and to establish a board of health, and to regulate the quarantine of vessels coming to the said port.

Sec. V. And be it further enacted, That the said corporation shall have full power and authority to provide for the due and orderly exercise of the powers herein before granted and conferred; for this purpose, to enact and establish all proper laws and ordinances, not contrary to the laws of the Commonwealth or of the United States.

Sec. VI. This act shall be in force from the passing thereof.

An Act establishing an inspection and storage of Tobacco, in the Borough of Norfolk.

(Passed January 31st, 1818.)

Section I. Be it enacted by the General Assembly, That an inspection of tobacco shall be, and the same is hereby established at such place in the borough of Norfolk, and to be called and known by such name as the court and common council of the said borough may direct. The proprietor of the said warehouse shall erect at his own expense, sufficient houses for the reception of tobacco, to be built of brick or stone, and covered with slate or tile; and, so soon as the same shall be completed, the Hustings Court of Norfolk borough shall recommend fit persons to be commissioned inspectors thereof.

Sec. II. It shall be the duty of the said inspector, or inspectors, as the case may be, to receive and store such tobacco as shall be inspected and brought from the upland warehouses, in case there be room for the same, and deliver it for exportation when demanded in manner as prescribed by law for tobacco inspections, receiving for each hogshead, previous to the delivery thereof, the sum of fifty cents; thirty-five cents whereof shall be paid to the owner or owners of said warehouse, and the remaining fifteen cents to the said inspector or inspectors; subject in other respects to the same rules and regulations as are prescribed by the law concerning the public warehouses in the cities of Richmond and Petersburg.

Sec. HI. There shall be allowed and paid annually, to each of the inspectors at the said warehouse, the sum of two hundred and fifty dollars for their salary: Provided always, that if the quantity of tobacco inspected at the said warehouse shall not be sufficient to pay the usual charges and the inspectors' salaries, the deficiency shall not be paid by the public.

Sec. IV. The duty on tobacco inspected at the said warehouse shall be the same, and collected, accounted for, and paid, in like

manner, as is prescribed by law for other tobacco inspections. Sec. V. This act shall be in force from the passing thereof.

An Act repealing in part the first section of the Act, entitled an "Act to extend the jurisdiction, and enlarge the powers of the corporation of the Borough of Norfolk.

(Passed March 10th, 1819.)

Section I. Be it enacted by the General Assembly, That so much of the first section of the act, entitled "an act to extend the jurisdiction and enlarge the powers of the corporation of the borough of Norfolk," passed on the fourth day of February, in the year one thousand eight hundred and eighteen, as extends the jurisdiction of the borough of Norfolk, its courts and officers upon the water beyond the following limits, that is to say: from the bridges over the eastern and southern branches of Elizabeth river, to a line running at right angles across the said river from Fort Nelson, to the north-eastern shore thereof; and so much of said section as gives police jurisdiction on the said waters, shall be, and the same is hereby repealed.

Sec. II. This act shall be in force from the passing thereof.

An Act concerning the Norfolk Provident Society.

(Passed January 27th, 1820.)

Section I. Be it enacted by the General Assembly, That the association formed in the Borough of Norfolk, for the purpose of providing a Fund for the benefit of the families of the deceased members thereof, shall be, and the same is hereby created into a body politic and corporate, under the name and style of "The Norfolk Provident Society," and as such shall have perpetual succession and a common seal; with capacity to sue and be sued, plead and be impleaded; to appoint all such officers as they may deem necessary, and to fix their salaries; and to pass all such bye-laws, rules and regulations as they may think necessary and proper: Provided, such bye-laws, rules and regulations are not contrary to the Laws and Constitution of this State, or the United States: and generally to do and perform all matters and things necessary to be done to attain the objects of the said Society: Provided, how

ever, That the said Society shall, in all things, and at all times, be subject to the control of the Legislature.

Sec. II. This act shall be in force from the passing thereof.

An Act to authorise the storage of Flour in the Tobacco Warehouses on the Corporation lands in the Borough of Norfolk.

