ing the duties hereinbefore required of them, shall be defrayed by the Corporation in the first instance; but recovered from the person or persons properly chargeable with the same, according to the provisions of this ordinance; and the Board of Health may, with the consent of the President of the Common Council, draw on the Register, from time to time, for such sums as may be requisite to carry into effect their said duties; and Detailed statethey shall return a detailed statement of their accounts, touching said service, to the Common Council, at the end of each and every year. And in all cases where the Board of Health shall cause any work to be done in pursuance of this ordinance, they shall forthwith return to the Register a particular account of the expense incurred in and about the same, with a specification where necessary and proper, of the proportions in which the several owners, occupiers, or other persons who may be interested in the work, ought to be severally chargeable with the said expense. And the Register is hereby required to put the said accounts into the hands of the Duty of the Inspector or Attorney of the Corporation, for the Register. proper proceedings by warrant or otherwise, against the delinquent or delinquents, for the recovery of said expense from them, without delay.

HEALTH OFFICER.

An Ordinance concerning the Health Officer.

(Passed July 11, 1828.)

I. Be it ordained by the Common Council of the Borough of Norfolk, in Common Hall assembled, That so much of the ordinance, entitled "An ordinance to amend and reduce into one the several ordinances now in force to provide against infectious and pestilential diseases, to regulate the quarantine of vessels coming to the port of Norfolk, and concerning the Health Officer," as allows to the Health Officer, from the Corporation, a compensation of two dollars for visiting a vessel by order of the Board of Health, be and the same is hereby repealed.

II. And be it further ordained, That the Health Officer be, and he is hereby authorised, to demand and receive from the owner, captain, or consignee, of each and every vessel which he may be required to visit by the Board of Health, the sum of two dollars. And if any such owner, captain, or consignee, shall fail, neglect, or refuse to pay the same when demanded by the Health Officer, he or they so failing or refusing, shall forfeit and pay the sum of five dollars, to be recovered by warrant before the Mayor, Recorder, or any Alderman of the Borough.

III. This ordinance shall be in force from and after the passing thereof.

HEALTH (SECURITY OF.)

An Ordinance to prevent Nuisances, and to provide for the security of the Public Health.

(Passed April 15, 1818.)

1. Be it ordained by the Common Council of the Borough of Norfolk, in Common Hall assembled, That the Inspector of the Corporation or persons appointed under him for that purpose, shall and may from time to time, enter into and examine between sunrise and sunset, any building of any kind, cellar, lot of ground, alley, sink, vault or privy in the said Corporation, which he or they may know, or may be informed upon good authority, is foul, damp, sunken or ill constructed, and may direct the cleansing thereof, altering and amending the same, and the removal of all nuisances in and about the same. And if any person shall obstruct the said Inspector, or any persons appointed under him, in the discharge of the duties aforesaid, every such person shall forfeit and pay for every such offence the sum of twenty dollars. And the said Inspector shall report, from time to time, to the Common Council or Mayor, all such buildings, cellars, lots, alleys, sinks, vaults or privics, public or private docks, slips and common sewers, as shall or may in his judgement require to be cleansed, altered or amended, by the authority of the Common Council or Mayor, for the security of the health of the said Corporation.

II. And be it further ordained, That no made ground, or ground formerly covered with salt or stagnant water, within the said corporation, shall be turned up or the surface thereof removed at any time during the months of July, August, September and October, unless on application to the said Inspector, and by special permission obtained from the Common Council or Mayor, under the penalty of twenty dollars for every such offence.

III. And be it further ordained, That no person or persons shall have, use, make or keep in his, her or their dwelling house, out house, cellar, yard, or any other place whatever, in any part of the said Corporation to the Southward of Plume's and Armistead's Rope Walks, any noisome or offensive substance, nor any vat, pit or pool of standing water, whether for Tanners', Skinners', Dyers', or any other use, under the penalty of twenty dollars for each offence.

IV. And be it further ordained, That no Tanners, Skinners, or other persons shall bring to or keep in any part of the said Corporation to the Southward of Plume's and Armistead's Rope Walks, for the period of twenty-four hours, any undressed or uncurried hides, skins or leather, or any blubber or other materials whatever, for dressing the same, which may cause any noisome or offensive smell, under the penalty of ten dollars for every twenty-four hours the same shall be so kept.

V. And be it further ordained, That if any person or ter stands, &c. persons shall erect any booth or establish or fix any stand, in any of the streets or public grounds of the said Corporation (excepting on the fourth of July) for the purpose of opening and exposing for sale any oysters or other kind of shell fish or any other fish, provisions or goods of any kind, without the permission of the Mayor of the said Corporation, every such person shall forfeit and pay for every such offence the sum of five dollars, and the like sum for every day the same shall be so continued.

VII. And be it further ordained, That any Butcher or other person who shall keep a slaughter house or yard within the limits of the Corporation, without a license first had and obtained from the Court of Hustings, (which license is hereby required to be obtained therefrom, under the penalty of twenty dollars for every day he or she shall so keep the same,) shall use especial care and diligence to prevent such slaughter house or yard from becoming offensive, and if at any time nuisances should be occasioned thereby, the party or parties concerned, shall remove and abate the same, after notice from the Inspector of the Corporation, under the penalty of twenty dollars. And further, that every Butcher who occupies a slaughter house within the said Corporation, shall on every day on which any beef, or other cattle may be killed, between the first day of June and the first day of November, cause the said house to be washed and thoroughly cleansed, under the penalty of twenty dollars for every neglect. VIII. And be it further ordained, That if any slaughter house shall be so situated as to throw off filthy water

from the same upon the premises of any neighbor, it shall be the duty of the owner or occupant of such Slaughter house to cause the same to be rectified in such manner, and within such time as may be prescribed by the said Inspector or person employed under him, under the penalty of twenty dollars for every neglect.

IX. And be it further ordained, That it shall be the duty of every Butcher or other person immediately after killing any beeves, or other cattle, to remove the blood, offals, garbage and other offensive and useless parts thereof, by conveying the same into the river, or some other place where the same shall not be injurious or offensive to the inhabitants, on pain of forfeiting for every offence the sum of twenty dollars.

X. And be it further ordained, That no person shall cast, or leave exposed, the carcase of any horse or other animal in any street, yard, lane or lot, within the Corporation, on pain of forfeiting for each offence the sum of ten dollars; and further, that no person shall cast any such dead carcase as aforesaid, into any dock or slip, without causing the same to be forthwith towed out into the stream of Elizabeth river, to the distance of at least three hundred feet from the nearest wharf, under the penalty of ten dollars for each offence, unless the Inspector of the Corporation shall otherwise direct.

XI. And be it further ordained, That whenever any putrid or unsound beef, pork, fish, hides or skins of any kind, or any other putrid or unsound substance shall be found within the said Corporation, it shall be the duty of the Inspector or person appointed under him for that purpose, to cause the same to be destroyed by casting them into the stream of Elizabeth river, or to be disposed of in such other manner as in their judg ment may most effectually secure the public health.

XII. And be it further ordained, That no tub shall be removed from any necessary house or privy, within the said Corporation, except between the hours of eleven o'clock in the evening and three o'clock in the morning from the first day of May to the last day of September, and between the hours of ten o'clock in the evening and five o'clock in the morning from the first day of October to the last day of April; and that no person shall remove the same at any other time, nor empty, cast or lay, the contents of any tub or privy in
