18. 19 20, 22223 24 25 3 resided on other than Federal property (A) with a parent employed on Federal property which was located in whole or in part in the county or counties in which the school district of such agency was located or (B) having a parent on active duty in the uniformed services (as defined in section 102 of the Career Compensation Act of 1949); and "(3) 20 per centum of the number of pupils (not otherwise counted) who, during such year, were in average daily attendance at the schools of such agency and resided on other than Federal property with a parent employed on Federal property which was not located in whole or in part in the county or counties in which the school district of such agency was located. "ASSISTANCE TO LOCAL EDUCATIONAL AGENCIES WITH GREATER THAN AVERAGE CONCENTRATIONS OF FED ERAL IMPACT PUPILS "SEC. 12. (a) A local educational agency shall be eligible for assistance under this section for any fiscal year for which its adjusted number of Federal impact pupils exceeds, by more than five, the lesser of (A) one thousand or (B) a number equal to 3 per centum of (i) the total number of pupils in average daily attendance at the schools. of such agency during such year minus (ii) such adjusted number of Federal impact pupils. 1 2 4 "(b) Subject to the provisions of subsection (e), such agency shall be entitled for such year to an amount equal 3 to the excess of its adjusted number of Federal impact 4 pupils over the lesser of one thousand or the number de5 termined under clause (B) of subsection (a) multiplied by the Federal payment rate determined under subsection 7 (c) or (d), whichever is applicable. 8 "(C) Except as provided in subsection (d), the pay9 ment rate for a local educational agency for a fiscal year 10 shall be an amount equal to 60 per centum of the average 11 per pupil expenditure (as determined in paragraph (3)) in 12 the United States except that such amount shall be multi plied by such agency's effort factor, if such factor is more than 1.00. For the purpose of this subsection "(1) the term 'effort factor' with respect to a local educational agency for a fiscal year shall be computed by "(A) dividing the average per pupil expenditure in the State in which such agency is situated by the per capita personal income of such State; "(B) dividing the average per pupil expenditure (as determined in paragraph (3)) in the United States by the per capita personal income of the United States; and "(C) dividing the quotient obtained under 5 6 7 со 10 clause 5 (A) by the quotient obtained under clause (B); "(2) the United States means the fifty States and the District of Columbia; "(3) the average per pupil expenditure in a State and in the United States shall be the aggregate current expenditures, during the fiscal year preceding the fiscal year for which the computation is made, as estimated by 9 the Commissioner, of all local educational agencies in the State, or in the United States, respectively, plus any direct current expenditures by the State and States, respectively, for the operation of such agencies divided by the aggregate number of pupils in average daily attendance during such preceding fiscal year; 11 12 13 14 345 15 16 17 18 19 20 "(4) the per capita personal income of a State and the United States shall be determined by the Commissioner on the basis of data for the fiscal year preceding the fiscal year for which the computation is made avail able from the Department of Commerce. "(d) The Federal payment rate for any local educa21 tional agency in Puerto Rico, Wake Island, Guam, American 222 Samoa, or the Virgin Islands, or in any State in which a 23 substantial proportion of the land is in unorganized territory 24 for which a State agency is the local educational agency, shall be determined for any fiscal year by the Commissioner in ac 6 1 cordance with policies and principles which will, in his judg2 ment, best effectuate the purpose of this title and most nearly 3 approximate the policies and principles provided herein for 4 determining payment rates. 5 "(e) In determining the amount to which a local edu6 cational agency is entitled under this section for a fiscal year, 7 the Commissioner shall deduct from the amount determined 8 under subsection (b) the sum of (1) such amount as he 9 determines such agency derived, directly or indirectly, for 10 such year on account of any taxes, payments in lieu of taxes, 11 shared revenues, or other payments, with respect to any property (or any improvements, personal, or other property 13 situated thereon, any interest therein, and any activity there 12 14 15 16 17 on) which is the basis of a determination of an adjusted num ber of Federal impact pupils of such agency for such year, and (2) such amount as he determines to be the value of any transportation, custodial, or maintenance services furnished 18 such agency by the United States during such year. "SEC. 13. (a) A local educational agency shall be eligible for assistance under this section for a fiscal year if the Commissioner determines that there will be in the school district of such agency during such year an adjusted number 7 1 of Federal impact pupils (as determined in accordance with 2 section 11 but computed with respect to average daily mem3 bership in lieu of average daily attendance) in excess of 50 4 per centum of the number of all pupils in average daily mem5 bership in the schools of such agency. A local educational agency eligible for assistance under this section shall not be 7 eligible for assistance under section 12. 6 8 10 "(b) The Commissioner shall pay to each local educa 9 tional agency eligible for assistance under this section for any fiscal year an amount equal to (1) the sum of the cur11 rent expenditures which he determines to be necessary to 12 provide a reasonable standard of free public education for 13 such year in the school district of such agency less (2) the 14 amount which he determines to be available to such agency 15 for such expenditures from local, State, and other Federal sources for such year, including the amount which he de17 termines would be raised if such agency were to levy taxes 16 18 at the average tax rate for the State on equalized assessed 19 valuation (as determined under State law) of taxable prop20 erty within such school district: Provided, That no educa21 tional agency shall be entitled to assistance under this section unless the eligibility of such agency under State law for State aid with respect to the free public education of children residing on Federal property, and the amount of such aid, is determined on a basis no less favorable to such agency than |
