AN ACT to amend an act, entitled "An act to incorporate the Junction Canal Company," passed 21st April

1828.

Passed April 12, 1833.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

$1. The time for completing the junction canal, is Timo extend hereby extended two years, but nothing contained in the ed act hereby amended, shall authorise said Junction Canal Company, to make or construct any improvements, inconsistent with the rights and privileges granted to the Union Bridge Company by an act, entitled "An act to incorporate the Union Bridge Company," passed February 22d,

CHAP. 149.

AN ACT to authorise commissioners of highways to aḍminister oaths in certain cases.

Passed April 12, 1833.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

S 1. The commissioners of highways are authorised to administer the oath required by the fifty-first section of title first, article third, chapter sixteenth, part first of the Revised Statutes.

CHAP. 150.

AN ACT to amend an act, entitled "An act to incorporate the village of Little-Falls, in the county of Herkimer."

Passed April 12, 1833. The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

S1. The boundaries of the corporation of the village of Little-Falls are hereby extended, beginning at the present line, at the southeast corner of H. Becker's farm, and running thence to the southwest corner of Friend Cook's farm; thence east along the north side of the highway, to Peter Eysaman junior's farm; thence south to the present line of the corporation.

$ 2. The trustees of the village of Little-Falls, in addition to the powers conferred on them by the acts hereby amended, shall have power to make and publish police regulations and ordinances for the prevention of noise and disturbances, for the dispersion of disorderly and riotous assemblages, and for the preservation of quiet and good order and morality within the limits of said village; to provide for the infliction of penalties upon all offenders against the said regulations and ordinances, not exceeding twenty-five dollars for any one offence; and to appoint an admeasurer of firewood, timber and lumber in said village (who may be removed at pleasure by them;) and shall in their by-laws from time to time define and prescribe his duties, powers and compensation, and to which he and all others shall conform, under such penalty as shall from time to time be prescribed by their by-laws; to compel the clearing off and cleansing the streets, sidewalks, alleys and other public places within said village, and to cause all grounds and lots, cellars, and other places within the same, wherein any offensive materials, pools of water, or other thing dangerous to the health of said village shall exist, to be cleared, drained, cleansed and otherwise purified, so as the same shall be safe; to pass ordinances for the preservation of the public health, and the prevention of contagious and malignant diseases; to take conveyance of, and in their corporate capacity to hold such grounds and lots as may be conveyed to them for the benefit of said village and for public squares, market places and public buildings; to cause to be improved, cultivated, ornamented and kept in good order, all public grounds, squares and places now or hereafter to be laid out within said village, and also such grounds and lots as they may hold for the benefit of said village, and to cause

the expenses of such improvement to be estimated, as-
sessed and collected upon and from all the lots fronting on
said squares, grounds and places, and upon streets that
run past or adjoin upon the same, in proportion to the be-
nefits and advantages which the owners or occupants of
said lots shall be deemed to acquire by such improve-
ments, in the same manner as the said trustees are now
authorised to open and improve streets, and to estimate,
assess and collect the expenses thereof, and to make all
such rules and regulations, by-laws, ordinances and provi-
sions as may
be necessary and proper to carry

S 4. The said trustees shall have power to appoint a Police conpolice constable for said village, who may be removed at the pleasure of the board of trustees, and who shall have power and it shall be his duty to keep order in all public places within said village, and to arrest all persons who are present, or are concerned in riotous, disorderly or noisy assemblages, or who break the public peace in his presence, and to convey them before a magistrate, to be dealt with according to law: and also upon the warrant of the president of said village, or of any justice of the peace residing within the same, to arrest vagrants, disorderly and suspected persons, and disturbers of the peace, and others charged with offences against the by-laws, ordinances and regulations of said village, and to take them before the magistrate who issued said warrant, or any other magistrate within the village, to be dealt with according to law, and to keep and retain such persons in custody until committed or duly discharged. The said constable shall be allowed the same compensation for his services as other peace officers, and his charges for the same shall be audited and allowed by the board of supervisors of the county of Herkimer, in like manner. in any civil prosecution against said constable for any act or omission happening in the execution of his duties, he may plead the general issue, and give special matter of defence in evidence; and if the plaintiff in any such action shall discontinue, be nonsuited, or judgment shall pass

against him by default, verdict or otherwise, the said con stable shall recover treble costs.