(Passed February 6th, 1821.)

Section I. Be it enacted by the General Assembly, That it shall be lawful to receive flour on storage in the tobacco warehouses on the corporation lands in the borough of Norfolk; and an inspection of Flour is hereby established at the same, under the like rules and regulations as are prescribed by law for other flour inspections within this commonwealth.

Sec. II. This act shall be in force from the passing thereof.

An Act authorising the Common Council of the Borough of Norfolk, to appropriate and use a certain piece of land therein, as a Burying Ground.

(Passed January 8th, 1825.)

Whereas it is represented to the General Assembly by the common council of the borough of Norfolk, that it would be a great accommodation and convenience to the inhabitants thereof, to enable that body to enclose, occupy and use the piece of land hereinafter described, and which is now vacant, and without any known proprietor or claimant, as and for a burying ground;

Section I. Be it enacted by the General Assembly, That all the right title and interest of the Commonwealth, of, in and to the said piece of land, be, and the same is hereby released, and it shall and may be lawful for the court of hustings of the borough of Norfolk, and they are hereby authorised and required forthwith to award and issue a writ of ad quod damnum, directed to the serjeant of said borough, commanding him to summon twelve able and discreet freeholders, inhabitants of said borough, to meet on the said ground, on some certain day named in the said writ, (of which notice shall be given by the said serjeant by advertisement in some newspaper of said borough, for one month previous to the said day,) to say upon oath what is the present value of a certain piece or parcel of land situate in said borough, and bounded as

follows, to-wit: beginning at the intersection of William Denby's land, lately purchased of Nimmo, with Newton's line on Cumberland-street; thence along the line of the heirs of Thomas Newton deceased, to Newton's creek; thence up and along said creek, and a cove which runs between the said land and Potter's field, to its head; thence south westwardly along said line to said Denby's line; and thence, along said Denby's line, to the beginning; containing about twenty acres more or less; and also, what is the value of said land per acre, per half acre, and per square foot; and the verdict of the jury, together with the writ, shall be returned to the said court, and entered of record therein.

Sec. I. And be it further enacted, That, upon the return of the said verdict. the said land shall be, and the same is hereby sequestered, and vested in the corporation of Norfolk borough, forever: Provided, always, That the said corporation shall, at all times hereafter, be liable to pay to any person or persons who may appear and prove title to the same or any part thereof, the said valuation found by the jury, or his, her or their proper proportion thereof, for his, her or their interest in the said land, according to the said verdict.

Sec. III. And be it further enacted, That, upon the return of the said verdict as aforesaid, it shall and may be lawful for the said common council to occupy, enclose and use the said piece or parcel of land, as and for a burying ground, and to provide by ordinance for the government and regulation of the same in all respects, as they shall deem most adviseable.

Sec. IV. This act shall be in force from and after the passing thereof.

I. Be it ordained by the Common Council of the Borough of Norfolk, in Common Hall assembled, That an Assessor shall annually be appointed, by the Common Council, at the first meeting after the general election in June, in each year, or at such other time, as they may think fit, and shall be notified of his appointment by the Register of the Corporation, and in case of a va- Vacancy how cancy happening in the office of Assessor, by death, supplied. resignation or otherwise, the said Common Council

II. And be it further ordained, That the said Assessor,

subscribe an oath.

before he enters on the duties required of him by this ordinance, shall take and subscribe, before the Mayor, Recorder or one of the Aldermen of the Corporation, To take and an oath, diligently, faithfully and impartially to perform the several duties required of him by this or any other ordinance of the Common Council, which oath, subscribed as aforesaid, and also signed by the Magistrate, before whom it is taken, shall be filed in the office of the Register of the Corporation.

II. And be it further ordained, That the said Assessor shall, in all respects, proceed in the discharge of his duties in the mode prescribed by the laws of the State for the public revenue of the State, where no other mode is prescribed by this, or any other ordinance of the Corporation, and that the said Assessor shall in no case whatever, dispense with the written lists of taxable property, and the oath or affirmation required by law
