each year, for the term of three years, direct and order the levy, assessment and collection of such sum as they shall by a vote at said meeting determine, not exceeding five hundred dollars in any one year, in addition to what they are now authorised by law to raise in said town, for the support of roads and bridges in said town.

$ 2. It shall be the duty of the board of supervisors of said county, to cause the amount that may, by said town be directed to be levied by virtue of this act, to be assess ed, levied and collected upon said town, in the same manner as other town charges of said town are directed to be collected.

$ 3. This act shall take effect immediately after its pas sage.

CHAP. 34.

AN ACT to alter the terms of the courts of common pleas and general sessions, in and for the county of Delaware. Passed February 25, 1833.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

$1. There shall hereafter be four several terms of the court of common pleas and general sessions, held in and for the county of Delaware, in each year, instead of three terms, as now provided by law, commencing as follows, namely: on the fourth Monday of February, the third Monday of June, and the second Mondays of September and December, which said terms shall respectively be called the February, June, September and December terms of the said courts; but no grand jury shall be summoned to attend the said June, September or December terms, unless the first or senior judge and the district attorney of the said county shall certify to the clerk of the said county, thirty days before term, that a grand jury will be ne-

cessary.

S2. All process already issued and made returnable of the first Monday of June next, shall be returnable on the third Monday of the same month.

$3. This act shall take effect immediately after its pas-sage.

CHAP. 35.

AN ACT extending the time for the collection of taxes in the county of Albany.

Passed February 26, 1833.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

$1. If the collector of taxes of the several wards of the city of Albany, and of the several towns of the county of Albany, shall renew the security which they have respectively given, in such manner as the supervisor of the town or ward in which such collector may reside, shall reasonably require, then the time for the collection and making the return of taxes shall be extended (in the said county,) to the first day of April, one thousand eight hundred and thirty-three.

$2. This act shall take effect from the passage thereof.

CHAP. 36.

AN ACT for the appointment of commissioners in relation to supplying the city of New-York with pure and whole

some water.

Passed February 26, 1833.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

$1. The governor shall nominate, and with the consent of the senate, shall appoint five persons, to be known missioners. as the water commissioners for the city of New-York, who shall be citizens and inhabitants of the said city.

$ 2. It shall be the duty of the said commissioners to examine and consider all matters relative to supplying the city of New-York with a sufficient quantity of pure and wholesome water for the use of its inhabitants, and the amount of money necessary to effect that object.

$ 3. The said commissioners shall have power to employ engineers, surveyors, and such other persons as in engineers. their opinion may be necessary to enable them to fulfil their duties under this act.

$4. The said commissioners shall make a report of, their proceedings under this act, which shall contain their opinion as to the best plan of furnishing the city of NewYork with a sufficient supply of pure and wholesome wa

ter, and an estimate of the expense of carrying such plan into effect; also the reasons and calculations upon which such opinion and estimate may be founded; and generally all such information connected with the object of their appointment, as they may deem important.

$ 5. The said commissioners shall present a copy of the mon council. said report to the common council of the city of NewYork, on or before the first day of November, of the yearone thousand eight hundred and thirty-three; and their said report shall be made and presented by them to the legislature, on or before the second Monday of January, of the year one thousand eight hundred and thirty-four.

S 6. This act shall continue in force one year from the passage thereof.

$ 8. All reasonable expenses to be incurred under this act, shall be paid by the mayor, aldermen, and commonalty of the city of New-York.

CHAP. 37.

AN ACT providing for the appointment of two additional inspectors of sole-leather for the city of New-York.

Passed February 26, 1833.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

$1. It shall be the duty of the person administering the government of this state to nominate, and by and with the consent of the senate, appoint two inspectors of sole-leather for the city of New-York, in addition to the number now authorised by law, which inspectors before they enter upon the duties of their offices, shall take and subscribe the oath or affirmation required by the constitution of this state.

$ 2. This law shall take effect immediately on the passage thereof.

CHAP. 38.

AN ACT to authorise the Matteawan company to extend their capital.

Passed February 27, 1833.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

$1. The Matteawan company, of the town of Fishkill, in Dutchess county, are hereby authorised to extend their capital to two hundred thousand dollars.

CHAP. 39.

AN ACT in addition to the act entitled "An act to provide for the erection of a new stone jail in the county of Cayuga, passed March 30th, 1832."

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

S1. The treasurer of this state, upon the warrant of $4,500 to be the comptroller to be drawn for that purpose, is hereby paid to B directed out of any moneys in the treasury belonging to the capital of the common school fund, to pay to Bradly Tuttle, Truman I. McMaster and Joshua Haskins, commissioners appointed by an act of the legislature, entitled "An act to provide for the erection of a new stone jail in the county of Cayuga," passed March 30, 1832, the sum of four thousand five hundred dollars, to be expended by the said commissioners in erecting and completing such jail, which sum of four thousand five hundred dollars shall be charged in the books of the comptroller as a debt due from the county of Cayuga to this state, with interest thereon at the rate of six per cent per annum, and the said debt shall belong to the common school fund.

$ 2. The comptroller at the time of the payment of Receipt to be the said moneys to the said commissioners, shall take taken. their receipt or the receipt of a majority of such commissioners for the same.

lecting, as will be sufficient with said sum of two thousand dollars, and with the sum of two thousand five hundred dollars in and by the before mentioned act, directed to be levied at the annual meeting of said supervisors in the year one thousand eight hundred and thirty-three, to extinguish the debt aforesaid, on the third Tuesday in February, one thousand eight hundred and thirty-five.

S 4. The third section of the act herein before mentioned is hereby repealed; and it shall be the duty of the treasurer of the county aforesaid, as soon as the sum of two thousand five hundred dollars, which by the said act is directed to be levied at the annual meeting of the supervisors, in the year one thousand eight hundred and thirty-two, shall be collected, to pay the same to the said commissioners, to be expended in erecting and completing the said jail, and to take the receipt of the said commissioners, or a majority of them, for the same.

$5. On or before the third Tuesday in February, in the year one thousand eight hundred and thirty-four, it shall be the duty of the treasurer of the county of Cayuga to pay into the treasury of this state, the sum of money which shall have been collected under the assessment by the act aforesaid, directed to be made by said board of supervisors in the year one thousand eight hundred and thirty-three, which moneys shall be applied to the payment of the interest then due, and the balance thereof upon the principal sum of the debt aforesaid.

$ 6, It shall be the duty of the treasurer of the said county of Cayuga, on or before the third Tuesday in February, one thousand eight hundred and thirty-five, to pay into the treasury of this state, the balance of principal and interest then due on the debt aforesaid:" and upon such payment being made, the said debt shall be extinguished.

$7. The commissioners aforesaid shall erect the said apartments. jail upon such a plan as will furnish proper apartments within the same for the keeper thereof,

$s. The commissioners aforesaid shall account to the board of supervisors of said county, for the faithful expenditure of all moneys which may come to their hands by virtue of this act, when called upon by said board so to do.
