when collected shall, by the fiscal officers of the cities of New York and Brooklyn, be applied in payment and discharge of the loans or debts by them respectively made under the provisions of this act.

$ 6. Section twenty of chapter four hundred and three of the Laws of eighteen hundred and sixty-four, is hereby amended so as to read as follows:

CHAP. 862.

AN ACT to cede the title and jurisdiction over certain lands to the United States.

PASSED April 30, 1866; by a two-thirds vote.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

1. The commissioners of the land-office are hereby authorized and directed to cede and convey to the United States of America all the estate, right, title and interest of this state to so much and such portion or portions of the easterly end or extremity of the lands and lands under water, commonly known as the battery extension, in the city of New York, with the open slip or basin at the easterly end thereof, as may be required by the United States of America, not exceeding two hundred and fifty feet, and necessary for the purpose of erecting and establishing a barge office and other suitable buildings and structures for the transaction of the public business connected with the United States revenue service, and for the landing of revenue and other government boats and barges for the use, convenience and accommodation of the United States custom-house for the port of New York.

$ 2. The mayor, aldermen and commonalty of the city of New York are hereby permitted, authorized and empowered powered to to cede, grant and convey to the United States of America, upon such terms and for such price as may be agreed upon with the authorities of the United States, all their estate, right, title and interest of, in and to the same lands, premises and appurtenances, and the slip or basin eastwardly adjacent thereto, for the same objects, uses and purposes as expressed in the first section of this act; and also to further cede, grant and convey to the United States a right of way or passage of not less than seventy-five feet in width from the aforesaid lands and premises, over and across the lands adjacent thereto, known as the battery ground, for purposes of ingress and egress to and from Whitehall street in said city.

S3. The jurisdiction over such lands, waters and premises as shall be conveyed by virtue of the first and second sections of this act, for the purposes therein mentioned, from and after the conveyance of such lands, premises and waters, and upon the execution thereof, shall be ceded to and vest in the United States of America, but such jurisdiction shall not impede the execution of any process, civil or criminal, issued under the authority of this state, except so far as such process may affect the real or personal property of the United States within the ceded territory.

AN ACT to amend an act entitled "An act to regulate the storage and keeping of crude petroleum, earth or rock oil, or any of its products, within the corporate limits of any city in the State of New York," passed June fifteenth, eighteen hundred and sixty-five.
