and all such works or other measures as may be connected with and necessary to the completion and efficiency of the same.

IV. And be it further enacted by the authority aforesaid, that it shall be the duty of the Commissioners to make or cause to be made with as much accuracy and minuteness as possible, calculations and estimates of the sums required for completing the said Canals according to the plans by them adopted and recommended; and to ascertain whether to any and to what amount, and upon what terms loans of money may or can be procured, for the said purposes; and to lay the said calculations, estimates, surveys, maps and plans, with a detailed and comprehensive Report of their proceedings under this Act, including the result of their enquiries with regard to the said loans, before the Governor, Lieutenant Governor, or person Administering the Government of the Province, who shall lay the same before the Provincial Parliament.

V. And be it further enacted by the authority aforesaid, that it shall be lawful for ney but not to the Governor, Lieutenant Governor, or person administering the Government of the Province, to issue one or more Warrants, in favor of the said Commissioners from time to time, provided the total sum for which such Warrants shall be issued, shall not exceed one thousand pounds currency.

V. VI. Et qu'il soit de plus statué par l'autorité susdite, que chaque personne qui sera chargée de l'emploi de quelque partie des deniers affectés par le présent, fera de l'emplo un compte détaillé de tel emploi, faisant ressortir la somme avancée au comptable, fectés par cet la somme alors dépensée, la balance, (si aucune y a,) restant entre ses mains, et le Acie, en renmontant des deniers affectés par le présent à la fin pour laquelle telle avance aura détaillé et dus été faite, restant non dépensé entre les mains du Receveur Général; et que tout tel met allesié, compte sera appuyé de pièces justificatives, auxquelles on renverra d'une manière claire, par des numéros correspondans à ceux des articles de tel compte, lequel sera clos le dixième jour d'Avril et le dixième jour d'Octobre de chaque année pendant laquelle telle dépense sera ainsi faite; et sera attesté devant un Juge de la Cour du Banc du Roi, ou devant un Juge de Paix, et sera transmis à l'Officier à qui il appartiendra de recevoir tel compte dans les quinze jours qui suivront l'expiration des dites périodes respectivement.

An Act to regulate the fees of persons employed by Justices of the Peace in the Country Parishes, as Clerks or Bailiffs in certain cases.

Preamble,

W

HEREAS the want of a Tariff for the persons performing the duty of Clerks and for the Bailiffs and Constables employed by the Justices of the Peace in the Country Parishes gives rise to many abuses and acts of extortion, and it is expedient to provide a remedy therefor: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Assembly of the Province of Lower Canada, constituted and assembled by virtue of and under the authority of an Act passed in the Parliament of Great Britain, intituled, “An Act to repeal certain parts of an Act passed in the fourteenth year "of His Majesty's Reign, intituled, "An Act for making more effectual provision Certain fees for the Government of the Province of Quebec, in North America, and to make "further provision for the government of the said Province"; And it is hereby as Clerks or enacted by the authority of the same, that no individual acting as Clerk to any Justices of the Justice of the Peace in the Country Parishes shall at any time or under any pretext whatever demand or require higher fees than those hereinafter mentioned; that is to say:

For each Copy, six pence currency;

le manque de Tarif pour les Personnes faisant les fonctions de Greffiers, et les Huissiers ou Connétables employés par les Juges de Paix dans les Par roisses des Campagnes, occasionne beaucoup d'abus et d'extortions, et qu'il est expédient d'y remédier; Qu'il soit donc statué par la Très Excellente Majesté du Roi, par et de l'avis et consentement du Conseil Législatif et de l'Assemblée de la Province du Bas Canada, constitués et assemblés en vertu et sous l'autorité d'um Acte passé dans le Parlement de la Grande-Bretagne, intitulé, "Acte qui rappelle certaines parties d'un Acte passé dans la quatorzième année du Règne de Sa Ma... jesté, intitulé, "Acte qui pourvoit plus efficacement pour le Gouvernement de la "Province de Quebec, dans l'Amérique Septentrionale ;"Et qui pourvoit plus ample. person performing the duty of Clerk shall not require any payment for any paper he may prepare in any criminal prosecution (mere assaults and. batteries excepted) and shall under the dictation and order of the Justice of the Peace, keep the Register of such Justice of the Peace without being intitled to any remuneration for so doing, and such Clerk shall likewise at his own cost (either by employing a person to perform the duty of Crier or otherwise) cause order to be maintained during the sittings of the Court, and shall execute all the orders which shall be made by any such Justice of the Peace in that behalf.

II. And be it further enacted by the authority aforesaid, that no Bailiff or ConConstable to stable employed to execute the orders of any Justice of the Peace, shall at any time fees than those or under any pretext whatsoever demand or require higher fees than those hereinherein menti. after mentioned, that is to say; for executing any warrant of arrest five shillings currency, and two shillings and six pence currency for his assistant (record) under execution, the publication included, seven shillings and sixpence currency, and one shilling and three pence currency, for his assistant. And for a seizure only not followed by a sale, one half of the said fees. For the service of any summons, subpoena, or order, one shilling currency, and one shilling currency for each league travelled to serve the same, the distance in returning not to be reckoned. For each Official Return of illegal resistance, two shillings and six pence currency, and one shilling and three pence currency for his assistant. Provided always, that whenever any Bailiff or Constable shall serve several summons or subpoenas for the same complainant, at the same time, and on the same road, he shall only be entitled to travelling expences as for one journey, and the fees for the services.

III. And be it further enacted by the authority aforesaid, that every person who shall contravene this Act shall be liable to a penalty not exceeding five pounds currency, recoverable in a summary way before any Justice of the Peace, of the District on legal proof, and whereof one moiety shall go to the Prosecutor, with reasonable costs, and the other moiety shall belong to His Majesty for the public uses of the Province, and shall be accounted for to His Majesty, His Heirs and Successors through the Lords Commisioners of His Majesty's Treasury, in such manner and form as it shall please His Majesty, His Heirs and Successors to direct.

IV. And be it further enacted by the authority aforesaid, that it shall be lawful point one or for any Justice of the Peace to appoint one or more Constables if need shall be, to bles to exe- execute the orders of such Justice of the Peace, to which Constables such Justice of cute his orders, the Peace is hereby empowered to administer the requisite oath, which shall be enregistered in the Register of such Justice of the Peace.
