the qualified voters of said precinct, may at all elections meet and give their votes at the house now occupied by Samuel Frederick, in the town of Jefferson Provided, however, that all the citizens of said county may vote indiscriminately, either in said precinct, or at the court-house.

SEC.2.Be it further enacted. That the county court of said county, shall, at the time of appointing judges and a clerk to attend the elections at the courthouse, to appoint judges and a clerk to attend the election in said precinct; and in case of said judges or clerk, or either failing to act, the vacancy shall be supplied as in other cases: and they shall be entitled to the same allowance, to be paid in like manner, and under the same penalties, as is directed by law in similar cases.

SEC.3. Be it further enacted, That the sheriff of said county shall by himself or deputy attend the said election, conduct the same according to the laws now in force; and shall on the Thursday succeeding the close of the election, meet at the court house, and on comparing the polls, shall give a certificate, and make the returns required by law.

CHAP. CCLXXXIII.

AN ACT to extend the time for returning plats and certificates into the Register's office, and for surveying certain lands in this Commonwealth.

APPROVED, January 4, 1816.

WHEREAS, it is represented to the General Assembly, that the law is about to expire, allowing a further time to return plats and certificates of surveys to the Register's office, and that injury will result to many of the purchasers of land under the several laws providing for the sale of vacant lands in consequence thereof: Wherefore,

SEC. 1. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That the further time of three years after the passage of this act, be to return survey allowed the several purchasers under the laws

of this commonwealth, enacted since the year 1792, for the sale of vacant lands, to survey the same, and return their plats and certificates of survey to the Register's office; and it shall be the duty of the Register to receive and register the same: Provided, however, that nothing herein contained, shall authorize the returning and registering plats and certificates for lands not now authorized by law.

CHAP. CCLXXXIV.

AN ACT for the relief of certain clerks in this Commonwealth.

APPROVED, January 4, 1816.

Be it enacted by the Ceneral Assembly of the Commonwealth of Kentucky, That the clerk of any of the courts in this Commonwealth, who may have failed to execute bond in the time prescribed by law, shall, and they are hereby allowed six months, from and after the passage of this act, to execute their bonds; which bonds, when executed, shall be as effectual to all intents and purposes, as if the same had been executed in the time prescribed by any law in force upon that subject.

CHAP. CCLXXXV.

AN ACT for the relief of Asa Killam.

APPROVED, January 4, 1816.

WHEREAS, it is represented to the General Assembly, that Asa Killam of Hardin county, by purchase, settled and improved three hundred acres of land on Nolin; that he has been residing thereon since the year 1788, and regularly paid the taxes; that the land has been entered by virtue of a treasury warrant from the state of Virginia, and conveyed to said Killam by the executor of Philip

Philips, deceased, and that it has been discovered by said Killam, that no grant has been issued, nor the survey returned on said entry; and as doubts have arisen, whether said Killam is authorized as an actual settler to appropriate said land: Therefore,

SEC. 1. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That the Register Registerte is shall issue a warrant for three hundred acres of land unto the said Asa Killam, without his paying the state price therefor; and in all other repects, it shall be lawful for the said Killam to carry into grant, the said three hundred acres, including where he lives, with the exclusive privilege of an actual settler, under the provisions of the laws passed last session of the Assembly, and this, for appropriating the vacant lands in this Commonwealth; and the Register of the land office, shall issue a grant to the said Asa Killam, his heirs or assigns, at the end of two months from the day on which the plat and certificate of survey of the said three hundred acres of land shall be returned to his office, which shall fully vest in the said Killam, his heirs or assigns, the title of this commonwealth.

Provided, That nothing herein contained, shall Proviso. impair the right or rights now existing, of any person or persons, bodies politic or corporate, who may claim said land, either in law or equity.

CHAP. CCLXXXVI.

AN ACT for the relief of Joshua Cates, and the trustees of the Harrison Seminary.

APPROVED January 6, 1816.

WHEREAS, it is represented to the General Assembly, that Joshua Cates, has become the purchaser of five thousand two hundred and fifty acres of land, part of the donation allowed the Harrison seminary, and that the same land hath been previously located and carried into grant apon settle ment rights:

other county as may have been stricken off from such county, and by his own oath, That he was the owner of said land at the passage of this act, and that he has not previously obtained a similar certificate from any other justice of the peace, in order to obtain indulgence under this, or any other law upon the subject: which oath shall be stated in said certificate, and returned to, and filed in the Auditor's office: such justice shall without fee, give to such applicant, a certificate that he was ac tually and in good faith, a settler at the passage of this act, within the county wherein the land now lies, or was originally granted, or such other county as may have been stricken from it; which certificate shall also contain a description of the land for which said indulgence was granted, by shewing the number and date of the certificate, and the name or names of the person or persons to whom the same was originally granted.

SEC. 3. Where a certificate as above described, shall be furnished the Auditor on or before the fifteenth day of October next, he shall file the same, tificate is returnand make a note thereof in the margin opposite the claim certified; and the land so described, shall not be sold by the Register as in other cases.

SEC. 4. Be it further enacted, That every person who may obtain a certificate under the provisions of this act, as well as those who have heretofore obtained certificates under the provisions of the acts passed the first day of February, one thousand eight hundred and thirteen, the twenty-first day of January, one thousand eight hundred and fourteen, and the second day of January, one thousand eight hundred and fifteen, further to regulate the payment of the debt due the commonwealth for the sale of vacant land, who shall pay into the public treasury the first day of January, one thousand eight hundred and seventeen, the whole amount of the state price, or the balance, in case of a partial payment already made, shall be entitled to a discount of all the interest due, or to become due thereon.
