may have been agreed upon between the said company and the said commissioners or their successors. The payment therefor shall be made within four months after the delivery to the comptroller of said city, of good and sufficient and duly executed instrument or instruments of conveyance or transfer to the said mayor, aldermen and commonalty of the said city, such transfer, however, to be subject to any valid liens then thereon outstanding, not exceeding fifty per cent. on the actual cost of such subways, and subject to all leases or contracts for the use of such subways then existing. In order to raise the money necessary to pay for said property so purchased, the comptroller of said city shall issue bonds of said city upon such terms as to rate of interest and time of payment as he shall be directed by said commissioners of the sinking fund to issue.

LAWS 1892, CHAPTER 454.

AN ACT relating to underground electrical conductors and electrical subways in cities of this state having according to the last census a population exceeding half a million and less than

one million.

Section 1. Commissioners. Within twenty days after the passage of this act, in every city of this state according to the last census having a population exceeding half a million and less than one million, the mayor of said city is hereby authorized to appoint two disinterested persons who shall be residents of such city to be the commissioners of electrical subways; such persons shall qualify by taking the constitutional oath of office. The said commissioners are hereby authorized to appoint such officers and subordinates as they may deem necessary.

§ 2. Powers and duties. The said commissioners shall have and possess the same power and authority, and in each and every respect be subject to the same duties as in and by an act providing for placing electrical conductors underground in the cities of this state, and for commissioners of electrical subways, passed June thirteenth, eighteen hundred and eighty-five, were held or possessed by and imposed upon the commissioners provided for by said act in cities having the population hereinbefore prescribed. The term of office of such commissioners shall expire on the first day of November, eighteen hundred and ninety-six, and from and

after said time the powers and duties of said commissioners shall in each of such cities devolve upon and be vested in the mayor of such city, and the commissioner of city works, or in place of the commissioner of city works in such other local officer having the charge of the streets and highways of such city.

§ 3. Salary and expenses. The salary of each of said commissioners shall be three thousand dollars per annum, payable monthly, which, with all necessary and incidental expenses of the commissioners, shall be paid by the comptroller of this state and collected from the several companies operating the conductors in the manner prescribed in and by section seven of the aforesaid act, passed June thirteenth, eighteen hundred and eighty-five.
