VI. James Scrimgeour, constable of Dundee, had, on his father's resignation, a charter (Mug. Sig. L., v., No. 77; L., vii., No. 335) of the barony of Glaster, in Argyllshire, and of the lands of Hillsfield, etc. in the barony of Inverkeithing, 27 January 1459-60, wherein he is designed son and heir apparent of Sir John Scrimgeour, constable of Dundee. He had another charter to James Scrimgeour of Dudhope, constable of Dundee, from George, Lord Haliburton, dated 9 December 1471, of the lands of Balegernoth, in Perthshire, confirmed by royal charter of 30 January 1475-6. He died not long afterwards, having married Isabell, daughter of Sir William Oliphant of Aberdalgy, and had issue,

1. James.

2. John of Glaster, of whom afterwards:

1. Matilda, married to John Graham of Balargus.

2. Elisabeth, married to John Sandilands, younger of Calder. They had a charter (Mag. Sig., L., xii., No. 256) of Dudhope, 12 January 1490-1.

3. Mariota, married to Sir Robert Arbuthnott of Arbuthnott.

VII. James Scrimgeour of Dudhope, constable of Dundee, had a charter (Mag. Sig., L., xiii., No. 165) from Andrew, Lord Gray, master of king's household, to him and the heirs male to be procreated betwixt him and Isabella Gray, his wife; which failing to his heirs male, bearing the name and arms of Scrimgeour, of the lands of Dudhope; and of that custom accruing out of the burgh of Dundee, to Lord Gray, as sheriff of Forfarshire, called the cold or colt silver, 27 April 1495, confirmed by royal charter of 30 June 1495. He died about 1503. He married Isabella, third daughter of Andrew, third Lord Gray ; she survived him, and married, secondly, James Crichton of Ruthven. By her first husband she had a son, James; and two daughters,

1. Margaret, married to John, Earl of Buchan.

2. Janet, married to James, third Lord Carlyle of Torthorwald, who died 1529, without issue. She had a charter (Mag. Sig., L., xxiii., No. 107) of half of the barony of Carlyle, 24 December, 1529. VIII. James Scrimgeour of Dudhope, constable of Dundee, the only son, is designed son and heir of James Scrimgeour, constable of Dundee, in a seisin (Penes D. Gray, D.) of Andrew, Lord Gray, 20 February 1504. He had a charter (Mag. Sig., L., xxi.. No. 19) to himself, and the heirs male of his body; which failing, to John Scrimgeour of Glaster, James and Walter, brothers of John, David Scrimgeour of Fardell, John Scrimgeour, macer, and the heirs male of their bodies respectively, of the barony of Dudhope, office of constable of Dundee, Hilsfield, etc., in the barony of Inverkeithing, in Fife, Bellauth and Kingudy in Perthshire, on his own resignation, 2 July 1527. He had another charter (Mag. Sig., L., xxii., No. 235) of the lands of Earl's Strathechty, in Forfarshire, 4 December 1528; and a third (Mag. Sig., L., xxviii., No, 258) to himself in liferent, and in fee to John Scrimgeour of Glaster, and the heirs male of his body; which failing, to John Scrimgeour, grandson of the said James Scrimgeour, procreated betwixt James Scrimgeour, late of Kirktoun, and Elisabeth Scrimgeour, daughter of the said James, the constable, or the other heirs male procreated, or to be procreated betwixt them; which failing, to James Scrimgeour, fiar of Fardell, James Scrimgeour of Fordy, James Scrimgeour of Gone, and John Scrimgeour of Myres, and the heirs male of their bodies respectively; which all failing, to the nearest heirs male of the constable, of the barony of Dudhope; lands of Hilsfield, etc., in Fife: North Bellock, etc., in Perthshire; Sonahard, in the county of Aberdeen; and the office of constable of Dundee, on his own resignation, 2 March 1541-2; and he died 1546.

He married Mariot Stewart, from whom he was divorced before 1524, as appears from grants (Lord Hailes's MS. notes) made to her and her two daughters by Robert Maule of Panmure, and by her had issue. 1. Elisabeth, married to James Scrimgeour of Kirktoun. 2. Agnes, married to Sir William Bruce of Earlshall.

Her descendant, William Bruce of Earlshall,

was, 15 December 1610, served heir of John Scrimgeour, constable of Dundee, fratris abavi ex parte matris (Inq. Ret. in Publ. Arch.).

