CHAP. CCCXVII.

AN ACT exempting from taxation, houses devoted to public worship and seminaries of learning, and the ground on which they are erected.

APPROVED, January 31, 1816.

SEC. 1. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That the several houses which now are, or shall hereafter be erected in this state, for the purpose of public worship, shall be, while they continue to be exclusively devoted to that object, exempt from taxation for state or corporation purposes.

SEC. 2. Be it further enacted, That the land permitted by the laws of this state to be held by any denomination of christians in a fiducial or individual capacity, for devotional purposes, shall be, and remain alike exempt from taxation.

SEC. 3. Be it further enacted, That the land upon which any seminary of learning may have been, or shall hereafter be erected, to the extent of five acres, held fiducially or individually for purposes of learning; together with the buildings thereon, devoted to that object, shall be alike exempt from taxation.

SEC. 4. Be it further enacted, That all libraries &c. held fiducially or individually for seminary or church objects, shall be alike exempt from taxa

CHAP. CCCXVIII.

AN ACT authorizing Lotteries for certain purposes therein mentioned.

APPROVED, January 31, 1816.

WHEREAS, the convenience of the citizens of the town of Danville, as well as that of the adjacent country, would be greatly promoted by having the main street of said town paved, and as the town

are unable to raise the necessary funds for that purpose.

SEC. 1. SEC. 2. The drawing of said lottery shall take place in the said town of Danville, and shall not commence, unless two of the justices of the pence for the county of Mercer, are present; whose duty it shall be, to see that the same is fairly and properly conducted: and each of the drawers, examiners and clerks, and all others concerned in drawing said lottery, shall, before the same commences, take an oath before some justice of the peace, “to act fairly and impartially.” And if said lottery is not drawn within two years from the passage of this act, it shall be lawful for the purchasers of tickets to demand and receive the money they have respectively paid, from the persons receiving the same; or in case the said commissioners shall not within two years from the drawing of said lottery, apply the proceeds towards the purposes specified in this act, it shall be also lawful for the purchasers of tickets, to recover back their money from said commissioners in like manner.

SEC. 5. And be it further enacted, That it shall and may be lawful, for William R. SEC. 7. Be it further enacted, by the authorityaforesaid, That it shall and may be lawful for Samuel M Millin, senr. The drawing of said lottery to take place in the town of Cynthiana, in the presence of two justices of the peace for the county of Harrison, subject to the same rules, regulations, and penalties, as are before described.

CHAP. CCCXIX. ·

AN ACT vesting certain powers in the Trustees of the Methodist Brick Chapel, in Shelby county.

APPROVED, January 31, 1816.

WHEREAS, it is represented to the present General Assembly of the Commonwealth of Kentucky, that the trustees of the methodist brick chapel, in Shelby county, received a conveyance from Mathew Sparks and wife, for three acres of land in trust, for the use of said methodist society: And it is further represented, that it is the wish, and would promote the interest of said society, to

sell the said three acres of land, and apply the proceeds of such sale, in finishing their church contiguous thereto :

SEC. 1. Be it therefore enacted by the General Assembly of the Commonwealth of Kentucky, That the trustees of said methodist brick chapel, or a majority of them, are hereby authorized and empowered to sell and convey title to the said three acres of land, and apply the proceeds thereof to the purpose above recited in the preamble to this act.

CHAP. CCCXX

AN ACT to authorize Jeremiah Buckley to build a bridge across Kentucky river.

APPROVED, January 31, 1816.

SEC. 1. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That Jeremiah Buckley or his assigns, his or their heirs, or legal representatives, be, and he or they are hereby authorized, to erect a floating bridge across the Kentucky river, at said Buckley's ferry, opposite his ware-house, upon the terms and conditions hereafter mentioned, to-wit: First, that the same shall be completed within two years from and after the first day of September next: Secondly, that it shall not in any manner, injure the navigation of said river: Third, that the said Buckley, or his assigns, shall, before he commences the erection of said bridge, enter into bond with good and suffiTo enter inte cient security, in the secretary's office, in the penalty of twenty thousand dollars, payable to the governor of this state and his successors; conditioned for the payment of all damages which may be sustained by persons navigating said river, by the erection of said bridge. On which bond, all and every person or persons navigating the same, who may be injured by the erection of said bridge, may bring suit and recover all damages they may have sustained thereby.
