ers thereof, the sum of one dollar and a half, and for every corner lot of any street or avenue the sum of two dollars and a half.

IV. And be it further ordained, That whenever the said Surveyor shall be employed by order of the Court or Common Council to take a survey, he shall have and receive at the rate of four dollars per day for the same, and also the sum of one dollar per day shall be allowed him for an assistant, when an assistant shall be necessary. That a protraction or profile of the survey so taken, shall be delivered to the Register of the Corporation, and no further or extra compensation shall be allowed therefor.

V. And be it further ordained, That if any wall shall be erected alongside of any street in the said Corporation, and above the level of the street, without notice thereof having been previously given to the Inspector or Surveyor of the Corporation, the owner and builder of such wall shall forfeit and pay twenty dollars to the use of the Corporation.

VI. And be it further ordained, That upon the said Surveyor being duly notified as aforesaid, it shall be his duty, with the said Inspector, to examine such wall, and to give such directions as may be necessary, to prevent encroachments upon the streets, for which service the Surveyor shall demand and receive from the owner of such wall, one dollar.

VII. And be it further ordained, That the said Surveyor and Inspector, for every refusal or neglect to perform any of the duties required by this Ordinance, after reasonable notice, to be adjudged of by the Mayor, Recorder, or any Alderman of the Corporation, shall forfeit and pay the sum of ten dollars to the use of the Corporation.

VIII. This Ordinance shall commence and be in force from and after the passing thereof, and all Ordinances and parts of Ordinances coming within the purview of this Ordinance, shall be and the same are hereby repealed.

TOBACCO WAREHOUSES.

An Ordinance to provide for the erecting additional houses for the reception of Tobacco, and authorising a loan for that purpose.

(Passed Sept. 2, 1818.)

I. Be it ordained by the Common Council of the Borough of Norfolk, in Common Hall assembled, That Messrs. John Nivison, George Newton, Thomas Reilly, Thomas Williamson and John Tunis, or a majority of them be, and they are hereby constituted and appointed Commissioners to take prompt and efficient measures for placing in a proper state of improvement, the water property extending from the wall in the rear of the Jail, (including the lot recently purchased by the Corporation of Burwell B. Moseley,) as far as Wide Water-street, and also the public lot on Town Point adjoining the present Tobacco Warehouse, by constructing suitable and permanent foundations thereon, and causing to be erected additional houses for the reception of Tobacco..

II. And be it further ordained, That in order to en-able the Commissioners aforesaid, to carry into immediate effect the provisions of the foregoing section, they are fully authorized and empowered, in conjunction with the Mayor, to borrow from any of the Banks of this Borough, on the credit of the Corporation, such sums of money as from time to time may be required to prosecute and accomplish the work committed to them, the payment of which is hereby guaranteed to the Bank or Banks loaning the same.

III. TOWN POINT LANDS.

An Ordinance authorising the sale of certain Lands belonging to the Borough of Norfolk.

(Passed Nov. 2, 1816.)

Whereas, it is represented that many of the lessees of the land belonging to the Borough of Norfolk, formerly known by the name of the Fort Land, and now by the name of the Town Point Lands, are desirous of Preamble. extinguishing the rents payable thereon to the Borough of Norfolk, and it is believed that such a measure, and the consequent change of their titles into a fee simple instead of a leasehold tenure, would be beneficial to the tenants and not injurious to the interests of the Borough of Norfolk,

I. Be it therefore ordained and enacted, That the President and Vice President of the Hall, on the part of the Common Council, with the Recorder of the Borough of Norfolk, be authorised and empowered to make such contracts, with the lessees, or any of them, or other persons, as to them shall appear judicious, for the sale and release of all the rights of the Corporation, in and to the rents payable to the said Borough, on all or any of the lands aforesaid, and for the sale and release of the right and title of the Corporation in and to the said lands, or any part thereof, or of their reversionary interest therein; and on the payment or security for the due payment of the consideration agreed on,

An Ordinance to regulate the digging of Vaults in the

streets.

(Passed July 31, 1818.)

I. Be it ordained by the Common Council of the Borough of Norfolk, in Common Hall assembled, That no vault shall hereafter be constructed or made in any of the streets of the Corporation without the permission of the Mayor, Recorder, or one of the Aldermen of the Corporation, under the penalty of twenty dollars, to be paid by the owner of such vault, and the like penalty to be paid by the master builder, by whom, or under whose direction such vault shall be constructed and made.

II. And be it further ordained, That every application for permission to construct such vault, shall state the number of square feet of ground, together with the width of the same which may be required for the said vault, and shall particularly specify the intended what to state. length, or extent of the same along the street, and the intended width of the same into the street, and that the person for whom such vault is intended to be constructed or made, shall forthwith, after obtaining permission to construct or make the same, and before the commencement thereof, pay to the Collector of the Corporation the sum of fifteen cents for each square foot of ground, which such application as above mentioned, shall state to be required for the said vault, and that no such vault shall extend into the street further than two fifths of the width of such strect, under

III. And be it further ordained, That it shall be the duty of the person for whom such vault may be constructing, to procure the same to be measured by the Surveyor of the Corporation, and to deliver a certificate of the said measurement, signed by such Surveyor, to the Register of the Corporation before the completion of said vault, under the penalty of twenty dollars.

And be it further ordained, That if it shall appear by such certificate, or otherwise, that any such vault does occupy a greater number of square feet than shall have been paid for as aforesaid, the owner of such vault and the master builder, by whom, or under whose direction such vault shall be constructed, shall each forfeit and pay the sum of fifty cents for each been paid for. square foot of ground occupied by such vault over and above the number of square feet paid for as aforesaid. V. And be it further ordained, That it shall be the duty of the Inspector of the Corporation, to give infor-. mation to the Mayor whenever any vault shall be constructing in any of the streets of the said Corporation; and if the said Inspector shall omit or neglect, for forty-eight hours after any vault shall be begun to be constructed in any of the streets of the Corporation, to Penalty for give information thereof to the Mayor, he shall forfeit and pay twenty dollars.

VI. And be it further ordained, That all vaults shall be constructed agreeably to the directions of the Mayor, under the penalty of twenty dollars for each and every offence, to be paid by the person or persons who may cause the same to be made.

VII. And be it further ordained, That the outward side of the grating or opening into the street of any vault which shall hereafter be constructed or made, shall be within twelve inches of the curb stone of the side walk, under the penalty of twenty dollars, to be Penalty. paid by the owner of the said vault.