VII. John Scrimgeour, second son of James Scrimgeour, constable of Dundee (No. VI.), had a charter' to John Scrimgeour, brother-german of James Scrimgeour, constable of Dundee, and Janet Ogilvy, his wife, and the heirs male of his body; which failing, to David Scrimgeour of Fordale, Alexander Scrimgeour of Henriestoun, James Scrimgeour, brother of Alexander, Nicholas Scrimgeour of Lillock, James Scrimgeour, son and heirof the late David Scrimgeour, burgess of Dundee, John Scrimgeour, macer, and the heirs male of their bodies respectively; which failing, to the nearest heirs male of John, bearing the name and arms of Scrimgeour; of the barony of Glaster, from James Scrimgeour, constable of Dundee, 12 December 1490, confirmed by charter under the great seal, 12 July 1491. He had charters of Lamlethyn and Craig, in Forfarshire, from Walter Strang of Petcorthy, 7 February 1503-4, to himself, and the heirs male of his body, which failing, to James Scrimgeour, constable of Dundee, and David Scrimgeour of Fardell, and the heirs male of their bodies respectively; of the lands of Gokelmure and Halhill, in Perthshire, from Andrew Kynnard of that ilk, 15 April 1508, to him, and the heirs male procreated betwixt him and the deceased Janet Ogilvy, his wife; of Ardormy, in Perthshire, 4 June 1509; of Wester Glenquharite and Ballantore, in Forfarshire, from Andrew Murray, 20 February 1510-1; of the barony of Panbride, in the same county, from Robert, Lord Crichton of Sanquhar, 25 October 1511; and Balmullo, in Fife, 24 February 1512-3. He had three sons,

1. John.

2. James, designed rector of Glaster in a charter to his father, 1512, mentioned in the constable's charter of Dudhope, etc., 1527, father of James Scrimgeour, next in substitution to the sons of the constable of Dundee, in the charter of Dudhope, etc., 1587.

3. Walter, mentioned in the constable's charter 1527.

VIII. John Scrimgeour of Glaster, the eldest son, succeeded James Scrimgeour, constable of Dundee, in the barony of Dudhope, etc., in 1546, in terms of the charter 1542. [He was served heir male of tailzie of his uncle's son, James Scrymgeour, constable, 29 Nov. 1546, Ret. Forfar 561.] He died about 1575, leaving two sons;

IX. Sir James Scrimgeour of Dudhope, constable of Dundee, the eldest son, had a charter (Mag. Sig., L, xxxii., No. 408) to James Scrimgeour, son and heir apparent of John Scrimgeour of Dudhope, constable of Dundee, and the heirs male to be procreated betwixt him and Margaret Carnegie, his wife; which failing, the other heirs male of his body; which failing, Donald, his brother-german, James Scrimgeour of Glaswell, John Scrimgeour in Ballegarno, James Scrimgeour of Fardell, David Scrimgeour of Fordy, James Scrimgeour of Rydgond, Alexander Scrimgeour, burgess of Dundee, and John Scrimgeour of Myres, and the heirs male of their bodies respectively, of the barony of Dudhope; office of constabulary of Dundee; Hilfield, etc., in Fife; Bellok, in Perthshire; Sonahard, in Aberdeenshire; and Glaster, in the county of Argyll, 30 June 1565. He had another charter to James Scrymgeour of Dudhope, constable, and now provost of Dundee, and the heirs male of his body; which failing, to James Scrimgeour, lawful son of James Scrimgeour, who was uncle of the said James Scrimgeour of Dudhope, John Scrimgeour of Kirkton, Gilbert Scrimgeour, his brother, John Scrimgeour of Glasswell, Alexander Scrimgeour, his brother, James Scrimgeour of Fardell, David Scrimgeour of Fordie, James Scrimgeour of Myres, Alexander Scrimgeour, now bailie of Dundee, and the heirs male of their bodies respectively; which failing, the nearest heirs male of the said James Scrimgeour of Dudhope, bearing the name and arms of Scrimgeour, of the barony of Dudhope, the office of constable of Dundee, and several lands in Forfarshire; Hilfield, etc., in Fife; Kingudie, etc., in Perthshire; Sonahard, in Aberdeenshire; and Glaster in Argyllshire, 15 November 1587. Sir James Scrimgeour of Dudhope, knight, constable of Dundee, was served heir (Ing. Ret. in Publ. Arch.) to John Scrimgeour, constable of Dundee, the father of his great-grandfather, and to John Scrimgeour, constable of Dundee, his father, 15 Dec. 1610. He married Margaret, daughter of Sir Robert Carnegie of Kinnaird, by whom he had a son,

