person shall, before that time, pay up the money due for the land, agreeably to the act for establishing the mode for granting lands now vacant in this state, and for allowing a commutation tobe received for some lands that have been granted, and the expenses incurred thereon, which expenses it is hereby declared shall not exceed six shillings for any one tract of land, he shall be entitled to the said grant, and the land thereby granted to him, any thing in the said clause of the said act, or any act or resolution of the legislature of this state to the contrary thereof in any wise notwithstanding: Provided always, That nothing in this act shall be construed to authorize the taking out of grants for the excessive surveys of land which have been made since the first day of April, one thousand seven hundred and ninety-one.