$ 5. The trustees of said village shall have power to appoint a street commissioner, who shall be removable at their pleasure, and who, under the direction of the president and trustees of said village, shall have the charge and management of all improvements in the public streets, squares and sidewalks in said village, and who shall be paid for his services such reasonable compensation as the trustees may from time to time direct, out of the funds by which such improvements shall be respectively made, and which shall be accounted a part of the expense thereof.

S 6. It shall not be lawful for any overseer of highways in any road district, in whole or in part, comprised within said village, to lay out any labor upon any street or highway within said village, except in such places and in such manner as the president or trustees of said village, or the street commissioner of the same shall direct; and the overseer of such districts as lie wholly or in part within said village, are hereby directed and required to lay out and expend a portion not exceeding one-half of their respective assessments of highway labor assessed on the inhabitants of said village, and on lands and property lying within the same, upon such roads and streets, and in such manner as the trustees of said village may direct, notwithstanding such roads or streets may not be within the territory of their respective districts.

$7. No tavern license shall be granted by the commissioners of excise within the limits of said corporation, except by consent of the board of trustees of said village; but the corporation shall charge no license fee for such consent; and the said trustees are hereby authorised to prosecute as well all offenders against the excise laws within their corporation limits, as all other offenders against the ordinances of said village, prohibiting the sale of ardent spirits and the keeping of petty groceries, victualling-houses and ordinaries without license; and all such penalties recovered, together with the license fees of such groceries, victualling-houses and ordinaries, as shall be duly licensed in said village, shall belong to said corporation. And the said trustees are hereby authorised to increase the fees for any such license allowing the sale of ardent spirits to a sum not exceeding fifty dollars for any

one year.

CHAP. 151.

AN ACT to incorporate the village of Mendon.

Passed April 12, 1833.

The People of the State of New-York, represented in Senate and Assembly, do enact as follows:

1. All that district of country in the town of Men- Boundaries. don and county of Monroe, contained within the following limits, that is to say: commencing at the point where the roads intersect each other that lead from Bloomfield to Pittsford, and from West-Mendon to Victor, and running one-half mile north, one half mile south, one-half mile east and one-half mile west, from said place of beginning, containing a part of said town one mile square; which shall hereafter be known by the name of the village of Mendon.

$2. There shall be five trustees of said village, who Trustees. shall be elected by ballot annually in public meeting by the inhabitants thereof qualified to vote for town officers, on the first Monday in May in each year. They shall be freeholders, and all officers appointed by them shall be residents of the village. Notice in writing of the time and place of such meeting shall be put up in three of the most public places in said village eight days previous thereto. The first meeting shall be called by the justices or justice of the peace residing in said village, who shall preside thereat. The trustees shall call and preside at all subsequent meetings. The presiding officers shall determine the qualifications of voters, and in open meeting declare the result. A plurality of votes shall constitute a choice. S3. The trustees shall elect one of their number to be their president, and designate any other trustee to preside at their meetings in his absence. They may appoint a clerk, treasurer, collector, constable and pound-master, who shall hold their offices for one year, unless sooner removed by the trustees, and shall give such security for the faithful performance of the duties of their offices as the trustees may require. The clerk shall keep all the records and papers belonging to said village. The collector, constable and pound-master shall have the same powers, duties, privileges, and be subject to the same liabilities as similar officers in the towns of this state; but the constable shall have no authority to serve or execute any civil process out of said village, except it be in favor of said village, or against an inhabitant thereof, or other persons fleeing from it. The collector shall be entitled, for his services, to five per cent upon all moneys by him