XI. Sir John Scrimgeour of Dudhope, who had a charter of the Mill of Kellie, 22 June 1609, wherein he is designed apparent of Dudhope; he also got charters to Sir John Scrimgeour of Dudhope. knight, of the barony of Dudhope, constabulary of Dundee, etc., December 1607, January 1618, and 5th February 1622. [He was served heir to his father 26 Aug 1615, Ret. Forfar 85.] He was raised to the dignity of the peerage, by patent, dated at Holyrood house, 15 November 1641, whereby King Charles I., for the good and faithful service done by his trusty and well-beloved Sir John Scrimgeour, elder of Dudhope, constable of Dundee, and his progenitors, to his majesty, and his predecessors, for which they were honoured with the heritable title of the king's standard-bearers; being willing to bestow some further degree of honour upon the said Sir John, therefore his majesty has created him and the heirs male of his body, which failing, his heirs male whatsoever, Viscounts of Dudhope and Lords Scrimgeour. He died 7 March 1643, having married Margaret Seton, of the family of Parbroath, in Fife, by whom he had a son,1 James, second Viscount of Dudhope; and two daughters,

1. Hon. Jean Scrimgeour, married to Sir Thomas Thomson of Dudingston, in the county of Edinburgh, Bart.; the baptisms of several of their children are entered in the register of Dudingston parish. from 1635 to 1648. Sir Thomas died at London, 11 January 1662; and was succeeded by his Sir Patrick, born 24 December 1637.

XII. James, second Viscount of Dudhope, was served heir to his father (Inq. Ret. Pub. Arch.) 25 April 1643; he had a command in the Scotish forces sent next year to the assistance of the parliament of England against Charles I., and was wounded at the battle of Marstonmoor, 2 July 1644, which brought on a fever of which he died on the 23rd of that month. He married Lady Isabel Ker, third daughter of Robert, first Earl of Roxburgh, and by her had issue,

1661, August, the Lord Cranston, in Louthian, the Earl of Leven's son-in-law, by way of duell, killed Captaine Skyrmger, the Earle of Dundie's brother, being both att London for the tyme" (Lamont's Annals, MS.).

XIII. John, third Viscount of Dudhope,3 was served heir to his father, 4 November 1644 (Ing. Ret. in Publ. Arch.), was a colonel of horse in the "Engagement" to attempt the rescue of King Charles Î., under the Duke of Hamilton, 1648; accompanied King Charles II. to the battle of Worcester, 1650; escaped, from thence, aud joined General Middleton in the Highlands of Scotland. He was taken, with a party of Middleton's forces, in the braes of Angus, by the English, in November 1654. At the restoration he was, in consideration of his services and sufferings in the royal cause, sworn a privy councillor, and created Earl of Dundee, Viscount of Dudhope, Lord Scrimgeour and Innerkeithing, 1661; the limitations are not known, the patent not being on record. [See ante, p. 185.] He died, 23 June 1668, without issue by his wife, Lady Anne Ramsay, second daughter of William, first Earl of Dalhousie, to whom he was married in 1644, and who took to her second husband, Sir Henry Bruce of Clackmannan.

On the death of the Earl of Dundee, the Duke of Lauderdale obtained from the crown a gift of ultimus hæres and of recognition of his estate in favour of his brother, Charles Maitland of Hatton. Agreeably to the settlements of the estates, 1541 and 1587, they should have devolved on the family of Kirkton, descended from James Scrymgeour of Kirktoun [see ante, p. 169], who married Elizabeth, daughter of James Scrymgeour of Dudhope. He had also a son David, who died before 11 July 1646, when his two daughters, Clara and Margaret, were served "heirs portioners of David Scrymgeour, son lawful of John, Viscount of Dudhope, their father" (Ing. Gen. 3151). Of these Clara died before 8 Oct. 1637, when her sister Margaret was served her heir (ib. 4279). Later on, 4 Feb. 1686, the Ladies Jean and Margaret Scrymgeour were served heirs to Sir John (sic. for James ?) Scrymgeour of Dudhope, their grandfather (ib. 6708), whose male line was thus extinct.
